The present master thesis provides the reader with overall and detailed review of jurisdiction of the CJEU in correlation with primary and secondary law of the European Union regarding justification of restrictions on imports or exports of goods on the grounds of the protection of health and life of humans, animals or plants pursuant to the art.36 of TFEU. The very first part deals with the essence of the free movement goods. It explains the concept of the prohibition on custom duties on imports and exports and charges having equivalent effect and quantitative restrictions on imports and exports and all measures having equivalent effect. Simultaneously this part demonstrates the application of the art.36 of TFEU and presents mandatory requirements and their purpose. The second part clarifies the concept of goods according to the European Union law, examples and provides proper definition. The third part presents the core of the thesis. It is subdivided into more than 10 parts. It contains explanations regarding principle of proportionality, protection of health and life of humans, total bans, precautionary principle, sufficiently rigorous risk assessment doctrine, protection of health and life of animals, prohibition on use, labeling requirements, or protection of the environment. The most relevant and most widely-known cases were chosen and analyzed in order to present the approach of the CJEU to the disputable measures and their justifications. / Šis baigiamasis magistro darbas suteikia skaitytojui bendrą, visaapimančią ir išsamią ESTT jurisdikcijos apžvalgą dėl importo ir eksporto prekių ribojimo pagrįstumo sąlygų žmonių, gyvūnų ar augalų sveikatos bei gyvybės apsaugos tikslais pagal SESV 36 straipsnį, remiantis pirminiais bei antriniais Europos Sąjungos teisės aktais. Pirmojoje dalyje kalbama apie laisvo prekių judėjimo esmę. Čia paaiškinama importo ir eksporto muitų bei lygiaverčio poveikio mokėjimų bei kiekybinių importo ir eksporto apribojimų bei lygiaverčio poveikio priemonių draudimo koncepcija. Taip pat, ši dalis pademonstruoja SESV 36 str. veikimą, pabrėžiant privalomuosius reikalavimus bei jų tikslus. Antrojoje dalis paaiškina prekių sampratą remiantis Europos Sąjungos teise,pateikia pavyzdžių bei deramą apibrėžimą. Trečiojoje dalyje pateiktas baigiamojo magistro darbo pagrindas. Ši dalis yra suskirstyta į daugiau kaip 10 dalių. Čia yra sutelkti paaiškinimai dėl proporcingumo principo, žmonių sveikatos ir gyvybės apsaugos, visiško draudimo, atsargumo principo, pakankamai griežtos rizikos vertinimo doktrinos, gyvūnų sveikatos ir gyvybės apsaugos, naudojimo draudimo, ženklinimo reikalavimų bei aplinkos apsaugos. Siekiant pristatyti ESTT požiūrį į abejotinas priemones bei ribojimo pagrįstumo sąlygas yra analizuojamios aktualiausios ir plačiausiai žinomos bylos.

Taršos lakiaisiais organiniais junginiais valdymas / Volatile organic compound pollution management

Along with industrial and economic growth there is a persistent risk of permanently increasing air pollution. Air pollution has especially grown in the second half of the 20th century due to intense development of energy, industry and transport sectors. These pollution sources still remain the largest air polluters. Solvents, paints, glues, ink and other substances, emitting volatile organic compounds to air are used in such industries like reel, metal and wood coating, covering with glue sticks, footwear production, production of pharmaceutical products, printing, dry (chemical) surface cleaning etc. Emissions of volatile organic compounds make harm both to people and environment as well as damage the ozone layer. Volatile organic compounds also affect smog formation and green house effect. In the paper it is hypothesised that after implementation of EU legislation, observing the given emission limit values, improving technologies and implementing new treatment technologies, applying the measures to reduce pollution with volatile organic compounds and replacing the materials, emitting volatile organic compounds, with less polluting ones or those without pollution, air emission of volatile organic compounds will reduce dramatically. Magistro darbo objektas - Lietuvos Respublikos norminiuose mokesčių teisės aktuose įtvirtintos prieš mokesčių vengimą nukreiptos normos: jų doktrininis aiškinimas bei analizė, jų taikymas mokestinius ginčus nagrinėjančių institucijų praktikoje. Pagrindinis dėmesys skiriamas turinio viršenybės prieš formą principui, kaip bendrajai prieš mokesčių vengimą nukreiptai normai ir specialiosioms antivengiminėms priemonėms – pajamų arba išmokų apibūdinimo iš naujo (plonos kapitalizacijos – angl. thin capitalization) taisyklėms, kontroliuojamųjų užsienio vienetų apmokestinimo taisyklėms, sandorių kainodaros (angl. transfer pricing) taisyklėms, ūkinių operacijų, atliekamų su tikslinėse teritorijose registruotais asmenimis, apmokestinimas. Darbo tikslai - išanalizuoti antivengiminių priemonių teisinį reglamentavimą bei atskleisti jo praktinio taikymo problemas. Main consideration is paid to substance over form principle, which is a general anti-avoidance rule and to specific anti-avoidance rules – thin capitalization rules, controlled foreign corporations imposition rules, transfer pricing rules, transactions with organizations, which operate in tax-heavens, imposition. The two objectives of this dissertation are as follows: to analyse anti-avoidance measures embeded in tax laws and unfold their practical implication problems. Information technologies and mobile telecommunications rapidly enter our personal and social life. Mobile phone is no longer luxury – it has become a necessity. Growing volumes of the mobile services has caused a need to expand the mobile service employment opportunities in the Internet portals. Today’s portals, created using the means, offered by software manufacturers, employ exclusively the mobile Internet service, thanks to which the users can see and manage the necessary information and process of the portal at any time and from anywhere. The problem is related with the fact that mobile Internet services are still expensive in Lithuania. Therefore one should look for cheaper ways to reach and manage portal information. In order to solve this problem one can consider the SMS and MMS message sending, suggested by mobile technologies. Basic aim of the work is to create an entertainment portal, rendering the user both various Internet entertainments (e.g. Internet acquaintances, games), and mobile entertainment (e.g. sending messages, logos, melodies, animations and games for mobile phone) as well as a wide range of mobile services to be used to obtain and to manage the portal information. Kriminalistinė homoskopinių pėdsakų charakteristika ir tyrimo galimybės / Characteristics of homoscopic traces and possibilities of their investigation from the point of view of forensics

Šiame magistro baigiamajame darbe nagrinėta pakankamai nauja tema ,,Kriminalistinė homoskopinių pėdsakų charakteristika ir tyrimo galimybės“, kadangi Lietuvos kriminalistinėje literatūroje nėra aptinkamos tokios sąvokos kaip homoskopinis pėdsakas, nors yra mokslinių darbų, kuriuose tas pats pėdsakas vadinamas homeoskopiniu. Homoskopiniai pėdsakai yra žmogaus kūno dalimi palikti pėdsakai, kurie skirstomi į rankų, kojų (basų kojų pėdsakai, kartais randami ir avalynės viduje), dantų, nagų ir galvos paviršiaus pėdsakus. Pirmoje darbo dalyje trumpai išdėstyta, kas yra pėdsakai nagrinėjamos temos prasme bei pėdsakų rūšys. Vėliau aptariama kiekviena iš homoskopinių pėdsakų rūšių anatomiškai bei kriminalistiniu požiūriu – pateikiama pėdsakų charakteristika. Rankų pėdsakai yra dažniausiai aptinkami, tiriami bei pagal juos lengviausia identifikuoti asmenį, todėl jie yra aptarti pirmiausiai. Toliau yra pateikiamos kojų, dantų, nagų bei galvos paviršiaus (svarbiausias vaidmuo tenka lūpų bei ausų pėdsakams) pėdsakų charakteristikos. Pagal juos taip pat galima nustatyti asmens tapatybę, tačiau tai padaryti yra sunkiau nei rankų pėdsakų atveju. Kita vertus, gali būti nustatyta daug informacijos apie atskiras nusikalstamos veikos aplinkybes. Antroje darbo dalyje nurodyta, kokiose įstaigose Lietuvoje yra atliekami specialisto tyrimai bei ekspertizės. Be to, pateiktos homoskopinių pėdsakų tyrimo galimybės surandant, išryškinant, fiksuojant, paimant bei tiriant laboratoriniu būdu homoskopinius... [toliau žr. visą tekstą] / A quite new subject “Characteristics of Homoscopic Traces and Possibilities of their Investigation from the Point of View of Forensics” was analyzed in this master’s thesis, whereas it cannot be found such a concept as homoscopic trace, although there is some scientific work in which the same trace is called homeoscopic. Homoscopic traces are the ones that are left by human body parts and they are divided into handprints, footprints (barefoot and footprints in footwear), bite marks, fingernail scrapings and prints that are left by a surface of a head. The first part briefly sets out what is the meaning of the traces and their types within the topic of the thesis. Also each kind of the homoscopic traces are discussed anatomically and from the point of view of forensics, thus the characteristics of homoscopic traces are given. At first handprints are discussed because they are mostly detected and examined. Furthermore by using them it is easy to identify a person. Then the characteristics of footprints, bite marks, fingernail scrapings and prints left by a surface of a head (especially lip prints and ear prints) are represented. Using them we can also determine person’s identity but it is more difficult than using handprints. On the other hand, we can learn some information about individual circumstances of the crime.
