Em países de constituição rígida como o Brasil, os juízes, ao contrário dos parlamentares, não são eleitos diretamente pelo povo e têm a prerrogativa de anular as leis feitas pelos representantes eleitos. Em se constatando, a partir daí, que há um déficit democrático nessa atividade da jurisdição constitucional, a pesquisa analisa alguns modelos de sistema político que tentam compatibilizar de forma mais equânime os princípios constitucional e democrático além das teorias que criticam ou tentam legitimar a atividade da jurisdição constitucional sobre bases democráticas. Em seguida, é analisado o papel do instituto do amicus curiae em tal contexto, enfatizando-o como mecanismo de legitimação democrática do controle de constitucionalidade das leis. Nessa trilha, é estudado o papel do amicus curiae na Suprema Corte Americana, bem como o modelo previsto no Brasil. Language Overlap Between Solicitor General Amicus Curiae and Supreme Court Majority Opinions: An Analysis

The specialized role of the solicitor general has been a topic of much discussion and research within the past, but the task of the solicitor as amicus curiae has been overlooked. A content analysis of Court majority opinions and their corresponding solicitor general amicus briefs for the terms of 1987, 1995, and 2003, allows us to examine the flow of language from brief to opinion, as well at its possible incorporation into legal doctrine and the creation of law. Through implementing Crawdad Text Analysis System© software, the percentage of identical language contained in each corresponding set of documents is reported in the form of a resonance score. Invitation amicus briefs, which are extremely rare and have not been present much within past literature, were also examined in the same manner. Findings show small to medium resonance scores between amicus and Court opinions, with averages between 26 to 33 percent. Invitation amicus have a higher percent of language overlap with averages from 31 to 43 percent. The way the Court implements language contained in amicus briefs shows that the Court might not be as independent as scholars such as Dahl had previously thought.

States on the Federal Stage: The Amicus Curiae Role of State Attorneys General

The past several decades have witnessed a remarkable increase in the number of amicus curiae briefs filed at the U.S. Supreme Court. While scholars debate the effectiveness of amicus curiae briefs, they generally agree on the effectiveness of briefs filed by executive attorneys. A plethora of studies address the amicus curiae brief activity of the solicitor general, but relatively few examine state attorneys general. State attorneys general are the legal representatives of the states and have become increasingly successful as amici since the early 1980s. I explore state attorney general amicus curiae brief activity and argue that existing theories of amicus curiae participation by the solicitor general and interest groups, are inadequate for state attorneys general because of the unique institutional context in which state attorneys general operate. State attorneys general, I argue, must balance political, legal, and administrative factors when filing amicus curiae briefs. I also recognizes that amicus curiae briefs are not a singular event and are instead a process in which actors make several decisions across a variety of contexts. Within each context each factor takes on a different weight. I conclude state attorneys general are strategic political actors who consider political, legal, and administrative factors in their amicus curiae briefs.

Para tanto, o direito e, com especial destaque, os direitos fundamentais de natureza constitucional, necessitam estar em permanente estado de abertura à comunidade de intérpretes que os cria, os atualiza, os nega ou os confirma. Transita-se, portanto, de paradigmas de caráter substancialista, em que o conteúdo do direito era arbitrado, para um paradigma procedimentalista, no qual a validade do direito pressupõe a possibilidade de que todos os grupos sociais, inclusive aqueles que foram excluídos ou que se encontram na periferia do sistema sociopolítico, possam participar da construção do sentido e da definição do alcance das normas jurídicas. Contudo, para que essa fundamentação democrática do discurso jurídico se manifeste, são necessários institutos que aproximem as esferas públicas de debate e de diálogo das instâncias centrais de deliberação normativo-jurídica. Em outras palavras, o direito contemporâneo procura uma legalidade que possibilite a sua legitimação democrática. Neste trabalho, se investiga a transição paradigmática pela qual passa o fenômeno jurídico por meio da reflexão jurídica e filosófica sobre um instituto emblemático: o amicus curiae. ______________________________________________________________________________ ABSTRACT / What are the necessary and possible reasons of the legal discourse in pluralistic societies like ours, where various forms of living well and the different semantic universes created by social groups can not be, a priori, delegitimized? If we can no longer rely on absolute truths or hoping to discover any inherent meaning in the things of the world, how could the law, a speech dated, historical, social and culturally located, be valid for the whole society? Currently, it requires a democratic genesis of law, which means that, somehow, must be able to build normative consensus, lawful enough to bring the different horizons of meaning that make up the idiosyncrasies of social groups. Thus, the law, with particular emphasis on the fundamental rights of a constitutional nature, need to be in a state of openness to the community of interpreters that creates, updates, confirms or denies them. Therefore, the law is carried over from substantialist paradigms, in which the contents of the law was arbitrated, to a proceduralist paradigm, in which the validity of law presupposes the possibility that all social groups, including those who have been excluded or are on the periphery of the sociopolitical system, can participate in the construction of meaning and definition of the scope of legal rules. However, for the reasons that democratic legal discourse manifests, institutes are required to approach the public sphere of debate and dialogue of the central bodies of normative- legal determination. In other words, the contemporary law seeks a legality that allows its democratic legitimacy. In this work, we investigate the paradigmatic transition that passes the legal phenomenon through the legal and philosophical reflection on a flagship institute: the amicus curiae.

Apresentam-se noções históricas e a passagem da lógica tópica para a lógica sistemática, com o consequente esvaziamento axiológico do contraditório. Analisam-se também as repercussões da democracia deliberativa na mudança do status dos indivíduos na construção das decisões estatais, de súditos a colaboradores. Verifica-se a insuficiência do conceito restritivo do contraditório e adiciona-se a faceta substancial ou dinâmica, compreendida como o direito a recíprocas influências na construção dos provimentos. Investigam-se as consequências da remodelação do princípio do contraditório: vedação a decisões surpresa, princípio da colaboração processual e deveres correlatos, modelo de processo cooperativo e reforço do dever de motivação das decisões. Após, faz-se uma releitura crítica de alguns institutos processuais em decorrência do contraditório substancial. O último capítulo aborda a concretização do contraditório nos processos cujas decisões possuem efeitos transcendentes e atingem pessoas não integrantes da relação processual. Para tanto, propõe-se a generalização da figura do amicus curiae. Em seguida, investigam-se a sua natureza jurídica, os critérios de admissão e poderes de atuação. Conclui-se que o contraditório no Estado Constitucional brasileiro ostenta concepção lata, relacionada ao direito democrático de participação e influência na construção dos provimentos jurisdicionais. Assegura ainda a instituição do processo como uma comunidade de trabalho e comunicação, em que a decisão deve retratar debate paritário travado no palco processual.

The Influence of Interest Groups as Amicus Curiae on Justice Votes in the U.S. Supreme Court

Amicus curiae participation by interest groups has greatly increased over the past few decades in the Supreme Court despite a limited understanding of their influence. Previous literature has suggested that at the U.S. Supreme Court level, interest groups as amici are no more likely to get justices votes in a liberal or conservative direction than when no amicus brief is provided. Some literature, however, suggests that there are certain types of cases in which amicus briefs may be influential, such as in constitutional, statutory, and civil rights cases. By conducting several comparisons of means tests for the number of justice votes in a certain ideological direction with and without an amicus brief, this study investigates the influence of briefs on justice votes in civil rights and economic cases. The findings support the previous literature that suggests briefs are no more likely to be related to an increased number of votes in the direction of the brief, but finds that civil rights cases may be positively affected by amicus briefs while economic cases are negatively affected. This thesis concludes by explaining that the content of the briefs submitted should change in order to be more effective in influencing justices or that interest groups should use their efforts in other avenues to impact policy. / Master of Arts

Die vorliegende Arbeit widmet sich der wissenschaftlichen Untersuchung der Drittbeteiligung im Verfahren vor dem EGMR. Die Arbeit unterscheidet dabei zwischen vier potentiellen Drittbeteiligungsakteuren und setzt sich spezifisch mit den verschiedenen, bislang wenig behandelten Fragestellungen der Drittbeteiligung anderer Personen als derjenigen des Beschwerdeführers und dem gegnerischen Konventionsstaat auf der Grundlage des Art. 36 Abs. 2 EMRK auseinander. Als Herzstück der Arbeit wird der Einfluss der Stellungnahmen Drittbeteiligter auf die Judikatur des EGMR untersucht. Im Wege eines Vergleichs mit der verfahrensrechtlichen Ausgestaltung der Drittbeteiligung vor anderen internationalen Spruchkörpern erfolgt abschließend eine wertende Betrachtung des derzeitigen Rechtsrahmens der Drittbeteiligung vor dem EGMR. / The dissertation is dedicated to the academic study of third-party participation in proceedings before the ECtHR. It distinguishes between four potential third-party participants and deals in particular with the various issues of third-party participation by persons other than the applicant and the opposing Contracting state on the basis of Art. 36 para. 2 ECHR, which have hitherto received little attention. The centrepiece of the work is an analysis of the influence of third-party observations on the case-law of the ECtHR. Finally, a comparison with the procedural requirements of third-party participation before other international courts is made in order to assess the current legal framework for third party participation before the ECtHR.

[pt] O uso do recurso Amicus Curiae no controle concentrado de constitucionalidade por parte das Organizações Não Governamentais (ONGs) que atuam na defesa de direitos humanos é o tema central desta tese. O Amicus Curiae é importante figura de legitimação nos processos que visam ao controle concentrado de constitucionalidade, uma vez que permite a participação ativa da sociedade, por meio de entidades, órgãos, grupos e instituições que expõem os princípios e valores da maioria. Destaca-se que a atuação de entidades associativas do chamado Terceiro Setor favorece a legitimidade dos pareceres jurídicos sobre normas que regularão o interesse coletivo e que tal legitimação é usada como fonte de segurança jurídica em casos de ativismo judiciário. A partir de uma análise qualitativa e quantitativa, foram analisados processos que aceitaram entidades classificadas pelo critério 9 da FASFIL/IBGE como desenvolvimento e defesa de direitos e que atuaram como Amicus Curiae em Ações Diretas de Inconstitucionalidade (ADINs) no Supremo Tribunal Federal (STF) entre 2000 e 2016. Aponta-se que a sociedade civil, crescentemente institucionalizada, indica a profissionalização das narrativas conflitivas e sua orientação na busca de sua hegemonia, fortemente ancorada na vontade geral, como o instituto do Amicus Curiae aponta potencialmente. The Amicus Curiae becomes an important legal figure for legitimation in cases that aim at concentrated constitutional control, since it enables de active participation of society by way of entities, branches, groups, and institutions that express the principles and values of the majority of the population. More specifically, this thesis emphasizes that the activity of entities in the so-called Third Sector favors the legitimation of legal opinions on norms that will regulate collective interests, and that such legitimation is used as a source of juridical security in cases of (political) activism in the judiciary branch. Employing both qualitative and quantitative analysis, this thesis examines cases in which entities classed under FASFIL/IBGE s criterion 9 (development and protection of human rights) were accepted, and acted as Amicus Curiae in Cases of Direct Unconstitutionality (ADIN s) in the Brazilian Supreme Court between 2000 and 2016. Civil society, ever more institutionalized, points to a professionalization of conflicting narratives and their orientation towards hegemony, strongly anchored in the general will, as the use of the Amicus Curiae legal institution seems to reveal. Such an expedient, whose affirmation as an instrument of representation of social life is still in process, indicates the desire to occupy (as well as being invited to participate in the community of interpreters in order to assure the legitimacy of activist judicial decisions) the arena of democratic representation and participation.

Les revirements de jurisprudence de la Cour de Cassation / The reversals of case law of the Court of cassation

L'évolution de la conception classique du rôle du juge de cassation a entraîné une remise en question des sources du droit. Alors qu'au XIXème siècle le juge était considéré comme un simple lecteur de la loi, aujourd'hui il trouve sa place au sein des sources du droit. Il en résulte que lorsqu'un revirement de jurisprudence intervient, il va venir modifier l'ordonnancement juridique en y intégrant une nouvelle règle de droit, une nouvelle règle jurisprudentielle. Si la plupart du temps le revirement de jurisprudence n'emporte pas de conséquences néfastes, il arrive que dans certains cas, la sécurité juridique soit mise à mal. Il en découle que le justiciable va se voir appliquer la nouvelle règle jurisprudentielle quelle que soit la date de réalisation de l'acte ou des faits en raison de la rétroactivité inhérente à ce type de décision, sans pouvoir s'en prémunir. Le juge de cassation, conscient de ce problème, a recours à certaines méthodes afin d'annoncer un futur revirement de jurisprudence mais également d'en limiter ses effets. Cependant, ces méthodes ne s'avèrent pas pleinement efficaces et il semble nécessaire de permettre au juge de cassation de moduler dans le temps certaines de ces décisions lorsque leurs conséquences néfastes surpassent les avantages attendus du revirement de jurisprudence. / The evolution of the classic conception of the role of the supreme has brought about a questioning of the sources of the right. While in the 19th century the judge was considered as a simple reader of the law, today he finds his place within the sources of the right. As a result when a reversal of case law intervenes, it modifies the legal organization by integrating in a new legal rule, a new judicial rule. If most part of time the reversal of case law does not have harmful consequences, it happens that in certain cases, the legal safety security is endangered. It ensues from it that the citizen goes to see to apply the new judicial rule whatever is the date of realization of the act or the facts because of the retroactivity inherent to this type of decision, and the citizen won't be able to protect himself against this décision. The judge at the Court of cassation, aware of this problem, turns to certain methods to announce a future reversal of a case law but also to limit its effects. However, these methods do not turn out to be completely effective and it seems necessary to allow the judge at the Court of cassation to modulate in the time some of these decisions because the harmful consequences of these décisions may exceed the advantages expected from the reversal of case law.
