The South African regulatory framework relating to illegal trade in rhino horn / Neil James de Wet

De Wet, Neil James January 2015 (has links)
The purpose of this study is to determine whether the current South African regulatory framework related to the illegal trade in wildlife, provides the means to regulate the illegal trade in rhino horn effectively. In an effort to combat and eradicate the illegal trade in wild species and parts therein, South Africa has enacted numerous laws and it has ratified various international conservation Conventions. However, with more than 800 rhinos having been killed in 2013 alone, it is doubtful whether these laws and conventions are adequate. The first chapter is an introductory chapter summarising the latest statistics on rhinos fatalities as a result of poaching, an estimate on their numbers as well giving a brief overview of what laws and conventions will be discussed in this study. In the second chapter the historical development of the trade in rhino horn is dissected, who the culprits are and the reason why rhinos are poached for their horn. The third chapter analyses international conventions that have been adopted by South Africa, including conventions such as the Convention on International Trade in Enangered Species, the Convention on Biological Diversity and agreements such as the General Agreement on Tariffs and Trade. The fourth chapter will focus more on the regional contributions which the African Union and Southern African Developing Community have made in an effort to combat the illegal trade in endangered species and their products such as rhino. The fifth and final chapter discusses South African legislation which comprises of the National Environmental Management Act, National Environmental Management Biodiversity Act, National Environmental Management Protected Areas Act and the Criminal Procedure Act so as to determine what influence it has had in the effort to regulate the illegal trade in rhino horn. The conclusion that can be drawn from this study is that the South African regulatory framework on paper is indeed adequate enough to regulate and even eradicate the illegal trade in rhino horn. The reason, however, for it’s currently failure is attributable to a lack of enforcement of these measures as a result of a lack of provisions holding entities accountable. / LLM (Import and Export Law), North-West University, Potchefstroom Campus, 2015

Det äldre brottsoffret : Från orsaker till åtgärder

Obleser (fd. Sundström), Jennifer, Johansson, Evelina-Ying January 2016 (has links)

Results from the Prognostic Analysis Completed on the NASA EUVE Satellite to Measure Equipment Mission Life

Losik, Len 10 1900 (has links)
ITC/USA 2011 Conference Proceedings / The Forty-Seventh Annual International Telemetering Conference and Technical Exhibition / October 24-27, 2011 / Bally's Las Vegas, Las Vegas, Nevada / This paper addresses the research conducted at U.C. Berkeley Space Sciences Laboratory, Center for Extreme Ultra Violet Astrophysics between 1994 and 1995 on the NASA EUVE ion-orbit satellite. It includes the results from conducting a scientific analysis called a prognostic analysis completed on all satellite subsystem equipment. A prognostic analysis uses equipment analog telemetry to measure equipment remaining usable life. The analysis relates equipment transient behavior, often referred to as "cannot duplicates" in a variety of industries caused from accelerated aging to the equipment end-of-life with certainty. The analysis was confirmed by using proprietary, pattern recognition software by Lockheed Martin personnel Lockheed Martin personnel completed an exploration into the application of statistical pattern recognition methods to identify the behavior caused from accelerated aging that experts in probability reliability analysis claims cannot exist. Both visual and statistical methods were successful in detecting suspect accelerated aging and this behavior was related to equipment end of life with certainty. The long-term objective of this research was to confirm that satellite subsystem equipment failures could be predicted so that satellite subsystem and payload engineering personnel could be allocated for only the time that equipment failures were predicted to occur, lowering the cost of mission operations. This research concluded that satellite subsystem equipment remaining usable life could be measured and equipment failures could be predicted with certainty so that engineering support for mission operations could be greatly reduced.

Duty of members of elected bodies and other persons to prevent threatened insolvency of business corporation and consequences of breach of the duty Abstract This diploma thesis deals with the area of civil, commercial and insolvency law. It focuses in particular on the duty of directors of a business corporation and other persons to prevent threatened insolvency with emphasis on the legal regulation of the consequences of breach of such duty. Emphasis is placed on the duty of care, whose breach is a prerequisite for the application of the sanctions described in the second chapter. The second chapter deals with the consequences of the breach of the duty to prevent threatened insolvency. The consequences are analysed in detail and the issues over which the legal consensus is missing are set out in the analysis. Význam supervize pro zdravotnické pracovníky v lůžkových zařízeních / Importance of Supervision for Health care professionals in Inpatient Hospitals.

CIKLEROVÁ, Monika January 2013 (has links)
Abstract The theoretical part of this thesis focuses on health care issues related to the work of health care professionals in the context of a current legislation. In this part the work of health care professionals is linked to the ethical principles and pressures on the emotional, mental, physical and social levels. The work focuses on the possible symptoms of exhaustion and fatigue on these levels. The emphasis is put on a personal development and coping with emotions so the health care professional is able to provide his or her clients and patients with relevant support. Supervision also develops its potential as a system of control and improving the quality of the provided care. It also helps to achieve the necessary health care quality standards in all respects. This system of a complex support and care for an individual worker as well as team of professionals is rooted predominantly in the development of psychotherapy. In its empirical part this thesis deals with the reasons which prevent supervision to be fully accepted and generally adopted as a system of support for health care professionals. The research in the Regional Hospital in Příbram tries to find and identify possible barriers to the development of supervision and thus contribute to greater interest in its implementation. According to the research findings the main barriers involve inadequate experience and awareness of senior professionals about possibilities and purpose of supervision, their concerns about high financial expenses, the need to devote extra time to this method and last but not least the necessity to study and apply a large amount of professional methods and information to work. The last two mentioned criterions also reduce space which could health care professionals otherwise use for meeting their own needs and self -care. In terms of conditions supervision in health care institution would have to meet, the thesis comes to a conclusion that the possible supervisor should be well-informed about health care sector or experienced in own medical practice. In this respect he or she would be authentic and trustworthy for the supervised health care staff. This thesis also finds out that hospital management strongly supports supervision but so far has not recorded any interest in its implementation among the employees. However, findings of the survey aimed at health care professionals from the selected hospital departments show that more than 50% of respondents regard supervision in health care as needed. The specific need of support for health care professionals is found predominantly in inadequate recognition and appreciation of their work and in the feeling that their work does not bring them joy. In this respect the respondents to a large extent described somatic problems such as frequent headaches, difficulties in digestion and breathing and sleep disorders. According to the research there are good conditions for implementation supervision in a health care institution. However, first it is necessary to ensure that both hospital management and health care professionals are provided with good and sufficient information. The goal of this thesis is to support implementation of supervision among health care professionals in inpatient wards. It is intended for the health care professionals as well as for hospital management. Its aim is to promote the idea that only a person who is healthy, self confident and meets his/her own needs is able to cure well and help others.

Exploring a sustainable anti-corruption regime for Tanzania

Lukiko, Lukiko, Vedastus January 2017 (has links)
Magister Legum - LLM / Corruption is among the world's devastating social, economic and political problems. It is enormous to the extent that ''not one single country, anywhere in the world, is corruptionfree''. Its effects on the quality of life of billions of people around the world are widely acknowledged. Kofi Annan, former UN Secretary General, in his statement on the adoption of the United Nations Convention against Corruption (UNCAC), proclaimed that: Corruption is an insidious plague that has a wide range of corrosive effects on societies. It undermines democracy and the rule of law, leads to violations of human rights, distorts markets, erodes the quality of life, and allows organised crime, terrorism and other threats to human security to flourish. Corruption takes different forms depending on the time and the social, political and economic circumstances that create avenues for its occurrence. Consequently, scholars construe corruption from different viewpoints. On the one hand, post-colonialists and Marxists perceive corruption as a product of capitalist pursuit of profit and capital accumulation. On the other hand, liberal-rationalists and free-market economists define corruption by looking at its negative effects on development and economic sustainability. The argument is that corruption discourages foreign investment and allows public officials to siphon off resources for their private advantage, thereby defeating the public good. Despite the definitional and ideological differences found in literature, there is an agreement that corruption is a bad thing and should be fought vigorously.
