The author introduces the regulatory and political landscape of the mining concession and the institutional decay it has suffered. He also shows the systems of acreage and the system which our country has received it well: the System of Public Domain. Finally, the author analyzes the mining concession and harvesting rights, raised according to the Constitution and the General Mining Law, explaining the policy changes needed to strengthen it as a fundamental qualifying title for the development of mining activities in the country. / El autor presenta un panorama normativo y político de la concesión minera y el desgaste institucional que ha sufrido. Asimismo, expone los sistemas de dominio minero y el que nuestro país ha acogido con acierto: el Sistema Dominalista. Por último, analiza la concesión minera y el derecho de aprovechamiento, planteado de acuerdo a la Constitución y Ley General de Minería, explicando los cambios normativos necesarios a fin de fortalecerlo como título habilitante fundamental para el desarrollo de las actividades mineras del país.

1 Abstract The subject of this work is to monitor a certain section changes the rule of law, regulating the organization and functioning of agriculture in the transition from one mode to another mode and period of stabilization. The work deals with the normative regulation of the Czechoslovak and Czech agriculture in the period of collectivized application form and the second part of the transition period in Czechoslovak and Czech agriculture on the market form. Collectivization and the actual development of the Czechoslovak socialized agriculture is defined as the years 1949-1990, transformation, or rather de- collectivization and the further development of the market, first Czechoslovak and later Czech agriculture, is dated from 1990 almost until today, and this work deals with the investigation of the legislation referred to by 2004, until the accession of the Czech Republic into the European Union. Since 2004 legislation has already ceased to be exclusively a matter of the state and must be adapted to European Union law, as well as the functioning of the market economic conditions of agriculture are modified implementation of the Common Agricultural Policy of the European Union. 由於目前國有非公用土地處分政策係以大面積國有土地不出售為主,且限於政府人力、物力的不足,加上人民對價格便宜的住宅需求與日俱增,故兩相權衡下即逐漸發展出將國有土地設定地上權交由得標之地上權人開發營運,待地上權期滿後,再將土地及建物移轉予政府之開發方式。因此,政府近年來推出許多設定地上權標案,造成設定地上權案例增加,也使得國有土地設定地上權制度成為近年來備受關注與討論的議題。 且由於國有非公用土地設定地上權適用法規之修正、停止適用或新訂,尤其是關於禁止地上權分割之規定所衍生之號稱「地上權住宅」但實際上為「使用權住宅」,及民國102年9月30日財政部台財產改字第10250007490號令修正發布並自即日生效後之「地上權住宅」法律性質及交易相關爭議。本文乃透過文獻分析法,對於國有非公用土地設定地上權制度法律觀念釐清,及梳理國有非公用土地設定地上權興建集合住宅各個當事人間之法律關係,歸結出各當事人間於國有非公用土地設定地上權興建集合住宅交易之法律問題。 / Due to the current public land for non-public purpose disposition policy department in a large area of state land does not sell, and lack of government limited human and material resources, coupled with people's growing demand for cheap housing, so the next two-phase balance that is gradually developed a national land establishment of superficies by the owner of the winning bid to develop the operation until after the expiration of superficies, and then was transferred to land and construction development mode of government. Esta problemática é presente em algumas partes do mundo e do país. Com o intuito de garantir o direito de uso dos recursos hídricos, proteção, preservação e o acesso a água potável, a legislação trouxe normas e dispositivos de proteção a este recurso natural esgotável, no sentido de orientar e determinar as obrigações e suas penalidades, para efetivar o art. 225 da Constituição Federal de 1988. Além disso, reconhece-se a crescente falta de água para a irrigação e outros usos, face sua irregular disponibilidade marcada ao longo do ano e da região. Com base na legislação federal e do Estado da Paraíba, surge a necessidade de analisar o gerenciamento dos recursos hídricos e sua aplicação aos municípios, e assim, situar a competência constitucional em matéria de recursos hídricos, e o estudo da outorga da água, a fim de definir as estratégias legislativas a serem adotadas pelo município acerca da gestão dos recursos hídricos na solução dos conflitos por água. A pesquisa utilizou o método indutivo, a partir do estudo de caso quanto o papel do Município de Pombal – PB, com relação aos conflitos pelo direito de uso dos recursos hídricos na irrigação. Como também está pautada na abordagem qualitativa enquanto pesquisador produtor rural, e quantitativa à medida da coleta de dados fornecidos pela Agência Nacional das Águas, Pastoral da Terra, AESA – PB, Comitê de Bacia Piranhas-Açú, pesquisas científicas e legislação. Conclui-se, pela necessidade do desenvolvimento de mecanismos permanentes de participação social nas negociações de âmbito de comitês de bacias, de modo a amenizar as situações de conflito e garantir a gestão compartilhada do bem comum. Daí o papel do Município na organização política-administrativa na aplicação das políticas públicas em favor de seus administrados, por ser mais próximo da realidade local. Verificou-se ainda, falha na gestão das águas da Bacia Piranha-Açú. Dessa forma, deve-se aumentar a participação dos irrigantes nos comitês de bacia para identificar a dimensão social dos conflitos por água. Criar uma legislação municipal que delegue competência a Secretaria de Agricultura na criação do cadastro informativo dos irrigantes, incluindo orientação técnica quanto o procedimento de outorga do direito dos recursos hídricos até sua extinção, e aumentar a participação da ANA sobre a realidade local através de audiências públicas. / Water resources are indispensable life of beings and of the whole planet, and its scarcity implies a new attitude of society. This issue is present in some parts of the world and the country. In order to guarantee the right of use of water resources, protection, preservation and access to drinking water, legislation brought standards and protection devices to this exhaustible natural resource, to guide and determine the obligations and its penalties for effect the art. 225 of the 1988 Constitution also recognizes the increasing lack of water for irrigation and other uses, given its irregular availability scheduled throughout the year and the region. Based on federal law and the state of Paraíba, the need arises to analyze the management of water resources and its application to municipalities, and thus place the constitutional competence in the field of water resources, and the study of grant of water in order to set the legislative strategies to be adopted by the municipality about the management of water resources in the solution of conflicts by water. The research used the inductive method, from the case study as the role of the Municipality of Pombal - PB with respect to conflict the right to use water resources for irrigation. As is also guided by the qualitative approach while farmers researcher, and quantitative as the collection of data provided by the National Water Agency, Ministry of Land, EFSA - PB, Piranhas-Açu Basin Committee, scientific research and legislation. It follows the need to develop permanent mechanisms for social participation in negotiating the framework of basin committees in order to ease the conflict and ensure shared management of the common good. Hence the role of the Municipality in the political and administrative organization in the implementation of public policies on behalf of its managed, by being closer to the local reality. There was also failure in the management of the waters of the Piranha-Açu Basin. Thus, one should increase the share of irrigation in the basin committees to identify the social dimension of conflicts over water. Create a municipal law to delegate powers the Agriculture Department in the creation of informative record of irrigators, including technical guidance regarding the right of concession procedure of water resources to extinction, and increase the participation of ANA on the local reality through public hearings.

Syftet med detta arbete är att, dels ur ett fastighetsrättsligt perspektiv, dels ett folkrättsligt perspektiv, utreda om Sveriges urbefolkning samerna kan sägas ha förvärvat en äganderätt till marken i Lappland enligt svensk rätt, eller om detta enbart handlar om en bruksrätt inkluderande renskötsel, jakt och fiske. Vad gäller det fastighetsrättsliga perspektivet har samerna haft en mycket stark fastighetsrättslig ställning på 1600- och 1700-talet. Då behandlades samernas lappskatteland som sådan skattejord, som skattebönderna sedermera genom lagstiftning automatiskt förvärvade full äganderätt till. Så skedde dock inte för samernas del. I stället trängdes de undan från stora delar av sina ursprungliga marker på grund av bl.a. kolonisation, exploateringsintressen, samt nedvärdering av nomadkulturen. Från att ha varit i stor majoritet blev de en minoritet på sina gamla marker. Dessa marker har sedermera kommit att betraktas som kronojord i statens ägo, vilket innebär en stor förskjutning av samernas fastighetsrättliga ställning inom loppet av fyra sekler. Gällande rätt garanterar inte samer som är medlemmar av en sameby någon starkare rätt än en bruksrätt, som till vissa delar är svagare än vad som gäller för andra bruksrättsinnehavare i Sverige. Praxis utesluter emellertid inte att renskötselrätten kan ha gett upphov till äganderätt, särskilt i nordligaste Sverige. Att samerna haft svårt att hävda sin äganderätt kan bero på att rättssystemet inte har haft en egentlig förståelse för rennäringens speciella förutsättningar, vilket gör att exempelvis beviskraven blir höga att nå upp till. Man kan dock hoppas på att Sverige framöver kommer att ta intryck av den internationella utvecklingen vad gäller erkännande av urbefolkningars markanspråk. / The aim of this thesis is to examine whether the Sami people, who is an indigenous people living in the north of Sweden, could have acquired ownership of land areas in Lapland according to Swedish law, or whether they only have a right to use the land that they traditionally occupy for reindeer breeding, hunting and fishing. The question is dealt with from a land law as well as an international law approach. Concerning the land law approach, the Sami people has had a very strong position close to ownership during the 17th and 18th centuries. At that time, the Samis paid tax for their lands, which meant that they were not considered to belong to the Crown, but were treated in the same way as the independent farmers’ lands. However, while the farmers through a declaration from the King in 1789 automatically achieved full ownership of their lands, the Sami people did not. Instead, the Samis were pressed back from large parts of their original territory because of colonisation, exploitation and depreciation of their nomadic way of living. Once a majority, they found themselves a minority in their own land and their territory had become the Crown’s property. Undoubtedly, there has been an extraordinary shifting of the Sami people’s land rights within four centuries. Current law does only guarantee the members of the Sami villages the right to use land for reindeer breeding, hunting and fishing, and this right is in some aspects even weaker than that of other Swedish citizens with similar rights. Still, case law does not exclude the possibility that reindeer breeding could have originated right of ownership, especially in Lapland. My findings on this area are that there is convincing evidence that the Sami people has acquired right of ownership on the lands which they traditionally occupy all year around. On the lands that they share with others, they have a strong right to use the land during the winter, probably stronger than the legislation provides for. What concerns the international law approach, Swedish legislation does fulfil the minimum demands according to the conventions the country has ratified. Still, Sweden has been criticized of not finding a balanced solution to and improving legal certainty on Sami land rights. Sweden has not ratified the ILO Convention no. 169 con-cerning indigenous and tribal peoples in independent countries. The reason for this is mainly the article which aims at strengthening the indigenous peoples’ land rights, which Sweden does not find compatible with national law. Still, one can hope that the ongoing international development on the area will show the way, and that Sweden will pay attention to it in future legislation.

A metodologia utilizada foi a revisão bibliográfica, por meio do levantamento de todos os diplomas legislativos em vigor, tanto na esfera federal, como na esfera estadual, que se refiram à gestão de recursos hídricos, assim como a consulta a doutrinas jurídicas e artigos publicados em periódicos da Capes; utilizando como período delimitador os anos de 2013 a 2016. Priorizou-se a consulta aos artigos revisados por pares. Também se verificou a existência de processos administrativos e judiciais na área da pesquisa. E, finalmente, foi realizada coleta de informações “in loco” com agentes públicos acerca dos procedimentos para concessão de outorgas e possível ocorrência de conflitos entre cidadãos. A proposta de análise dos conflitos pela água teve como motivação o quadro crítico que assola o semiárido brasileiro, com grandes períodos de ausência de chuvas e, ainda assim, os usuários (em sentido amplo) continuam desperdiçando o uso da água, sem a consciência de que se trata de um recurso limitado. Como elemento de gestão e recurso limitado, a água traz muitas discussões jurídicas, inclusive, quanto à viabilidade do seu acesso, principalmente, em propriedades privadas, assim como a discussão acerca da efetividade de aplicabilidade dos instrumentos de gestão desse recurso natural. Como resultado, observou-se a necessidade da uma melhor integração do cidadão-usuário da água no sistema de gerenciamento para que conheça as suas fases e procedimentos, a definição dos órgãos públicos e suas funções, para que se possa colaborar mais ativamente com a eficiência da política nacional de recursos hídricos. / This study deals with the analysis of conflicts over the use of water in the Paraiba region of the Piranhas-Açu River basin and its solution form, from the point of view of the management tools and mechanisms for conflict resolution presented in the legal literature. The methodology used was the bibliographical revision, by means of the survey of all the legislative diplomas in force, as much in the federal sphere, as in the state sphere, that they refer to the management of water resources, as well as the consultation to legal doctrines and articles published in periodicals Of Capes, using as a delimiting period the years of 2013 to 2016. Prioritized the consultation of articles peer reviewed. It was also verified the existence of administrative and judicial processes in the research area. The proposal for the analysis of water conflicts was motivated by the critical situation that plagues the Brazilian semi-arid region, with periods of heavy rainfall, and yet users (in a broad sense) continue to waste water, without the awareness of That it is a limited resource.
