A presente dissertação dedica-se ao estudo da relação entre a teoria e a prática do Supremo Tribunal Federal no que diz respeito aos limites da interpretação conforme a Constituição. A partir do confronto entre as principais lições doutrinárias sobre o tema e os acórdãos proferidos pela Corte nos processos do controle abstrato de constitucionalidade, verifica-se que os limites reconhecidos pela doutrina e pelo Tribunal não são obedecidos em muitos dos precedentes, casos nos quais tem-se a utilização da interpretação conforme como mecanismo de correção e integração judicial do direito. Nesse cenário, busca-se averiguar a legitimidade de tal conduta pelo aplicador do direito. Chega-se, assim, a conclusão de que, nos casos em que o Supremo Tribunal Federal se vê diante de hipóteses em que há lacuna ou antinomia que não podem ser resolvidas pela interpretação conforme em sua função de decisão, o princípio da inafastabilidade da jurisdição impõe a aplicação da integração conforme a Constituição, desde que ela não esteja vedada tácita ou expressamente pelo ordenamento e que a decisão que a determine esteja fundamentada. / This study tries to understand the relationship between theory and practice regarding the limits of the interpretation according to the Constitution. Confronting the most common jurisprudence that relates to the topic and the decisions that the Supreme Court emitted in the cases of abstract judicial review, it becomes clear that the before mentioned limits of the interpretation according to the Constitution aren\'t respected by the decisions of the Court and that the technique is used as a mechanism of correction and integrity of the law. In this scenario, this study tries to reveal the legitimacy of the decisions the Supreme Court took on this basis. The conclusion one has arrived at states that in the cases in which the Supreme Court confronts itself with antinomy or law blanks that can\'t be resolved by regular interpretation, the non liquet principle forces the Court to correct or to integrate the law, as long as: 1) it isn\'t expressly or implicitly forbidden by the constitutional text; and 2) the decision is thoroughly motivated.

Voice and accountability in one party dominant systems : a comparative case study of Mexico and South Africa

This thesis examines the impact of one party dominant systems on liberal democracy in developing countries. It is insufficient to argue that one party dominant systems – systems where one party dominates over a prolonged period - need not be further scrutinised because they occur within democracies. Instead it is contended that the term ‘democracy’ is but one public virtue in a political system and thus needs to be prefixed for it to have meaning beyond a method of government selection. The importance of this is highlighted when looking at two major trends in the understanding of democracy. The first is democracy as rule by the people -a non-authoritarian democracy- where governmental control is limited, and agents of voice and accountability are protected. Voice and accountability refers to citizens being able to exercise power over the process of decision-making and not merely power to select decision-makers. The second type of democracy is rule for the people -an authoritarian democracy- where governmental control extends over all spheres of society, and the operating space for agents of voice and accountability is constrained. Since unchecked centralisation is the anti-thesis of a non-authoritarian democracy, the observed tendency of dominant parties to use their predominant position to further consolidate their control is a concern. The apprehension is, as power is centralised so the operating space of agents of voice and accountability (including political and civil society) is constrained. Despite differences in the type of one party dominant system, whether they be hegemonic (Mexico) or dominant (South Africa) the ruling dominant/ hegemonic party uses similar methods of consolidating dominance – they essentially centralise power through the establishment of (1) economic, (2) political, and sometimes (3) ideological monopolies. These monopolies are established using internal and external methods of control (centralising of political power; party controlled process of political leadership selection; institutional arrangements and electoral amendments, which favour the ruling party; patronage and corporatism), which in turn effectively close down or limit the operating space of civil and political society, especially in developing countries which do not have histories of liberal-constitutionalism, and have vast socio-economic inequalities making them especially susceptible to the manipulation of ruling elites. Although one party dominant systems may initially have a uniting, stabilising effect, if continued they tend to lead towards either the entrenchment of authoritarianism or the establishment of authoritarianism, since dominance is achieved at the expense of competition, and independent and alternative voices. Uncompetitive democracies result in unresponsive governments. Pursuing a liberal democracy, while simultaneously monopolising power is to indulge in serious programmatic contradictions. Eventually something has to give and it is usually liberal democracy. Voice and accountability inevitably become inhibited in one party dominant systems due to the mechanisms of internal and external control used by the dominant or hegemonic party. These mechanisms of control culminate in, as they did in Mexico, there being ‘no life outside the ruling party’. Only when the economic, political and ideological monopolies are dismantled through either economic liberalisation, opposition maintaining its integrity, civil society keeping its independence and societies refusing to be drawn into relationships of patronage, can the space for voice and accountability be prised open again. In the interests of its citizens and the future success of its country, the ruling party of a one party dominant system needs to recognise that it is not the sole channel for the voice of its citizens and to acknowledge the space for agents of voice and accountability. La question prioritaire de constitutionnalité et le juge administratif / The priority preliminary ruling on the issue of constitutionality and the administrative courts

La question prioritaire de constitutionnalité constitue une véritable « révolution » en droit interne, tant au regard des institutions de l’ordre juridique français qu’au niveau de la protection constitutionnelle des droits fondamentaux des citoyens. Ce mécanisme novateur, permettant désormais au Conseil constitutionnel d’opérer un contrôle de constitutionnalité des lois a posteriori, ne peut toutefois fonctionner sans le concours des juridictions ordinaires qui s’érigent désormais en juges du filtre de la constitutionnalité. Or, en prenant le parti d’organiser une telle procédure, le constituant et le législateur organique ont invité officiellement le juge administratif à participer au contrôle de la constitutionnalité des lois. Au-delà de ce premier constat, que la thèse s’attache à étayer in concreto, l’entrée en vigueur de cette nouvelle voie de droit a entrainé une modernisation du droit tant au niveau juridictionnel qu’institutionnel. Celle-ci s’analyse comme la conséquence immédiate du processus de constitutionnalisation des diverses branches du droit qu’accroit de manière exponentielle l’utilisation quotidienne de la question prioritaire de constitutionnalité. Le droit du contentieux administratif, qui voit certaines de ses règles renouvelées sous l’effet de la nouvelle jurisprudence constitutionnelle affectant concomitamment l’office du juge administratif et plus globalement l’exercice de la justice administrative, montre que le juge administratif n’est pas seulement acteur de ce mécanisme mais aussi son sujet / The priority preliminary ruling on the issue of constitutionality is a real "revolution" in domestic law, both in terms of the institutions of the French legal system and at the level of constitutional protection of fundamental rights of citizens. This innovative mechanism, now allowing the Constitutional Council to reviewa posteriori the constitutionality of laws, however, can not function without the help of the ordinary courtswhich are now elevated as judges of the constitutional filter. Taking the party to organize such a procedure, the constituents and the legislator officially invited the administrative courts to participate in the review of the constitutionality of laws. Beyond this observation, which the thesis illustrates concretely, the entry in force of this new remedy has led to a modernization of the law both at the institutional and the jurisdictional levels.This is the immediate consequence of the process of constitutionalisation of the various branches of the law which the daily use of the priority question of constitutionality exponentially increases. The contentious rules before administrative courts, which are renewed under the influence of the new constitutional case law affecting simultaneously the powers of the administrative courts and more generally the exercise of administrative justice, shows the administrative courts are not only the participants of the process but also its subject matter

The thesis deals with the preliminary reference procedure. There is outlined not only the characteristic of this procedure or its evolution, but also the interpretation of the term "court or tribunal of a Member State" or the Exceptions to the Duty to Refer. The following chapters are concerned with the statistical curiosities of the preliminary reference procedure or the ways of how to make this procedure more efficient. The last chapter is analysing the preliminary reference procedure from the Czech law's point of view. It deals with some Czech institutions as courts of the Member State, procedural aspects of this procedure or study of the Czech preliminary references. It also contains some cases of The Constitutional Court of the Czech Republic regarding with this procedure.

L’étude des élèves en situation scolaire difficile dans les classes dominantes nous permet un autre éclairage quant à la construction de l’idée d’échec. Les enfants issus de milieux très favorisés bénéficient d’un cumul de capitaux leur assurant théoriquement la reproduction de leur posture et de leur niveau social. Cependant on observe au sein même de ces classes des situations d’échec non négligeables. À travers une recherche ethnographique dans des établissements scolaires privés sous contrat très favorisés de Bordeaux et d’une immersion ethnographique dans les classes dominantes, ce travail décrit les modes de construction sociale de l’idée même d’échec dans ces classes ainsi que des formes de rattrapage des « repris de justesse ».La thèse montre à quel point les établissements scolaires d’excellence créent eux-mêmes de l’échec dans ces classes sociales. L’étude des normes d’excellence et des distances à celles-ci, montre à quel point une culture d’établissement trop forte et tournée exclusivement vers les codes des classes favorisées est créatrice d’échec pour les plus éloignés de ces normes et des règles théoriquement inhérentes aux classes supérieures. L’étude montre également comment par la quotidienneté, des établissements se mettent au service d’une classe entière afin de récupérer ces « repris de justesse » et leur assurer la perpétuation attendue. Loin d’une attitude rationnelle de rupture volontaire avec les codes de leur classe, ces élèves en situation d’échec sont les produits des structures même des classes dominantes et des établissements scolaires qui les accueillent. / The study of students from the upper classes in difficulty at school offers a different perspective on the idea of failure. Children from very advantaged backgrounds benefit from a variety of assets, which, in theory, guarantee their position and social status. Within these classes, however, significant situations of failure can be observed.Through ethnographic research in Bordeaux's private schools under contract, and ethnographic immersion in the dominant classes, this work describes the types of social constructions of the idea of failure in these classes and forms of remedial for children of ruling classes in failure.This thesis shows how elite schools themselves create a kind of failure in their social classes. The study of the gap between actual performance and the expected standards of excellence in highly respected institutions shows how a strong school culture which exclusively adheres to the codes of the privileged classes could lead to school failure even in children far removed from the rules and values of the upper classes. The study also shows how institutions are at the service of an entire class to retrieve their own children from failure and ensure the perpetuation expected. Far from a rational attitude of deliberately breaking away from the codes of their class, these failing students are the product of the same structures of the dominant classes and schools that host them

5 Abstract This dissertation examines the standing of the Court of Justice of the European Union in the area of police and judicial cooperation in criminal matters, which was formally included under the umbrella of the European Union as a result of the Maastricht Treaty in the early nineties. Yet this area was excluded from the Community framework, which had a significant impact on the jurisdiction and competencies of the Court of Justice. Despite limitations arising from the construct of the third pillar, the Court of Justice took an opportunity through case law to overcome some of these limitations. The most recent milestone in the development of this area is the entry into force of the Lisbon Treaty which removed the so-called pillar structure and further limitations disappeared with the end of the transitional period. Further, existing case law of the Court of Justice in this area has been closely linked to the framework decision on the European arrest warrant, which is based upon the principle of mutual recognition and mutual trust between the EU Member States, and thus became an important part of the case law of the Court of Justice. The introduction of personal assistance in Sweden in 1994 showed an ambi­tion by policymakers to ameliorate the conditions of persons with extensive disabilities. The legislators expressed a vision of autonomy and integrity, and that persons with considerable disabilities should lead a life like others. This includes having a family and being a parent. The thesis “Family life with personal assistance” has aimed at exploring what it means to have an extensive disability and to have personal assistants in everyday family life. The thesis has had an explorative onset and is based on interviews with eight women and men and their family members: partners, children and members from the family of origin. They were interviewed about their experiences of daily life with personal assistance. The results are structured under three themes. The first theme is about power - loss of power and control – loss of control in different situations in everyday life. The results indicate that the assistance users, in spite of a legislation that allows the user to choose how they want to form their personal assistance, are confronted with different dilemmas striving to maintain power and control over their everyday life and daily help. To cope with these challenges the assistance users had developed different strategies. The second theme is about the results of applying a life course perspective on the different experiences depending on when in life the assistance users became disabled – if they were born with the impairment or if they had an accident or became ill as adults. These different experiences have had an effect on how they look upon personal assistance and it has also had an impact on how they formed their strategies about assistance and the assistant’s relations to their children. The third theme is about the role of the family. Family members play a significant role in making everyday life work. In designing and using personal assistance, the individual’s freedom is balanced against his or her need of autonomy on one hand and the family’s demands for privacy on the other.

In Europe, the protection of this right is guaranteed at a multi-layer level, whose layers interact: first layer is formed by constitutional orders of individual States, second layer by institutions of European Union, in particular the Court of Justice of the European Union, and a third one, that of the European Court for Human Rights. In the European Union, the Treaties have introduced the mechanism of preliminary ruling with the aim of preserving unity within the Union and of ensuring coherent interpretation and application of European law by the courts of the Member States. Preliminary ruling proceedings ensure effective cooperation between national courts and the Court of Justice of the European Union. Art. 267 TFEU provides for an obligation to request a preliminary ruling for national courts of last instance (if none of the CILFIT case law conditions is met). Text in Afrikaans / Executions were discontinued during November 1989. In February 1990 the State President announced a moratorium on executions. Since 27 July 1990 the Criminal Law Amendment Act, 1990 effected important changes to the substantive law and procedure regarding the death sentence. The "new" death sentence dispensation was applied by the courts and the moratorium would be lifted as soon as the new dispensation became effective. That never materialised. The death sentence issue was dealt with in a game of political compromise. Criminal law and the esteem of the Government suffered as a result. Judicial frustration and uncertainty developed regarding application of the death sentence. The opportunity was seized by the abolitionists to attain their ideal. The Constitutional Court declared the death sentence unconstitutional. Presently a final Constitution is being drafted which will probably finally do away with the death sentence. An effective process of denigration of the death sentence thus resulted from the moratorium on executions. / Teregstellings is gedurende November 1989 gestaak.
