La lutte contre le terrorisme, ainsi que ses conséquences sur la sphère des droits de l'Homme, n'est pas un thème nouveau en Europe. Cependant, depuis les attentats du 11 septembre 2001 perpétrés sur le sol des Etats-Unis, «confirmés» par ceux de Madrid en 2004 et Londres en 2005, elle n'a jamais incarné une telle priorité. La majeure partie des mesures prises par l'Union européenne tombe sous le titre de la coopération en matière pénale, c’est-à-dire sousl’ex-troisième Pilier, parmi lesquelles la décision-cadre sur la lutte contre le terrorisme, la décision-cadre sur le mandat d'arrêt européen et les accords entre l'Union européenne et les Etats-Unis d'Amérique sur l'extradition et l'assistance juridique mutuelle. Sur base des mesures européennes, certains Etats, historiquement non concernés par ce phénomène, ont été pressés à adopter des mesures anti-terroristes alors que d’autres y ont vu une légitimation pour renforcer leur corpus juridique déjà existant. Quel est l'impact des mesures européennes et de celles prises par les Etats sur le délicat équilibre entre la sécurité et la liberté ? En d'autres termes, quel est le rôle de l'Etat de droit : une limitation à ces mesures ou, un principe visant au renforcement du combat contre le terrorisme? / The fight against terrorism, as well as its consequences in the field of Human Rights, is not a new theme for Europe. However, since the terrorist attacks of September the 11th 2001 in the United States of America, “confirmed” by the ones of Madrid in 2004 and London in 2005, it has never embodied such a priority. The larger part of the measures taken by the European Union falls under the heading of cooperation in criminal matters, i.e. within the scope of the former Third Pillar, among which the framework decision on combating terrorism, the framework decision on the European arrest warrant and the agreements between the European Union and the United States of America on extradition and mutual legal assistance. On basis of the European measures, some States, not historically concerned by terrorism, have been compelled to carry out counter-terrorism measures whereas, others have seen a legitimation to reinforce their existing body of law. What is the impact of the European measures and the ones taken by States on the delicate balance between security and liberty? In other words, what is the role of the Rule of Law: a limitation to those measures or, a principle aiming to the strengthening of the fight against terrorism?

Cette thèse porte sur les initiatives et les stratégies de recherches de solutions politiques au conflit nord-irlandais, engagées par les gouvernements britanniques et irlandais depuis les années 1970. L’enjeu est d’expliquer les possibilités de solutions en privilégiant l’angle d’approche de sortie du conflit, adopté par Londres, Belfast et Dublin. L’espoir de paix en Irlande du Nord s’amorce avec le cessez-le-feu de l’IRA de 1994 qui marque un tournant dans l’histoire du conflit. Dès lors, la recherche d’une issue est engagée dans la voie du compromis [partage des pouvoirs entre la minorité catholique et la majorité protestante et lutte contre les systèmes de discrimination et d’inégalités]. Avec l’engagement de ce processus de paix et l’implication de l’Union européenne, à travers des programmes de paix et de réconciliation va émerger un désir de réconciliation intercommunautaire [entre catholiques et protestants]. L’examen de l’Accord de paix du Vendredi Saint de 1998 a révélé que l’expérience nord-irlandaise fournit un mode opératoire de négociation de sortie du conflit par un compromis suis generis. Cette configuration de la paix multidimensionnelle est devenue une métaphore européenne sur les principes de prévention et de règlement des conflits. L’émergence d’un « paradigme » nord-irlandais constitue l’objet de cette étude sur les formes de mobilisation pour la paix et la prévention des conflits dans l’Union européenne. / This thesis deals with political initiatives and efforts to achieve solutions to the Northern Irish conflict, by examining policies instituted by the British and Irish Governments since the 1970s. The purpose is to explain how possible solutions to the conflict were envisioned by focusing on differing approaches to conflict resolution as adopted by London, Belfast and Dublin. The hope for peace in Northern Ireland is interconnected with the ceasefire of the IRA in 1994 that marks a turning point in the history of the conflict. Therefore, the quest for a peaceful outcome involved engagement in the path of the compromise and power sharing between the Catholic minority and the Protestant majority as well as the fight against discrimination and inequality. With the commitment of this peace process, the involvement of the European Union through peace and reconciliation programmes helped to foster a desire for inter-community reconciliation. The examination of the Good Friday Agreement of 1998 reveals that the Northern Ireland experience provides a procedure to negotiate the end of the conflict by sui generis compromise. This multidimensional approach and configuration of peace process has become a European metaphor for conflict prevention and resolution principles. The object of this study is consequently to show the emergence of a Northern Irish « paradigm » that can provide the basis for forms of mobilization for peace and conflict prevention in the European Union.

Cette thèse porte sur les conceptions d’Egon Bahr dans le domaine de la politique à l’Est (Ostpolitik) de la République fédérale d’Allemagne (RFA) entre 1945 et 1975. L’analyse se concentre sur le lien entre l’Ostpolitik et l’idée que Bahr se fait de la place et du rôle de l’Allemagne en Europe. Plus précisément, cette étude veut cerner les buts poursuivis par Bahr dans le cadre de la politique orientale. La première partie traite du développement conceptuel de l’Ostpolitik (1945-1969), tandis que la seconde examine sa mise en application entre l’élection de Willy Brandt comme chancelier de la RFA et la conclusion des accords d’Helsinki (1969-1975). Les principales sources utilisées sont les écrits de Bahr ainsi que des documents inédits se trouvant dans divers centres d’archives non seulement en Allemagne, mais aussi aux États-Unis, en France et en Grande-Bretagne. Pour Bahr, l’Ostpolitik ne saurait se résumer à l’élimination des obstacles qui gênent la diplomatie ouest-allemande durant la guerre froide. Bahr poursuit plutôt un projet nationaliste ambitieux dans le contexte des relations avec le bloc soviétique : créer les conditions d’une redéfinition de la place de l’Allemagne en Europe. Pour lui, l’Ostpolitik constitue un instrument idéal pour faire de l’Allemagne la puissance prépondérante dans un nouvel ordre de paix européen. Trois éléments complémentaires participent à l’accomplissement de cette vision : 1) la consolidation de la paix et de la sécurité continentales; 2) la réunification allemande et 3) l’émancipation de la politique étrangère (ouest-)allemande. Cette thèse éclaire la pensée politique de Bahr et contribue à une meilleure compréhension de la signification de l’Ostpolitik dans le contexte plus large de la politique étrangère de la RFA. Les conceptions de Bahr sont uniques dans l’Allemagne de la guerre froide parce qu’elles sont centrées sur les notions de puissance, d’intérêt national et de « normalité ». En même temps, Bahr comprend que la coopération doit toujours rester l’instrument diplomatique privilégié des Allemands vu leur position géographique centrale. À travers le prisme des conceptions de son « architecte », l’Ostpolitik apparaît comme un véritable effort de réconciliation entre la paix en Europe et l’affirmation de l’influence allemande sur la scène internationale. / This thesis deals with Egon Bahr’s understanding of the Federal Republic of Germany’s (FRG) Eastern policy (Ostpolitik) between 1945 and 1975. The analysis is centered on the link between Ostpolitik and Bahr’s conception of Germany’s position and role in the European system. More precisely, this study aims at finding out which goals Bahr pursued in the context of Bonn’s Eastern policy. The first part of the thesis deals with the conceptual development of Ostpolitik (1945-1969). The second part takes a look at its implementation for the period between Willy Brandt’s election as West German Chancellor and the conclusion of the Helsinki Final Act (1969-1975). This thesis relies primarily on Bahr’s writings, including a vast number of unpublished sources, located mostly in German archives, but also in American, French and British archives. According to Bahr, Ostpolitik was not limited to the elimination of West Germany’s burdens in foreign policy during the Cold War. In fact, he pursued an ambitious, nationalistic project in the context of relations with the Soviet bloc. Bahr sought to create the necessary conditions for Germany to redefine its place in Europe. With Ostpolitik as his diplomatic instrument, his ultimate goal was to see Germany become the central power in a new European peace order. Three interrelated objectives formed the core of this vision: 1) the consolidation of peace and security on the continent; 2) German reunification and 3) the emancipation of (West) German foreign policy. This thesis sheds new light on Bahr’s political thought and contributes to a better understanding of Ostpolitik’s significance in the larger context of West German foreign policy. Bahr’s conceptions were unique in Cold War Germany because they were based on notions of power, the national interest and “normality”. At the same time, Bahr understood that Germans, because of their central geographic position, always had to rely on cooperation as the prime instrument of all their diplomatic initiatives. Through its “architect”, Ostpolitik appears as an effort at reconciliation between a peaceful Europe and the unhindered affirmation of German influence in world affairs.

As mudanças ocorridas no esquema de segurança e defesa europeu receberam um grande ímpeto por parte do Reino Unido, que, tradicionalmente, tem se caracterizado por uma política reticiente no que diz respeito a cooperação em questões de segurança e defesa. Argumenta-se que o novo enfoque da política britânica com relação à Política Européia de Segurança e Defesa, a partir de 1998, insere-se num processo de redefinição da identidade coletiva com relação a União Européia, apos o Reino Unido ter sido relegado ao segundo plano no que se refere a questões de uniao política européia. / [en] The aim of this dissertation is to analize the process of identity reformulation of the United Kingdom under Tony Blair through its participation in the European Security and Defence Policy of the European Union. This analysis is based on constructivism litterature. The changes that had taken place in the european security and defence field were, to a certain degree, the result of a british attitude, which has traditionally been characterized as sceptical in these areas. The argument is that this new british approch is part of a deeper process of colletive identity reformulation.

Diploma thesis "European collaborative defense projects and the military capacity of the EU" is dealing with the realization of cooperative projects and with their influence on the development of military capacities of the European Union member states. The author examines the economic and military advantages of international defense collaboration. The optimal way of collaboration leads to lower development and production costs, higher quality of the product and better competitiveness on the market. The author uses selected European programs to test how the results are achieved in reality. Further author identifies the goals of the European Defense and Security Policy as they were set up by the European Union. Mainly the so called Petersberg Tasks. The author examines which military capabilities the European Union needs to build in order to realize the full scope of the Petersberg Tasks and whether the realized collaborative projects enhance the capabilities of the Union for these tasks.

The thesis "Sweden and European Integration in the Field of Security" deals with the Swedish role in the military dimension of the EU"s Common Security Policy. The thesis applies the concept of "Integration Dilemma" that forms the basis of the theory of national integration policy formulated by Nikolaj Petersen. The thesis draws on Petersen"s premise that all states involved in integration sooner or later experience an integration dilemma constituted by difficult choices between preserving autonomy and exercising influence on other participants. According to Petersen the salience of the integration dilemma differs among states depending on their influence capability, stress sensitivity and degree of identification with ideological sources of integration. Petersen argues that to handle the dilemma, national governments will most likely use adaptive strategies typical for the "balancing policy" mode. Petersen also predicts that countries characterised by high stress sensitivity, limited influence capability and aloofness from the ethos of European integration will perceive the dilemma as highly salient. Petersen assumes that integration policies of those countries will also include strategies characteristic for the "acquiescent" or "quiescent" mode.
