A presente dissertação, intitulada Jurisdição e poder de enunciação fática: a normalização nos interstícios do agir jurisdicional. tem por objetivo aproximar-se da atuação dos magistrados e tribunais do Poder Judiciário (o agir jurisdicional), especificamente em sua atuação relacionada com o estabelecimento de versões oficiais sobre os fatos. A partir da consideração de tal atuação como oriunda de um poder estatal próprio, denominado por este estudo de poder de enunciação fática, explicitar-se-á que o agir jurisdicional é formado por outros poderes necessários à atuação estatal. Diante dessa diversidade de poderes, o presente estudo indaga a respeito do tipo de autoridade e do tipo de procedimento de legitimação a que os cidadãos estão sujeitos, especificamente os jurisdicionados. Utilizando a metodologia crítico-dualista, que defende a cisão entre fatos e decisões, redimensionada pela teoria dos atos de fala, especificamente de Searle, o presente estudo procurará compreender as diversas formas de força ilocucionária envolvidas no agir jurisdicional. Nessa direção, após questionar as formas de justificação da atividade jurisdicional e da verificação de sua legitimidade, buscar-se-á compreender a ideia de modalização explicitada por uma linguística da enunciação, que será utilizada para explicar como se procede à normalização, verificada no interior do Estado, em seu agir jurisdicional. É importante ressaltar, contudo, que este estudo, apesar de se aproximar da teoria dos atos de fala, acredita ser possível a compatibilização de suas ideias com o dualismo crítico e com a teoria da verdade como correspondência. Por fim, este estudo dissertativo resulta em um direcionamento teórico não vinculado, apenas, à necessidade de legitimação da atividade normativa em um Estado republicano (nos moldes de Arendt) e democrático, mas
também, da atividade relacionada com o estabelecimento de versões oficiais sobre fatos pretéritos, através do poder de enunciação fática / This study titled "Jurisdiction and the power of fact enunciation: normalization in the interstices of the court act" aims to get close to the performance of magistrates and courts of the judiciary power (the court action), specifically in its activities related to the creation of official versions of facts. From the assumption that such activity is based on a specific state power, called in this study the power of fact enunciation, we will show that the court actions are composed by other powers required for its performance. Given this diversity of powers, this study questions what kind of authorities and what kind of legitimization procedures the society is subjected to, specifically the citizens in courts. Based on a critical-dualistic methodology, which divides facts and decisions, balanced by the theory of speech acts, from Searle, this study will try to understand the various forms of ilocucionary strength, which affect the court actions. In this direction, after questioning the means of justification for the judicial activity and verification of its legitimacy, this study will seek to understand the idea of modalization explained by a linguistics enunciation, which will be used to explain how to carry out normalization, found inside the State, in its court action. However, it should be highlighted that this study, although closer to the theory of speech acts, believes that it is possible to match this ideas with the critical dualism and with the theory of truth as correspondence. Finally, this study results in a theoretical discourse related not only to the needs to legitimize the normative activity in a Republican state (in the way of Arendt), and democracy, but also to the activity related to the creation of official versions for past happenings, through the power of the fact enunciation

Statistical and Graphical Methods to Determine Importance and Interaction of Building Design Parameters to Inform and Support Design DecisionsJanuary 2015 (has links)
abstract: This research is aimed at studying the impact of building design parameters in terms of their importance and mutual interaction, and how these aspects vary across climates and HVAC system types. A methodology is proposed for such a study, by examining the feasibility and use of two different statistical methods to derive all realistic ‘near-optimum’ solutions which might be lost using a simple optimization technique.
DOE prototype medium office building compliant with ASHRAE 90.1-2010 was selected for the analysis and four different HVAC systems in three US climates were simulated.
The interaction between building design parameters related to envelope characteristics and geometry (total of seven variables) has been studied using two different statistical methods, namely the ‘Morris method’ and ‘Predictive Learning via Rule Ensembles’.
Subsequently, a simple graphical tool based on sensitivity analysis has been developed and demonstrated to present the results from parametric simulations. This tool would be useful to better inform design decisions since it allows imposition of constraints on various parameters and visualize their interaction with other parameters.
It was observed that the Radiant system performed best in all three climates, followed by displacement ventilation system. However, it should be noted that this study did not deal with performance optimization of HVAC systems while there have been several studies which concluded that a VAV system with better controls can perform better than some of the newer HVAC technologies. In terms of building design parameters, it was observed that ‘Ceiling Height’, ‘Window-Wall Ratio’ and ‘Window Properties’ showed highest importance as well as interaction as compared to other parameters considered in this study, for all HVAC systems and climates.
Based on the results of this study, it is suggested to extend such analysis using statistical methods such as the ‘Morris method’, which require much fewer simulations to categorize parameters based on their importance and interaction strength. Usage of statistical methods like ‘Rule Ensembles’ or other simple visual tools to analyze simulation results for all combinations of parameters that show interaction would allow designers to make informed and superior design decisions while benefiting from large reduction in computational time. / Dissertation/Thesis / Masters Thesis Built Environment 2015

What About “He Said, He Said?" The Effect of Rape Myth Acceptance and Extra-Legal Factors on Blame AttributionsJanuary 2017 (has links)
abstract: Many authors have shown that "real victim," "real rape," and traditional gender role stereotypes affect how people attribute blame to victims and perpetrators of sexual assault, and that jury decisions in rape cases are likewise influenced by extralegal factors, such as how much the victim resisted. Most studies only focus on the acceptance of rape myths and stereotypes about female victims, while myths and stereotypes about male victims are largely ignored. It is unknown how female rape myth acceptance (FRMA) and male rape myth acceptance (MRMA) may differently affect victim and perpetrator blame attributions. Whether the juror influences the effect of extra-legal factors on rape perceptions is also unknown. Using a randomized vignette design, the current study investigates 1) the effect of rape myth acceptance and gender attitudes on victim and perpetrator blame attributions, 2) how blame attributions differ by victim gender, level of resistance, and victim-perpetrator relationship, and 3) how the juror role influences the effects of rape myth acceptance and extra-legal factors on blame attributions. Results show that FRMA and MRMA are both positively associated with victim blame and negatively associated with perpetrator blame, that male victims are blamed more than female victims, and that jury membership does not influence the effect of extra-legal factors on blame attributions. Victim resistance and victim-perpetrator relationship also affected rape perceptions in unexpected ways. Background: In today’s society, Influencer Marketing (IM) has become a rising phenomenon where brands collaborate with influencers in order to reach a wider range of consumers. Through the popularity of IM, influencers hold strong influential power since consumers feel a higher level of relatedness to them than traditional marketing efforts. The strong influential power enables influencers to communicate competing brands within a short period of time. Purpose: The purpose of this study is to explore how consumers are evaluating influencers who communicate competing brands, from the aspects of trust and relationship. Method: This study applied an inductive, qualitative approach with an exploratory and interpretive view of the findings. The research was conducted through semi-structured interviews with 11 participants, on the aspect of how they evaluate a fashion influencer’s communication on the platform Instagram. Conclusion: The findings of this research contributed to the development of a conceptual model, including the aspects of personality & relatedness, trust, as well as influencer-consumer relationship. These aspects are important for the influencer to understand, in order to perform the communication in the most effective way to increase consumer purchasing decisions.

marketing decisions and the ethical intentions of managers that work in tourist activities. The
ethical subject has been emphasized in the managerial field over the last 30 years, in the
understanding that a best ethical behaviors would generate higher business profits. However
after the 1980´s, approaches aiming social benefits began to gain importance, supporting other
areas of knowledge like tourism. This area (Tourism) presents strong presence in level of
society, by involving various types of exchanges, whether of information, ideas, products,
services etc., and also for constituting an economically important industry. Based on these
understandings, the specific objectives of this research were outlined, which involved, in
particular, the development of a scale for measuring the moral intensity construct (latent
variable) about the perspective of tourism decision makers. The construct of moral intensity
is part of the Theory of Moral Intensity developed by Jones (1991), which includes six main
components: magnitude of the consequences, social consensus, probability of effect, temporal
immediacy, proximity and concentration of the effect. This survey included three samples:
two of them were formed by students and the other one by managers of tourism firms. The
first sample was composed by 137 undergraduate students in tourism and the second one by
103. For the group of managers, 61 individuals were interviewed. This study was based on a
quantitative approach, with sampling based on convenience and accessibility, and used
specific statistical procedures for measuring the constructs of formative nature. Overall, the
main goals were achieved, with the validation of items and scenarios developed in a
consistent way. Some of the observed results indicate that the variable social consensus
influences the ethical intentions in almost all the tourist groups of decision makers, including
the current and future ones. Another finding refers to the possibility of the characteristics of
moral intensity to be considered independent of a single variable measure of the moral
intensity construct, since they together did not indicate to statistically form the moral
intensity. At the end of the work were presented suggestions for future studies. / O objetivo geral deste trabalho foi avaliar a relação entre a intensidade moral de decisões de
marketing e as intenções éticas dos gestores que atuam em atividades turísticas. A temática
ética ganhou ênfase na esfera gerencial, no entendimento de que melhores condutas éticas
gerariam maiores lucros empresariais. Porém, após os anos 1980, abordagens visando
benefícios a nível social passaram a ganhar importância, respaldando outras áreas do
conhecimento como o Turismo. Esta área (Turismo) apresenta forte presença em nível de
sociedade por envolver diversos tipos de trocas, sejam elas de informações, idéias, produtos,

A manifestação da intuição na tomada de decisão instantânea pelos empreendedores da Serra GaúchaMorello, Andreia January 2016 (has links)
As decisões racionais ou intuitivas delimitam a vida das pessoas, gerando boas ou más consequências. São as decisões que geram oportunidades, desafios e incertezas. Até pouco tempo, a teoria gerencial era embasada nas premissas, de que, por critérios de racionalidade poderíamos dominar a vida e o destino das empresas. No entanto, em virtude de limitações envolvidas no processo decisório, como falta de tempo, excesso de informações, mudanças constantes e instabilidade tanto econômica quanto política, fizeram com que métodos suportados pela racionalidade, busquem apoio em conhecimentos gerados pela experiência acumulada pelo indivíduo. Esta dissertação visa abordar a tomada de decisão dos empreendedores, juntando aspectos da administração e da psicologia. Primeiramente uma abordagem da evolução do pensamento sobre a tomada de decisão é repassada, com conceitos que dão conta da racionalidade limitada e também de que o nível de incerteza e a complexidade inerente às decisões aumentaram. Após evidências teóricas mostrando como a intuição influencia a tomada de decisão, esperasse demonstrar como os empreendedores entrevistados utilizam a intuição para a tomada de decisões. Através de estudo de caso com oito empreendedores, foi possível apresentar aspectos que influenciam o comportamento dos empreendedores no exercício do processo decisório, demonstrando que suas decisões nem sempre seguem um processo racional descrito na literatura, mas respaldam-se muitas vezes em formas intuitivas e criativas que dependem muito mais de sua experiência e de sua percepção sobre oportunidades ou ameaças que propriamente uma planilha estatística. Como resultado, verificou-se que a intuição tem papel importante na formação da solução percebida pelos empreendedores, e como outros autores já colocaram, há uma grande dificuldade em colocar todos os elementos que compõem a tomada de decisão nos processos decisórios, fazendo com que o empreendedor recorra em muitas decisões, a fontes mais informais, como é o caso da intuição, que respondendo ao objetivo principal desta dissertação, constatou-se que possivelmente a experiência e a intuição sejam os elementos que mais auxiliam a tomada de decisão, principalmente na primeira e na terceira geração, conforme será demonstrado nesta dissertação. / Intuitive and rational decisions put a limit on people’s lives, resulting in good and bad consequences. The decisions generate opportunities, challenges and uncertainties. Until recently, management theory was grounded in assumptions that, by rational criteria we could dominate life and companies’ fate. However, due to limitations involved in the decision-making process, such as lack of time, information overload, constant changes and instability both economic and political made methods supported by rationality, seek support in knowledge generated by the accumulated individual experience. This work seeks to address the entrepreneurs’ decision-making, combining aspects of management and psychology. First of all an approach to thought evolving on the decision-making is checked on through concepts that take into account bounded rationality and also that the level of uncertainty and the inherent complexity of decisions increased. After theoretical evidences showing how the intuition influences the decision making-process, it is expected to demonstrate how interviewed entrepreneurs use intuition to make decisions. Through a case study with eight entrepreneurs, it was possible to present aspects that influence entrepreneurs’ behavior in the exercise of decision-making by demonstrating that their decisions do not always follow a rational process described in the literature, but often they are supported in intuitive and creative ways, which rely more heavily on their experience and their perception of opportunities or threats, than in a exactly statistical spreadsheet. As a result, it was found that intuition plays an important role in forming the solution perceived by entrepreneurs, and as others have already put, there is great difficulty in putting all the elements that make up the decision-making into decision-making processes, making the entrepreneur refers, in many decisions, the more informal sources, such as the intuition case, that responding to the main objective of this abstract , it was found that perhaps the experience and intuition are the factors that most help the decision making, especially in the first and in the third generations, as will be shown in this work.

O objetivo desta pesquisa é realizar um memorial da construção de uma interpretação das Cartas Celestes I de Almeida Prado, que consiste em um relato das dúvidas interpretativas surgidas durante o processo de preparação da performance e das escolhas de realização, investigando os possíveis fatores que levaram a essas decisões. Como subsídios para a fundamentação das escolhas interpretativas foram utilizadas as informações provenientes de aulas de instrumento e de gravações de outros volumes de Cartas Celestes, bem como de outras obras semelhantes de alguma forma às Cartas Celestes I. Concluiu-se que, em determinadas passagens, a notação representa de forma aproximada o efeito que se quer. Nessa interpretação da peça, assumo, portanto, a responsabilidade de buscar escolhas possíveis. / The aim of this work is to report an interpretation process of Cartas Celestes I, explaining the interpretative doubts and realization choices, searching for the factors that led to these decisions. The sources for the interpretative choices were the information from the piano lessons and from the recordings of others volumes of Cartas Celestes. Somewhat similar works have also been used. It is possible to point out that, in certain passages, specially in the matter of rhythm, the notation is aproximate and not the exact way it is notated considering how it may sound. Thus, the performer takes the responsibility to search for possible solutions.

The Relationship between Household’s Risk Preference and the Homeownership Decisions among Young Adults in Changing Housing Market ConditionsLe, Vien January 1900 (has links)
Doctor of Philosophy / School of Family Studies and Human Services / Martin Seay / For many decades, the American Dream of homeownership has been a source of pride and one of the traditional ways to improve financial and non-financial well-being for American households. However, during the recent housing crisis, millions of homeowners lost their homes or experienced negative home equity due to job loss, reductions in work hours, or a decline in home values. The recent housing crisis made many individuals and families rethink their American Dream. As with most investments, there are some risks associated with owning a home, especially when housing markets are volatile and the economy is uncertain. Understanding the relationship between household’s risk preference and homeownership decisions may help households make better and more informed decisions regarding their housing tenure choice. This study investigates the relationship between household’s risk preference and homeownership decisions among young adults made during the stability in the housing market, which occurred around 1993, and during the decline in the housing market, which occurred around 2010. This study also examined demographic and economic characteristics of homeowners during those periods.
Two separate datasets from the National Longitudinal Study of Youth 1979 and the National Longitudinal Study of Youth 1997 were utilized to address research questions and research hypotheses under the lens of the expected utility theory. The results showed shifts in household’s rick preferences, homeownership rates, and demographic and economic characteristics between periods. Compared to households who preferred lowest risk level, households who preferred highest risk level were more likely to own a home in both periods. The relationships between household’s risk preference and homeownership decisions did not change between periods. However, some relationships between household’s demographic and economic characteristics and homeownership decisions changed between periods.
The findings of this study have several important implications for potential homebuyers, lenders, and personal financial planning practitioners. Household’s risk preference, as well as demographic and economic characteristics, should be considered during the home purchase process. The findings also expand the literature on expected utility theory, household’s risk preference, and homeownership research areas.

Através do presente estudo analisou-se as decisões judiciais proferidas pelos Tribunais Superiores do Brasil - Supremo Tribunal Federal (STF) e Superior Tribunal de Justiça (STJ) - acerca dos conflitos entre usuários e operadoras de planos de saúde, a fim de verificar se nos julgamentos tem sido considerada a necessidade de preservação do direito à saúde. Na Parte I foram apresentados os pressupostos de compreensão do setor de planos de saúde, colocando-se à disposição informações sobre as denominações e classificações adotadas, histórico de formação e atual configuração. Ainda na primeira parte dissertou-se sobre o foco escolhido para a análise jurisprudencial: o direito à saúde. Evidenciou-se o processo histórico de reconhecimento dos direitos humanos e como o direito à saúde nele se inseriu, a natureza desse direito e sua consagração na legislação internacional e brasileira. Considerada a abordagem contratual que é dada aos planos de saúde, também se discorreu, ainda que brevemente, sobre o Código de Defesa do Consumidor (Lei nº 8.078/90) e a Lei de Planos de Saúde (Lei nº 9.656/98). A pesquisa jurisprudencial, apresentada nos capítulos da Parte II, abrangeu decisões sobre conflitos entre usuários e operadoras de planos de saúde disponíveis nos endereços eletrônicos dos Tribunais Superiores até 3 de junho de 2008 - data em que a Lei de Planos de Saúde completou 10 anos. Verificou-se que o STF não analisou o mérito dos recursos que lhe foram apresentados. A fundamentação adotada para tanto tem relevância na análise do impacto das decisões dos Tribunais Superiores na efetivação do direito à saúde em planos de saúde, mas prejudicou análises complementares. Assim sendo, no capítulo 5 as decisões do STJ e do STF foram analisadas no que diz respeito ao direito à saúde, e ao capítulo seguinte reservou-se a apresentação de aspectos complementares dos Recursos Especiais (STJ), como a natureza dos conflitos, a autoria das ações e os principais procedimentos, insumos e doenças negados aos usuários / Health insurance at Justice: is the right to health being effectived? studies how the Brazilian Superior Courts judge conflicts between health insurance companies and their users/clients. The objective of the study is to investigate whether and how the right to health takes part in the sentences. In the first part of the study the specific characteristics of the health insurance sector are introduced, including its development and its nowadays configuration and data. In the second part the judments of the Superior Courts (Superior Tribunal de Justiça and Supremo Tribunal federal) are presented and analysed.
