84 Abstract Main theme of this diploma thesis is notice of termination of employment, in particular by the employer. The goal is to fully describe and analyze legal institution of notice. At first the Czech legal regulation is described, then it deals with a regulation of notice of termination according to the Peruvian legal system. The emphasis is put on notice of termination in Peru by the employer and aim is taken at comparing both laws and propose possible future reciprocal inspiration. The thesis is divided into five chapters, the first chapter focuses on labor law, its conception, function and origin, employment as such and describes possible methods of its termination (agreement on termination of employment, summary dismissal, summary dismissal during trial period, termination on the basis of official decision, termination following legal event). The second chapter elaborates the notice of termination with emphasis on termination by the employer according to Czech law, its formal requirements, its proper delivering, reasons for termination, prohibition of termination on period of protection and applicable exceptions. This master's dissertation deals with notice of termination of employment in three countries, specifically Czech Republic, Federal Republic of Germany and Great Britain, specifically England. The Federal Republic of Germany has been selected because Germany is a country with highly developed economy, however the social function of which is very fundamental that is also reflected in the notice of termination of employment legal regulation. Great Britain was selected because it represents different legal system to Czech republic or Germany, so called common law. British legal system can be further divided into legal systems of England and Wales, Northern Ireland and Scotland. This master's essay deals with the enactment in England. At the same time, it is also one of the economically most developed country in the framework of the European Union and a country in which a great number of Czech citizens seek their work opportunities. As far as structure of the individual Chapters is concerned, they are not arranged herein in the same scheme, because the legal form of the notice in the legal regulations differs so much, as far as conception or legal sources is concerned, that even the breakdown of the individual Chapters respects reflects such differences. Depuis plus d’un siècle, l’existence du concept de responsabilité contractuelle suscite de vives controverses au sein de la doctrine française. Le retard contractuel, aussi dénommé demeure, ou mora, constitue le second fait générateur de la responsabilité contractuelle, à côté du défaut d’exécution. Les spécificités de la demeure tiennent tant à ses conditions de mise en œuvre qu’à son régime, caractéristiques qui ne cesseront d’être réformées depuis le Moyen Âge, au gré des besoins et valeurs de chaque époque sans cesse en évolution. Fidèle à l’héritage romain dévolu par la Codification justinienne, le jus commune ne parviendra pas à formuler un principe général de responsabilité contractuelle pour retard, admettant que cette question relève davantage du fait que du droit. Il dispose néanmoins du matériau nécessaire à l’édification du principe. Mais le retard n’y est jamais considéré comme une faute, et ce constat est d’autant plus frappant dans les sources du droit propre au Royaume de France qui privilégient la recherche de l’exécution en nature de la dette. Le véritable changement de paradigme s’opèrera à la fin du XVe siècle, puis surtout sous la plume des juristes humanistes, qui, pour la première fois, qualifieront le retard de faute. Toutefois, faute, dommage et causalité ne feront pas l’objet d’une systématisation aboutie, bien que favorisée par l’énonciation d’un principe général de responsabilité civile par Grotius, sous l’égide du précepte du neminem laedere. Aux siècles suivants, l’ambiguïté demeurera manifeste, entraînant d’ailleurs une importante discordance entre les deux sommités de la doctrine française moderne, Domat et Pothier. Finalement, les rédacteurs du Code civil ne prendront pas partie pour un principe de responsabilité contractuelle pour retard, tout en confirmant les traits principaux d’un tel concept. / Since over a century, the concept of contractual liability has been generating strong controversies within the French doctrine. The contractual delay, also called mora, forms the second operative event of the contractual liability, beside of the contractual failure, from which independent issues can be distinguished. Thus some specificities of the mora belong to its deployment conditions as well as its legal regime, characteristics that keep being reformed since the Middle Ages, depending on the needs and the time values constantly evolving. Following the Roman heritage from the Codification of Justinian, the Jus Commune will never succeed in formulating a general principle of contractual liability for delay, admitting that this question belongs more to the fact than the law. Yet, there is the needed ressources to edify such a principle. But the delay is never considered as a tort, and this finding is even more striking in its sources of the French Kingdom. The texts of the jus proprium are indeed very far from establishing a damages system of the delay, encouraging the search of the execution of the debt in nature. The true change of paradigm will happen at the end of the 15th century, and especially with the humanist jurists who, for the first time, will qualify the tort delay. However, tort, damage and chain of causation will not be the object of an achieved systematization, despite the enunciation of a general principle of civil liability by Grotius, under the aegis of neminem laedere precept. During the next centuries, the ambiguity will remain obvious, generating actually a strong discord between the two thoughts leaders of the modern French Doctrine, Domat and Pothier. Finally, the Code Civil redactors will not decide for a principle of contractual liability for delay, while still confirming main features of such a concept.

The Diploma work includes the valuation of a flat-building according to the valuation rules in Břeclav.The main line of this work is to give information about valuation of properties and concepts, which connented with these questions. In the conkrete there is a fixed price of flat-building and there are for methods for valuation of properties. The first task is to appoint the price of flat-building as a whole and the second is to appoint the prices of flats. The price of flat-building also includes outdoor alterations. There are used the methods for valuation. For flat-building it is a load and a decree way and their combination and for flats it is a comparing method.In the end it is necessary to find out the change of price of flat-buiding if the ownership is change. We found out that if the price will be appoint according to the combination of the load the decree wayand comparing method, the price of the sum of accommodation units will be higher than price of combi ation of the load and the decree way.

Using SMS Text Message Reminders as a Way to Decrease Short Notice Cancellations of Surgeries : A Semi-randomized Controlled Trial / Användning av SMS-påminnelser som ett sätt att minska antalet operationer som avbokas med kort varsel : En semirandomiserad kontrollerad studie

Health care providers face large costs in terms of operating rooms not being utilized due to patients (1) not canceling enough in advance to allow a different patient to be scheduled or (2) not being in a good enough condition to be operated on due to failure to follow preoperative instructions properly. This degree project aims to see if SMS text reminders can be used to lower the number of surgeries canceled in this manner. Patients of the surgical-, urological- and orthodontic clinics at a hospital in Stockholm were placed into one of three groups; (1) a group that did not receive a text message reminder, (2) a group that received a "short" reminder, (3) and a group that received a "long" reminder. A survey was also conducted to determine what the patients thought of the reminders and whether they believed it influenced them or not. The study suggests that reminders do not work as a method to decrease the short notice cancellation rate as it may not be a poor memory that causes the patient to cancel. Instead, anxiety might have a greater impact than expected. Further studies should be conducted in order to confirm this hypothesis. / Sjukvårdsgivare möts av stora kostnader då operationssalar inte används på grund av att patienter (1) inte avbokar i tid för att tillåta att en annan patient tar deras platser eller (2) inte är i tillräckligt bra tillstånd för att bli opererad på grund av ett misslyckande att följa de preoperativa instruktionerna ordentligt. Detta examensarbete har som mål att undersöka om SMS-påminnelser kan användas för att minska antalet operationer som avbokas på detta vis. Patienter från de kirurgiska-, urologiska och ortopediska klinikerna på ett sjukhus i Stockholm placerades i en av tre grupper; (1) en grupp som inte mottog SMS-påminnelser, (2) en grupp som mottog en ”kort påminnelse”, (3) och en grupp som mottog en ”lång” påminnelse. En enkätstudie utfördes för att kunna avgöra om patienter ansåg att påminnelserna påverkade dem eller inte. Studien antyder att påminnelser inte fungerar som ett sätt att minska antalet avbokningar med kort varsel eftersom det avbokningar eventuellt inte beror på minnet. Istället är det möjligt att ångest har en större påverkan än förväntat. Fler studier borde utföras för att kunna bekräfta denna hypotes.

The Whereabouts Screens are a minimalistic publishing system offering location awareness at the workplace. The employees can share information with their colleagues, relevant mostly to their whereabouts, by publishing it on several situated displays located around the office space. The Whereabouts Screens have been installed with minimal changes since 2012 at the Mobile Life center and as a relatively new system, it has still not reached its full potential. Despite its “primitive” characteristics however, the employees show a continued interest in using them. Based on related research on situated displays the research questions to be answered are: What do the semi-public situated displays in the workplace have to offer to their users? How can they be augmented and better integrated in their environment using the existing technology? To investigate these questions, Human-Computer Interaction methods such as in-situ observations, interviews, a design workshop and prototyping were used. The result was a prototype of an augmented system, in the form of a notice board where the users can post notes of different types (text, images, etc.). The board is extended beyond the limits of the screen with LEDs. The intensity and colors of the LEDs are affected by the use of the system, and illuminate the area around the screen. The augmented Whereabouts Screens aim to promote social interaction and location awareness at the workplace. They were evaluated through user testing and the first results show a positive reception from the users. / Whereabouts Skärmar är ett minimalistiskt publicerings-system som bjuder närvarokännedom på arbetsplatsen. De anställda kan dela information med sina kollegor, mestadels kopplat till vad de befinner sig, genom att publicera det på flera  skärmar belägna runt om på arbetsplatsen. Whereabouts Skärmar har funnits installerade med minimala förändringar sedan 2012 vid Mobile Life centret men har  som ett relativt nytt system ännu inte nått sin fulla potential. Trots begränsningar i systemet visar anställda ett fortsatt intresse av att använda dem. Baserat på relaterad forskning kring situerade skärmar tar sig uppsatsen an två frågeställningar: Vad har semi-publika situerade skärmar på arbetsplatsen att erbjuda sina användare?  Hur kan deras funktionalitet utökas och integreras bättre i omgivningen med hjälp av befintlig teknik? För att undersöka dessa frågor, används människa-datorinteraktion metoderna in-situ observationer, intervjuer, designworkshops och prototypbyggande använts. Resultatet är en prototyp av ett system med utökad funktionalitet i form av en anslagstavla där användare kan lägga upp anteckningar av olika slag (text, bilder, etc.). Anslagstavlan sträcker sig över gränserna för skärmen med LEDljusen.  Intensitet och färger hos LEDljusen påverkas av användningen av systemet, och lyser upp området runt skärmen. De utökade Whereabouts skärmarna syftar till att understödja social interaktion och  närvarokännedom på arbetsplatsen. De utvärderades genom användartester och de första resultaten visar på ett positivt mottagande av användarna.

Preparation of a hearing in the civil procedure The topic of this thesis is preparation of a hearing in civil procedure. It represents a phase of civil procedure which starts the moment the action it brought to the court and ends with the hearing itself. The hearing should be regarded as the culmination of the whole procedure, which is why the right approach to the preparation of a hearing is not any less important than the hearing itself. The aim of this thesis is to give a comprehensive overview of this issue by reviewing the past, analysing the present legislation and providing de lege ferenda reflection. The thesis is divided into three parts. The first one is a historical overview, in which the author describes the legal development of the preparation of a hearing since 19th century until present. Legal principles, that has formed during this legal evolution and that are affecting today's legislation, are described in the beginning of the second part of the thesis. Tolerating transitions between activities and locations is an essential daily-living skill, as transitions are inevitable in most typical settings. However, for some individuals, requests to transition may occasion problem behavior which can interfere with daily routines and result in a more restrictive lifestyle. The unpredictability of transitions is often assumed to be aversive and functionally related to transition-related problem behavior. As a result, advance notice procedures are often recommended to reduce problem behavior during transitions. However, Brewer et al. (2014) found mixed results for the use of advance notice highlighting some studies where advance notice procedures reduced problem behavior and others where the procedures were inefficacious. In this study, we reviewed the relevant literature between 1994 and 2020, including studies reviewed by Brewer et al. (2014) and extended Brewer et al.’s (2014) review in a number of ways. We first summarized the current literature, including new studies published since Brewer et al.’s (2014) review, which included a total of 28 applications of advance notice published in 14 papers. Next, we identified key features of each study, including the presence or absence of demonstrated functional relations, inclusion of additional antecedent or consequent interventions, and evaluation and control of the effects of pre- and post-transition reinforcers on responding. Then we identified gaps in current knowledge regarding predictability and made research recommendations for addressing these gaps. Finally, we discuss practice recommendations for transition-related problem behavior based on current research.

Optimizing the Use of Public Transit System in No-Notice Evacuations in Urban Areas

Natural or man-made disasters result in unfortunate events around the nation every year. Such extreme events necessitate the short-notice or no-notice evacuation of a large population from the stricken area. This research presents an optimization modeling technique to develop an evacuation plan for transit-dependent residents during no-notice disaster situation. The proposed plan relies on the application of existing public transit system of an urban area. The public transit routing plan (PTRP) problem is formulated as a mixed integer linear program. The PTRP identifies the optimal routes for transit vehicles to move evacuees from the danger zone to designated safe destinations. A heuristic TABU search algorithm is used to find high-quality solution in a reasonable amount of time. Finally, DYNASMART-P is used to evaluate the effectiveness of the developed PTRP. Numerical experiments are conducted using the traffic network of the city of Fort Worth, TX, to illustrate the proposed modeling technique.

The master's thesis is focused on the analysis of the conditions for use of particular modes of public tenders under the Act no. 137/2006 Coll., on Public Contracts, as amended. The main part of the thesis covers the negotiated procedure without prior notice, as the least transparent and yet frequently used type of award procedures. However, principal characteristics of all other types of award procedures are also mentioned. To provide a complete and sufficiently detailed analysis and comparison of particular types of award procedures, this thesis refers not only to doctrinal literature, but also to case law of the Office for the Protection of Competition, the Regional Court in Brno, the Supreme Administrative Court and also European case law. The thesis also includes analysis of selected provisions of Act no. 55/2012 Coll., effective as of 1 April 2012, significantly amending the Act on Public Contracts.
