This thesis is aimed at the current issues of juvenile justice system, especially the educational measures. The center of attention is the youths responsibility for their illegal acts, alternative process and measures, which are set up against the delinquents. Statistics show how the criminality of young people appears at present and what sanctions are taken against them. The main focus is aimed at the educational measures, which are specific to the type of sanctions imposed on young delinquents. The practical part shows the description of sample cases, where educational measures were imposed on young people. In conclusion is a recommendation and some incentives how to improve the current situation in juvenile justice system.

Comics, crime, and the moral self : an interdisciplinary study of criminal identity

An ethical understanding of responsibility should entail a richly qualitative comprehension of the links between embodied, unique individuals and their lived realities of behaviour. Criminal responsibility theory broadly adheres to ‘rational choice’ models of the moral self which subsume individuals’ emotionally embodied dimensions under the general direction of their rational will and abstracts their behaviour from corporeal reality. Linking individuals with their behaviour based only on such understandings of ‘rational choice’ and abstract descriptions of behaviour overlooks the phenomenological dimensions of that behaviour and thus its moral significance as a lived experience. To overcome this ethical shortcoming, engagement with the aesthetic as an alternative discourse can help articulate the ‘excessive’ nature of lived reality and its relationship with ‘orthodox’ knowledge; fittingly, the comics form involves interaction of rational, non-rational, linguistic, and non-linguistic dimensions, modelling the limits of conceptual thought in relation to complex reality. Rational choice is predicated upon a split between a contextually embedded self and an abstractly autonomous self. Analysis of the graphic novel Watchmen contends that prioritisation of rational autonomy over sensual experience is symptomatic of a ‘rational surface’ that turns away from the indeterminate ‘chaos’ of complex reality (the unstructured universe), instead maintaining the power of rational and linguistic concepts to order the world. This ‘rational surface’ is maintained by masking that which threatens its stability: the chaos of the infinite difference of living individuals. These epistemological foundations are reconfigured, via Watchmen, enabling engagement beyond the ‘rational surface’ by accepting the generative potential of this living chaos and calling for models of criminal identity that are ‘restless’, acknowledging the unique, shifting nature of individuals, and not tending towards ‘complete’ or stable concepts of the self-as-responsible. As part of the aesthetic methodology of this reconfiguration, a radical extension of legal theory’s analytical canon is developed.

Les sciences criminelles ont mis en lumière le développement contemporain des infractions commises en groupe. Leur domaine recouvre des activités criminelles variées, du trafic de stupéfiants à la traite des êtres humains, en passant par la piraterie ou le terrorisme. La complexité et la gravité des crimes commis par ces groupes, ainsi que la capacité d'organisation qu'ils révèlent, constituent aujourd'hui une menace pour l'État de droit et pour la démocratie. Les groupes criminels prennent des formes diverses, depuis le regroupement ponctuel d'amateurs jusqu'aux réseaux organisés de professionnels aguerris et socialement implantés (bandes, mafias, sectes, milices...). Aussi le droit pénal doit-il s'adapter à cette délinquance collective et concertée. Cela pose la question des modalités de répression en cas de division des tâches et de pluralité d'agents, quand le droit pénal est traditionnellement soumis au principe de personnalité de la responsabilité. Cette recherche se propose donc de réaliser une étude comparative des dispositions adoptées en droit français et libanais, qui permettent d'appréhender les infractions commises en groupe en mettant l'accent sur la légitimité et sur l'efficacité des différentes techniques pénales introduites ces dernières années. / Criminal sciences have highlighted the recent rise of group crime. This cover term refers to a variety of criminal activities, from drug smuggling to piracy and terrorism to human trafficking. The complexity and seriousness of the crimes committed by these groups, as well as the organizational capacity they reveal, constitute a threat for the rule of law and democracy today. Criminal groups take various forms, from informal, random petty thief bands to organized networks of hardened and socially embedded professionals (gangs, mafias, cults, militias). In response to this collective, well-planned crime, criminal law has to adapt itself. This raises the issue of how to tackle this problem in a context of division of labor and multiple agents, when criminal law traditionally applies the principle of personal liability. This piece of research therefore aims to make a comparative study of the measures taken by the French and Lebanese law to deal with group crime, focusing on the legitimacy and effectiveness of various criminal techniques introduced in recent years.

Si la question de l'inclusion des actes de terrorisme dans la notion de crime contre l'humanité avait déjà été abordée à plusieurs reprises dans certains travaux, c'est au lendemain des attentats terroristes du 11 septembre 2001 perpétrés aux États-Unis d'Amérique qu'elle s'est posée avec acuité. Cette étude est née de la volonté de savoir si le terrorisme pourrait être considéré comme un crime contre l'humanité. Celle-ci se veut une analyse des points de ressemblance et de dissemblance entre l'incrimination et la criminalité terroristes d'une part et celles liées au crime contre l'humanité d'autre part. Si à certains égards, le terrorisme se rapproche du crime contre l'humanité, par la violence et le contexte idéologique qui les caractérisent, il n'en demeure pas moins qu'il s'agit de deux criminalités essentiellement différentes. Étant donné que traiter du crime contre l'humanité et du terrorisme, c'est aborder des sujets où se trouvent étroitement imbriqués le droit, l'histoire, la politique et la sociologie politique, l'étude ne se limite pas au seul droit pénal. / If the matter of including terrorist acts in the notion of crime against humanity had already been approached repeatedly in certain research works, since the terrorist attacks of September 11th 2001, committed in the United States of America, it raised intensively. This study grew from the will to know if terrorism could be considered as a crime against humanity. This one aims to be an analysis of similarities and disparities between terrorist incrimination and criminality on the one hand and those linked with crime against humanity on the other hand. If in certain respects, terrorism gets closer to the crime against humanity, by violence and ideological context which characterize them, the fact remains that they are essentially two different forms of criminalities. Given that dealing with crime against humanity and terrorism, will raise subjects in which are closely interconnected law, history, politics and political sociology, thus the study is not restricted to the plain criminal law.

La responsabilité individuelle des membres du gouvernement : étude comparative des procédures constitutionnelles thaïlandaises et françaises

Le déclin de la responsabilité collective du gouvernement devant Parlement, est la situation à laquelle plusieurs pays pratiquant un régime parlementaire ont été contraints de faire face comme les expériences passées de la France, ainsi que de la Thaïlande, le prouvent. En effet, le contrôle parlementaire sur le gouvernement est bloqué par le fait majoritaire, si bien que le gouvernement peut difficilement perdre la confiance de l’Assemblée nationale. Cela ne fait qu’encourager la recherche de nouveaux moyens de contrôle et d’améliorer les instruments de contrôle de la responsabilité individuelle des membres du gouvernement sous diverses formes. Par exemple : le contrôle de la responsabilité individuelle des ministres par l’exécutif lui-même ; le déplacement de cette responsabilité devant le juge ; la revalorisation de la responsabilité politique individuelle des ministres devant le Parlement, ou bien encore une moralisation accrue de la vie politique et une amélioration de sa transparence. Les principaux instruments du contrôle de responsabilité individuelle des ministres en matière politique et pénale en Thaïlande et en France sont étudiés de manière comparative. L’étude comparée peut être utile afin d’adapter ces mécanismes aux conditions sociales et politiques de chaque pays. / The decline of the “parliamentary control on the collective responsibility of members of the Government” is the situation that many countries under the parliamentary regime often encounter in their practices including of France and Thailand. In fact, the parliamentary control on the collective responsibility is obstructed by the “majority rule”, for that reason, it is difficult that the Parliament has lost confidence in the Government. This situation leads to improvement in the mechanisms: the control on the individual responsibility of Ministers is, therefore, found in various forms For example the self-control of the executive, the displacement of the individual responsibility of Ministers to the court, the parliamentary control on the individual responsibility of Ministers, and the moralisation of politic and transparency of political life. The main instruments of control on the individual responsibility of Ministers in political and criminal fields in Thailand and France are comparatively studied so that each country can use and adapt the mechanisms to suit its own social and political conditions.

Der mit Verfassungsrang ausgestattete Schuldgrundsatz als Voraussetzung der Bestrafung ist eine der zentralen Systemkategorien des Strafrechts. Anders als ein Erfolgsstrafrecht verlangt das Schuldstrafrecht nach einem "Andershandelnkönnen" des Täters als Vorbedingung der Zuschreibung von Verantwortlichkeit. Die dabei vorausgesetzte Anlage des Menschen zu Selbstbestimmung und ethischer Einsicht gehört elementar zum Menschenbild, das der Rechtsordnung des Grundgesetzes mit seiner Betonung von Wert und Würde des Einzelnen zu Grunde liegt. Als Ausgangspunkt der Betrachtung werden in der vorliegenden Arbeit Befunde über von Jugendlichen und Heranwachsenden begangene Straßenraubdelikte zusammengetragen, wobei diese Perspektive innerhalb eines wissenssoziologischen Bezugsrahmens auf die Lebenssituation junger Menschen in den aktuellen gesellschaftlichen Zusammenhängen, die Deutungen von abweichendem Verhalten, Gewalt und Kriminalität und schließlich die Wirkungsweise des Strafrechts erweitert wird. Vor diesem Hintergrund wird zu den rechtsdogmatischen Schuldkonzepten Stellung bezogen. Dabei wird die Abhängigkeit des Rechts von gesellschaftlichen Werten herausgearbeitet und eine aktive Rolle der Strafrechtswissenschaft im Prozess der gesellschaftlichen Verständigung über Werte eingefordert. In diesem Verständnis von Schuld im Sinne eines "Wertkonzepts" wird auf eine gegenüber Strafzweckerwägungen und kriminalpolitischen Überlegungen eigenständige Fundierung des Schuldprinzips bestanden, und es werden generalisierende Betrachtungen zur Vorwerfbarkeit abgelehnt. Ausgehend von den Überlegungen zum Schuldgrundsatz wird schließlich kritisch auf moderne kriminalpolitische Konzepte eingegangen, die sich zunehmend in den Bereich des Ordnungsrechts verlagern und auf diese Weise die spezifisch strafrechtlichen Verfassungsgewährleistungen umgehen. / The requirement of guilt as a prerequisite for punishment is both a constitutional principle and one of the central categories of penal law. Contrary to criminal law systems that focus on the outcome of a criminal wrongdoing, a criminal law system that requires the personal guilt of the offender before imposing criminal liability considers whether the offender has the capability and possibility to act legally in a certain situation. Based on this premise, the ability to self-determine one's actions and to conform them to ethical standards is a fundamental component of the image of human kind, which constitutes the basis of the German Basic Law that emphasizes the value and dignity of every single human being. The thesis begins with a report on street robberies committed by young offenders. It then expands to an analysis of the living situation of young people in modern society and interpretations of delinquent behavior, specifically violence and crime and the effect of legislative reactions to crime within a theoretical frame of the sociology of knowledge. Proceeding from this, the author next discusses the different dogmatic concepts of guilt. He shows that law depends on social values and contends that criminology plays an active role in the process of forming an understanding of values within society. Understanding guilt as an ethical concept, the author claims a foundation of the principle of guilt independent from the purpose of punishment and criminological policies. He rejects generalized approaches to the concept of guilt. Finally, he analytically discusses modern concepts of criminological policy that are increasingly shifting into regulatory law, thereby circumventing constitutional guarantees that are specifically related to criminal proceedings.

Thus, the present work aims in identifying which are relative individual fundamental rights and thus, analyze possibility of application in these criminal input models for higher levels to Brazilian law tools, lege lata, in such an appropriate way to current paradigm in fundamental rights / O presente trabalho trata da responsabilidade penal pelo produto com destaque em duas dificuldades: i) na imputação dos níveis superiores pela responsabilidade penal pelo produto nocivo ao consumo, diante da posição de garante ocupada na estrutura empresarial e ii) na comprovação probatória entre a causa e o resultado lesivo, na qual o juízo de probabilidade substitui o juízo de certeza. Percebe-se que não há uma distorção ou uma ampliação sobre os tradicionais conceitos de autoria e participação, mas um verdadeiro e notável câmbio metodológico do princípio da imputação penal. Parte-se da concepção dualista do tipo penal, na qual as infrações de deveres surgem como novo modelo de injusto penal aplicado aos intraneus (relação especial dos níveis superiores com bens jurídicos deveres positivos). Nesta há uma clara relativização dos direitos e garantias fundamentais individuais e, por consequência, uma ampliação da esfera de restrição à liberdade individual, em medida além da usual, daqueles que atuam no âmbito da colocação de produtos no mercado de consumo. Certo é que ao relativizar esses direitos o sistema jurídico penal e processual penal tradicional se vê francamente modificado. Na busca pela efetividade social da prevenção de produtos nocivos inseridos no mercado de consumo a garantia contra o engano, inata às ciências criminais principalmente no âmbito processual penal, se vê amplamente fragilizada. Mas até que ponto isto não significa dizer que os direitos fundamentais individuais na realidade são suprimidos de concretização? Nesse ponto parte da doutrina e jurisprudência, em decorrência da efetividade da segunda e terceira dimensão de direitos fundamentais, entende ser legítimo que os direitos fundamentais individuais sejam relativizados no processo de harmonização e acomodação entre os interesses sociais e direitos individuais na sociedade pós-moderna. L’interesse a realizzare un approfondimento delle responsabilità penali connesse al fallimento delle attività di protezione civile sorge in connessione all’incremento di procedimenti penali a carico di operatori della Protezione Civile. Collocato l’obiettivo primario nella individuazione delle condizioni di dichiarazione della responsabilità, inquadrato il fenomeno di flessibilizzazione delle categorie penalistiche emerso nella prassi giudiziaria in risposta al bisogno sociale di sicurezza, l’indagine si snoda attraverso due aree tematiche idealmente suddivise, volte alla ricostruzione della disciplina dedicata alla P.C. e alla descrizione dei criteri di affermazione della responsabilità, secondo un approccio per problematiche che segue l’incedere dell’accertamento. Quale trait d’union il rischio, elemento trasversale dell’intera analisi, è oggetto delle attività di protezione civile da un lato, fattore di distorsione delle categorie penalistiche in funzione espansiva della responsabilità dall’altro, manifestazione della necessità di scindere la visuale prospettica della funzione di valutazione e gestione del rischio da quella di giudizio sul fallimento dell’attività previsionale. Le soluzioni prospettate, calate nella realtà giudiziaria attraverso l’analisi critica del procedimento sul terremoto dell’Aquila, si muovono in un’ottica di equilibrio tra opposti valori di sicurezza e libertà, in vista di una tutela penale che, se non può a priori essere esclusa, deve situarsi entro confini imposti dalle garanzie penalistiche. / The interest in realizing an in-depth analysis of the criminal responsibilities related to the failure of the activities of civil defence arises from the increase in criminal proceedings against workers of the Civil Defence. Given the phenomenon of versatility of the elements of crime risen from the social need for safety, the main purpose of the investigation is the identification of the conditions of statement of responsibility. The investigation is divided in two thematic areas intended to remodel the legislation of Civil Defence and describe the criteria of statement of responsibility. As a joining link, the risk, cross element of the whole analysis, is both the subject of the activities of civil defence and a factor of distorsion of the elements of crime and expression of the necessity to distinguish the perspectival view of the management of risk from that of judgement on the failure of previsional activity. The proposed solutions, placed in the legal reality of the criminal procedure of Aquila earthquake, have a perfect balance between the opposite values of safety and freedom, in order to grant a legal protection which cannot be excluded and must be placed within the borders of the guarantees of the criminal procedure.

Derived from centuries-old English laws, Australian laws ascribe criminal responsibility to children according to their age and their assumed level of understanding of the rightness and wrongness of certain acts. This project first charts the creation and development of the English and Australian positions. Then, using insights from postmodernity and the idea of deconstruction, the law is critically assessed to reveal practical, theoretical and moral limits in the law's attempt to do justice. The justifiability of the current Australian legal positions is questioned by demonstrating the law's internal inconsistencies, by revealing the law's historical and philosophical preferences, and by contrasting the law's restricted ambit of inquiry with contemporary knowledge from other disciplines including developmental psychology and sociology.
