The following article analyses the progressive process of deregulation of labour and social relations through the withdrawal of the State and public authorities, as well as public administration, control and direction of the relations of this type, both individual and collective. The comparison is made between the Spanish and Peruvian model, but especially between the regulation of the European Union and several Latin American countries. Stands in the article between “public” intervention – regulation legislative or Government– of “administrative” intervention, control by the administration of the employment relationship, especially in this case through the labour inspection bodies. / El artículo analiza el progresivo proceso de desregulación de las relaciones laborales y sociales a través de la retirada del Estado y de los poderes públicos, así como de la Administración Pública, en el control y dirección de las relaciones de este tipo, tanto individuales como colectivas. La comparativa se efectúa entre el modelo español y peruano, pero muy especialmente entre la regulación de la Unión Europea y de diversos países de América Latina. Se distingue en el artículo entre la intervención “pública” –regulación legislativa o gubernamental– de la intervención “administrativa”, control por parte de la Administración de las relaciones laborales, especialmente en este supuesto a través de los órganos de la inspección de trabajo.

Syftet med denna uppsats har varit att undersöka digitalisering och dess påverkan på kompetens och kompetensförsörjning inom svenska myndigheter. Detta med avseende på det 16:e hållbarhetsmålet, framtaget av FN, som syftar till att främja fredliga, rättvisa och inkluderande samhällen för en hållbar utveckling. För att uppnå denna vision studeras e-förvaltning och dess inverkan på samhället. Insamling av primärdata har skett genom semistrukturerade intervjuer. Vidare har sekundärdata tillämpats i form av statistik för att stödja en del påståenden. Utifrån denna studie kan det konstateras att digitalisering inom de studerade myndigheterna dels bidragit till att ersätta arbetsuppgifter och dels till att förändra arbetsverktyg. De nya arbetsuppgifterna och arbetsprocesserna har ställt ökade krav på nya kompetenser bland medarbetarna inom den operativa verksamheten. Främst handlar det om en ökad digital kompetens hos medarbetare. Beroende på den digitala mognaden och införandet av digital teknologi varierar efterfrågan på den digitala kompetensen. Ur myndighetens perspektiv har digitaliseringen bidragit till ökad kompetensnivå. Detta har medfört att arbetsuppgifternas process och resultat blir av högre kvalitet. / The purpose of this thesis has been to study how digitalization has affected competency and competency management within Swedish authorities. This regards to the sixteenth sustainable goal developed by the UN which purpose is to promote peaceful, equitable and inclusive societies for a sustainable development. E-governance and its effect on the society is being studied to achieve the vision of a sustainable development. Collection of data has included primary data in the form of semi-structured interviews. Further on, secondary data have been applied in form of statistics for varying contexts. Based on the study’s findings it can be confirmed that the digital transformation within the examined authorities partially has contributed to replace professional tasks and partially to change the working tools used in the operation. The new professional tasks and their applied processes have contributed to higher demands of new competencies within the operation. It is mainly about an increased digital competency of employees. Depending on the digital maturity and the implementation of new technologies, the demand of digital competence varies between the authorities.

Hodnocení řešení problému azbestu ve škole regionu z pohledu pedagogů / Rating solve the problem of asbestos in school of the region from the perspective of teachersŠMERHOVÁ, Ilona January 2014 (has links)
Asbestos, a fibrous mineral with excellent chemical and physical properties and a very wide application, especially in civil engineering, is now known to be a proven human carcinogen and therefore its utilization was forbidden. It causes asbestosis, pleural hyalinosis, acute exudative pleuritis, lung cancer and pleural mesothelioma. Recently, many reconstructions of school facilities took place and are still taking place across the Czech Republic. This causes the drilling and cutting of asbestos and thus the release of fibres into the atmosphere and the interiors of buildings. Many reconstructions were also executed in South Bohemia, where panels containing asbestos were handled. This was a cause of concern not only for teachers, the employees of the schools affected, but also for the parents of children attending schools containing asbestos materials. A whole number of bodies in mutual cooperation participated in the disposal of asbestos in schools in the Czech Republic. It is thus very necessary and useful for public health officers and the above-listed entities involved, to have information about how their approach to the given problem and the whole solution of the problem was assessed by the teachers. The thesis consists of two parts: theoretical and investigative. The work deals with the evaluation of the solution to the problem of asbestos by authorities involved in the school from the teachers' point of view. The theoretical part deals with selected chemical pollutants in the work environment. It also focuses on the pollutant asbestos in general. Lastly, another chapter is devoted to the issue of the assessment of health risks, which is very closely related to pollutants in the work environment. The practical part contains the results that emerged from interviews with teachers. In the discussion, the results are compared with online articles and specialist literature. The necessary data for the research part of the thesis was obtained through qualitative research interviews with educators from the elementary school Máj I. Through the evaluation of the interviews, I answered the research questions and identified several hypotheses that could be tested in future quantitative research. In this thesis, I aimed to identify the level of cooperation of stakeholders in addressing the issue of asbestos disposal in the school concerned in the South Bohemian Region. Research suggests that the solution to the problem of asbestos in the school was judged largely positively by the teachers. They particularly praised the approach of the Municipality of České Budějovice. They criticized the errors made by the OHL ŽS and Mapoz Zliv companies regarding the reconstruction and also the company Sita cz, which carried out the sanitation works, after whose intervention the teachers lacked many things. Educators confused the competences of the regional health authorities with the competences of the Health Institute, and therefore the general public should get acquainted with the competences of these bodies in order to facilitate the communication between the different entities and the public, not only in the asbestos issue.

Its starting point is a question about the reality which influenced the author at the time of writing by using baffling language. The hypothesis is that John s Apocalypse which is an important source of the experiences of primitive Christianity at the end of the first century offers a strong criticism of the demands of adoration offered to the Roman authorities by means of the Imperial Cult. The images of the beasts described in Ap 13,1-18 express this theme by using provocative language grounded in the force of the word and mythical tradition of the Ancient Near East. In this way, the author demonizes and stigmatizes the expressions of official religion that treat the governors as divine beings as well as the promoters of the Imperial Cult in Asia Minor.(AU) / Esta dissertação investiga a narrativa de visão apocalíptica encontrada em Ap 13,1-18. Ela parte da pergunta sobre a realidade que influenciou o autor no momento da composição, utilizando-se, assim, de uma linguagem provocativa. Nossa hipótese indica que o Apocalipse de João, importante fonte das experiências do Cristianismo primitivo no final do primeiro século, proporciona uma dura crítica às exigências de adoração dirigidas às autoridades romanas através do Culto Imperial. As imagens das bestas descritas em Ap 13,1-18 expressam este tema através de uma linguagem provocativa, fundamentada na força da palavra e na tradição do mito do antagonista encontrado no Antigo Oriente Próximo. O direito internacional da concorrência sofre profunda influência do processo de globalização econômica em um cenário no qual a convergência da aplicação das legislações de diversos países é possibilitada pela cooperação jurídica internacional entre as autoridades concorrenciais. O Brasil adequa-se à cooperação internacional para a defesa da concorrência através dos acordos bilaterais, da participação nos foros regional e internacional e das normas do ordenamento jurídico interno, sendo que ao Conselho Administrativo de Defesa Econômica (CADE) é atribuída a competência para realizar os procedimentos cooperativos. Nesse contexto, a finalidade da presente dissertação é analisar a institucionalização da cooperação jurídica internacional pelas autoridades concorrenciais como mecanismo disponível à defesa da concorrência, especialmente no que tange aos instrumentos de direitos internacional e interno disponíveis ao Sistema Brasileiro de Defesa da Concorrência (SBDC) e ao papel do CADE. Para desenvolver os objetivos propostos, o estudo divide-se em dois capítulos. No primeiro capítulo é abordada a cooperação jurídica internacional entre as autoridades concorrenciais na função de mecanismo de convergência ao direito internacional da concorrência. Para tal, discorre-se sobre a cooperação bilateral e a estrutura institucional das autoridades concorrenciais em seu papel de protagonismo, além da influência das iniciativas multilaterais e regionais de cooperação em matéria concorrencial. O segundo capítulo dedica-se à análise dos instrumentos existentes no ordenamento jurídico nacional. Do ponto de vista internacional, estudam-se os acordos bilaterais firmados pelo Brasil ou no âmbito do SBDC, a participação do Brasil nos foros regionais e internacionais e a internalização e a utilização destes instrumentos pelo SBDC. Do ponto de vista interno, estuda-se o aparato jurídico nacional que fundamenta a cooperação internacional para a defesa da concorrência, o papel do CADE e as decisões do Tribunal Administrativo de Defesa Econômica, apresentando-se as dificuldades e perspectivas da disciplina. Por fim, ressalta-se que a cooperação jurídica internacional conforme realizada entre as autoridades de defesa da concorrência é instrumento indispensável para o bom funcionamento do sistema internacional. No âmbito do SBDC houve uma clara evolução na institucionalização dos instrumentos de direitos internacional e interno disponíveis, sendo que o CADE representa a autoridade adequada para o endereçamento das questões relativas à cooperação em matéria concorrencial. / International competition law is deeply influenced by economic globalization in a scenario where the convergence of application of laws from different countries is made possible by international cooperation between competition authorities. Brazil adapts to international cooperation through celebration of bilateral agreements, participation in regional and international forums and also through rules of domestic law. The Brazilian Council of Competition Defense (CADE) is responsible for the cooperative procedures in competition matters. In this context, the aim of this study is to analyze the institutionalization of international cooperation as conducted by competition authorities as a mechanism to ensure the defense of competition, especially in the case of instruments of domestic and international law available in the Brazilian Competition Policy System (SBDC) and the role of CADE. In order to develop the proposed objectives, the study is divided into two chapters. The first chapter examines the international cooperation between competition authorities as a useful tool for competition law. In order to perform such examination, discussions on bilateral cooperation between competition authorities, the institutional structure of competition authorities and the influence of multilateral or regional initiatives for cooperation are presented. The second chapter is dedicated to the analysis of domestic and international law tools that exist in the Brazilian legal system. From an international point of view, bilateral agreements celebrated by either Brazil or the SBDC, Brazilian participation in regional and international forums, and the practical use of these instruments by SBDC. Domestically, both the role of CADE and the practical application of these instruments in the administrative case law are studied, revealing the perspectives and difficulties of the discipline. Finally, it is highlighted that international legal cooperation, as held between competition authorities, is essential to the proper functioning of the international system. In the framework of SBDC, there was a clear evolution in the institutionalization of instruments of international and domestic law, with CADE being the appropriate authority for addressing issues relating to cooperation on competition matters.

Therefore, this research aims to analyze the role of this body in its intervention to prevent and remedy the injustices of government, having as its mechanism of
action recommendations to target organs after submission of complaints by individuals of the actions or omissions of powers public. Thus, among the main obstacles in the intervention of
the Ombudsman is the lack of decision making power of its recommendations. The thesis is grounded in research referenced in bibliographical information, looking to make a comparative study of the figure of the Ombudsman in the Angolan relatively few jurisdictions that enshrine this figure in its Constitution. The event aims to highlight the Ombudsman as an organ useful for checking the legality and justice that the law imposes on the Angolan government, in ensuring respect for the rules and principles of law and the system as a mechanism for access to law and justice, which aims to defend the rights, freedoms and
guarantees of citizens of the activity of public administration. Focusing on this aspect of the dissertation will address the role of this body for institutions who exercise judicial functions
under enshrined in the Constitution of the Republic of Angola, in order to ensure the realization of the democratic state of law. Therefore, intending still sharpen the awareness that, regardless of enjoying power without making claims to this court required the State, the Ombudsman plays a key role in the prevention and remedying of injustices and illegalities of government. / Este trabalho versa sobre a relevância da figura do Provedor de Justiça no ordenamento jurídico angolano, como uma instituição garantidora do respeito pelos direitos, liberdades e garantia dos cidadãos face aos poderes públicos. Portanto, esta pesquisa tem por objetivo analisar o papel deste órgão na sua intervenção com vista a prevenir e reparar as injustiças dos
poderes públicos, tendo como mecanismo da sua atuação as recomendações aos órgãos visados após apresentação das queixas pelos particulares das ações ou omissões dos poderes
públicos. Assim, dentre os principais entraves na intervenção do Provedor de Justiça reside na ausência do poder decisório das suas recomendações. A dissertação está referenciada numa
pesquisa pautada em indicações bibliográficas, procurando fazer um estudo comparativo da figura do Provedor de Justiça no direito angolano relativamente algumas ordens jurídicas que
consagram esta figura na sua Constituição. A hipótese pretende evidenciar a relevância do Provedor de Justiça como um mecanismo do sistema de acesso ao direito e à justiça, que visa

Cette recherche doctorale s’intéresse à la gestion de la précarité par les collectivités territoriales, au travers des relations nouées avec le tissu associatif local. L’exploration théorique de ces liens conduit tout d’abord à relever la triple contribution de ces relations inter-organisationnelles à la gestion locale de la précarité (une aide aux précaires plus complète, un meilleur repérage de la précarité, un meilleur savoir et savoir-faire en matière de publics précaires). Elle conduit ensuite à relever l’importance des interactions entre la nature de la relation collectivité territoriale – associations (au travers des comportements d’engagement et de confiance qui la définissent) et les modes de contrôle inter-organisationnel mobilisés dans ces relations. L’influence de ces interactions sur la force de la contribution des relations observées à la lutte contre la précarité est alors révélée. La recherche empirique conduit à s’intéresser plus particulièrement aux relations nouées entre une mairie française et les associations qu’elle subventionne afin de pallier la précarité sur son territoire. Une démarche qualitative reposant sur l’analyse de contenu d’entretiens semi-directifs permet de dépeindre largement leurs liens. Une classification hiérarchique des relations étudiées permet d'aboutir à une typologie en trois familles des relations mairie-associations dans la gestion locale de la précarité. / This dissertation focuses on relationships between local authorities and local associations as a means of dealing with precariousness. The theoretical exploration of these partnerships leads us firstly to point out the triple contribution of those inter-organizational relationships to the local management of precariousness (in the form of more complete support for precarious people, better identification of precariousness, and better knowledge and expertise concerning the precarious public). It then brings us to highlight the importance of interactions between the nature of the relationship of local authorities with local associations (through commitment-trust behaviors) and the inter-organizational forms of control used in those relationships. Those interactions’ influence on the contribution’s strength of the observed relationships to the local management of precariousness is then revealed. The empirical research concentrates on the relationships between a French municipality and its associations to overcome precariousness on their territory. A qualitative approach based on a content analysis of semi-directive interviews helps paint an accurate picture of their links. A hierarchical classification of the studied relationships allows to end in a typology in three families of French municipality-associations relationships in the local management of precariousness.

The dissertation deals with trafficking of foreigners for the purpose of forced labour and other forms of exploitation. The goal of the work is to evaluate measures taken by state authorities and nonprofit sector with regard to the original causes. The first part of the dissertation shows a brief aspect into the issue. Further follow specific causes of trafficking of foreigners in the Czech Republic. This part is concluded by analysis of individual measures, which are also divided into nonprofit sector and public authorities. The second part of the dissertation aims (through 10 case studies) to confirm or refute the allegations which were found in the first part of the work.

Činnost Policie ČR v případě opakování povodní na Třeboňsku. / Czech Republic Police Activities in the Event of Reoccurring Floods in the Třeboň Region.KROUPA, Josef January 2010 (has links)
While writing this diploma thesis, I realized that the issue of the Czech Police{\crq}s activities in the context of potentially reoccurring floods is a considerably complex matter. Moreover, it is subject to a multitude of mutually intertwined and interlinked laws and regulations. In the theoretical part, I studied the relevant laws concerning high-water crises, e.g., floods, and the work of the police in such emergency situations. Also, I focused on floods as such, their types, the factors leading to high-water scenarios, and the different levels of activities during floods. Thereupon I compiled an overview of the authorities of competence during floods, and examined the laws dealing with high-water crises. The second part of my thesis details the events that occurred during the flood in the Třeboň region in 2002. Finally, my thesis presents a detailed description of the current organizational structure of the PCR, as one of the fundamental elements of the country{\crq}s Integrated Rescue System (IZS). In the practical part of my thesis, I present an evaluation of a questionnaire that was taken with the aim of analyzing the level of preparedness of the PCR for maintaining public order in the event of a flood. My research indicates that the level of the PCR{\crq}s preparedness is not adequate enough, primarily in terms of existing material provisions and communication amongst the individual units of the IZS. This problem cannot be solved on the level of the Třeboň District Police (OOP) alone, for it has to be approached centrally in the context of potential flooding in the given locality. Another drawback appears to be, apart from shortage of PCR{\crq}s material provisions, also communication amongst the IZS units, particularly on the level of field watches (ground surveillance). A survey focused on to-date experience of the PCR{\crq}s members in the area of assuring public order in flooded territories revealed that the main problems the policemen had to deal with was disobedience and obstinacy on the part of the public when asked to evacuate a place, as well as inadequate provisions for effective communication. Moreover, the survey revealed inadequate knowledge of the scope of competence on the part of the PCR when ordered to evacuate a flooded area. Clearly, the Police Code should be applied consistently and better knowledge thereof pursued through periodical training, upgrading, and independent study. Despite the above shortcomings and the many problems arising therefrom, it should be noted that the organization of rescue activities was handled well, thanks to maximum effort of all the participating persons, so that the population suffered no major casualties or significant material losses.

The thesis rounds up fundamental information about municipalities and cities concerning crisis management. Further analyzed are responsibilities and duties of municipal and city authorities in resolving major emergency incidents and crisis situations, and status of municipalities in the security system of Czech republic. The thesis further describes the ensuring of crisis preparedness at the level of municipalities and cities. The aim of the research part of the thesis was to analyze, describe and evaluate present state of crisis preparedness of municipalities and cities in South Bohemian region and, at the same time, to find suggestions for systemic solution to the current situation. And this for a reason that the status of municipalities in the security system of Czech republic is irreplaceable because a municipality, most importantly represented by a mayor, is closest to a citizen, and therefore a help in resolving major emergency incidents and crisis situations must primarily be ensured from the level of a municipality. For this purpose the hypothesis was set that municipalities, as opposed to municipalities with extended powers, are professionally, personally and materially not sufficiently prepared for resolving emergency incidents and crisis situations. Furthermore, the thesis deals with methodical tool ? procedure for solving emergency incidents and crisis situations by municipality bodies that could directly serve mayors of municipalities. And also, a proposal for tasks and measures is dealt with which could improve crisis preparedness of municipalities and cities.
