Previous issue date: 2014 / Resumo: A proposta deste estudo cujo foco é a obra Arcos sonoros da catedral Anton Bruckner ¿ meditação sinfônica (1996) do compositor Almeida Prado é apresentar uma reflexão norteada por três tipos de análises: a estrutural, onde materiais e técnicas composicionais são investigados; a semiótica, que trata da compreensão e interpretação de significados expressivos presentes no texto musical e a comparativa, com a função de identificar semelhanças e aproximações entre esta obra de Almeida Prado e as sinfonias de Bruckner. Após breves exposições sobre Almeida Prado e sobre a obra sinfônica de Bruckner, bem como a apresentação da fundamentação teórica, o estudo se centraliza nos gestos empregados por Almeida Prado ao longo da peça. Na medida em que as análises vão sendo efetuadas, a integração das três vertentes analíticas é constantemente buscada, na intenção de que os resultados alcançados possam proporcionar uma visão o mais integral possível de cada gesto presente. A edição digitalizada da obra, baseada no manuscrito de Almeida Prado e a composição de uma obra com base neste estudo fazem parte do trabalho / Abstract: The purpose of this research on Arcos Sonoros da Catedral Anton Bruckner - meditação sinfônica (1996) by the composer Almeida Prado is to present a reflection that is guided by three types of analysis: ¿ Structural: investigating materials and compositional techniques. ¿ Semiotic: understanding and interpreting expressive meanings present in the musical text. ¿ Comparative analysis: identifying similarities and approaches between this work of Almeida Prado and Bruckner symphonies. After a brief presentation about Almeida Prado and Bruckner¿s symphonies, as well as a review of the related literature, the research focuses on the gestures used by Almeida Prado throughout the work. The integration of the three analytical lines is constantly done so that the achieved results may provide wide view of each gesture present in the piece. Attached to this research are the digitalized edition of Almeida Prado¿s Arcos Sonoros, based on his manuscript and the composition of a work based on this study / Mestrado / Processos Criativos / Mestre em Música

Para tanto, tomamos as correspondências trocadas entre os naturalistas integrantes da Comissão como nossa principal fonte de análise, e não apenas como um material complementar a outras fontes. This dissertation politically analyses the principles of literary evaluation (here called "axiology") argued and applied by the English critics Christopher Caudwell, Raymond Williams, and Terry Eagleton. The paradoxical fact that all three claim to be working within a Marxist framework while producing mutually divergent rationales for literary evaluation prompts a detailed examination of Marx and Engels. Moreover, since Caudwell and Eagleton acknowledge Leninism to be Marxism, and, further, since Eagleton and I both in our own ways argue that Trotskyism--as opposed to Stalinism--is the continuator of Leninism, the evaluative methods of Lenin and Trotsky also become relevant.
Examined in light of that revolutionary tradition, however, and in view of the (English) critics' high political self-consciousness, the latter's principles of "literary" evaluation reveal definitive political differences between each other and with Marxism itself, centrally over the question of organised action. Thus, each of the chapters on the English critics begins with an examination of the chosen critic's purely political profile and its relationship to his general theory of literature. Next, I show how the contradictions of his "axiology" express those of his politics. Finally, with Hardy as a focus, I show the influence of each critic's political logic on his particular "literary" assessment of individual authors and texts.
The heterogeneity of these critics' evaluations of Hardy, the close correspondence of each critic's general evaluative principles to his political beliefs, and the non-Marxist nature of those beliefs themselves all concretely suggest that none of the three English critics is strictly a Marxist. I do not know whether a genuinely Marxist axiology is inevitable; however, I do admit such a phenomenon as a logical possibility. In any case, I argue, this possibility will never be realised unless aspiring Marxist axiologists seek to match their usually extensive knowledge of literature with an active interest in making international proletarian revolution happen. And, since it can only happen if it is organised, the "Marxist" axiologist without such an orientation will be merely an axiologist without Marxism. / Arts, Faculty of / English, Department of / Graduate

Unlike other Confederate armies at the conclusion of the Civil War, General Edmund Kirby Smith's Trans-Mississippi Army disbanded, often without orders, rather than surrender formally. Despite entreaties from military and civilian leaders to fight on, for Confederate soldiers west of the Mississippi River, the surrender of armies led by Generals Robert E. Lee and Joseph E. Johnston ended the war. After a significant decline in morale and discipline throughout the spring of 1865, soldiers of the Confederate Trans-Mississippi Department chose to break-up and return home. As compensation for months of unpaid service, soldiers seized both public and private property. Civilians joined the soldiers to create disorder that swept many Texas communities until the arrival of Federal troops in late June.

The decade of the 1850s saw the Texas press separate into two opposing groups on the issue of filibustering. The basis for this division was the personal beliefs of the editors regarding the role filibustering should have in society. Although a lust for wealth drove most filibusters, the press justified territorial expansion along altruistic lines. By 1858, however, a few newspapers discarded this argument and condemned filibusters as lawless bands of ruffians plundering peaceful neighbors. Throughout the decade, the papers gradually drifted from a consensus in 1850 to discord by the date of William Walker's third attempt on Nicaragua in 1858.

A Constituição Federal de 1988 inovou ao trazer um artigo (4o) especificamente dedicado a estabelecer os princípios das relações internacionais do Brasil. Esta tese situa essa inovação no contexto da evolução constitucional brasileira, examina se os atos praticados pelo Poder Executivo no exercício da competência para conduzir as relações internacionais podem ser submetidos ao controle jurisdicional e, finalmente, avalia como um dos princípios do art. 4o o da prevalência dos direitos humanos poderia ser utilizado como parâmetro para aferição de constitucionalidade, buscando identificar que exigências ele impõe ao Estado brasileiro em sua atuação externa. Com base na investigação da jurisprudência local e estrangeira, demonstra-se que a judicialização de questões internacionais é um processo já em curso, mas que, na ausência de uma definição mais clara do papel que cabe ao Judiciário no campo das relações internacionais, esse Poder tem reagido de forma incerta e pouco consistente às demandas que lhe são apresentadas. Nesse contexto, são identificados os principais obstáculos jurídicos geralmente oferecidos ao controle jurisdicional dos atos de relações internacionais no Brasil para, em seguida, expor suas fragilidades, sustentando-se a possibilidade desse tipo de controle. Em situações em que o princípio da prevalência dos direitos humanos seja relevante, trata-se de verificar se o Executivo agiu internacionalmente com observância dos direitos humanos de quaisquer indivíduos que possam ser afetados pelo ato em questão, sejam ou não brasileiros, estejam ou não em território nacional. Condutas (ações ou omissões) eventualmente restritivas dos direitos humanos, desacompanhadas de fundamentação constitucional, podem corresponder a uma violação do princípio e ser, portanto, objeto da censura judicial. A tese se encerra com um estudo de casos, onde essas ideias são aplicadas a duas situações concretas. / The 1988 Federal Constitution broke new ground by establishing in a specific provision (Article 4) the directive principles for Brazils international relations. The present thesis firts considers this provision in light of the Brazilian constitutional history, it further questions whether acts from the Executive branch in exercise of its constitutional mandate to conduct foreign policy are subject to judicial review and, finally, it discusses how a specific principle established by Article 4 the one determining primacy of human rights in international relations operates as a constitutional standard, seeking to clarify what are the obligations that this provision imposes on the Brazilian State while conducting its foreign policy. Based on an analysis of case law from Brazil and other jurisdictions, this thesis argues that the judicialization of international relations is already underway, although the Judiciary has not been able to develop assertive and consistent judicial standards to resolve cases dealing with issues of foreign policy, considering the lack of a clear definition of the role to be played by the Judiciary in this realm. In this sense, the thesis takes into account the main legal barriers generally faced in cases of judicial review of foreign policy issues in Brazil, revealing some of its shortcomings, and argues in favor of such judicial scrutiny. In cases where the principle of primacy of human rights applies, the act of the Executive branch should protect the human rights of all individuals involved by this act, regardless their nationality (Brazilian or not) or location (national territory or abroad). Restrictive measures (actions or omissions) that limit human rights, without a constitutional basis, can amount to a violation of the abovementioned principle, and, therefore, might be struck down by the Judiciary. This thesis concludes with a case study, where those ideas are applied to two particular situations.
