Bedienstete Internationaler Organisationen stehen in einem speziellen Rechtsverhältnis zu ihrem Arbeitgeber, das ihnen ermöglicht, belastende Maßnahmen von speziell für Personalrechtsangelegenheiten errichteten internationalen Verwaltungsgerichten (Administrative Tribunals) überprüfen zu lassen. Anläßlich einer konkreten Streitigkeit (ESA) um Gehaltskürzungen befaßt sich der Beitrag sowohl mit prozeduralen als auch mit materiell-rechtlichen Fragenstellungen und erörtert, wie weit hier bereits allgemeine Rechtsgrundsätze existieren.

Die Rolle des „Koordinationsstaates“ beim Schutz des Unterwasserkulturerbes: Eine Analyse des kooperativen Jurisdiktionsregimes in der UNESCO-Konvention zum Schutz des Unterwasserkulturerbes (2001) unter Einschluss relevanter Staatenpraxis

Der vorliegende Aufsatz bewertet die Auswirkungen, die das Koordinationsstaatssystem auf die Behandlung des unterseeischen Kulturerbes fast zehn Jahre nach seinem Inkrafttreten hat. Der Artikel bietet in diesem Zusammenhang eine erste Analyse der relevanten staatlichen Praxis zum Koordinationsstaatsprinzip. Insgesamt sechs untersuchte Fälle, darunter die berühmte Titanic und die derzeit umstrittene San José, belegen, dass das Regime des Koordinationstaates noch keinen höheren Schutzstandard für das Kulturerbe unter Wasser etablieren konnte. Einerseits werden so in der Arbeit allgemeine Auswirkungen der Vertragsgestaltung, wie z.B. die Miss-achtung privater Interessengruppen und Elemente der Bürokratie, identifiziert. Andererseits wird die Unzufriedenheit einiger Vertragsstaaten mit den relevanten kooperativen Zuständigkeitsvor-schriften aufgezeigt und bewertet. All dies unterstreicht die Notwendigkeit einer Reform des Übereinkommens, insb. unter Beachtung des Entwurfs der 'Ratification and Implementation Strategy' des sechsten Treffens der Vertragsstaaten (Paris 2017). Um einen praktikablen Re-formvorschlag zu unterbreiten, evaluieren die Autoren die potenzielle Vorbildwirkung bereits bestehender Systeme geteilter Jurisdiktion. Abschließend wird vorgeschlagen, den Wissen-schaftlich-Technischen Beirat (STAB) des Übereinkommens zu stärken, d.h. ihm die Kompe-tenz zur Identifizierung des Unterwasserkulturerbes, der Notifizierung von Vertragsstaaten mit nachweisbarer Verbindung zum Kulturerbe sowie der Ergreifung von Notfallmaßnahmen zu übertragen. Die unterbreiteten Vorschläge stehen nicht nur im Einklang mit den Missionen, die der STAB bereits zur Unterstützung von Staatsparteien entsandt hat, sondern auch mit Vorüber-legungen zur Stärkung der Unterstützung und Finanzierung des STAB im Rahmen des oben genannten Entwurfs einer Ratifikations- und Implementierungsstrategie. Bei erfolgreicher An-wendung könnte dies die Popularität des Koordinationstaates über das internationale Seerecht hinaus potenziell erhöhen. / The article at hand concerns itself with evaluating the impact the State Cooperation System has had on how underwater cultural heritage is dealt with in international waters. A total of six researched cases, including the infamous Titanic and the currently controversial San José, attest that the notion of the Coordinating State has yet to deliver a higher standard of protection for cultural assets underwater. On the one hand, generic ramifications caused by the superficial configuration of the treaty, such as disregarding private stakeholders and elements of bureaucracy, are identified. On the other hand, the discontent with cooperative jurisdictional provisions seems to be omnipresent. This affirms the need for reforming the convention itself, even in consideration of the sixth Meeting of State Parties’ Draft Ratification and Implementation Strategy. In order to provide a workable proposal for reform, the authors acknowledge the potential role model effect of existing systems of shared jurisdiction. In conclusion, it is suggested to upgrade the convention’s Scientific and Technical Advisory Body (STAB) and assign it the identification of underwater cultural heritage, notifying state parties with a verifiable link to the heritage site as well as taking emergency measures. This is consistent with missions the STAB has already deployed to assist state parties on-site and preliminary deliberations to strengthen the support and funding of the STAB in the aforementioned Draft Ratification and Implementation Strategy.

The Politics of Community Development: A History of the Bedford-Stuyvesant Restoration Corporation

This dissertation explores the nearly fifty-year history of the Bedford-Stuyvesant Restoration Corporation (BSRC), the nation's first federally funded community development corporation (CDC). The BSRC's creation stemmed from the bottom-up initiatives of African American women in the Central Brooklyn Coordinating Council (CBCC), a federation of more than one hundred community groups aided by city planners at Pratt Institute. Their seminal efforts at rehabilitating Bedford-Stuyvesant marked a transition in the Civil Rights-Black Power Movement's confrontation of discriminatory practices, municipal neglect, and the pathologies of poverty and urban decay. These efforts attracted the attention and commitment of Senators Robert F. Kennedy and Jacob K. Javits, who recruited business and philanthropic leaders to the cause and secured the initial funding to launch Restoration in December 1966. Together these partners in renewal forged a public-private partnership at a time when black and white Americans were moving farther apart. Together they articulated a new definition of community in which the combination of mutual responsibility and the strength of the American business system provided the means to turn poor neighborhoods into engines of renewal. They created an intermediary level of American governance that was more responsive to the needs of local people and placed new resources at the disposal of community leaders. The BSRC was the innovative product of a "creative federalism" that coordinated the power of the federal government, philanthropies, labor unions, universities, and the private enterprise system. This comprehensive organizational history investigates the full spectrum of the BSRC's comprehensive physical, economic, social, and cultural redevelopment agenda. Building on the concept that the 'process is the product' Restoration's successes and failures demonstrate how capacity was built in one of the nation's most challenged communities. After a decade of impressive accomplishments, Restoration was forced to retreat and reevaluate its mission as successive conservative presidential administrations withdrew the federal support that once largely sustained the corporation. The 1980s served as a crucible in which Restoration reinvented itself in order to survive. The new structure underscored the importance of communal ties, profitable sustainability, and nimble leadership that could move from "the streets to the suites." As it emerged from the challenges of the 1980s, Restoration was no longer the movement's North Star, but rather another point of light in a competitive constellation of more than 4,500 CDCs. In 2014, Restoration continues to balance the weight of its historic mission to provide comprehensive community development in a neighborhood that is undergoing rapid change. While poverty remains a fact of life for many of the area's minority residents, gentrification brings new challenges and opportunities to create a collaborative community that steps beyond the boundaries of race and class to build a better Bedford-Stuyvesant. / History

These characteristics were used to eventually appraise the issues and trends underlying the shaping of Black perspectives on education in South Africa. This study has revealed that the shaping of Black perspectives on education in South Africa goes hand in hand with the growing realization among Blacks that education is not merely a political issue but also deeply imbedded in the interconnectedness and/or differences between social realities such as the church, the school itself, teachers' associations, the news media et cetera. The aim is to investigate connecting words in spoken and written language, their use in text and links with other words, compare the use of the coupling term in written and spoken Czech language. Theoretical basis for master's thesis is based on several works which are devoted to this issue, either in whole or in dealing with some of its parts. But the major outline of work is driven by the Czech National Corpus (hereafter CNC), namely the corpora SYN2005 and ORAL2008. First chapter deals with CNC and coupling expressions in general, second deals with secondary linking conjunctions, their use in text types and surrounding words. The content of the third chapter incorporates the connecting conjunctions.
