A review of provincial land-use planning in the Western CapeAbrahams, Farah January 2005 (has links)
Magister Legum - LLM / Planning administration in the Western Cape is at a critical juncture. It is faced with having to address planning issues and housing needs whilst at the same time demonstrating through its practices the promotion of environmentally sustainable development. This paper will discuss planning and environmental legislation and the impact that the application of the legislation has on development proposals. Current legislation addresses issues of spacial development in developed areas and new development proposals but lacks the ability to address issues within informal settlements. Although socio-economic factors are not currently considered when assessing the viability of applications, the courts seem to consider these factors. Since new housing settlements are often developed for the poor and industrial developments in close proximity to these areas have direct impact on these individuals, planning could only gain if these factors are taken into consideration.If planning administration in the Western Cape is to continue successfully and without endless litigation against the Department of Environmental Affairs and Development Planning administrators will have to find a balance between promoting development and protecting the environment. To promote environmentally sustainable developments will require closer cooperation between the land use planning and environmental management components. The loopholes, which permit incremental development in the present legislation, have to be identified and addressed. Guidelines, which will standardize the conditions under which applications can be approved or refused, will have to be drafted to ensure decision-making that is consistent and defensible. If having a liquor store within an affluent environment is not considered desirable such applications should not be considered within lower income areas. The same should apply when dealing with applications to establish factories or industry which will have an impact on the living conditions of communities in close proximity. The MEC will have to ensure that all decision taken are within the legal framework and that such decisions benefit entire communities and protect the rights of the poorest communities as well as that of the wealthy and influential. Environmental legislation and the growing importance of environmental protection is also having an impact on the way in which new settlements are planned and on the rights of property owners. Although, we are responsible for the preservation of the environment for the next generation, socio-economic conditions, HIV and a myriad of other considerations may have to take precedence over environmental concerns. / South Africa

Retrofitting Vancouver's most sacred land use: the intensification of ground-oriented housing in single-family neighbourhoodsPatrick, Lyndon Lee 05 1900 (has links)
The Metropolitan Vancouver Region is expected to have a population of over 3.3 million
within the next 25 years. As a designated growth concentration area, the City of
Vancouver is expected to absorb 160,000 people by 2021. While existing plans will
allow for future high density developments, 70% of the City's residential areas remain
zoned explicitly for single-family use. The intensification of these single-family
neighbourhoods is viewed as a way of using the existing housing stock and the existing
residential land more efficiently. The intensification techniques that are appropriate for
single-family neighbourhoods include: conversion, infill and redevelopment.
Planners think that intensification efforts will not only alleviate some of the detrimental
impacts of sprawl, but will also provide a more diversified housing stock that will be
more appropriate for the needs of an increasingly complex society. Unfortunately, some
existing residents have been extremely vocal in opposition to any intensification efforts in
their neighbourhoods. The residents claim that any intensification will disrupt the
character of their existing single-family neighbourhoods. While the arguments for
retaining exclusive single-family neighbourhoods are specious at best, the NIMBY
mentality of residents has often proved to be an effective form of opposition to
intensification efforts.
An approach for overcoming the NIMBY syndrome is a successful program of
community outreach. Community outreach attempts to minimize community opposition
and to rally support for the development within the community. Attention is focused on
the residents who have not already become opponents of the development. A successful
community outreach program will limit residents' factual misunderstandings and their
exaggerated fears about the project's potential impacts. Negotiations should be
undertaken with residents who are willing to compromise; residents who refuse to talk
cooperatively should not be brought into the problem-solving process.
Future plans for intensification must establish a sense of certainty in the way a
neighbourhood will change. The exaggerated sense of fear that residents have about the
potential changes in their neighbourhood is the biggest obstacle to overcome if the
Metropolitan Vancouver Region is to successfully implement an intensification program

issues are studied in the following chapters
to determine motivations for negotiating community
benefits agreements (CBAs), and to determine
motivations for the specific benefits outlined
within each community’s respective CBA. The
case study research examines the historic
preservation language within each CBA as well
as how the development itself and the other
benefits prescribed in the CBAs will positively
or negatively impact each community. The case
study communities demonstrate that CBAs can be
used as historic preservation planning and
implementation tools. By including thoughtful
and transparent community benefits language,
a community will be able to use the tools – i.e.
financing, technical assistance, advice and guidance, etc. – provided to them within the CBA
to successfully carry out the benefits promised

dispute from the experiences in the cities of Diadema and São Bernardo do Campo/SP,
located in the metropolitan area of São Paulo. Mainly after 2009, with the implementation
of the program called ‘Minha Casa Minha Vida’ (MCMV), new challenges have been being
faced by the different subjects who participate in the execution process of the housing and
urban policy. We start from the hypothesis that the forces in the private property capitalist
model establish relationships of interest in housing disputes, which condition the
effectiveness of the urban and housing policy, impelling to a distance from the ideology
defended by the guidelines aimed at the consolidation of the Housing National Policy
(PNH) and in the City Statute. This way, as the investigation central axis, the study has
objectified to explain answers to the housing and urban policy, in its relationship with the
matters related to the land dispute, having as a perspective the right to the city, in an
approximation with the cases of the counties of Diadema and São Bernardo do Campo/SP,
raising capabilities and difficulties in confronting alarming data of exclusion and territorial
segregation. The study has demonstrated relevance in creating a reflection on the usage of
the urban territory, and the proposition of popular housing, part of the social spatial
segregation, understanding the territory as one of the social reproduction dimensions, space
that conditions subjects’ positions, composes strength relationships and orient political
choices. As a methodological path, we opted for the qualitative research, which has
combined bibliographical survey on the formation of cities in Brazil, the State role, the
social function of space, and the history of social movements in housing and urban and
housing policy, and has included visit and observation of the experiences from the studied
cities, besides interviews with technicians, managers and social movements representatives
from both counties. The analysis has indicated that even experiences that have been
compromised by the implementation of urban policies in favour of the construction of less
uneven and more inclusive spaces, still, could not break with the structural capital logic, of
divergence between classes, spatial segregation, and attendance to the market interests. The
State’s role in public regulation and the social movements in resistance and confrontation is
decisive for the construction of fairer and more democratic cities / A presente tese apresenta o estudo que tratou sobre o direito à moradia e os impasses da
disputa da terra a partir da experiência das cidades de Diadema e São Bernardo do
Campo/SP, localizadas na região metropolitana de São Paulo. Principalmente após 2009,
com a implementação do programa Minha Casa Minha Vida (MCMV) novos desafios estão
colocados para os diferentes sujeitos partícipes do processo de execução da política
habitacional e urbana. Partimos da hipótese de que as forças do modelo capitalista de
propriedade privada estabelecem relações de interesses de disputa da terra, que condicionam
a efetivação da política urbana e habitacional, impelindo a um distanciamento do ideário
defendido pelas diretrizes apontadas na consolidação da Política Nacional de Habitação
(PNH) e no Estatuto da Cidade. Desta forma, como eixo central da investigação, o estudo
objetivou explicitar respostas da política urbana e habitacional, na sua relação com as
questões ligadas à disputa da terra, tendo como perspectiva o direito à cidade, numa
aproximação com o caso dos municípios de Diadema e São Bernardo do Campo/SP,
levantando capacidades e dificuldades de enfrentamento aos dados alarmantes de exclusão e
segregação territorial. O estudo demonstrou relevância ao elaborar reflexão sobre o uso do
território urbano, e a proposição de habitações populares, componentes da segregação socioespacial,
entendendo o território como uma das dimensões de reprodução social, espaço que
condiciona as posições de sujeitos, compõe relações de forças, e orienta as escolhas
políticas. Como caminho metodológico, optamos pela pesquisa qualitativa que combinou o
levantamento bibliográfico sobre a formação das cidades no Brasil, o papel do Estado, a
função social do espaço, e o histórico dos movimentos sociais de moradia e da política
urbana e habitacional, e incluiu visita e observação às experiências das cidades estudadas,
além de entrevistas com técnicos, gestores e representantes de movimentos sociais de ambos
os municípios. A análise indicou que mesmo experiências que se comprometeram com a
implementação de políticas urbanas a favor da construção de espaços menos desiguais e
inclusivos, ainda assim, não conseguiram romper com a lógica estrutural do capital, de
apartação entre classes, segregação espacial, e de atendimento aos interesses do mercado. O
papel do Estado na regulação pública e dos movimentos sociais na resistência e
enfrentamentos é decisivo para a construção de cidades mais justas e democráticas

Previous issue date: 2017-12-14 / The present survey has as a theoretical framework the Urban Law and intends to be a multidisciplinary study between the areas of Law, Sociology and Urbanism, with the aim of investigating the National system of urban Mobility, limited of the urban highway system (excluding water and airway issues), as an instrument to enable the right of access to the city, under the aegis of the Right to the City.
To this end, the fulfilment of the objective in a satisfactory way, the study deeply analyzes the meaning of the city and its social functions, reflecting its use and appropriation, equality and social inclusion, as well as sustainable urban development, of the National System of Urban Mobility with the legal bases of Law 12,587 of January 12, 2012, Urban Mobility Law.
Direct result of the analysis allowed to identify the social externalities arising from the administrative management of the National System of Urban Mobility and the role of the State in its effectiveness, a scope of great importance in the context of large cities / A presente pesquisa possui como marco teórico o Direito Urbanístico e pretende ser um estudo multidisciplinar entre as ciências na área de Direito, Sociologia e Urbanismo, tendo como desiderato, investigar o Sistema Nacional de Mobilidade Urbana, limitado ao sistema viário urbano em vias terrestres (excluindo-se, metodologicamente, as questões viárias aquáticas e aéreas), como instrumento viabilizador do direito de acesso à cidade, sob a égide do Direito à Cidade.
Com esse propósito, para que se cumpra de forma satisfatória o objetivo, o estudo analisa com profundidade o sentido de cidade e suas funções sociais, refletindo sobre seu uso e apropriação, igualdade e inclusão social, assim como o desenvolvimento urbano sustentável, entrecruzando a gestão do Sistema Nacional de Mobilidade Urbana com os fundamentos legais da Lei nº 12.587, de 12 de janeiro de 2012, Lei de Mobilidade Urbana.

Its implementation is a Municipality mandatory duty to be performed in planning operations, general works, and for both public and private activities. Through the Municipal Environmental Zoning, the territorial environment is recognized. The Municipal Environmental Zoning is a way in which weaknesses are then determined, thus allowing a better-qualified evaluation to guide the public policies. This act prevents any sacrifices that could represent a sustainability rupture. The Municipal Environmental Zoning represents the fulfillment of an environmental protection platform, on which the master plan will establish the city's development and expansion policy. The interrelationship between local, estate, regional and national environmental zoning allows an overlay process in this environment protection platform on the entire national territorial level, thus resulting in greater effectiveness, protecting the ecologically balanced environment right.

O direito ao lazer como máxima dos direitos sociais fundamentais positivados no artigo 6º da Constituição Federal Brasileira de 1988, porém ainda não perpetrados na sociedade brasileira contemporânea, é o principal objeto de discussão deste trabalho. Sempre com enfoque no meio ambiente urbano, aventam-se questões acerca do bem-estar, qualidade de vida, tempo livre e ócio do cidadão no contexto em que está inserido, a partir do problema principal que é em que medida um ambiente urbano que propicie aos seus cidadãos o direito ao lazer contribui para a efetivação e consolidação dos conceitos de cidadania, bem-estar e qualidade de vida no contexto brasileiro? Assim, o Direito Urbanístico aparece no pensamento de que é o Município o responsável pela garantia do exercício do direito ao lazer pelo cidadão, através da adoção de políticas públicas universalizantes e instrumentos jurídicos, como por exemplo o plano diretor e o zoneamento urbano. A presente pesquisa objetiva analisar os aspectos jurídicos e sociológicos que permeiam o tema do direito à cidade, na problemática urbana atual. Só é possível discuti-la se relacionar a forma como o território urbano foi planejado com o atendimento dos anseios de qualidade de vida e bem-estar dos seus habitantes. A história demonstrou como o período moderno permitiu o desmantelamento das considerações clássicas inerentes às cidades, que visavam o território como um todo, cujo golpe de distorcer tais conceitos foi no sentido de possibilitar com que a cultura privatista e individualista tornasse a propriedade privada urbana um direito absoluto. O território urbano pôde ser utilizado como mercadoria onde, a partir de políticas públicas eminentemente econômicas, produzidas em benefício de poucos, o interesse da coletividade passou a ser deixado de lado. Mesmo com o advento da Constituição de 1988, que trouxe preceitos diretamente relacionados com a função social das cidades, o direito coletivo a uma cidade socioambientalmente sustentável não encontra plena efetividade administrativa e judicial. A forma e os mecanismos pelos quais o atual ordenamento jurídico trata o direito à cidade são de profunda incompatibilidade com a sua verdadeira natureza e titularidade. É a partir da construção de um novo paradigma jurídico que se busca a elevação do direito à cidade para a categoria de um “novo” direito. Visa pleitear a indivisibilidade e a desfragmentação do direito à cidade reconhecendo-o como um direito coletivo, para que ele possa ser praticado não apenas através das políticas públicas exclusivamente estatais, mas também considerando a possibilidade de personificação e autonomia de um sujeito coletivo. Previous issue date: 2017-10-04 / Esta investigación tiene como objetivo exponer los aspectos jurídicos y sociológicos que relacionan el derecho a la ciudad en los actuales problemas urbanos. Sólo podemos hablar de ello si relacionamos la forma de cómo el territorio urbano se planeó con el cuidado de la calidad de vida y el bienestar de los habitantes. La historia ha demostrado que el período moderno permitió el desmantelamiento de las consideraciones clásicas inherentes a las ciudades, cuyo golpe fue el fin de permitir que la privatización y la cultura individualista conviertir la propiedad privada urbana en un derecho absoluto. El territorio urbano tiene a ser utilizado como una mercancía, donde a partir de las políticas económicas eminentemente, iba a ser dejado de lado el interés de la comunidad. Con la llegada constitucional de 1988 existía la posibilidad de una implantación da función social de las ciudades, a un derecho colectivo a la ciudad social y ambientalmente sostenible, pero no se dejó la posibilidad de plena eficacia administrativa y judicial en el ordenamiento jurídico brasileño. La forma y los mecanismos del sistema actual en relación con la ciudad son de profundas incompatibilidades con su verdadera naturaleza y la propiedad. Es a partir de la construcción de un nuevo paradigma legal que busca elevar el derecho a ciudad a la categoría de un “nuevo" derecho. El objetivo es defender la indivisibilidad y la desfragmentación del derecho a la ciudad, de modo que pueda ser practicado no apenas por políticas públicas exclusivamente del estado, pero también teniendo en cuenta la posibilidad de suplantación de identidad y autonomía de un sujeto colectivo. Aún así, para superar el hecho de que es un declarado derecho y no pagado, también es necesario crear mecanismos específicos para la protección de este "nuevo" derecho colectivo a ciudad, en el sentido de que la participación o manifestación popular, identificado como un sujeto de derecho procesal (legislativo, judicial o administrativo dirigido por la autoridad pública), pueden ser el sello a Gobierno para la aplicación efectiva de un nuevo derecho a la ciudad como un derecho colectivo.
