Learner's perceptions of discipline as management tool in school classrooms Thabo Mofutsanyana District, Free State Province

It has become obvious that a worldwide awareness of the quality of children’s behaviour and therefore also of learner-behaviour exist (Lewis, 2001:307). Moreover, according to Lee and Powell (2005:83), the whole of America has turned concerned interest towards the dilemmas that are associated with the troublesome behaviour of young people at schools. The purpose of this non-experimental, descriptive survey was to react to Gossen (in Lee & Powell, 2005:85) who advocates the restructuring of school discipline to create an atmosphere that would support learners in re-adjusting their behaviour. As a result, the main aim of this study is to examine how learner discipline can be managed in Thabo Mofutsanyana District as informed by the literature study and empirical survey. This aim is conceptualised into objectives and was achieved by investigating the nature of learner discipline, investigated how learner discipline in the Thabo Mofutsanyana District was managed. A quantitative method of gathering data was used in this study. According to Leedy and Omrod (2005:950, quantitative research methods are those that seek to objectively measure the variables of interest. To qualify and quantify the effects of learner’s perception on behavioural choices, this study offers a guide to the data collection and analysis, which provides useful information that is relevant to pre-service and practicing educators. For the purpose of this research, structured questionnaire was selected as a research tool. Tuckman (2008:230) explains the fact that questionnaires are used by researchers to convert information directly given by people into data. The findings suggest that classroom management has an impact on how learners learn and how educators manage learning in a classroom situation. Findings also suggested that by means of a classroom policy, an educator can use rules and procedures to regulate all aspects of the classroom environment and all the actions and behaviour within the classroom. Also, findings confirm that the following issues are pivotal to schools when developing classroom policy: a good classroom policy must clearly reflect the objectives (long-term) and aims (short-term) for which the class is striving, the policy should also be consistent, be acceptable to the majority, facilitate decision-making about certain matters and make provision for the class rules and procedure. In conclusion, an overview of the challenges identified by this research project, as well as the aspects in need of further research, is highlighted. / Educational Leadership and Management / M. Ed. Adolescents' perspectives of discipline problems at a secondary school in Gauteng

Problem behaviours amongst adolescent learners continue to affect the goals of effective education. The current study sought to investigate adolescents’ perspectives of discipline problems at a secondary school in Gauteng. A mixed method research design was followed during which questionnaires, focus groups and interviews directed the empirical investigation. The findings revealed two areas for addressing and improving the discipline problems of the secondary school, namely improving extrinsic factors and improving the current discipline system. Based on the findings, it was suggested that the school encourage greater parent involvement and improve parent-teacher communication. Creating a positive school identity and developing teachers further was proposed. An improved discipline system based on a positive learning approach was recommended. This included clarifying the discipline system to all role players, standardising discipline procedures throughout the school and improving follow up procedures regarding learner discipline. / Psychology of Education / M. Die bevindinge waartoe gekom is, dui pertinent daarop dat ar­ beids- en bestuursetiese-begeleiding as gevolg van verskeie de­ struktiewe invloede vanuit die tegnokratiese bestel teenswoordig nie meer so vanselfsprekend en toereikend geskied nie. Inteen­ deel, die eietydse bestuurder se begeleidingsopgawe word al moei­liker en al hoe meer gekompliseerd en in baie gevalle selfs on­moontlik. Hierdie toedrag van sake gee dan oak daartoe aanleiding dat die hedendaagse bestuurder in sy handel en wandel nie meer altyd be­ treffende "etiese kwessies" 'n onderskeid kan tref tussen wat "reg" en wat "verkeerd" is nie. Sodanige gebeure hou verreikende gevolge in vir die begeleideling (ondergeskikte) se toereikende arbeids- en bestuursetiese-volwassewording, aangesien die bestuurder ten spyte van sy begeleideling se ageinsnood aan etiese-begeleiding, nie daartoe instaat is om 'n nastrewenswaar­ digevoorbeeld van arbeids- en bestuursetiese-volwassenheid te kan stel nie. Arbeids- en bestuursetiese-volwassenheid kan derhalwe slegs be reik word aan die hand van die praktykwording van die normbeeld van arbeids- en bestuursetiese-volwassenheid. In organisasieverband geskied sodanige praktykwording deur die vestiging en insti­tusionalisering van 'n etiese kultuur met 'n etiese gedragskode wat as meet- en rigsnoer dien ten opsigte van etiese en morele kwessies. Deur middel van hierdie etiese gedragskode kan die kriteria vir 'n normbeeld van arbeids- en bestuursetiese-volwassenheid dan as norme binne die etiese kultuur van 'n bepaalde organisasie gevestig word. / The contents of this study represents an attempt to obtain a metabletic-andragogical perspective-grasp on the indisputable reality of an ever-changing labour- and management-milieu by penetrating to the radix of the problematic nature, regarding the labour- and managerial-ethical-agein occurrence. The resultant findings that were arrived at pertinently indicate that labour- and managerial-ethical-guidance is obviously at present not being sufficiently achieved as a result of various de­structive influences from within the technocratic dispensation. On the contrary, the present-day manager's guidance-role has become so much more difficult and complicated and in many cases even impossible. This state of affairs also gives rise to the fact that the modern-day manager cannot always distinguish the difference between what is "right" and "wrong" regarding "ethical issues" in his daily life. Such an occurrence has particularly far-reaching implications for the protege's (subordinate's) adequate labour­ and managerial-ethical-adulthood, since the manager, in spite of his protege's agein-need for ethical-guidance, is incapable of setting an example of labour- and managerial-ethical-adulthood worthy of emulation. Labour- and managerial-ethical-adulthood could therefore only be attained by putting into practice the norm-image of labour- and managerial-ethical-adulthood. In organisational-context such implementation occurs through the establishment and institutionalisation of an ethical-culture with an ethical code of conduct as criteria for evaluating ethical and moral issues. Country-Adjusted Motivation : A Conceptual Model, applied in the Context of Motivation of a Code of Conduct

Companies adopt codes of conduct to set minimum standards on ethical issues, minimums that suppliers must keep. Problems has been found by other researchers regarding suppliers motivation to comply to the code. This study develops a conceptual model for how motivation can be adjusted to different countries, depending on economic situation, politic stability and culture of the country.   Country-Adjusted Motivation is made  by shaping motivating in relation to the human need that dominates in the country and by using the national culture to colour motivation. The model is applied in the context of how to motivate suppliers to a code of conduct in different countries. The model Country-Adjusted Motivation could as well be applied to other multinational contexts, where strong motivation is needed.

Tredjelandsöverföring av personuppgifter: en jämförelse mellan artikel 45, artikel 46 och artikel 49 GDPR / Transfer of Personal Data to Third Countries: A Comparison Between Article 45, Article 46 and Article 49 GDPR

The introduction of algorithms has for companies led to new ways of marketing themselves. However, access to personal data is needed for a company to successfully use an algorithm, which means companies can trade with our personal data. Personal data is therefore no longer used solely for nonprofit purposes but has rather acquired a financial value. This has led to new challenges in terms of third country transfer of personal data, which requires legislation that can effectively protect personal data. Within the EU, the General Data Protection Legislation (GDPR) regulates how personal data can be transferred to a third country. Article 45 GDPR, which contains the first requirement for third country transfers, states that transfers are only permitted based on an adequacy decision issued by the Commission. On the basis, inter alia, of the annulment of the Safe Harbor decision, by the European Court of Justice, and the criticism that has been addressed towards the Privacy Shield decision, questions are raised if there are reason for companies to make third country transfers based on the alternative provisions in article 46 and article 49 GDPR. The aim of this thesis is to examine the possibilities of making third country transfers according to articles 45, 46 and 49 GDPR by making a comparison that has been made from an individual- and company perspective. The research questions have been focused on the content of the adequacy decisions concerning USA, Switzerland, Canada, Israel and Japan, a review of the legal basis for third country transfers stated in articles 46 and 49 GDPR, as well as benefits and drawbacks with applying the grounds set forth in articles 46 and 49 GDPR rather than applying an adequacy decision pursuant to article 45 GDPR. In conclusion, it may be noted that the adequacy decisions that have been discussed leave room for doubt in relation to the level of protection that is guaranteed in the GDPR. This gives reason for companies to consider application of article 46 and article 49 GDPR. There are several benefits and drawbacks with such considerations including the size of the company and its financial recourses affecting which appropriate safeguard in article 46 GDPR is the most suitable safeguard to use. Furthermore, the derogations in article 49 GDPR may, in theory and in practice, be very difficult to apply instead of article 45 and article 46 GDPR since the derogations focuses on specific situations and must be used restrictively. The findings in this thesis however leads to the conclusion that there are several reasons for companies to consider application of article 46 GDPR instead of article 45 GDPR.

Das übergeordnete Ziel der vorliegenden Arbeit ist es, ökonomische Gesichtspunkte konsequent in die Diskussion zu den Verhaltenspflichten des Vorstands während öffentlichen Übernahmeverfahren zu integrieren. Aus wohlfahrtstheoretischer Perspektive müssen hierbei die ökonomischen Funktionen des Markts für Unternehmenskontrolle umfassend Berücksichtigung finden. Das Instrumentarium der Ökonomischen Theorie des Rechts dient im Rahmen der Untersuchungen zum einen der positiven Analyse der diskutierten Ansätze zur Regelung der Verhaltenspflichten sowie der bestehenden Regelungen nach der EU-Übernahmerichtlinie (ÜRL) und dem WpÜG. Der normativen Variante der Ökonomischen Theorie des Rechts kommt insbesondere bei der Entwicklung von Regelungsalternativen zu den bestehenden Vorschriften bezüglich der Verhaltenspflichten nach dem WpÜG Bedeutung zu. Vor dem Hintergrund dieses übergeordneten Ziels verfolgt die Arbeit nach der umfassenden Darstellung der, mit der Regulierung des Verhaltens des Vorstands während des Übernahmeverfahrens verbundenen Regelungsprobleme aus juristischer und ökonomischer Perspektive zwei konkrete Ziele: die positive Wirkungsanalyse der bestehenden Regelungen nach der ÜRL und dem WpÜG sowie die Entwicklung einer Regelungsalternative auf nationaler Ebene. / The primary objective of the dissertation is to systematically integrate economic considerations into the discussion about the code of conduct for the board of directors during public takeovers. From a welfare theoretic perspective, the economic functions of the market for corporate control have to be taken into account in their entire scope. In this context the instruments of Law and Economics are used for a positive analysis of different approaches to regulate the code of conduct as well as the existing regulations of the EU Directive on Takeover Bids and the WpÜG. The normative approach of Law and Economics is particularly useful for developing regulatory alternatives to the existing code of conduct under the WpÜG. Based on a survey of the regulatory problems of public takeovers from an economic and legal perspective, the dissertation is perusing two objectives: a positive effect analysis of the impact of the existing rules of the EU Directive on Takeover Bids and the WpÜG as well as the formulation of an alternative concept for the code of conduct on the national level.

Compliance programs have grown since the early 1990s and evolved more formally into corporate institutional or enterprise-wide programs with the passage of the Sarbanes-Oxley Act of 2002. Formal institutional compliance programs are emerging in colleges and universities to assist in the management of the myriad of regulations and requirements placed on them by accrediting bodies, creditors, boards, donors, grantors, and federal and state regulators. An effective compliance program provides the structure for the institution and its employees to conduct operations ethically, with integrity, and in compliance with legal and regulatory requirements. The goals of this study were to identify organizational structures that assist large, public universities in effectively managing institutional compliance, the elements that shape these structures, and the benefits and limitations of those structures.

Jag har under detta arbete undersökt hur företaget MAD ELF ART kan arbeta med miljö och sociala aspekter i produktionen. Min uppgift har varit att lokalisera en materialleverantör och producent som kan arbeta med detta på bästa sätt.Under arbetets gång har jag kontaktat flera materialleverantörer och producenter och undersökt hur de jobbar med dessa aspekter. Samtidigt har jag även fördjupat mig i hur man kan ta hänsyn till miljö och sociala aspekter i produktionen, för att undersöka hur vi bäst kan arbeta med det.Vad jag kommit fram till är att materialvalet är det viktigaste och det som skiljer en produkt från att vara en miljöbov och en fara för människor till miljövänlig. Därför har jag i bilagan presenterat en leverantör och producent av materialet 100% silke som är ekologiskt färgad och handvävd. Silke lämnar inget energi-fotavtryck och går att återvinna. Jag tror och hoppas att framtiden kommer handla om att producera alltmer ekologiskt och samtidigt ta vara på det vi har istället för att producera nytt, detta genom ett återvinningssystem för textilier. Utvecklingen hos stora företag pekar även på att det i framtiden kommer att vara en självklarhet att ha uppförandekoder på fabriker och jobba med CSR. Därför är även det viktigt för MAD ELF ART.I have looked into how MAD ELF ART can work with environmental and social aspects during production. My assignment has been to find a materialsupplier and manufacturer who can work with this in the best way possible.During this work I have contacted several materialsuppliers and manufacturers and examined how they work with these aspects. At the same time I have also looked into how we can deal with social and environmental aspects to find the best way for us to work with this.I have come to the conclusion that the choice of material is the most important and what differs a product from being a danger for the environment and human beings to a environmental friend. Because of that I will present a materialsupplier and manufacturer who can provide the material 100% silk wich is organically dyed and handwoven. Silk leaves no energy-footprint and is recycable. I believe that the future will have more focus on the environment and that we will work with more ecologic materials and instead of producing new products, we will recycle what we have through a recyclingsystem for textiles. Os resultados fornecem evidências preliminares de que o background institucional destes gestores pode impedir que eles percebam quando não cumprem as práticas de sustentabilidade da empresa compradora (focal) e de que certas configurações da cadeia de suprimentos influenciam a propensão a não cumprir as políticas de sustentabilidade da empresa focal. A generalização destes resultados é limitada devido à metodologia experimental utilizada. / Based on institutional theory and social cognitive theory, a discrete-choice experiment was conducted with 128 American, 105 Brazilian and 109 Indian managers to test three alternative causes of suppliers’ non-compliance with supply chain focal company’s sustainability practices. Results provide preliminary evidence to support that managers’ institutional background may prevent them from perceiving their non-compliance with buyer (focal) company’s sustainability practices and that certain supply chain configurations influence their likelihood not to comply with focal company’s sustainability policies. Generalization of such findings is limited because of the experimental methodology used.
