The practicing of the Constituent Power is the manifestation of the political power which belongs to the People, who relies on the State the power for regulating social relations, limiting its acting in order to assure fundamental rights, by using the ruling established in the Constitution. The objective of this study was analyzing the Constituent Power, in order to reveal its nature, its rationale, so that its identity can be defined allowing the analysis of a few interesting points about its reach. Considering that this study aimed at discovering the essence of the Constituent Power, concepts of Philosophy, Law, power, Constitution and Constitutional State were also investigated, enlarging the comprehension of what actually is the Constituent Power and the analysis of its manifestation, by using a zetetic (philosophical) focus, based on research of issues related to Law, Sociology, Politics, Economy and History. As consequence of the studies carried out, it became possible to realize that the power is characterized by the presence of an authority and of a hierarchic relation, due to which its withholder can grant his will to be fulfilled voluntarily by his addressees, being strongly related to matters of sovereignty and legitimacy. The Constitution is a set of juridical ruling responsible for the formation of the State, limiting the practice of the political power and assuring the fundamental rights of a person. It is the fundamental rule, featured of supremacy, which is positioned on the most elevated spot of the legal system, granting validity to any other juridical rules. The Constitutional State is an outgrowth of the elaboration of its Constitution by the Constituent Power, being conceived as a historical means for organizing political power, before a given society, in a given territory, in a given moment. As for the essence of the Constituent Power, it was identified as a political will which acts over a determined social structure, either in the practice of elaborating the Constitution of a country (Original), or in the elaboration of a Constitution of a State Member of a Federation (Resulting Derivative), or yet in the reformulation of the constitutional text (Resulting Reformer). The theory of the Constituent Power has been developed based on the manifest of Emmanuel Sieyès ( What is the Third Estate? ), which grants its title to the nation, with power to create the Constitution of a country / O Poder Constituinte é uma figura misteriosa e intrigante, pois desperta a curiosidade sobre o exercício de um poder responsável pela elaboração de uma Constituição, que institui o Estado Constitucional e cria o ordenamento jurídico de um país. O exercício do Poder Constituinte é a manifestação do poder político, de titularidade do povo, que confere ao Estado a prerrogativa de disciplinar as relações sociais, limitando sua atuação, para segurança dos direitos fundamentais, por meio de normas presentes na Constituição. O objetivo do estudo foi analisar o Poder Constituinte, a fim de descobrir qual é a sua natureza, a sua razão de existência, para lhe conferir uma identidade que permita a avaliação de algumas questões interessantes sobre sua atuação. Considerando que o estudo teve por finalidade descobrir a essência do Poder Constituinte, foram apreciados os conceitos de essência, Filosofia, Direito, Poder, Constituição e Estado Constitucional, permitindo a compreensão do que é o Poder Constituinte e a análise de sua manifestação, valendo-se de um enfoque zetético (filosófico), com base em pesquisas de questões de ordem jurídica, sociológica, política, econômica, filosófica e histórica. Pelos estudos realizados, percebe-se que o poder é caracterizado pela presença de uma autoridade e uma relação hierárquica, mediante a qual o seu detentor consegue que sua vontade seja respeitada voluntariamente pelos seus destinatários, estando intimamente relacionado às questões de soberania e legitimidade. A Constituição é o conjunto de normas jurídicas responsáveis pela formação do Estado, limitando o exercício do poder político e assegurando os direitos fundamentais da pessoa humana. É a norma fundamental, dotada de supremacia, posicionada no lugar mais elevado do ordenamento jurídico, conferindo validade às demais normas jurídicas. O Estado Constitucional é fruto da elaboração dessa Constituição pelo Poder Constituinte, sendo concebido como uma forma histórica de organização do poder político, diante de determinada sociedade, num dado território e em um momento específico. Quanto à essência do Poder Constituinte, identificou-se tratar de uma vontade política que atua sobre determinada estrutura social, seja no exercício de elaborar a Constituição de um país (Originário), seja na elaboração de Constituições dos Estados-membros de uma Federação (Decorrente Derivado), seja na reforma do texto constitucional (Decorrente Reformador). Limitações ao poder de reforma constitucional na Constituição Federal de 1988 / Amending process limitations in the Brazilian constitution

A Constituição é produto do Poder Constituinte. Após a elaboração e edição da Constituição, o Poder Constituinte continua a existir em estado de latência. Contudo, a Constituição, como norma jurídica que é, necessita ser adaptada à realidade social cambiante, caso contrário não será apta a reger a vida da sociedade e do Estado e terá de ser substituída pela ação revolucionária do Poder Constituinte. Assim, o Poder Constituinte incumbe um órgão ou um complexo de órgãos da reforma da Constituição, o qual, contudo, com ele não se confunde. Como o Poder de Reforma Constitucional é um poder instituído, sujeita-se às regras impostas pelo Poder Constituinte, que o cria, e, entre estas regras, encontram-se as limitações à reforma da Constituição. Certa doutrina rejeita as limitações à reforma da Constituição, pela impossibilidade de uma geração vincular as gerações futuras; outra parte defende a superação das limitações por um processo de dupla revisão; finalmente, uma terceira corrente defende as limitações alicerçando-as em três argumentos principais: o precompromentimento constitucional, o dualismo democrático e a defesa da democracia e dos direitos humanos. A Constituição Federal de 1988 prevê quatro espécies de limitações à reforma da Constituição: material, formal, circunstancial e temporal. Os maiores questionamentos, contudo, apresentam-se em relação às limitações materiais, que formam o núcleo intangível da Constituição. Para a garantia de existência de limitações, a reforma da Constituição sujeita-se ao controle de constitucionalidade por parte do Supremo Tribunal Federal. / The Constitution is a product of Constituent Power. After elaborating the Constitution, the Constituent power remains asleep. Nevertheless, the Constitution, as a law, necessits to be adjusted to the social reality or will not be able to rule the live of the State and the society and will be replaced by the Constituent Power revoluctionary action. Therefore, the Constituent Power imputes to an Assembly the function of amending the Constitution; however, both of them are not the same phenomenon. The power of amending the Constitution is created by the Constituent Power and consequently is submited to the limitations established. Some authors refuse the limitations of amending process, because the generation can not bind the future generations; others support the possibility to overcome the limitations by a double amending process; finaly, there is a tendency to defend the limitations presenting three mainly arguments: constitutional precommitment, dualist democracy and the defense of the democracy and the human rights. The Brazilian Constitution ordains four sorts of limitations: substantial, formal, circunstantial and temporal. The deepest disagreement refer to the substantial limitations that obstruct the reform of the Constitution nucleus. To guarantee the existence of the limitations, the amending process submits to the control by the Supreme Court.

O objetivo desse trabalho é analisar os projetos de cidadania diferenciada de negros e de indígenas no contexto da Assembleia Nacional Constituinte de 1987-88, uma vez que ambos os grupos tensionam a questão da igualdade e da diferença no debate político e teórico sobre cidadania. Para tanto, realizamos uma reconstrução histórica da mobilização política desses grupos até o momento da Constituinte e, adentrando a ANC de 1987-88 por meio dos seus diários de reuniões, demos voz às lideranças dos dois grupos. A partir disso, compreendemos os níveis que compõem os projetos de cidadania diferenciada e demonstramos a dificuldade imposta à antecipação teórica da justiça em relação à cidadania diferenciada. / This work analyzes blacks and indians differentiated citizenship projects in the National Constituent Assembly context of 1987-88, considering that both groups cause tension in the theme of equality and difference in the political and theoretical debate of citizenship. Therefore, we carry out a historical review of these groups political mobilization until the moment of the Constituent Assembly and, into de NCA of 1987-88, with its journals of meeting, we gave voice to both groups leaders. From this, we understand the levels that compose differentiated citizenship projects and we demonstrate the difficulties imposed to theoretical anticipation of justice regarding differentiated citizenship.

Os aços para tubos API 5L X80 são aços de alta resistência e baixa liga (ARBL) usados na fabricação de tubos para o transporte de gás e petróleo conduzidos através de dutos. Os tubos API 5L X80 se caracterizam por terem excelentes propriedades mecânicas como resistência à tração, tenacidade, ductilidade e resistência à corrosão, além de boa soldabilidade. Estes tubos trazem muitos benefícios como, por exemplo, o fator econômico já que ao ter boa resistência mecânica estes tubos podem ser fabricados com espessuras de parede menores. Estas reduções nas espessuras diminuem os custos de transporte, construção, soldagem e instalação. Além disso, estes tubos podem ser fabricados com grandes diâmetros, permitindo o transporte de grandes quantidades de fluidos a elevadas pressões e vazões. A tenacidade confere ao material a propriedade de ser resistente à fratura frágil, uma vez que estes tubos em sua maioria trabalham em condições ambientais severas. O objetivo deste trabalho é simular fisicamente e estudar as propriedades mecânicas de regiões da zona afetada pelo calor (ZAC) produzidas por diferentes ciclos térmicos, que ocorrem quando o tubo é fabricado e o duto montado. A ideia foi estudar a ZAC produzida no tubo fabricado pelo processo UOE (solda longitudinal) e a solda feita no campo quando o tubo é montado (solda circunferencial) além da ZAC na intersecção entre a soldagem longitudinal e circunferencial. Foram usinados corpos-de-prova nas orientações L-T e T-L e com o cordão de solda longitudinal do tubo no centro. Estes corpos-de-prova foram submetidos a quatro ciclos térmicos únicos com temperaturas máximas de 650, 800, 950 e 1300 °C e ciclos térmicos multipasse 950-800 e 950-800- 650 °C. Estes corpos-de-prova foram submetidos a diferentes ensaios e caracterizações. Foram feitos ensaios de impacto a 0 °C, as superfícies fraturadas foram analisadas no MEV e mediu-se a expansão lateral produzida pelo ensaio de impacto. Mediu-se a dureza da microestrutura por meio do ensaio Vickers com 300g de carga. A microestrutura da ZAC foi caracterizada por microscopia óptica, com ataque convencional e ataque colorido Klemm, e microscopia eletrônica de varredura. Metalografia quantitativa foi usada para obter a quantidade de perlita na matriz dos corpos-de-prova. A trajetória da fratura na microestrutura dos corpos-de-prova simulados, provocada pelo ensaio Charpy, foi analisada com microscopia óptica e eletrônica de varredura. Os resultados mostraram que as energias absorvidas no ensaio de impacto pelos corpos-de-prova simulados cumprem com os requisitos exigidos pela norma API 5L para o metal base sem simulação e que as microestruturas observadas variam segundo o tipo de ciclo térmico aplicado a cada posição do tubo. / API 5L Grade X80 steel are high strength low alloy steels (HSLA) used in the manufacture of pipes for transporting oil and gas by pipelines. API 5L X80 pipes are characterized by having excellent mechanical properties such as tensile strength, toughness, ductility, corrosion resistance, and good weldability. These pipes bring many benefits, for example, the economic factor related to the good mechanical strength of these tubes which can be produced with smaller wall thicknesses. This reduction in thickness lowers costs for transportation, construction, welding and installation. In addition, these tubes can be fabricated with large diameters, allowing the transport of large amounts of fluids at high pressures and flow rates. The toughness gives, to this material, the characteristic of being resistant to brittle fracture, since these tubes mostly work in aggressive environmental conditions. The objective of this work is to physically simulate and study the mechanical properties of regions of the heat affected zone (HAZ) produced by different thermal cycles, which occur when the duct pipe is manufactured and assembled. The idea was to study the HAZ produced in the pipe manufactured by the UOE process (longitudinal weld) and the welding done in the field when the tube is mounted (HAZ beyond the intersection between the longitudinal and circumferential welding). Charpy V samples were machined in the L-T and T-L orientations and in the longitudinal weld in the center of the tube. These samples were subjected to single thermal cycles with maximum temperatures of 650, 800, 950 and 1300°C and multipass thermal cycling with maximum temperatures of 950-800 and 950-800-650°C. The samples were subjected to different tests and characterizations. Impact tests were made at 0°C, measured the lateral expansion produced and the surface fracture were examined under SEM. Vickers 300g microhardness was also measured in the simulated HAZ region. The microstructure of the HAZ was characterized by optical microscopy with conventional etching and Klemm colorful etching, and scanning electron microscopy. Quantitative metallography was used to obtain the amount of pearlite in the matrix of samples. The Charpy V fracture propagation path trajectory in the simulated microstructure was analyzed with optical microscopy and scanning electron microscopy. The results showed that the Charpy V absorbed energy by the simulated samples complies with the requirements of the API 5L standard for the base metal without simulation and the HAZ observed microstructures vary according to the thermal cycle type applied to each tube position.

Ele foi eleito como deputado pelo Partido Comunista do Brasil e em seu exercício parlamentar participou das principais comissões para a elaboração da Constituição do Estado de São Paulo. Por outro lado, abordaremos sua atuação parlamentar após a promulgação da Constituição Estadual de São Paulo de 1947. Desta destacamos sua defesa em prol da liberdade de expressão, garantida na Carta Magna Federal de 1946, bem como a elaboração de projetos de lei que colaboraram para o desenvolvimento da pesquisa em nosso país. / In this work we present a view of Caio Prado Juniors performance as a representative in the constituent assembly of the legislative body of São Paulo State in 1947. Therefore, based on the theoretical perspective that considers the text as a place of interaction of active, dialogically constituted subjects which reconstruct the senses using linguistic clues and also based in the studies of Theory of Argumentation by Perelman and Obbrechts-Tyteca (1996) and in the Enunciation by Benveniste (1995), I argue that these reflections presume that the exploitation of those constituent processes of argumentation and of rhetorical figures in the speech of this sacred and exceptional orator are essential and effective strategies for the construction of religious speech, capable of convincing and persuading the community to live Gospel`s words much more than just explaining Them. As object of study, we have chosen randomly some chapters from this work whose theme is expressed by a metaphor, preaching is sowing. The analysis of some topics like the discursive parts, the audience importance, the rhetorical figures and the linguistic resources has enabled us to check the use of argumentative strategies by the orator in order to produce sense effects for persuasive purposes. Besides contributing to religious people concerning the preparation of their speeches, we also hope to add our reflections about the studies of Rhetoric Argumentation to the already existing ones. / A partir do princípio de que uma argumentação eficaz resulta no assentimento do auditório, na sua predisposição para a ação, o tema do nosso trabalho tem como questão norteadora demonstrar que o processo argumentativo no Sermão da Sexagésima é um procedimento fundamental da oratória de Padre António Vieira, e pode servir de ensinamento para os pregadores da palavra divina. Assim, ancorada na perspectiva teórica que considera o texto lugar de interação de sujeitos dialogicamente constituídos, ativos, que (re) constroem os sentidos a partir das pistas linguísticas e nos estudos da Teoria da Argumentação abordados por Perelman e Olbrechts-Tyteca (1996) e nos da Enunciação abordados por Benveniste (1995), estas reflexões têm como pressuposto que a exploração desses processos constituintes de argumentação e das figuras de retórica, que povoam o discurso desse pregador sacro singular, são estratégias fundamentais e eficazes para a construção do discurso religioso, capaz de muito mais que explicar o Evangelho convencer e persuadir a comunidade a viver a palavra proferida Nele. Como objeto de estudo, escolhemos aleatoriamente alguns capítulos que compõem essa obra cujo tema é expresso por uma metáfora: Pregar é semear. A análise das partes discursivas, da relevância do auditório, das figuras retóricas e dos recursos linguísticos possibilitou verificar o uso de estratégias argumentativas do orador para a produção de efeitos de sentido com o objetivo de exercer um fazer persuasivo no auditório. Além de contribuir com os estudiosos do discurso religioso, esperamos também somar as nossas reflexões às já existentes sobre os estudos da Argumentação Retórica.

A MICROSTRUCTURE-BASED MODEL VALIDATED EXPERIMENTALLY FOR QUANTIFICATION OF SHORT FATIGUE CRACK GROWTH IN THREE-DIMENSIONS

Built on the recent successes in understanding the crystallographic mechanism for short fatigue crack (SFC) growth across a grain boundary (GB) and developing an experimental method to quantify the GB resistance against short crack growth, a microstructure-based model was developed in this study to simulate the growth behaviors of SFCs in 3-D, by taking into account both the driving force and resistance along at each point along the crack front in an alloy. It was found that the GB resistance was a Weibull function of the minimum twist angle of crack deflection at the boundary in AA2024-T3 Al alloys. In the digital microstructure used in the model, the resistance at each GB that the short crack interacted with could be calculated, as long as the orientations of grains and the crack were known. In the model, an influence function accounting for the overlapping effect of the resistance from the neighboring grain boundaries was proposed, allowing for calculation of the total resistance distribution along the crack front. In order to overcome the time consuming problem for the existing equations to derive the distribution of stress intensity factor along the crack front under cyclic loading, an analytical equation was proposed to quantify the stress intensity factor distribution along an irregular shape planar crack. By introducing two shape-dependent factors, the fractured area and the perimeter of the crack front, the newly proposed equation could readily and accurately derive the stress intensity factor distribution along the crack front that had large curvatures and singularities. Finally, a microscopic-scale Paris’ equation was proposed that took into account both the driving force, i.e., stress intensity factor range, and the total resistance to calculate the growth rate at each point along crack front. The model developed in this work was able to incorporate microstructure, such as grain size and shape, and texture into simulation of SFC growth in 3-D. It was capable of simulating all the anomalous growth behaviors of SFCs, such as the marked scatters in growth rate measurement, retardation and arrest at grain boundaries, and crack plane deflection at grain boundaries, etc. The model was used to simulate the growth behaviors of SFCs initiated from prefractured constituent particles in order to interpret the multi-site fatigue crack initiation observed in AA2024-T351 Al alloys. Three types of SFCs were observed initiating from these particles, namely, type-I non-propagating cracks; type-II cracks which were arrested soon after propagating into the matrix; and type-III propagating cracks. To quantitatively study the 3-D effects of particle geometry and micro-texture on the growth behaviors of micro-cracks in these particles, rectangular micro-notches with different dimensions were fabricated using focused ion beam in the selected grains on the T-S planes in AA2024-T351 Al alloys, to mimic the pre-fractured particles in these alloys. Knowing the notch dimensions or particle shape, grain orientation and GB geometry, the simulated crack growth behaviors were consistent with the experimental observations, and the model was able to verify that the three types of cracks evolved from these particles were mainly associated with the thickness and width of the pre-fractured particles, though the particle geometry and grain orientation could also affect the behaviors of fatigue crack initiation at the particles. When the widths of the particles were less than 15 μm, like in most high strength Al alloys, the simulated results confirmed that the crack type was only associated with the particle thickness, consistent with the experimental results in AA2024-T351 alloys with a strong rolling texture. The lives for the SFCs to reach 0.5 mm in length were quantified with the model in the AA2024 alloy, revealing that there was a bimodal distribution in the life spectrum calculated, with the longer life peak being related to larger twist angles of crack deflection at the first GB the cracks encountered and the shorter life peak being associated with small twist angles (< 5°) at the first GB. The model further demonstrated the influence of grain structure on SFC growth by considering two different grain structures with the same initial short crack, namely, a layered grain structure with only the primary GBs perpendicular to the surface and the layered grains with both primary and secondary GBs. Depending on their positions and geometry, the secondary GBs could still exert a strong retarding effect on SFC growth on surface. The model was validated by matching to the growth rate measured on surface of a SFC in an AA8090 Al-Li alloy. Good consistency was achieved between the simulated and experimentally measured growth rates when both the primary and secondary GBs were considered in the model. The model developed in this study exhibits its potential applications to optimizing the microstructure and texture in alloys to enhance their fatigue resistance against fatigue crack growth, and to satisfactory life prediction of engineering alloys.

Experimental and Modelling Studies on the Spreading of Non-Aqueous Phase Liquids in Heterogeneous Media / Spridning av flerfasföroreningar i heterogen mark : Studier med experiment och modellering

Non-Aqueous Phase Liquids (NAPLs) include commonly occurring organic contaminants such as gasoline, diesel fuel and chlorinated solvents. When released to subsurface environments their spreading is a complex process of multi-component, multi-phase flow. This work has strived to develop new models and methods to describe the spreading of NAPLs in heterogeneous geological media. For two-phase systems, infiltration and immobilisation of NAPL in stochastically heterogeneous, water-saturated media were investigated. First, a methodology to continuously measure NAPL saturations in space and time in a two-dimensional experiment setup, using multiple-energy x-ray-attenuation techniques, was developed. Second, a set of experiments on NAPL infiltration in carefully designed structures of well-known stochastic heterogeneity were conducted. Three detailed data-sets were generated and the importance of heterogeneity for both flow and the immobilised NAPL architecture was demonstrated. Third, the laboratory experiments were modelled with a continuum- and Darcy’s-law-based multi-phase flow model. Different models for the capillary pressure (Pc) – fluid saturation (S) – relative permeability (kr) constitutive relations were compared and tested against experimental observations. A method to account for NAPL immobility in dead-end pore-spaces during drainage was introduced and the importance of accounting for hysteresis and NAPL entrapment in the constitutive relations was demonstrated. NAPL migration in three-phase, water-NAPL-air systems was also studied. Different constitutive relations used in modelling of three-phase flow were analysed and compared to existing laboratory data. To improve model performance, a new formulation for the saturation dependence of tortuosity was introduced and different scaling options for the Pc-S relations were investigated. Finally, a method to model the spreading of multi-constituent contaminants using a single-component multi-phase model was developed. With the method, the migration behaviour of individual constituents in a mixture, e.g. benzene in gasoline, could be studied, which was demonstrated in a modelling study of a gasoline spill in connection with a transport accident. / Flerfasföroreningar innefattar vanligt förekommande organiska vätskor som bensin, dieselolja och klorerade lösningsmedel. Spridningen av dessa föroreningar i mark är komplicerad och styrs av det samtidiga flödet av organisk vätska, vatten och markluft samt utbytet av komponenter (föroreningar) mellan de olika faserna. Detta arbete syftade till att utveckla nya metoder och modeller för att studera spridningen av flerfasföroreningar i mark: (i) En metodik utvecklades för att i laboratorium noggrant och kontinuerligt mäta hur en organisk vätska är rumsligt fördelad i en tvådimensionell experimentuppställning. Metoden baserades på röntgenutsläckning för olika energinivåer. (ii) Infiltration av organisk vätska i vattenmättade medier studerades för olika konfigurationer av geologisk heterogenitet. I experimentuppställningen packades olika sandmaterial noggrant för att konstruera en välkänd, stokastiskt heterogen struktur. Spridningsprocessen dokumenterades i tre detaljerade mätserier och heterogenitetens påverkan på flöde och kvarhållning av den organiska vätskan påvisades. (iii) Experimenten simulerades med en numerisk modell. Olika modeller prövades för att beskriva de grundläggande relationerna mellan kapillärtryck (Pc) vätskehalt (S) och relativ permeabilitet (kr) för detta tvåfassystem av vatten och organisk vätska. En relation infördes för att beskriva partiell orörlighet hos den organiska vätskan i porer vars halsar tillfälligt blockeras av vatten då mediet avvattnas. Vikten av att i de grundläggande relationerna ta hänsyn till hysteresis och kvarhållning av organisk fas visades. (iv) Olika Pc-S-kr relationer för trefassystem av vatten, organisk vätska och markluft testades mot befintliga experimentella data. En ny relation för hur slingrigheten (eng. tortuosity) beror av vätskehalten infördes i kr-S relationen och olika möjligheter för att skala Pc-S relationen analyserades. (v) En modelleringsmetodik utvecklades för att studera spridningen av flerkomponentsföroreningar. Med metoden kunde spridningsbeteendet hos enskilda, särskilt skadliga komponenter som t.ex. bensen särskiljas då ett bensinutsläpp i samband med en transportolycka simulerades.

The Impacts of Index Futures on Stock Market in China

After a long-time preparation, CSI 300 index futures has made a milestone in the financial market in China in the 16 of April, 2010. In order to know what kind of impact will bring to stock market after the appearance of stock index future, the study discusses volatility and volume separately. On one hand, the study applies Modified Levene and GJR-GARCH as the empirical model, and the result indicates that stock return fluctuation is a short-term phenomenon. However, the result shows that the stock return volatility has no difference in the long-run. Furthermore, it not only reduces the asymmetric return fluctuation from good and bad news cause but improve the information efficiency in the spot market after the introduction of the stock index futures. On the other hand, the study applies multiple regression model and panel model to examine the crowding-out effect and the volume difference after the stock index futures enters the market. First, there is no crowding-out effect in the stock market. Second, both the trading volume of the constituent and non-constituent stocks increase after the introduction of the stock index futures, whereas the level of increasing trading volume of the constituent stocks is larger than non- constituent stocks are.
