Rede de urgência e emergência na grande oeste de Santa Catarina e a educação

Na implantação da Política de Redes de Atenção à Urgência e Emergência (RUE) na Macrorregião do Grande Oeste de Santa Catarina, como parte do projeto de saúde no Brasil, esta dissertação trata de analisar o papel da educação. Tem como foco os três hospitais porta de entrada na Rede de Urgência e Emergência: Hospital Regional São Paulo, Hospital Regional Oeste e Hospital Regional Terezinha Gaio Basso. A pesquisa qualitativa descritiva-exploratória estuda: 1) o plano de implantação desta rede confrontando o planejado e o executado; 2) a qualificação destes Hospitais e, 3) o papel da educação e saúde desenvolvido pelos hospitais e profissionais que realizam o atendimento. Ao avaliar o papel da educação, tematiza nas Redes de Atenção à Saúde no SUS, a regionalização, a gestão dos serviços e o processo vivido na RUE. Utilizando como base a análise documental do Plano da Rede e das Portarias Ministeriais, foram realizadas 12 entrevistas semiestruturadas, abrangendo profissionais, Diretores de Hospitais, Coordenadores de Comissão Intergestores Regional e Usuários do SUS. O levantamento das fragilidades e possibilidades considera o período entre 2013 e 2016. Identificadas a descontinuidade, a fragmentação, fragilidade na coordenação do cuidado com os usuários na rede, o estudo possibilita analisar, além da implantação desta rede, o processo de proposição de ações para a formação dos envolvidos. Com os resultados obtidos apresentamos sugestões para a educação e saúde que fortaleçam a rede e indiquem soluções. / In the implementation of Emergency Attention Network Policy in Macro region of big west region of Santa Catarina as a part of health project in Brazil, this dissertation tries to analyze the role of education. It has as its focus three hospitals which are the entrance of emergency Attention Network: São Paulo Regional Hospital, West Regional Hospital and Terezinha Gaio Basso Regional Hospital. The descriptive-exploratory qualitative research studies: 1) The implementation plan of this network confronting the planned and executed; 2) the qualification of these Hospitals and 3) the role of education and health developed by the hospitals and professionals who perform the care. When evaluating the role of education, it is thematic in the Health Care Networks in SUS, regionalization, service management and the process lived in the RUE. Based on the documentary analysis of the Network Plan and Ministerial Ordinances, 12 semi-structured interviews were carried out, including professionals, Hospital Directors, Regional Interagency Commission Coordinators and SUS Users. The survey of weaknesses and possibilities considers the period between 2013 and 2016. Identifying the discontinuity and fragility in the coordination of care with users in the network, the study makes it possible to analyze, in addition to the implementation of this network, the process of proposing actions for the training of those involved. With the results obtained we present suggestions for education and health that strengthen the network and indicate solutions.

Due to the fact that the main function of the physician is to save their patients lives; responsibility that is aggravated by the necessity of to take decisions quickly, once he need to deal with the unexpected situations of the urgency and emergency, many times these professional have to face of impotency and fail situations, when he lose a patient. The main goal of this study was to understand the experience of physicians that work in the urgency and emergency, in front of death. These questioning it justified by the fact of the physicians do not have, many times, a space to express their suffering and anguish about the issues related to death in their work routine, despite lifedeath question to be often present their everyday. It is still possible to verify in the literature, an appointment of the necessity of to include in the curriculum of Medicine courses, subjects that approach such questions. The method used was based on the existential-phenomenological perspective, using as instrument the participant observation, to the intent of understand the routine in the urgency and emergency context, and semi-structured interview. It was interviewed six physicians that work in the urgency and emergency of the most important hospital of public health system of Natal-RN. The results showed that the physicians reported pleasure in work in the urgency and emergency, despite of they presented stress and the difficulties that they deal with in the public system. Despite of the fact that the death to be considered as a phenomenon that make part of the physician s routine, sometimes, deals with these one is more difficult. Many times losses generate an impotency and guilty feeling, as well as questionings about their performance during the attempts to save lives. We verified, from this study, the importance of the existence of some kind of intervention in the emergency, in order to the physicians can elaborate the questions about death and die emerged in their work. We consider yet that this study corroborates and reiterates the discussions concerning the importance of this thematic to be approached in a more effective way, during the academic formation of these professionals, as well as, the importance of a larger investment from the part of Government in the urgency and emergency sector, in order to propitiate to these professionals a work that brings less harmful for their health / A literatura aponta que a forma como as pessoas encaram a morte vem sofrendo mudan?as no decorrer dos s?culos e hoje o que se percebe ? que, cada vez mais, o ser humano tem dificuldades para lidar com a morte. Em raz?o de o m?dico ter como fun??o primordial salvar a vida dos seus pacientes, e sendo essa responsabilidade agravada pela responsabilidade de tomar decis?es rapidamente, j? que precisa lidar com o inesperado das situa??es de urg?ncia e emerg?ncia, muitas vezes esse profissional tem que enfrentar situa??es de impot?ncia e fracasso diante da perda de um paciente. O objetivo principal deste estudo foi compreender a experi?ncia de m?dicos que trabalham em urg?ncia e emerg?ncia diante da morte. Justifica-se tal questionamento pelo fato de que, apesar das quest?es da vida e da morte fazerem parte do cotidiano desses profissionais, os m?dicos n?o t?m, muitas vezes, espa?o para expressarem o seu sofrimento e ang?stia sobre as quest?es relacionadas ? morte em sua rotina de trabalho. Verifica-se ainda na literatura um apontamento da necessidade de se incluir nos curr?culos das universidades de medicina disciplinas que abordem tais quest?es. A metodologia utilizada foi de car?ter enomenol?gico-existencial, utilizando como instrumento a observa??o participante, a fim de conhecer a rotina da urg?ncia e emerg?ncia, e a entrevista semi-aberta. Foram entrevistados seis m?dicos que trabalham na urg?ncia e emerg?ncia do maior hospital da rede p?blica de Natal-RN. Os resultados mostraram que, apesar dos m?dicos relatarem ter momentos de estresse e das dificuldades encontradas por eles no servi?o p?blico, esses profissionais sentem prazer em trabalhar na urg?ncia e emerg?ncia. Embora a morte seja considerada um fen?meno que faz parte de sua rotina de trabalho, em alguns momentos ela ? mais dif?cil de ser encarada. Muitas vezes as perdas geram sentimentos de impot?ncia e culpa, bem como questionamentos sobre suas atua??es durante as tentativas de salvar vidas. La recherche proposée concerne « la dimension constitutionnelle de l’urgence en France et en Italie». Elle sera divisée en deux parties. La première concernera l’autonomie sémantique et la dimension théorico-juridique de la notion d’urgence. L’appréhension de la notion d’urgence, en effet, soulève la question de sa définition juridique, permettant de la distinguer d’autres notions juridiques proches, comme celles de la nécessité, de la rapidité ou du péril en la demeure. Définir l’urgence d’une façon rigoureuse est-elle une entreprise vouée à l’échec ? La deuxième concernera l’urgence dans les systèmes constitutionnels français et italien. On examinera les 47, al. 4, et 61, al. 3, de la Constitution française et les articles 13, 21, 72, 73 et 77 de celle italienne. Il nous a apparu intéressant, en outre, d’analyser la loi sur l’état d’urgence dans les deux ordres juridiques, pour se demander, finalement, s’il est possible d’envisager une "urgence démocratique". / The research concerns «the constitutional dimension of the emergency in France and Italy». The PhD Thesis will be divided into two parts.The first part is aimed at the theoretical definition of the emergency. We have paid priority attention to highlighting the difference between the emergency and the others “similar” legal notions (necessity, periculum in mora, celerity, etc. Is it possible defining the emergency in a rigorous way?In the second part we have examined the articles 47, al. 4, and 61, al. 3, of the French Constitution and the articles 13, 21, 72, 73 and 77 of the Italian Constitution. We have also analyzed the state of emergency law in France and in Italy. It is possible to envisage a «democratic emergency»

Évaluation du rôle modérateur de l’intégration des Relations d’Objet dans la relation entre l’Urgence Négative et les comportements impulsifs dirigés contre soi et autrui

L’Urgence négative est un trait caractéristique du trouble de personnalité limite. Cependant ce modèle des traits ne permet pas d’expliquer les variétés des formes d’expression ni le niveau de sévérité de gestes impulsifs, qu’ils soient dirigés contre soi ou contre autrui. L’intégration du modèle des relations d’objet à celui des traits offre une meilleure compréhension de cette variabilité. Dans la théorie des relations d’objet, la diffusion de l’identité est spécifique aux organisations limites de la personnalité. Elle est caractérisée par un manque d’intégration des représentations de soi et d’autrui à cause d’une séparation excessive des affects positifs et négatifs investis dans les images de soi et d’autrui. Elle est associée à un manque d’intégration des structures psychiques du Moi et du Surmoi. Le niveau de l’intégration de l’identité agirait en modulant la relation en un trait d’urgence négative élevé et l’expression des gestes impulsifs. Cette étude, réalisée auprès d’étudiants, était la première à tester une telle hypothèse. Bien qu’elle n’ait pas permis de démontrer une telle relation de modération, compte tenu de certaines limites, il apparaît nécessaire de réévaluer ce modèle modérateur au sein d’un d’échantillon de plus grande taille. / Borderline personality disorder (BPD) is characterized by negative Urgency, one of the impulsivity facets. However the model of personality traits can’t explain the varieties of expression and severity of impulsive behaviors which can be directed against self or others in BPD. Integrating the object relations model with the personality traits leads to an improved understanding of this variability. In object relations theory, identity diffusion is specific to borderline organization. It is characterized by a lack of integration of the conceptions of self and others derived from an excessive split between positive and negative affects invested in self and others images. This diffusion is associated with a deficit of Ego and Superego structures. Level of identity integration would modulate the relationship between high negative urgency and the forms and severity of impulsive behaviors. This study is the first to evaluate this hypothesis. Data collected from students sample have not demonstrated any moderating effect because of some limitations in the study. Nevertheless, the Identity diffusion index was as expected negatively correlated with many variables related to impulsivity such as borderline impulsivity (r=-.23), physical aggression (r=-.31), urgency trait (r=-.31) and acting out (r=-30). However, this hypothesis needs to be tested with larger samples.

Coordenação de Aperfeiçoamento de Pessoal de Nível Superior / O presente trabalho examina as razões dos procedimentos de urgência nos projetos do Executivo junto à Assembléia Legislativa do Estado do Rio Grande do Sul entre 1999-2006. Para tal, o texto discute os fundamentos e algumas implicações de teorias sobre a organização legislativa, especialmente as vertentes partidária e informacional, situando, primeiramente, o debate sobre a política regional gaúcha e as relações Executivo-Legislativo no âmbito subnacional brasileiro. O objetivo do estudo é analisar a rationale dos procedimentos de urgência utilizados pelo Governador, unilateralmente, e pelo próprio Legislativo, através de seu Colégio de Líderes, para acelerar a tramitação dos projetos do Executivo, retirando a matéria das Comissões permanentes antes da aprovação de parecer. Empiricamente, a pesquisa investiga se a presença de cartéis legislativos e a distância das preferências do Governo em relação às do mediano do Plenário da Assembléia têm efeitos sobre as chances de utilização de tais procedimentos. Assim, avalia a possibilidade de conjugação da teoria partidária com problemas informacionais para a análise do processo decisório legislativo no âmbito subnacional. O exame conclui que tanto a urgência governamental quanto o acordo de lideranças possuem padrões distintos apresentando resultados diversos que dependem do tamanho das forças políticas e da distribuição de preferências, figurando as instituições como fatores intervenientes, de modo que tais procedimentos obedecem a uma lógica partidária, mas colocada diante de problemas informacionais / This paper examines the reasons of the urgency procedures in the Executive bills at the state legislature of Rio Grande do Sul from 1999-2006. To this end, the text discusses the fundamentals and some implications of theories on legislative organization, especially partisan and informational aspects, placing first the debate on regional politics and Executive- Legislative relationship at subnational scope. The goal is to analyze the rationale of the urgency procedures used by the Governor unilaterally and by the Legislature, through partisan leaders, to accelerate the conduct of executive bills, removing them from committees before approving reports. Empirically, the research investigates whether the presence of legislative cartels and Government distance of preferences in relation to the median of the floor Assembly have effects on the odds of using such procedures. Thus, it evaluates the possibility of combining partisan theory with informational problems for the analysis of legislative decision-making at subnational levels. It concludes that both the gubernatorial urgency procedure and the leaderss agreement have distinct patterns showing different results depending on the size of political forces and the distribution of preferences, with the institutions figuring as intervenient factors, so that such procedures follow a partisan logic, but placed in front of informational problems

Le temps dans la procédure préjudicielle devant la Cour de justice de l'Union européenne / The time factor in the preliminary ruling procedure in front of the european court of justice

Procédure de juge à juge non contentieuse, le renvoi préjudiciel consiste en une voie de droit qui permet à toute juridiction nationale d’interroger la Cour de justice de l’Union européenne sur l’interprétation du droit de l’Union et sur la validité des actes des institutions européennes. Laissée à la discrétion des juridictions nationales, ou parfois imposée, cette procédure n’est enfermée dans aucun délai particulier. Se pose alors la question du temps, envisageable de différents points de vue, qu’il s’agisse des parties, de la juridiction nationale à l’origine du renvoi et de la Cour de justice en charge du traitement.Il s’agit d’un sujet tout à la fois récurrent et d’actualité, dans la mesure où, notamment, la procédure préjudicielle d’urgence a vu le jour récemment et où les statistiques de la Cour de justice ne cessent de rendre compte des efforts déployés sans relâche pour diminuer les délais de procédure. De même, le nouveau règlement de procédure de la Cour de justice s’efforce de rendre cette procédure aussi célère que possible. La procédure préjudicielle se prête particulièrement à une étude introduisant la dimension temporelle pour de nombreuses raisons. Pour n’en citer qu’une : le délai de la réponse préjudicielle s’ajoute aux délais nationaux, ce qui, selon la position de la juridiction de renvoi, au sein de son ordre, et selon le type de procédure pendant, ouvre de vastes pistes de réflexion. Il ne s’agit pas d’expliquer la procédure préjudicielle uniquement par des considérations d'ordre temporel, mais d’observer cette procédure en prenant en compte les différentes manières dont le temps, au sens juridique du terme, joue un rôle dans cette procédure.Cette thèse développe ainsi deux idées principales : la prise en compte du temps préjudiciel par les juridictions nationales (partie I) et la prise en compte du temps préjudiciel par la Cour de justice (partie II). / As a non-litigious court procedure, the reference for a preliminary ruling is a legal remedy that enables any national court or tribunal to refer questions to the Court of Justice of the European Union on the interpretation of Union law and on the validity of acts of the European institutions. Upon discretion of national courts, or sometimes imposed to them, this procedure is not locked up within any particular time frame. This raises the question of time, which may be regarded from different points of view, whether it is one of the parties, of the national court at the origin of the referral, or of the Court of Justice in charge of the processing. The subject is both recurrent and topical, since, in particular, the urgent preliminary ruling procedure has recently emerged and because the statistics of the Court of Justice show constant and countless efforts to reduce the length of the proceedings. Similarly, the new Rules of Procedure of the Court of Justice endeavour to make this procedure as fast as possible.The preliminary ruling procedure is particularly suitable for a study introducing the temporal dimension for many reasons. To mention only one: the time for the preliminary ruling procedure comes in addition to the national duration of the trial. This suggests many lines of thought, considering the position of the referring court, within its order, and depending on the different types of courts in general. The goal of the reflexion is not of explaining the preliminary ruling procedure solely by temporal considerations, but of observing this procedure taking into account the different ways in which time, in the legal sense of the term, plays a role in this procedure.This thesis thus develops two main ideas: the taking into account of the prejudicial time by the national courts (or judges) (part I) and the taking into account of the prejudicial time by the Court of justice (part II).

Ce travail de thèse a pour ambition de comprendre les mécanismes et les processus qui régissent l’action en situation decrise, c’est-à-dire dans des conditions de gestion fortement marquées par l’urgence et la nécessité d’agir vite en situationd’incertitude. Le constat d’une vulnérabilité du réseau routier face aux crues rapides nous conduit à la question suivante :quelles sont les modalités de gestion de crise lors d’événements pluvieux violents ayant pour conséquences des fermetures, des coupures ou des submersions du réseau routier et quelles sont les conditions de l’efficacité de gestion ? Notre étude souhaite montrer comment les acteurs en charge de la gestion du réseau routier dans un département régulièrement impacté par les inondations « gèrent » ces périodes de turbulences, avec quelles ressources et avec quels outils (plans, logiciels, dispositifs techniques, fiches actions etc.). Ce que nous souhaitons montrer, ce n’est pas tant qu’il existe des décalages entre le travail prescrit et le travail réel des opérateurs en temps de crise, mais bien les modalités de ces déplacements. En ce sens, c’est la question de l’efficacité qui est au coeur de notre démarche. Au sens étymologique, l’efficacité est une « vertu », une « force » (du latin efficacitas), elle doit nous permettre dans ce travail de saisir les décalages entre se qui se rapporte d’un côté à la planification et à une gestion organisée des crises, et de l’autre ce qui se rattache à la métis, c’est-à-dire l’intelligence pratique des acteurs en charge de l’exécution des tâches planifiées. Plutôt que d’identifier des défaillances, nous souhaitons montrer ce qui semble efficace du point de vue des acteurs, ce qui est « porteur » pour l’action, ce qui fait sens (Jullien, 1996, 1992). Quels sont les mécanismes vertueux que les acteurs mettent en place afin d’assurer une certaine efficacité de gestion, et de « faire tenir » ce moment de crise caractérisé, d’après une partie de la littérature, par la perte de repères pour l’action ? Approcher les conditions de l’efficacité demande d’une part d’analyser les pratiques des acteurs (rapport à la confiance, à l’adaptation, à l’improvisation, à l’interprétation de l’environnement et des informations), d’autre part de connaître les plans d’action qui les prescrivent. / This PhD dissertation aims at a better understanding of the mechanisms and processes which dictate the actions taken ina situation of crisis, that is to say, in a context very much characterized by urgency, and the necessity to act quickly inan unpredictable situation. After assessing the vulnerability of the road network in the event of a rapid rise in the waterlevel, we were led to raise the following questions : what are the various modes of crisis management in the event of violentrainstorms leading up to closings, interruptions or submersion of the road network ? What are the required conditions foran efficient management ? Our study intends to show the modus operandi of the actors in charge of the road networkmanagement in a district subject to frequent flooding to « manage » those times of trouble and the means and tools given tothem (maps, softwares, technical devices etc). What we originally aimed at was not so much emphasizing the gap betweenthe stipulated work and the effective work of operators in a time of crisis but rather focusing on the modalities of these« moves ». In a sense, matters of efficiency are at the heart of our approach. In its etymological meaning, efficiency is avirtue, a strength (from latin efficacitas) and it should enable us in this work to grasp the discrepancies between whatis linked on one side to the planning and organized managing of crises and on the other to metis, that is, the practicalintelligence of the actors in charge of the execution of the devised tasks. Instead of identifying the deficiency, we intend tohighlight what seems efficient from the actors’ point of view, what is « bearing » to the action, what makes sense (Jullien,1996, 1992). Orientador: Yvete Flávio da Costa / Banca: Antônio Marcio da Cunha Guimarães / Banca: Riva Sobrado de Freitas / Resumo: Tidas as tutelas de urgência como gênero diferenciado dentro das tutelas jurisdicionais, a progressiva importância que estas ganham no meio jurídico, demonstra a adoção, por parte dos legisladores e aplicadores do Direito, do princípio da efetividade, mesmo em face ao da segurança jurídica. Assim, a faculdade ofertada aos magistrados de concessão das mesmas, apresenta-se como verdadeira obrigação, a partir do momento em que analisamos a estrutura destas, que em seu sumário procedimento exige maior serenidade e agilidade de decisões para atingir seu escopo de medida de segurança, inclusive adotando uma cognição sumária, sacrificando-se a certeza, em nome de um processo mais útil, apto e eficaz. Desta forma, mesmo nas questões inaudita altera pars, de maior gravidade, e que sofrem maior resistência por parte dos magistrados, o status de obrigatoriedade de concessão, quando preenchidos os elementos embasadores (em especial fumus boni iuris e periculum in mora), a fim de não oferecer risco a jurisdição, que visam garantir, tornam tais tutelas verdadeiras pedras preciosas dentro do nosso moroso sistema processual. E quando negadas de maneira a ameaçar, ou mesmo tornar irreparável o dano ao direito do requerente, deve sim ser alvo de ações de responsabilização contra o órgão jurisdicional que erroneamente negou sua efetivação. Analisar a extensão da responsabilidade objetiva do Estado (na qual bastam estarem configurados o dano e o nexo causal), e subjetiva do Magistrado, é certamente a demonstração da efetividade do Estado de Direito / Abstract: Considered the urgency guardianships as differentiated sort inside of the jurisdictional guardianships, the gradual importance that these earn in the legal way, demonstrates the adoption, on the part of the legislators and applicators of the Right, of the principle of the effectiveness, even in face of the legal security. Thus, the option offered to the magistrates of concession of the same ones, is presented as true obligation, from the moment where we also analyze the structure of these, that in its summary procedure greater demands serenity and agility of decisions to reach its target of measure of security, adopting a summary cognition, sacrificing the certainty, on behalf of a more useful process, apt and efficient. In such a way, exactly in the questions inaudita altera pars, of bigger gravity, and that they suffer greater resistance on the part from the magistrates, the status of concession obligatoriness, when filled the elements embased (in special fumus boni iuris and periculum in mora), in order not to offer risk to the jurisdiction, whom they aim at to guarantee, become such true guardianships inside precious rocks of our weak procedural system. And when denied in way to threaten, or yet to become irreparable the damage to the right of the petitioner, it must yes be white of action of responsabilização against the judicial body that erroneamente denied its efetivação.
