Theoretical bases for the limitation 
 of fundamental rights and freedoms in the Czech Republic 
 In the Czech Republic, the conception of fundamental rights and the conditions for their limitations are the result of a specific interpretation of the Charter of Fundamental Rights and Freedoms by the Constitutional Court, which in turn reflects its own views on constitutional theory. Despite being presented almost dogmatically, the confrontation with foreign literature suggests that the so-called external theory of the Constitutional Court finds strong opponent in the so-called internal theory. Internal theory sheds doubts on such hallmarks of the Court's doctrine like the wide conception of fundamental rights, the principle of proportionality or the very existence of conflicts of constitutional values. In this thesis, it is argued that although the internal theory cannot substitute for the external theory at the moment, it represents an opportunity for the Constitutional Court to reassess its current position in order for it to better depict the aims of the constitution-maker, to respect the policies of the legislator and - above all - to take fundamental rights seriously. Strategies Hospital Administrators Utilize to Optimize Patient Services

Hospital administrators face challenges that arise from environmental factors or psychosocial factors, and lack resources to deliver valuable medical services to stakeholders, including patients and employees. A multicase study served to explore experiences and gain a broader perspective of hospital administrators' use of strategies to optimize patient services. Ten hospital administrators from acute care hospitals in Nevada and California were purposefully selected from the population of hospital managers with a minimum of 2 years of documented experience in successfully implementing management strategies to improve patient services. The conceptual framework was Drucker's management theory. Data were collected from semistructured interviews with 10 administrators, from the participants' archival documents, and from hospital archives. Interview transcripts and data from multiple hospital locations were coded and analyzed using methodological triangulation. Five themes identified from data analysis were triple-aim strategy, evidence-based practice, lean methodology, public health strategy, and innovation strategy. Implementing the appropriate strategy in each hospital setting might facilitate identification of elements that are lacking, mitigating, or slowing down the hospital improvement process. The findings of this study might contribute to positive social change by creating platforms for sharing information among patients and providers, payors, pharmacies, and policymakers.

To be successful in fulfilling one's potential, the learner needs the accompaniment of an adult, as no person can reach selfactualisation without this accompaniment. If the parent commits an educational error by not putting the educational essences into practice, it can lead to intrinsic barriers to learning, which manifests as learning problems, or specific educational needs, in a learner. Research was conducted to determine the accompaniment role of parents with children who experience barriers to learning, in Grade 4 - 7, in the Vanderbijlpark district. The aim was to determine the extent to which parents apply the educational essences to their children (learners) who experience barriers to learning. The main conclusion from the research is that the majority of parents do apply some of the educational essences. It is clear however that some parents omit I neglect to put the educational essences into practice, or make errors in educating their children. Summaries in Afrikaans and English / Text in Afrikaans / In the recent decision in Kellerman v South African Transport Services 1993 4 SA 872 (C) a claim for the loss of the use of a thing not utilised in the production of income was apparently allowed for the first time in South African law. A number of strict requirements were however set for such a claim. For a considerable time a claim has been recognised in English and German law even where a substitute was not hired and where the article was used for pleasure purposes. It is submitted that this should also be the position in South African law because the loss of the use of a thing per se has an independent value. It is further submitted that the interest on capital value method (as per English law) can be used as starting-point in the determination of quantum. A degree of flexibility is necessary to ensure fairness and equity. / In die onlangse beslissing in Kellerman v South African Transport Services 1993 4 SA 872 (K) is daar klaarblyklik die eerste maal in die Suid-Afrikaanse reg 'n eis om skadevergoeding weens gebruiksverlies van 'n saak wat nie in die produksie van inkomste gebruik is nie erken. Die hof stel egter 'n aantal streng vereistes vir so 'n eis. 'n Eis word al 'n geruime tyd in die Engelse en Duitse reg erken selfs waar 'n substituut nie gehuur is nie en waar sake bloot vir plesierdoeleindes gebruik is. Daar word submitteer dat dit ook die posisie in die Suid-Afrikaanse reg behoort te wees aangesien gebruiksverlies opsigself 'n selfstandige waarde het. Madame Bovary et Rides sur les eaux dormantes : deux destins de femmes : étude interculturelle / No title

Aussitôt après que les œuvres de Gustave Flaubert ont été traduites en chinois, elles ont tout de suite suscité une grande attention de la part des lecteurs chinois. Ses pensées philosophiques, son objectivité et son exactitude dans l’écriture ont provoqué une résonance dans les milieux lettrés chinois d’alors et ont influencé profondément leurs écrits. Le traducteur-romancier chinois, Li Jieren, qui fut le premier traducteur du roman Madame Bovary, avoue qu’il s’est beaucoup inspiré du style de Flaubert présent dans ce roman. En 1935, dix ans après sa première traduction de Madame Bovary, il a commencé la rédaction de son chef-d’œuvre Rides sur les eaux dormantes, qui est depuis considéré par les milieux critiques chinois comme Madame Bovary en Chine. Nous pouvons constater une similarité surprenante entre les deux héroïnes selon différents aspects. Mais on ne peut tout de même pas apparenter le roman de Li Jieren à une réécriture du roman français, car hormis certains points communs, on observe aussi de nombreuses divergences sur la conception des deux femmes, et en particulier dans leurs destinées. La présente thèse est consacrée à l’étude des raisons expliquant les dissemblances de dénouement, dans l’histoire de chacune des héroïnes. Premièrement au niveau du contenu du roman, les raisons se basant sur les éléments de différenciation des deux femmes et sur leur condition sociale ; puis, sur le plan de l’auteur, les raisons sont abordées sous l’angle interculturel, telles que les objectifs d’écriture, les choix littéraires ainsi que la conception de vie de Gustave Flaubert et de Li Jieren. / As soon as the works of Gustave Flaubert were translated into Chinese, Chinese readers immediately paid great attention to them. His philosophical thoughts, objectivity and accuracy in writing caused a resonance in Chinese literary circles of the time and profoundly influenced their writings. Chinese translator and novelist, Li Jieren, who was the first translator of Madame Bovary, admitted he was much inspired by the style of Flaubert in this novel. In 1935, ten years after the first translation of Madame Bovary, he began writing his masterpiece Ripples across stagnant water which has been considered by Chinese critics as the Chinese Madame Bovary. Astonishing similarities can be noticed between the two main characters from various aspects. Despite these similarities, Li Jieren’s novel is not just a simple rewriting of the French novel, for there are also many differences in the perspectives of the two women and especially in their fate. This thesis is focusing on the reasons that can explain the major differences in the outcome of each heroine’s story. First within the content of both novels, reasons based on elements differentiating the two women and on their social class. Then, studying at the author’s level, we will look at reasons from a cross-cultural perspective, such as the writing objectives, literary choices and living concepts of Gustave Flaubert and Li Jieren.

Applying the RE-AIM Model to Asset-Based Community Health Interventions: A Multiple Case Study in Tower Hamlets, London, UK

Public health policy and practice principally acknowledge a needs-based approach when developing, implementing, and evaluating community health programs. This needs-based perspective receives criticism because it focuses too heavily on what is missing or wrong with communities as opposed to building on their strengths. As a result, community members are perceived as passive recipients, which is disempowering, and ultimately risks creating unsustainable and ineffective programs. In recent years, there has been a growing interest in achieving a balance between the needs-based approach and the asset-based approach, which accentuates positive capabilities. While the amount of literature discussing the benefits of this latter perspective has grown substantially, accompanying evaluation required to sustain continued investment has been limited. Compared to needs-based research, there is less literature on asset-based evaluation. Emphasis on such research could contribute to the progression of evaluation methodologies and theories, ultimately encouraging their use. The purpose of this study is to apply an existing public health evaluation framework – the RE-AIM model (Glasgow, Vogt, and Boles, 1999) – to asset-based community health interventions and to examine the utility of such an evaluation structure across a variety of asset-based health projects. A multiple case study design facilitated comparison of the applicability of the RE-AIM model dimensions – Reach, Effectiveness, Adoption, Implementation, and Maintenance across three cases in the East London borough of Tower Hamlets, United Kingdom. These included the Local Links Asset-mapping project, the Healthy Early Years Project, and the Good Moves project. The RE-AIM framework is additionally guided by principles of the Realist Evaluation approach (Pawson and Tilley, 1997). This research study contributes to asset-based research by providing a guideline and conceptual framework to support asset-based intervention evaluation theory and practice.

Strategie implementace inteligentních systémů měření do české elektroenergetiky / The strategy of AMM system implementation within the Czech distribution system

This thesis deals with issues around the implementation of an AMM (Automated Meter Management) system within the Czech electricity distribution system. The theoretical section of the thesis provides a historical context and looks at the development of the electricity sector. The thesis then goes on to discuss issues regarding the competitiveness of distribution companies in terms of IT/ICT use. This section defines the elements of the Smart Grid concept, in particular the AMM system. The chapters dealing with the conditions for implementing the system in the Czech Republic and pilot projects abroad make up the major sources for the practical section. The goal of the practical section is to come up with a project aim for the AMM system implementation trial project in Prague. The proposed project aim is divided into a number of separate tasks whose results are obtained using a detailed analysis of available sources and the conclusions of the theoretical part of the thesis. The thesis's main benefit is in forming a basis for the AMM implementation trial project in PREdistribuce, Inc. distribution networks and providing a comprehensive overview of the development and current state of the electricity sector.
