ES įtaka tautinių mažumų pilietinėms teisėms Baltijos valstybėse / The impact of EU on the civic rights of national minorities in the Baltic states

Tautinių mažumų apsauga – viena iš labiausiai diskusijas sukeliančių temų Baltijos valstybių visuomenėse. Jų pilietinių teisių užtikrinimas – vienas iš įstojimo į Europos Sąjungą kriterijų, kuriuos turėjo įgyvendinti šalys kandidatės. Tyrimo objektas – ES poveikis tautinių mažumų pilietinių teisių pokyčiams Baltijos valstybėse, įvykusiems po jų nepriklausomybės atkūrimo. Tikslas – išanalizuoti kaip ES reikalavimai ir rekomendacijos paveikė teisinį tautinių mažumų traktavimą Baltijos valstybėse. Darbo uždaviniai: pateikti pagrindinius teorinius tautinių mažumų apibrėžimus ir analizuoti tautinių mažumų situaciją Baltijos valstybėse pagal šiuos modelius; analizuoti ES reglamentuotus teisės aktus ir nuostatas dėl tautinių mažumų apsaugos; aprašyti tautines mažumas Lietuvoje, Latvijoje ir Estijoje ir palyginti jų teisės aktus bei jų atitikimą ES teisės aktams; analizuoti ir palyginti tautinių mažumų kilmės šalių poveikį Lietuvai, Latvijai ir Estijai. Darbe naudojami metodai: lyginamasis ir analitinis. Naudojant šiuos metodus pasiekti rezultatai – panašumų ir skirtumų Lietuvoje, Latvijoje ir Estijoje tautinėms mažumoms suteiktose teisėse atskleidimas bei valstybių pažangos šioje srityje įvertinimas. Didžiausios problemos Baltijos valstybėse iškyla dėl išorinių tautinių mažumų, kaimyninėse valstybėse sudarančių daugumos visuomenę. Due of very different reasons, for example, changing of states borders or collapse of one state and emerging of other and many other political factors, a lot of people find home for them selves not in their ethnical countries. This way they become national minorities. It means, they are groups of peole living not in their home-land and they compound minority in that country. They differ from majority on their culture, languige, traditions and so on. Sometimes these people are discriminated by majority, even enslaved. Nowadays all means necessery for keeping they rights are taken, but not in every state. Not all nations behave with national minorities in the same way. Will Kymlicka explaines where is the difference between the Western democracy states and Eastern postcomunist states. The common model in the first ones – territorial autonomy and in the second ones – cultural autonomy. Now then they are members of EU the situation should change into the good – they must preserve all human rights including the rights of the ethnic minorities. Anyway, the civic rights of national minorities is still very controversial topic in the Baltic states. This determined choice of the theme of this paper. State transformation and European integration : the expression of rights (1990-2014)

This work examines the impact of European integration on modern European states, focusing in particular on the expression of civic, political, and social rights in these states. Without an accurate understanding of how integration has transformed states, those involved in the creation of state institutions--now and in the future--cannot hope to know how their societies will be affected by European integration, what role social voice will play in the governance process, and ultimately, how the European project might play-out. Understanding the effect of European integration on the lives of everyday citizens is the main impetus behind this research. This work aims to provide an objective assessment of the effects of European integration on state transformation and, subsequently, the expression of rights in modern Europe. This is accomplished through the examination of three case studies, each of which focuses on a different policy area. Overall, these case studies cover the time period 1990-2014. Operationalized, the research herein addresses the following question: How has being a member of the European Union or striving to join it changed states and specifically those areas linked to the expression of civic, political, and social rights? Additionally, this study tests a new theoretical construction of statehood--the Member State--so that, in the future, this construct might be used to better inform integration theories. This is all carried-out through statistical analyses that establish causal links for observed changes in the expression of civic, political, and social rights in Europe. The findings of the thesis suggest that the expression of civic and social rights have not been decreasing due to state transformation brought on by European integration, while the expression of political rights have been. Furthermore, this research finds support for the new theoretical construct of Member Statehood.

Honra no direito ático / Honor in Attic law

Esta dissertação aborda o Direito Ático por um prisma axiológico. Admite a influência dos valores na formulação de normas e institutos, e destaca um valor que considera como dos mais importantes na cultura grega dos séculos V e IV a.C., a saber, a honra. Uma primeira parte do trabalho se propõe a delimitar a honra, distinguindo seu uso em dois sentidos principais de: valor que se tem, e de fenômeno da percepção deste valor. Uma segunda parte demonstra a origem do apreço pela honra e pela excelência na poesia épica, esclarecendo depois que posição a honra ocupa na escala grega de valores. Trata-se ainda da guerra como local para o nascimento e consolidação dos significados de honra de que dispomos, e em seguida, aborda a tormentosa situação enfrentada por Drácon por conta da prática da vingança privada, destacando a vinculação desta ao restabelecimento da honra e comentado as características da lei de homicídio de Drácon. A terceira parte dedica-se a detalhado exame de três institutos jurídicos Áticos que têm na honra sua razão de ser: perda dos direitos civis, atimía; serviços ao povo de Atenas, liturgias; a tratamento e punição da hýbris. / The present work examines Attic Law through an axiological perspective. Admits the role of values in forming norms and juridical institutes, focusing in a special value considered to be one of the main forms of excellence in 5th and 4th century: honor. The first part of the work delimits honor, indicating two meanings for the term: a value that the subject has, and the perception of such a value by others. A second part demonstrates the origin of the greek concern with honor and excellence in Homer´s epic poetry, establishing a post for honor in greek axiological rankings. Identifies war as the birthplace of the meanings of honor we discussed, and analyzes the difficult social condition that Draco had to face in its time, related to private revenge, emphasizing it connection with the theme of honor and commenting Draco´s Homicide Law. The third part brings a detailed exam of three of attic law´s institutes related to honor: disenfranchisement, atimía; public service in Athens, liturgies; treatment and punishment of hýbris.

The teaching of civic education in Zambia : an examination of trends in the teaching of civic education in schools

This study focused on the teaching of Civic Education in Zambia. Specifically, the study examined pedagogical practices in relation to the teaching of Civic Education in schools. It is argued in this study that following right pedagogical practices in the teaching of Civic Education can lead to social change and transformation of society. As such, the purpose of the study was to ascertain therefore the extent to which Civic Education was enhancing or impeding social change and transformation in society. In order to realize the objectives of the study, an exploratory research design was used. The study found out that Civic Education in schools was not modelled on practices that can lead to social change and transformation of society; service learning approaches were rarely promoted in Civic Education lessons; teaching approaches in colleges and the university with respect to Civic Education are greatly lacking; teaching and learning materials in Civic Education were not readily available in schools; teachers of Civic Education were not grounded in the key theoretical and pedagogical perspectives underpinning Civic Education. The study therefore concludes that with correct pedagogical practices and approaches Civic Education can lead to social change and transformation of society. / Educational Foundations / D. Ed. This thesis presents and analyzes the media image of political programs of parties Christian and Democratic Union - Czechoslovak People's Party, Green Party, Party of Civic Rights - Zemanovci and Sovereignty after parliamentary elections in 2010 in programs of publice service media Czech Television and Czech Radio Political Spectrum and Twenty Minutes of Radiojournal. The theoretical part is introduced by description of the relationship between public service media and political sphere together with the different approaches to the study and exploration of public service media. There is a description of concepts of news coverage in the media public service generally as well specifically in the Czech Republic. This thesis also includes a description of management concepts of broadcasting public service media. Further more ale explained ideas of impartiality, objectivity and balance in public service media. The last area of theoretical part presented political programs of examined parties and surveyed programs. After the introduction of a methodology practical section contains a description of the results of the author's research. The final part of the thesis contains the interpretation of results and recommendations for further research.

This thesis presents and analyzes the media image of political programs of parties Christian and Democratic Union - Czechoslovak People's Party, Green Party, Party of Civic Rights - Zemanovci and Sovereignty after parliamentary elections in 2010 in Czech public service media - Czech Press Agency, Czech Television and Czech Radio. In the theoretical part of the thesis are presented political party programs in the period 2010-2013, and also briefly introduced Czech public service media, their historical development or their current position in the media world. The practical part contains an analysis of textual and audiovisual content of individual media in the selected time period and focuses on the search for mentions of individual program points. Minor, but for understanding the role of public service media is an important part that compares the situation of position Czech public service media with those from another countries. The practical part then also examines the situation in the Czech world media after parliamentary elections in 2013 and if there are any consequences based on these results. The text analyses the institutional/constitutional framework of the selection process for new justices, and exemplify changes in the profile of political players, in the network of competences of institutions involved in the process and in the social, political, economic and cultural context that pushed through the practical transformation of the institutional selection model without altering, however, the format originally established in the 19th Century. By mapping the origin and evolution of the constitutional formula for collaboration between the Executive and Legislative branches in choosing the members of the Judiciary’s highest court, the study finds the origin of the Brazilian model in the US experience, describing the latter and making parallels between the two. Taking the 1988 Constitution of the Federative Republic of Brazil as a milestone, the work demonstrates the even greater mobilization of political and social players concerning the selection process, especially in relation to the hearings and confirmation of appointments for the Federal Supreme Court by the Federal Senate Constitution, Justice and Civic Rights Commission (CCJ). Finally, the studies analyzes actual CCJ hearing sessions and some of the main discussions therein so as to draw lessons that may guide the debate on the evolution of the selection process of justices to the Federal Supreme Court , including as an early control tool used by those involved in the creation of future public policy through Federal Supreme Court decisions. / Partindo da constatação de que o Brasil acompanha hoje um fenômeno global de protagonismo das cortes supremas nas sociedades complexas contemporâneas, notadamente na criação de políticas-públicas e regulação, o estudo procura mapear a evolução – e progressiva democratização – de uma estrutura de freios e contrapesos prevista na Constituição da República Federativa do Brasil de 1988 ('Constituição'), qual seja, o processo de seleção dos ministros do Supremo Tribunal Federal. Ao longo do texto é analisada a arquitetura institucional e constitucional do processo de indicação e aprovação de novos ministros, bem como exemplificadas mudanças no perfil dos atores políticos, no plexo de competências das instituições envolvidas e no contexto social, político, econômico e cultural que forçaram a transformação prática do modelo de seleção institucional, sem alteração, no entanto, da formatação originalmente prevista desde o Século XIX. Mapeando a origem e evolução da fórmula constitucional de colaboração entre o Poder Executivo e o Poder Legislativo para a escolha dos membros da cúpula do Poder Judiciário, o estudo identifica a origem do modelo brasileiro na inspiração da experiência norte-americana, descrevendo esta e os paralelos possíveis com aquele. A partir do marco central da Constituição, o trabalho procura demonstrar uma progressiva mobilização de atores políticos e sociais em relação ao processo de escolha, notadamente em relação ao momento em que os indicados para o Supremo Tribunal Federal são sabatinados pela Comissão de Constituição, Justiça e Cidadania do Senado Federal. Finalmente, são analisadas concretamente as sabatinas e algumas das suas principais discussões, buscando extrair lições que sirvam de norte colaborativo para a evolução da forma de seleção dos ministros do Supremo Tribunal Federal, inclusive como instrumento de controle prévio de seus membros, futuros elaboradores de políticas-públicas.
