Policy Reform in Egypt? : A case study

This paper studies the police reform in Egypt in the light of the revolution 2011. The ousting of the authoritarian president Hosni Mubarak was the beginning of the transition towards democracy. Within 15 months both parliamentary and presidential election had taken place. The political leaders were new and the transitional process had begun however the institutions where still the same and one feature of the revolution was to reform the police since the police was hated as the oppressive power it was. Transition from totalitarian regime to democracy is more than elections it is about reforming the institutions and especially the security sector hence they often play a significant role in oppressing the citizens in an authoritarian state. The police in Egypt used repressive methods to control the citizens. Therefore it is interesting to investigate whether the police are beginning to transform along the principles of democratic policing, a specific part of security sector reform focusing on the reformation of the police. The notion of human security with the people at the centre lay as a foundation of the theoretical framework. The material consists of in- depth interviews with leaders and active people in the civil society and their view regarding police work and police reform after the revolution. The conclusions drawn from the study is that the police lack capacity, understanding and training to reform. The reformation has to be influenced by political will from legislative and institutional level as well from the police officers themselves. There are challenges if a reform of the police will be successful and some of them are connected with national and international circumstances.

Det förstärkta laglottsskyddet : En utredning av gällande rätt avseende 7:4 ÄB

Uppsatsen behandlar det förstärkta laglottsskyddet i 7:4 ÄB som är en viktig del av den svenska successionsrätten samtidigt som den är svår att tillämpa i praktiken. Det är därför av vikt att bringa klarhet i detta komplexa rättsområde. Syftet med uppsatsen är därav att utreda gällande rätt kring denna rättsregel och påvisa samt analysera de praktiska tillämpningssvårigheter rättsregeln ger upphov till för domstolen med avsikt att undersöka om den är i behov av en reform av något slag. För att uppnå detta syfte används en rättsdogmatisk metod, där rättspraxis har en framträdande betydelse i uppsatsen. När någon avlider ska dennes kvarlåtenskap fördelas genom den legala arvsordningen om inget testamente har upprättats. En arvlåtare kan fritt testamentera bort den ena halvan av arvslotten medan den andra halvan utgörs av bröstarvingarnas laglott. En bröstarvinge är alltid berättigad att utfå sin laglott, vilket föranleder att en bröstarvinge kan påkalla jämkning av ett testamente som inskränker hens laglott. Det förstärkta laglottsskyddet ger bröstarvingar ett ytterligare laglottsskydd. Rättsregeln aktualiseras när en arvlåtare har bortgivit egendom under sådana omständigheter eller på sådana villkor att gåvan är att likställa med testamente och särskilda skäl ej föreligger. Om gåvan inskränker en bröstarvinges laglott ska gåvan återbäras till dödsboet. Kan gåvan inte återbäras ska ersättning motsvarande gåvans värde utgå. I rättsregelns ordalydelse återfinns tre stycken vaga rekvisit, vars innebörd har utkristalliserats i rättspraxis. Domstolen har därav tolkat vad som innefattas i begreppet gåva, vad som ska likställas med testamente samt när särskilda skäl ska anses föreligga. Vid en tillämpning av rättsregeln måste domstolen således beakta dessa vaga rekvisit, som till sist utmynnar i en subjektiv bedömning. Med det i beaktande och i samband med att vissa situationer faller utanför rättsregelns tillämpningsområde, vore det önskvärt med en reform avseende det förstärkta laglottsskyddet. / The thesis discuss the reinforced statutory share of inheritance in the 7th chapter 4 § ÄB, which is an important part of the Swedish inheritance law but likewise difficult to implement practically. It is therefore important to clarify this complex branch of law. The purpose of the thesis is to examine applicable law concerning the legal rule and to detect and analyze the practical implementation difficulties that occur for the court in order to examine if the legal rule is in need of a reformation. To achieve this purpose, a legal dogmatic method is utilized; where case-law have a prominent part of the thesis. When someone passes away, his estate shall be allocated through the legal rule of inheritance if a will has not been created. A devisor freely can bequeath one half of the share of inheritance, while the other half constitutes the direct heirs statutory share of inheritance. A direct heir is always entitled to obtain his statutory share of inheritance, which means that a direct heir can claim a will that circumscribes his statutory share of inheritance. The reinforced statutory share of inheritance gives additional protection of the statutory share of inheritance for direct heirs. The legal rule is actualized if a devisor gives property away during circumstances or upon such terms that the bequest is equivalent with a will and special reasons does not apply. If the bequest circumscribes a direct heirs’ statutory share of inheritance, the bequest shall be refunded to the estate. If the bequest cannot be refunded, remuneration corresponding to the bequest shall be reimbursed. The legal rules’ wording consists of three vague necessary conditions, whose meaning has been crystalized by case-law. The court has therefore interpreted what the term bequest is contained of, what is equivalent with a will and when special reasons shall apply. The court must therefore pay attention to these vague necessary conditions when the legal rule is applied practically, which finally results in a subjective judging. With that in mind and that some situations is not regulated within the legal rule, it would be desirable with a reformation regarding the reinforced statutory share of inheritance.

Die vorliegende Arbeit befasst sich mit der Kenntnis über Patientenverfügungen sowie deren Akzeptanz und dem Vorhandensein dieser Vorsorgedokumente innerhalb eines Studienkollektives von Senioren in Leipziger Alten- und Pflegeheimen. Der Gegenstand der Patientenverfügung selbst wird, unter Berücksichtigung soziodemographischer, persönlicher sowie gesundheitlicher Aspekte, evaluiert. Außerdem werden Standpunkte der Heimbewohner wie beispielsweise die Bereitschaft zu lebensverlängernden Therapien sowie zu Reanimationsmaßnahmen hinterfragt. Vor dem Hintergrund der Ergebnisse werden Lösungsmöglichkeiten diskutiert, welche die Grenze zwischen medizinisch-technisch Möglichen und ethisch Vertretbarem bezüglich der Entscheidungen am Lebensende regulieren können.

Situational Context, Philosophical Belief, and Moral Constructs: The Multifaceted Nature of Moral Judgment

Recent studies have shown that different free will beliefs affect moral behavior. The purpose of the current study was to investigate whether different free will beliefs also influence moral judgment. College students (N = 56) were randomly assigned to one of three framing manipulations: free will, determinism, or neutral. They then read three morally questionable scenarios that differed by situational context. Following each scenario, participants completed a moral judgment questionnaire that measured four moral constructs: moral evaluation, moral responsibility, justification, and punishment. Finally, participants completed a Free Will & Determinism Questionnaire (FWD-Q) that measured their lay beliefs in free will and determinism. For analysis, we grouped participants according to their reported FWD-Q scores into one of three groups: free will, determinism, or compatibilism. We found that different free will beliefs influenced moral judgment to a small degree, but not in the ways that we predicted. Our results show that situational context affects moral judgment much more than lay philosophical beliefs regarding free will. Future studies should examine whether this still holds true for older adults with more developed worldviews.

In this essay I have examined text, speech and action in Chekhov's Three sisters, as well as how the characters express their wills in action and in speech. I have used different methods such as action analysis, the five W questions and BSI (background, situation and intention). These methods are similar to those actors use to uncover situatedness of characters and to find motivated and intentional patterns behind their actions. I have used these techniques to identify the plot, explore what happened before the plot begins and to read the text in terms of action. The aim was also to find the counter points where wills expressed in action are contradicted by wills expressed in speech. Using these methods I found that the characters in Three sisters manage their lives dreaming about the future or recalling the past, except the character Natasha. Her goal is obvious, she runs her will with clear intentions and she uses functional means to achieve her goal. The main conclusion is that the characters’ wills expressed in speech, are contradicted by will expressed in action. This creates a discrepancy. The characters are controlled by their unspoken desires which drive them further away from their expressed goals. It seems to be paradoxical, but it makes perfect sense since it drives the plot forward, deepens the image of the characters and the relationships between them. It also becomes clear when actions are interpreted from wills and motivations, stated or unstated, and I argue that action is not only the doing but also the intention to do; this makes sense when events in a dramatic text are analyzed as relational and conditional.

Cognitive Basis Of The Concept Of Conscious Self

Contemporary developments in cognitive sciences have uncovered strong correlations between mental events and nervous activity. Despite their achievements, cognitive sciences are still unable to provide an adequate explanation for the concept of conscious selves. There are two main reasons behind this inability. The first one is the mismatch between the distributed nature of the nervous information processing and the unified nature of the consciousness. The second one is the fundamental differences between conscious experiences and the objects and events in classical physics. This thesis aims to provide a basis for a theory for consciousness and conscious selves by using certain findings of modern physics, neuroscience and philosophy. The argumentation is based on the biological necessity of having neural mechanisms that act like a self and quantum-theoretical approaches to consciousness. Consequently, it is shown that, the concept of conscious self is just a concept that we use to encompass several related concepts and experiences rather than being an ontological reality that is assumed by our common-sense intuitions.

This thesis argues that Friedrich Nietzsche???s notion of world and self as ???will to power and nothing besides??? offers a highly productive interpretive lens or ???grid of intelligibility??? for understanding the ethical implications of Michel Foucault???s middle and late works on power and subjectivity. For if the late modern era is marked by a sustained and pervasive incredulity toward metanarrative, it is also the historical site for the reappearance and widespread acceptance of a very ancient metanarrative ??? the Heraclitean view of material reality as continual flux. Inasmuch as Nietzsche???s will to power philosophy is grounded in this Pre-Socratic worldview, his works and those of his devotee Foucault may serve as a productive foundation for a late modern ethics. The scholarly implications of reading Foucault???s middle and late works through the interpretive lens of Nietzschean will to power in its two key manifestations, domination and dynamism, are multiple. In addition to providing new insights into the value of Nietzschean-Foucauldian philosophy for advancing a late modern ethics, such an analysis also illuminates important continuities in Foucault???s theory of power and how his works simultaneously extend and critique Nietzschean views on the role of asceticism in culture. The thesis then turns to a more futuristic exploration of how Foucault???s final texts, feminist critiques and extensions of these texts, and works from the separate discipline of feminist moral theory may advance a feminist form of will to power ethics. Feminist reflection upon the dualistic philosophical basis of modern androcentric power invites further speculation upon the utility of the nondual philosophies of yoga, including those found in Ved??ntic texts like the Bhagavad G??t??, for such an endeavour. Because yoga utilises asceticism-based practices of the self as its primary means for moulding moral subjects, it is comparable to the Greco-Roman will to power ethics described in Foucault???s final works. On the other hand, yoga???s nondual telos may present certain ethical possibilities that dualistic constructs like the Greco-Roman model cannot. Indeed, by practicing nonduality through yoga, contemporary women and others may be engaging in a practice of freedom in the most essential sense.
