Řízení rizik ve stavebních zakázkách železniční infrastruktury / Risk Management in the Railway Construction Contracts

The purpose of this master´s thesis is to perform a risk analysis of a specific rail infrastructure building project. In the first part I described the goal of the thesis and the methods used. In the second part I focused on determining notions related to the rail infrastructure - its historical development until the present. I then described specifics of nowadays railway and the standards it makes use of in today´s construction projects. Next I took a closer look at risk management, defined risks, described today´s guidelines and classified the risks based on standards commonly used at present. In the third and final section of the thesis I applied the risk management process to a selected rail infrastructure project.

The thesis is focused on Vilem Hromadko, an engineer who had a signifiant influence on industrial production in former Czechoslovakia, but also in Poland and USSR. During his life, Vilem Hromadko met J. V. Stalin in person, he was imprisoned several times and joined the antifascist resistence. The main focus of the thesis is on his activities associated with an improvement of arms production in USSR between 1937 and 1941. Hromadko`s business co- operation with USSR and general contribution to the global industry were analyzed based on archive information and historical documents. Activities of Vilem Hromadko are proven by photographic attachments enclosed to the thesis. This thesis deals with the topic of liability for damage caused by a defect in a product, i.e. liability of a producer (but also of another entity, such as the supplier or importer) for damage caused by the defective product to the health or property of the user (consumer) or other third persons. The primary area of this issue that the thesis has examined is the legal regulation in the UK (liability for damage caused by a defect in a product is in the UK usually expressed as "Product liability"). The main reason why I have chosen to describe the British legal regulation is my study experience in the UK at Northumbria University, where I studied within the program Erasmus+. In the UK, I had the opportunity to find all the resources, experience and incentives necessary in order to analyze the topic of Product liability and therefore, to write this thesis. The aim of this thesis is not only the description of the British Product liability, but also its comparison with the Czech regulation. This thesis then draws a clear conclusion that Product liability in the UK is as compared to the Czech Republic an institute much more frequently used and British regulation is compared to the Czech one more sophisticated and detailed. English abstract The subject of my thesis is liability for loss caused to the environment. This is a fairly complex issue in the environmental law, which has developed significantly in recent years and decades, coming under the spotlight of the national, international, and European legislation. The principal aim of this thesis is to present and describe various legal instruments in the field of environmental law, particularly the legal regime of liability for loss caused to the environment in international, European, and national law. This thesis consists of nine chapters in which I analyze various modes of legal liability as a means of protecting the environment. The opening chapter of my work defines the term of legal liability in the field of environmental protection. Then I deal with tort liability in the environmental law, both criminal responsibility and liability for administrative misconducts. Next chapter of my work is devoted to liability for damage to the environment in international law. I focus primarily on the Lugano Convention on Civil Liability for damage resulting from activities dangerous to the environment, which has become an important source of inspiration for further development of a common regime of liability for damage to the environment in European countries. The mode and of harm and non-proprietary damages relating to health care The subject of this thesis is the issue of compensation of proprietary and non- proprietary damage suffered by patients during the provision of health care. Particularly, it is a damage resulting from bodily and deadly injury, which is most commonly caused by malpractice of doctors and other medical workers. Legal institute of damage compensation is of cardinal and irreplaceable importance in the area of Civil law. The thesis examines this institute from its material aspect, namely in terms of the mode and amount of compensation. First part of the work deals with the introduction of the major changes brought by the new regulation of Czech Civil law into the area of damage compensation and their potential impacts on this sphere. Subsequently, there are further definitions of compensation's content, mode and amount, their mutual relations and historical development. This thesis is concerned with an evaluation of a role of financial and managerial accounting in the management of financial performance. From the range of criterions, that indicate the development of performance, the profit was chosen. The basic approach of the thesis is the concept of financial performance in the U.S. Generally Accepted Accounting Principles (U.S. GAAP). The diction of U.S. GAAP is compared with the text of International Accounting Standards / International Financial Reporting Standards (IAS / IFRS) and the Czech accounting legislation. In addition, the thesis deals with the concept of financial performance and its role in the performance management system. In conclusion, the theoretical background is confronted with its practical application.
