Le génocide constitue incontestablement le crime le plus monstrueux, du fait que ses victimes sont un groupe de personnes innocentes et inoffensives, visées, non pas à cause de leurs actes ou du risque qu’elles représentent au regard de la sécurité de l’État criminel, mais uniquement pour ce qu’elles sont, comme telles. La Convention sur la prévention et la répression du crime de génocide, mise en place en réaction contre l’Holocauste en tant qu’instrument juridique à même de permettre au "plus jamais ça" de devenir une réalité, n’a pas contribué à la prévention de ce crime, dans la mesure où le génocide des Tutsis est venu rappeler que les plus belles promesses restent vaines, lorsque les instruments juridiques internationaux, régionaux et nationaux de protection des droits humains ne sont pas solides, et surtout lorsque ceux-ci ne sont pas "arrimés" à des outils structurels et opérationnels cohérents en mesure de faciliter la prise de décision rapide et efficace des plus importants décideurs politiques au sein de la "société internationale", en vue de la prévention du génocide et d’autres crimes de masse.
La question à laquelle tente, dès lors, de répondre cette étude est celle de trouver les voies et moyens à utiliser pour permettre à la "société internationale" de prévenir le génocide et les autres crimes de masse. Cette étude suggère, entre autres, aux Nations Unies, aux organisations régionales, aux États ainsi qu’aux citoyens, des moyens susceptibles de relever ce défi. Figurent notamment parmi ces moyens, le renforcement des normes et institutions de protection des droits humains tant à l’échelle universelle que sur les plans régionaux. Elle propose également les moyens structurels et opérationnels utilisables dans la même perspective

Especially the trend of building CSR in the core business and in brands themselves is pointed out. The diploma work shows many examples of practising marketing with some social effect, from which both the company and the supported object can profit. Finally, the work describes some possibilities of CSR implementing and communicating. The practical part describes current CSR activities of Unilever company, including its Vitality mission, that is built in the whole business.

Les entreprises de spectacle vivant évoluent dans un contexte de diminution de ressources externes et de modification des modalités d’attribution des subventions par l’application de la LOLF (Loi Organique relative aux Lois de Finances). Leur problématique repose sur les moyens à mettre en œuvre pour faire face à ces contraintes. Nous nous attachons à démontrer que leur développement dépend de l’amélioration de la logique de coopération entre les acteurs à partir du projet artistique et de l’appropriation des contraintes d’évaluation de la LOLF, pour révéler les performances cachées et développer des ressources internes. Cette recherche se construit à partir de l’hypothèse que l’amélioration de la performance globale des organisations dépend d’une action transformative qui opère selon trois axes interdépendants : l’intervention, les outils de management, le langage–acteur. A partir d’une recherche-Intervention dans un théâtre et d’un diagnostic qualitatif dans un autre, nous accompagnons les acteurs dans une conduite de changement et étudions les conditions de développement managérial dans ce type d’organisation. Nous analysons comment l’utilisation du langage dans le cadre de l’Intervention Socio-Economique modifie les représentations et contribue à l’élaboration d’un nouveau dispositif managérial. Nous proposons d’associer les outils de management socio-Économiques, utilisés comme des matrices de lecture de l’organisation, aux critères d’évaluation et de subvention des pouvoirs publics pour en faire des outils de réflexion sur le processus de réalisation et de diffusion de spectacle et construire une représentation partagée entre les différents acteurs. / Performing arts companies operate in a context of declining resources and changes in the rules governing the allocation of grants, in accordance with the LOLF (Organic Law relative to the Laws of Finance). Their challenge lies in finding ways to address these constraints. We aim to demonstrate that their development depends on improving the manner in which all parties cooperate, based on the artistic project and taking into account the constraints resulting from the evaluation used by the LOLF, to reveal hidden costs and to develop internal resources. This research is based on the hypothesis that improving the overall performance of organizations depends on a transformative action that operates in three interdependent areas: intervention, management tools, and the speech-Actor. Based on intervention-Research in one theatre and on a qualitative study in another, we have assisted actors in the process of change management and examined the conditions in which managerial development takes place in this type of organization. We analyse how language use in the context of Socio-Economic Intervention modifies the representations and contributes to the elaboration of a new managerial instrument. We propose the use of socio-Economic management tools, serving as a framework for analyzing the organisation, combined with the criteria of evaluation and allocation of public funding as a basis of reflexion on the process of creation and dissemination of shows, as well as a means of building a shared representation between the different actors.

The theme of this diploma thesis is the analysis of the legal status of Palestine. The theoretical part of this thesis examines the history of Palestine, the relations between Palestine and Israel, the rejection of United Nations General Assembly Resolution 181 by Arab states, Palestinian membership in international organisations, the Oslo I Accord and the Montevideo criteria for statehood.The thesis also evaluates the final status negotiations between Israel and Palestine and various Palestinian government programs. The second part of the thesis analyses the constraints posed by divided Palestinian territories and the dynamics and interactions between Palestinian populations living in and outside the territory. Furthermore this diploma thesis focuses on the Palestinian public sector; especially on the areas of justice, education, health system and defense. Individual chapters also deal with the economic instability of Palestine and its financial dependence on the other, mostly European, countries. In conclusion, this diploma thesis will give not only a comprehensive legal view of the status of Palestine, but also views on Palestinian governance.

Can NGOs cultivate supportive conditions for social democratic development? : the case of a research and development NGO in Western UgandaKing, Sophie January 2013 (has links)
There is an emergent consensus that the ‘poverty reduction through good governance’ agenda has failed to meet expectations. The capacity of non-governmental organisations (NGOs) to cultivate the political economies and state-society synergies that might be supportive of more pro-poor development trajectories is contested. Advocates of inclusive liberalism identify increased political space for NGOs focused on popular empowerment and policy influence within the participatory spaces created by the good governance agenda. More radical critiques cast NGOs as apolitical brokers of neo-liberal development resources which distract from or are disinterested in more fundamental questions of redistribution. This thesis explores the potential for Ugandan NGOs to cultivate supportive conditions for a more redistributive development process amidst a semi-authoritarian, patronage-based, political regime and within a predominantly agrarian economy, using the lens of a single case study organisation situated in the Western region of the country. The findings suggest Ugandan NGOs should move beyond strategies associated with inclusive liberal governance towards a closer engagement with the politics and political economy of progressive change. Micro-enterprise and economic associational development emerge as more effective enhancers of political capabilities among the poor than strategies aimed solely at promoting inclusive liberal participation because they can tackle the socio-economic power relations that curb political agency in such contexts, and begin to undermine patronage-politics. In contrast, strategies for enhanced inclusive liberal participation engage with the formal de jure rules of the game in ways that either sidestep or re-enforce the de-facto patronage-based political system and fail to tackle the power relations that perpetuate ineffective forms of governance. Creating new cross-class deliberative spaces which engage with grass roots perspectives, can facilitate the emergence of new ways of thinking that promote a more pro-poor orientation among development stakeholders. Triangulation of qualitative primary data and relevant literature leads to the overarching conclusion that NGOs operating in such contexts are more likely to enhance the political capabilities of disadvantaged groups by adhering to a principle of self-determination. This focuses energy and resources on non-directive facilitative support to disadvantaged groups. This enables them to a) make socio-economic progress; b) become (better) organised; c) develop the necessary skills and knowledge to advance their interests; and d) cultivate opportunities for direct engagement with power holders and decision-makers. This approach requires a high level of what the thesis terms ‘NGO political capacity’ and a far more open-ended and programmatic approach to the provision of development aid than currently prevails.

De même la spécificité principale de la responsabilité internationale est liée aux particularités du droit international et de ses sujets principaux- Etats souverains. La compréhension du mécanisme de la mise en œuvre de la responsabilité internationale des Etats et de son rapport avec la souveraineté montre la validité et l'efficacité du droit international. La réalisation de la responsabilité en tant que processus est examinée en thèse en tenant compte des différents critères : comme la réalisation des éléments de la responsabilité (application de mesures de contrainte), le processus de l’attribution de la responsabilité (le procès de l’attribution à l'Etat des faits des autres sujets du droit international) et la réalisation des phases de la responsabilité (les questions liées à la procédure judiciaire et à l’exécution des décisions internationales).La corrélation de ces deux notions est conçu en thèse sous deux aspects: à savoir, si l'Etat souverain peut en se couvrant sous la souveraineté tenter d'éviter la responsabilité et quels sont les mécanismes pour l’en empêcher et à contrario, comment la réalisation de la responsabilité peut toucher ou même violer la souveraineté des Etats. / Being a member of the international society, the State can not be irresponsible for its actions. At the same time the peculiarity of international responsibility is joined to the peculiarities of the international law and its subjects-sovereign states.The understanding of the mechanism of application of State’s international responsibility and its relation with sovereignty shows the validity and the efficiency of the international law.The realization of the responsibility is regarded in this research as a process taking into account different criterions: as the realization of elements of responsibility (application of coercive measures), as a process of attribution of responsibility (a process of attribution to a State the acts of other subjects of the international law) and as a realization of phases of the responsibility (questions related to the court procedures and to the execution of the international awards).This research considers the correlation of these two legal concepts in two aspects: on the one hand, if the Sovereign state by using the principle of sovereignty can escape the responsibility and what are the mechanisms to prevent it, and, on the other hand, how the realization of responsibility could touch or even violate the sovereignty of the states.

Étude des pratiques et des rôles de gestion favorisant l’engagement des patients dans les soins et l’amélioration de la qualité des services de santéClavel, Nathalie 06 1900 (has links)
Contexte : dans les pays de l’OCDE, la plupart des organisations de santé ont mis en place
différentes approches afin d’accroître l’engagement des patients que ce soit au niveau des soins
ou au niveau de l’amélioration de la qualité. Au Canada, la province du Québec se caractérise
par un contexte particulièrement novateur en matière d’engagement des patients au sein des
organisations de santé. Alors que les démarches d’engagement se sont généralisées dans bon
nombre d’organisations, peu de connaissances existent sur leur mise en oeuvre dans différents
contextes cliniques et organisationnels. La littérature sur l’engagement des patients identifie
principalement les facteurs facilitants et entravants, sans comprendre les rôles et pratiques clés
des gestionnaires à différents niveaux des organisations de santé.
Objectif : l’objectif de la thèse est d’analyser les rôles et les pratiques des gestionnaires, à
différents niveaux des organisations de santé, dans la mise en oeuvre de l’engagement des
patients.
Méthodologie : la thèse repose sur la réalisation d’études de cas multiples (articles 1 et 3) et
d’une étude transversale (article 2), mobilisant des données qualitatives et quantitatives, qui ont
donné lieu à trois articles. Dans les deux premières études, des données qualitatives (entrevues,
groupes de discussion et documents) ont été utilisées afin d’explorer les rôles et les pratiques
des gestionnaires pour favoriser l’engagement des patients dans les démarches d’amélioration
de la qualité. La dernière recherche repose sur l’utilisation de méthodes mixtes (entrevues,
groupes de discussions, documents et questionnaires) en vue d’explorer les pratiques de gestion
visant à renforcer l’engagement des patients dans leurs soins. Au total, 74 entrevues ont été
réalisées auprès de gestionnaires à différents niveaux de gestion (stratégique n=26, tactique
n=28 et opérationnel n=20) et 11 groupes de discussion ont été effectués auprès de
professionnels de la santé (n=7) et de patients en oncologie et en santé mentale (n=4). De plus,
des questionnaires ont été administrés auprès de patients en santé mentale.
Résultats : la thèse met en évidence six résultats principaux. 1-Les pratiques de gestion sont un
levier important d’intégration de la perspective des patients dans les soins et les efforts
d’amélioration de la qualité. 2-L’intégration de l’engagement des patients implique une
coopération renforcée entre les gestionnaires à différents niveaux de gestion. 3-Le leadership
des gestionnaires se situe à différents niveaux de gestion en fonction du niveau d’intégration des
patients (organisationnel ou clinique). 4-Les pratiques des gestionnaires sont soutenues par un
ensemble de facteurs contextuels propices à l’intégration de l’engagement des patients. 5-
L’intégration de la participation des patients favorise l’émergence de nouvelles pratiques de
gestion au sein des organisations de santé. Enfin, 6-La mise en oeuvre de l’engagement des
patients crée des défis et des paradoxes auxquels les gestionnaires doivent répondre.
Contribution scientifique : les résultats de la thèse contribuent au développement des
connaissances dans le domaine de l’engagement des patients et ouvre la voie à un nouveau
champ de recherche sur la gestion de l’engagement des patients. / Background: In OECD countries, most health organizations have implemented approaches to increase patient engagement in direct care and quality improvement. In Canada, the province of Quebec stands out by an innovative context in terms of patient engagement in healthcare organizations. While patient engagement approaches are becoming widespread in many organizations, little is known about their implementation in different clinical and organizational contexts. The patient engagement literature primarily identifies facilitating and impeding factors, without understanding the key roles and practices of managers at different levels of healthcare organizations.
Objective: This thesis aims at analyzing the roles and practices of managers, at different levels of health care organizations, in integrating patient engagement in care and quality improvement.
Methods: The thesis is based on multiple case studies (articles 1 and 3) and one cross-sectional study (article 2) using both qualitative and quantitative data and methods. In the two first studies, qualitative data have been used to explore managerial roles and practices that aims at enhancing patient engagement in quality improvement. In the last study, a mixed-methods approach has been used to understand managers’ practices that contribute to improve patient engagement in their care. In total, 74 interviews were conducted with managers at different levels of management (top-level n=26, mid-level n=28 and front-line level n=20) and 11 focus groups have been realized with health care professionals (n=7) and patients in oncology and mental health (n=4). In addition, surveys have been administered to patients in mental health.
Findings: This thesis highlights six main results. 1-Management practices are an important lever for integrating the patient perspective into care and quality improvement efforts. 2-The implementation of patient engagement approaches requires enhanced cooperation between managers at different levels of management. 3-Managers’ leadership is situated at different levels of management, depending on the level of patients’ integration (organizational or clinical). 4-Managers’ roles and practices are supported by a set of contextual factors which foster patient engagement. 5-The integration of patient participation creates innovative management practices within healthcare organizations. Finally, 6-The implementation of patient engagement generates challenges and paradoxes that managers have to face.
Scientific contribution: Our findings contribute to the development of knowledge in the field of patient engagement and can pave the way for a new research area on the management of patient engagement.

An investigation into the organisational leadership brand concept for public listed South African organisationsEichstadt, Carl 12 1900 (has links)
Global and South African business challenges necessitate an increased focus on the need for effective leadership. The leaders of South African public listed organisations need to investigate new business solutions to enhance and sustain organisational effectiveness. Public listed South African organisations on the Johannesburg Stock Exchange (JSE) were selected as the organisation type for this study.
This study was motivated by the need for public listed South African organisations to explore organisational leadership as a means to assist in differentiating their organisations from competitors, thereby enhancing organisational competitiveness. The primary research objective of this study was to investigate and establish an organisational leadership brand concept model for public listed South African organisations.
The discussion of the literature covered the global and South African business context, the concepts of the nature of organisational leadership, brand and organisational leadership brand, and emminated in an exploratory conceptualisation of organisational leadership brand for public listed South African organisations.
The pragmatic paradigm was used as the foundation of this study. The study adopted an exploratory, sequential mixed methods research approach, combining a qualitative emphasis and supportive quantitative research approach to conduct the exploratory research. The qualitative findings proposed the concepts: the nature of organisational leadership and organisational leadership brand, including stakeholders and these concepts served as the basis for designing the quantitative survey questionnaire. The quantitative results indicated reliable questionnaire items, and based on the exploratory statistical analysis of the multivariate linear regression equation, described the organisational leadership brand (OLB) concept exploratory model with the best fit.
An integration of the qualitative findings and quantitative results provided the empirical support to achieve the primary research objective. The OLB concept model integrates the concepts of organisational leadership and organisational leadership brand.
The study contributed across the methodological, theoretical and practical domains as follows: the nature of organisational leadership for South African public listed organisations was conceptualised; the elements comprising the concept of OLB for public listed South African organisations was described; the OLB concept model for public listed South African organisations describes the development of organisational leadership brand equity through four levels of organisational leadership brand equity development; and the OLB concept
model for public listed South African organisations may assist by providing guidance for the senior leadership of organisations in establishing organisational leadership brand equity. Furthermore, the study’s research approach provides support for the use of a mixed methods research approach in the study of organisational leadership within the pragmatic context of business organisations / Industrial and Organisational Psychology / D. Abstracts in English, Zulu and Afrikaans / The stakeholder instrument (SI) is a conceptual framework developed to complement integrated reports for value creation, transparency and accountability. It is a tool developed specifically for stakeholders to have an understanding of the integrated reports and assist them in making informed decisions. Currently, integrated reports fail to provide meaningful insights into organisations’ performance and its strategy focus, thus making it difficult for stakeholders to understand the contents of the integrated reports. The research illuminated pertinent variables synonymous with value creation.
The study involved analysis of data from 42 companies trading on the Johannesburg Stock Exchange and administration of 80 questionnaires on randomly selected respondents. Significant and positive correlations between value creation and the attributes namely integrated reports; corporate governance and financial measures were established.
Contributions: The results of the empirical study provide significant perceptions into the process of stakeholder value creation. The study established the significance of complementing the integrated reports in creating stakeholder value. The study, further, authenticated the stakeholder instrument as a distinct antecedent of value creation. Operation and regulation of copyright collective administration in Nigeria : important lessons for AfricaOla, Olukunle Rotimi 13 November 2012 (has links)
The introduction of a regulatory framework in the area of collective management of rights in Nigeria must have been intended to strengthen the creative industry. Unfortunately, it has thrown this industry and in particular the music and film industries into a battle of a regulated against a non-regulated collective administration sector for upward of twenty (20) years.
My choice of research on this topic could be attributed to the interest I developed while administering the collective administration desk at the Nigerian Copyright Commission. Serving on that desk afforded the opportunity to see the frustration of right owners who were being deprived the fruit of their labor, as the societies meant to collect and distribute royalties on their behalf were enmeshed in litigations and in the process, rarely paid any royalties to authors.
Within this context, this research seeks to explore whether there is any merit in the continued existence of the current regulatory framework for collective management in Nigeria, and what the best operational framework for collective administration in Nigeria would be.
A methodological approach entailing literature review of books, articles, journals, legislation, cases, reports of committees and interviews with experts was adopted, with critical analysis carried out on particularly the Nigerian Copyright Act, the Nigerian Copyright (collective management organisation) regulation, the South African Copyright Act, the South African Performers’ Protection Act, the South African Collecting Societies Regulation, as well as judicial decisions challenging certain provisions in the Nigerian legislation.
It is hoped that this research will spur a desire for the need for supervisory and regulatory agencies of government to seek the national interest above all others in taking and making decisions that affect the collective administration of copyright and related rights. / Mercantile law / LL.M.
