[pt] O trabalho em questão visa analisar o papel dos advogados populares junto ao avanço dos movimentos sociais no Brasil. Estes profissionais ganharam relevo com as transformações da Carta Constitucional de 1988 e seus efeitos na emergência de novos sujeitos e novos direitos na seara política. Também, o fenômeno da judicialização da política, vem demarcando, a cada dia, o Direito como um acirrado campo de disputas e lutas simbólicas pelo monopólio de tradução e atuação das causas e repertórios (capital social), lutas que transbordam nos demais campos sociais (político, cultural, etc.), ressignificando o papel destes agentes e suas visões/ projetos de sociedade, e das bandeiras de luta dos movimentos sociais. Buscar-se-á entender quem são estes atores jurídicos, quais suas estratégias de atuação, como estabelecem o diálogo com os movimentos sociais e por fim, como constroem um perfil de militância profissional que tem como eixo o compromisso político e ético que norteia seu ativismo. Para tanto refletiremos a contribuição das dimensões da utopia e da tradição messiânica do romantismo revolucionário nas identidades do advogado popular como catalisador de uma ação política cercada de ideais de Justiça e projetos emancipatórios. / [en] The dissertation seeks to analyze the role of popular lawyers with the advancement of social movements in Brazil. These professionals attained relevance with the transformations of the Constitutional Charter of 1988 and its effects on the emergence of new subjects and new rights in political matters. Also, the phenomenon of judicialization of politics, has been pivotal in making the law as a fierce battleground and symbolic struggles for the monopoly of translations and actions in the causes and repertoires (social capital), such struggles, which overflow in other social fields (political, cultural, etc.), redefining the role of these agents and their society projects and views, and rallying points of social movements. This work shall seek to understand who are these legal actors, what are their strategies of action, how they establish dialogues with social movements and finally, how they build a professional profile of militancy that is centered on the political and ethical commitments that guides their activism. To do so, this essay shall think the contribution of the dimensions of both utopian and the messianic tradition at the romanticism in the popular lawyer identities as a catalyst for political action surrounded by ideals of justice and emancipatory projects.

[pt] Esta dissertação procura realizar uma investigação do fenômeno social de manifestações políticas individuais e coletivas exercidas de forma anônima sob a ótica do direito à privacidade, principalmente em razão da tendência proibitiva adotada pelos entes institucionais brasileiros nas oportunidades em que se manifestaram sobre o tema. Neste sentido, desenvolve-se uma pesquisa teórico-prescritiva, de método hipotético-dedutivo, cujo principal objetivo se refere à construção analítica de determinados conceitos relacionados à participação política democrática na atualidade, ao anonimato e à privacidade. Pretende-se, portanto, identificar e propor alguns princípios regulatórios do exercício da manifestação política anônima, de acordo com limites explorados no desenvolvimento da própria pesquisa. A construção destes princípios regulatórios, por sua vez, foi realizada a partir dois conjuntos conceituais principais. Primeiramente, foi utilizada a concepção de Michael Hardt e Antonio Negri a respeito de Multidão (2005), o sujeito político responsável por guiar as ações políticas atuais, bem como a descrição das manifestações em rede feita por Manuel Castells (2013). No que diz respeito aos contornos assumidos atualmente pelo direito à privacidade e sua relação com o anonimato das ações políticas, foi utilizada a noção de privacidade desenvolvida por Stefano Rodotà (2007, 2011). A partir destes dois eixos teóricos principais, identificamos que, nas diversas formas de atuação política contemporâneas, influenciadas, principalmente, pelo paradigma comunicacional das tecnologias digitais, o anonimato, além de característica essencial da comunicação e expressão em diversos casos, apresenta benefícios sociais que devem ser levados em consideração em qualquer proposta regulatória sobre o assunto. / [en] The present dissertation intends to realize an investigation about the social phenomenon of individual and collective political actions conducted anonymously from the perspective of the right to privacy, especially because of the prohibitive trend adopted by Brazilian s institutional agents, in the opportunities they have spoken on the subject. In this sense, we develop a theoretical and prescriptive research, using the hypothetical-deductive method. Our main objective is the analytic construction of certain concepts related to democratic political participation today, to the anonymity and to privacy. It is intended, therefore, to identify and propose some regulatory principles of the exercise of anonymous political action, according to limits exploited in the development of the research. The construction of these regulatory principles, in turn, was made from two major conceptual perspectives. First, we used the concept of Michael Hardt and Antonio Negri about Multitude (2005) , the political entity responsible for guiding the current political actions, as well the description of events in network made by Manuel Castells (2013) . With regard to the contours currently assumed by the right to privacy and its relation to the anonymity of political actions, we used the privacy notion developed by Stefano Rodotà (2007, 2011). From these two main theoretical axes, we found that, in the various forms of contemporary political activity, mainly influenced by the communication paradigm of digital technologies, anonymity, as an essential feature of communication and expression in several cases, has already social benefits that should be considered in any regulatory proposal on the subject.

[pt] Essa tese é resultado da observação crítica sobre as mudanças de experiências e reflexões teóricas, que o próprio autor realizou, durante o período de sua formação acadêmica. Explorou-se também o vínculo entre as experiências de produção e recepção de diversos bens culturais, testemunhadas em várias circunstâncias sociais. Desta maneira, diferentes paradigmas teóricos foram analisados na tentativa de compreender como a recepção e produção de bens culturais podem provocar contatos culturais entre contextos diversos, na complexidade do mundo contemporâneo. Devido ao caráter teórico e autobiográfico do trabalho, esta tese fundou-se no diálogo entre as referidas perspectivas teórico-metodológicas: o conceito de rizoma é deslocado de seu contexto, no pensamento de Gilles Deleuze e Félix Guattari, para confrontar-se com as visões pós-estruturalista, construtivista e sistêmica de Niklas Luhmann e Siegfried Schmidt, com o objetivo de dar conta da dimensão política das ações de sujeitos envolvidos em práticas culturais e no trânsito entre vários sistemas sociais. / [en] This dissertation is the consequence of a critical observation of the changes of direction in the author`s theoretical reflections, in the course of his academic life. In it, he explored the link between the experiences of production and reception observed in social situations according to different theoretical paradigms, in an attempt to understand how the reception and production of cultural products can create cultural contacts between many contexts in the complexity of the contemporary world. For reason of character, theoretical and autobiographical, this work bases itself on the dialogue between the following theoretical and methodological perspectives: the concept of rhizome as the dislocation of one`s context in Gilles Deuleze and Félix Guatarri`s thought, and also in light of the post-modern, constructivist and systemic view of Niklas Lhumann and Siegfried Schmidt. The objective is to understand the social dimension of actions by subjects that are involved in cultural practices and in the crossing to of many social systems

Analisa-se as condições humanas do trabalho, obra e ação, buscando, assim, compreender o papel da liberdade política na contemporaneidade diante da emancipação do trabalho e da vitória do animal laborans. / [en] The present work aims to analyze freedom and political action at the thought of Hannah Arendt, mainly by adopting The human condition as central reference. We analyze the humans conditions of labor, work and action, seeking thereby to understand the sense of political freedom in the contemporary face of emancipation of labor and the hegemony of animal laborans.

[pt] O presente trabalho discute a polêmica visão de Hannah Arendt relativa ao papel ocupado pela dimensão social no processo político contemporâneo. Arendt insurge-se contra a corrente articulação entre o social e o político, que instrumentaliza a prática política reduzindo-a a uma atividade secundária e, consequentemente, alienante. Essa visão de Arendt encontra fortes contrapontos em diversos pensadores da filosofia política que serão aqui tratados, com destaque para Jürgen Habermas e Seyla Benhabib. Para uma adequada compreensão da polêmica, três pontos são de fundamental importância: o conceito de distinção no pensamento de Arendt; sua teoria de ação política (oriunda da práxis aristotélica); e, finalmente, sua concepção de modernidade. / [en] The present dissertation discusses the Hannah Arendt s polemic vision of the role of social dimension in the current political process. Arendt claims that the ongoing way to articulate these two dimensions, leads to an instrumentalization of the political sphere which reduces it to a secondary role and therefore increases the process of alienation. This vision meets strong reactions by several scholars, who will be discussed herein, highlighting Jurgen Habermas and Seyla Benhabib. For a proper understanding of the subject, three issues are of paramount importance: the concept of distinction in Arendt s thinking; Arendt s theory of political action (from Aristotelian praxis); and the Arendt s idea of modernity.

[pt] Essa dissertação busca analisar o papel da ação política centrada em uma identidade - aqui, o conceito mulher - para o acesso à esfera pública hegemônica e para utilizar o direito como ferramenta de paridade participatória e empoderamento. Tomando por base esses três conceitos-chave (identidade, ação política e direito) e suas interações, buscar-se-á explorar possibilidades e limites da ação política centrada em um conceito fechado de agente para garantir direitos ao grupo que se pretende representar. A partir da apresentação de importantes exclusões dadas dentro dos movimentos feministas, utiliza-se um recorte da obra da filósofa feminista Judith Butler para construir a lente teórica que guiará a análise. O processo de formulação e promulgação da lei Maria da Penha de 2006, que lida com a violência doméstica e familiar contra mulheres, assim como as exclusões que se pode enxergar no texto dessa lei, formam o contexto escolhido para ilustrar a análise, por fornecer tanto exemplos das possibilidades e dos limites tratados em teoria, como também para que se pudesse obter um recorte adequado do tema. / [en] This dissertation aims at analyzing the role of political action based on identity - here, the concept of women - to gain the hegemonic public sphere and use law as a tool for participation parity and empowerment. Using these three key concepts (identity, political action and law) and their interactions, this work hopes to show some possibilities and limits of a political action based on a closed concept of agent. Departing from the presentation of important exclusions occurred within feminist movements, a part of feminist philosopher Judith Butler is used to form a lens that will guide further analysis. The formulation and enactment process of the Maria da Penha statute, concerning domestic and familiar violence against women, alongside the exclusions one may notice in this statute, form the chosen context of analysis, for it provides examples of both possibilities and limits presented in theory. It also allowed for adequate framing of such a complex theme.
