The system of guarantee of rights' way of operating in cases of sexual abuse against children: a processual analysis

Silvia Ignez Silva Ramos 24 June 2010 (has links)
The way sexual abuse against children and teenagers is dealt with nowadays, mainly by the System of Guarantee of Rights (SGR), reveals a repressive and punitive way of operating inherent to the Brazilian penal system. This bias with an emphasis on punishment produces a certain lore on the topic, delineating a similar modus operandi within each part of SGR, which is subdivided in 3 branches: promotion, defense, and control. Based on this logic, a Masters degree research was carried out together with the Post-Graduate Program in Social Psychology at Rio de Janeiro State University (UERJ). The goal of the research was to understand, by means of a documental analysis of three concluded lawsuits involving children who supposedly were victims of sexual abuse, the actions of SGR from the initial reporting of the case until the verdict was pronounced by the judge. The main focus was the actors understanding of their role in these cases of sexual abuse against children, their decisions and concepts they resorted to in the proceedings, and, finally, what arguments led to the final decision and verdict. Going through the specific legislation for Childhood and Youth one can comprehend how rights-related issues were incorporated to issues related to childhood, particularly in the last twenty years. In reality, the research reveals that the principles of penal law took the center stage, running contrary to the needed attention that should have been given to the victim and his/her family, repeatedly placing the blame on the mother for negligence. And the actual abuse, considered upheld at the beginning of the proceedings, ends up watered down in court.

Gonçalves, Sérgio Fusquine 31 August 2009 (has links)
Made available in DSpace on 2015-03-05T17:21:11Z (GMT). Essa realidade é percebida e exemplificada em precedentes da Justiça Gaúcha, exigindo a construção de alternativas para que os direitos e garantias fundame / The new Integral Protection Doctrine, constituted nationally in the 1988 Constitution and in the Child and Adolescent Act, a sound paradigm change occurred concerning the childhood and youth issues, in which children and adolescents became subjects of right instead of simple assistance objects. The former Irregular Situation Doctrine was revoked, causing, as a result, a reduction of the limits to the Childhood and Youth Judge actions. However, it is possible to identify a denying move towards to the new determination, reflecting on decisions directed to the former juridical system. In this situation, the best interest of the child principle, foreseen in the Convention on the Rights of the Child, is being used for discretionary decisions, disregarding the new valid order. This reality is perceived and exemplified in precedent situations of the Justice in Rio Grande do Sul, demanding alternatives in order to protect the fundamental rights and guaranties of children and adolescents. Thus, the present paper int

The Young Offender Rural Facility of Anitapolis, from its founding in 1918 until the end of its activities in 1930, presents us with interesting elements to the understanding of the stay of those children, mostly from Rio de Janeiro, at that institution. Understanding the institution in its internal dynamics, its networks of relationships established between its residents or with its educational agents provides us with important instruments to understand the complexity of relationships and behaviors of people commonly investigated only in the production area. The location of the institution and its demands, however, can not be seen leaving aside the area of education and work, since people act simultaneously in both worlds. The world of education and the world of work, as well as the Colonial Center and the Young Offender Rural Facility, are connected by the experiences and everyday practices of the minors and their teachers, seen as social subjects in this perspective. Thus, the life at the Facility is directly linked to the life of the Colonial Center (Anitapolis), making it necessary to observe what are the channels of dialogue, in which the games of power and rights disputes are played. The dissertation was organized into three chapters. In the first chapter, entitled Action and perspective of the State on minors, we present a scenario of the Brazilian government position in relation to public policies regarding children. In the second chapter, called The Young Offender Rural Facility of Anitapolis, we investigated the pedagogical and social-administrative practices present in the institution and imposed by the pedagogy of progress. In the third chapter, entitled Action and perspective of the subjects: the minors and the Rural Facility, we researched the existing relations of sociability between inmates in the Rural Facility as well as with the Colonial Center. Several documents were investigated, such as official letters, messages, reports and information related to the Rural Facility, the Colonial Center of Anitapolis, and the Ministry of Agriculture, Industry and Trade, between the years 1918 and 1930. A research was also done in newspapers, reports of the Governors of Santa Catarina and documentary collections on police, minority and legislation over the period. In this thesis we reflected on the inclusion of these young people and their relationships with the institution of education and correction, focusing mainly on the analysis of forms of participation of children and young people in the institution and their interaction with the colonial Center / A história de uma instituição como o Patronato Agrícola de Anitápolis (Santa Catarina, Brasil), antes de se tratar de uma análise restrita aos acontecimentos de uma determinada instituição ou, ao contrário, simples expressão da conjuntura regional e nacional, aparece para o historiador como uma possibilidade de reconstruir histórias de crianças e jovens, suas trajetórias, sua inserção social e educacional e suas resistências às políticas públicas na Primeira República (1889- 1930). The influence of a changing society on young adults’ exodus from the church over the last fifty years in South Africa

Rose, Howard Richard January 2019 (has links)
Today’s world in the new Millennium is a far cry from church and home life for young people (18-30) fifty years ago, where quantum change on top of change, and disconnectedness in family structures, have all contributed in various ways to an exodus of young people from mainline churches throughout the world. To counteract this ongoing trend, significant effort has been applied by mainline churches throughout the world, and South Africa in particular, to grow young people in the “Faith”, all of which has resulted in young people continuing to exodus the church after confirmation or graduating from high school. However, the bottom line challenge being faced is not simply one sided with young people exiting the church - for so called ‘better’ activities, but that the church has also not found an effective strategy for engaging with non-churched young people (those who have never been to a church) and those who used to actively participate, but have now abandoned the church and its ministry. Parents of today’s young people to a great extent have failed to understand and recognize that it is impossible for their children to accept the ‘faith and truth’ if they don’t role model and practice it in their homes. Similarly, if they don’t help their children to see and understand how faith is applied and has meaning in their everyday lives, then the current status quo between children, family and church will continue to grow exponentially. The church, and more particularly parents, need to understand and listen to the young people’s postmodern views and how it has reshaped their lives, in comparison to the preceding generations. By adopting the conclusions and broad practical recommendations from this research, churches may be able to reach out more effectively to parents, children and young people, to help them discover a life changing relationship – in their walk with Jesus Christ / Christian Spirituality, Church History and Missiology / M. Imagining Freedom: Black Popular Music and the Poetics of Childhood

DeCoste, Kyle January 2024 (has links)
In the U.S., Black childhood has been underimagined. The representational vocabulary of Black childhood is fraught with dehumanizing and adultifying imagery and sounds—from representations of “Topsy” and “Black Sambo” to caricatures of pickaninnies and their many (re)iterations in U.S. popular culture. Popular music is one expressive domain wherein artists and audiences alike have contested and reinforced the peculiar adultification and infantilization that have long haunted Black American life. In the years surrounding the Trump presidency, numerous Black popular music artists made childhood a primary feature of their artistic output through vocal technique, lyrical content, merchandise, music videos, social media, and more. At the precise moment when white innocence was wielded most violently and obviously on the national stage, these artists challenged the assumed goodness and whiteness of innocence and its relation to childhood, performing capacious versions of free Black childhoods to various ends. This dissertation turns to the performance of childhood as a productive domain of inquiry and focuses on four artists/groups—Tank and the Bangas, Chance the Rapper, Jamila Woods, and Noname—all of whom chart a liberatory politics of Black childhood through sound. Through the poetics and aesthetics of their work, I theorize and historicize four interrelated, childhood-adjacent concepts: nostalgia, vulnerability, innocence, and freedom. Methodologically, I attempt to turn the tables on how vulnerability has normally been rendered in ethnographies. I blend (auto)ethnography about my own experiences as a white father of a multi-racial child with critical theory to analyze live and mediated performances of popular music. I look to music as a poetic and aesthetic space with which to not only grapple with the realities faced by Black children in the United States, but also to affirm Black childhood as a space of freedom, play, possibility, and joy. Ultimately, I make two interrelated assertions: (1) foregrounding Black childhood in our social analysis urges the necessity of abolition and (2) popular music is a primary conduit through which we can imagine an abolitionist future free of police, prisons, and the carceral logics that undergird their imagined necessity.

[en] DISCONTENT AT SCHOOL: TENSIONS BETWEEN THE SINGLE AND THE COMMON / [pt] MAL-ESTAR NA ESCOLA: TENSÕES ENTRE O SINGULAR E O COLETIVO

MARIO ORLANDO FAVORITO 21 March 2019 (has links)
[en] The articulation between psychoanalysis and education to think about the discontent in school dates back to the beginnings of the constitution of the former. If we can find in S. Freud an oscillation between the inhibiting role which had to be done by education and, on the other hand, a libertarian trace, in that this hosts into its objectives the instinctual reality in the child, there is another line of thought in psychoanalysis that goes from S. Ferenczi to D. W. Winnicott which allows other referrals to this theme approach, especially in its current expression. This thesis aims to investigate what psychoanalysis can do against the discontent in the current school using as tools the genealogy of the disciplinary power and the biopower in M. Foucault to understand the child-student category emergency, the standard and standardization concepts to discuss the medicalization and pathologizing processes of children and youth in the school surroundings in the control society and, finally, D. W. Winnicott s thought and his psychic maturing theory and its developments. It is still aimed to the property of this theory of the early subjective constitution and its developments, which allow to think the forms of insertion into the culture, to the different referrals of the discontent in the current school, understood as creative living disempowerment.
