Previous issue date: 2017-09-17 / Este trabalho quer apresentar a discussão referente ao tema da prova na análise das concentrações empresariais pelo Conselho Administrativo de Defesa Econômica (CADE) no âmbito da Lei n. 12.529/2011, notadamente diante da constatação de que tal análise, necessariamente prognóstica, se dá sob fortes condições de incerteza quanto à conformação e à dinâmica dos mercados após a consumação do ato de concentração. A discussão justifica-se para assegurar a aplicação isonômica da Lei por parte da autoridade, em um contexto em que há prognoses concorrentes a respeito de tal conformação de mercado, cabendo ao CADE fazer uma ponderação de probabilidade, verossimilhança ou plausibilidade a respeito dessas prognoses, a partir de informações apresentadas pelas empresas interessadas na consumação de uma concentração e obtidas junto a outros agentes do mercado, como concorrentes, clientes e fornecedores. Após contextualizar criticamente o quadro normativo aplicável à matéria, inclusive no que toca ao tema da incerteza, e apresentar a metodologia tradicional de análise dos chamados “atos de concentração”, cristalizada no Guia para Análise de Atos de Concentração Horizontal, editado pelas autoridades de defesa da concorrência, à luz de sua fundamentação perante a teoria econômica, o estudo examina os antecedentes históricos da matéria probatória no âmbito das concentrações no Direito Comparado, para então delimitar as discussões, no Direito Brasileiro, sobre o ônus da prova, standard probatório e os meios de prova disponíveis no âmbito do exame das concentrações no Brasil. O capítulo final conclui com recomendações voltadas ao tratamento prático do tema, considerando as especificidades apontadas ao longo do estudo. / The work aims to present the discussion regarding the theme of evidence in the review of corporate concentrations by the Administrative Council for Economic Defense (CADE) pursuant to Law no. 12,529/2011, especially in view of the conclusion that this review, necessarily forward-looking, is conducted under strong uncertainty as to market conformation and dynamics following consummation of the merger. The debate is required to assure equal enforcement of the Law by the authority, in a context in which there are competing prognoses about these market conformation, resting upon the CADE to assess the probabilities, likelihoods or plausibility of those prognoses, based upon information submitted by the merging parties and obtained from other market agents, such as competitors, clients and suppliers. After critically contextualizing the normative frame applicable to the subject, including the topic of uncertainty, and presenting the traditional methodology for the analysis of merger cases, in the form of the Horizontal Merger Guidelines edited by the competition authorities, the study reviews the history of the antecedents of the discussions about evidence in the context of merger control in Comparative Law, so it can then delineate the debate, under Brazilian Law, about the burden of proof, standard of proof and means of proof available in merger control review in Brazil. The final chapter concludes with recommendations regarding practical aspects of the matter, considering the particularities identified throughout the analysis.

The purpose of the research was to establish action steps than can assist the criminal investigator in the processing of information into evidence for prosecution purposes, by focusing on the basic principles of criminal investigation from where information sources could be utilised to their full potential in the search for the truth.
The researcher evaluated the current methods that investigators within the SAPS use and read extensively on the topic in international literature sources. The research used an empirical research design because of the limited information available, and a qualitative research approach which enabled real-life observations. Simple random sampling was used to interview 30 experienced investigators each with more than five years experience and purposive sampling was used to identify five expert respondents who had more than 30 years' investigation experience. Die ekstrinsieke getuienis-reël word in die algemeen beskou as een van die mees problematiese areas van die Suid-Afrikaanse bewysreg. Die Suid-Afrikaanse Regskommissie het dan ook redelik onlangs ondersoek ingestel na die wenslikheid van die behoud of afskaffing van die reël.
Ondersoek word ingestel na die ware aard van die ekstrinsieke getuienis-reël en of die reël op ’n korrekte wyse in die Suid-Afrikaanse reg ingevoer is. ’n Deeglike kritiese ontleding word verder gedoen van die twee komponente waaruit die ekstrinsieke getuienis-reël bestaan, naamlik die integrasiereël en die interpretasiereël, met behoorlike verwysing na relevante regspraak en die standpunte van akademiese skrywers op hierdie gebied.
Kritiese ondersoek word verder ingestel na die verslag en aanbevelings van die Suid-Afrikaanse Regskommissie ten aansien van die ekstrinsieke getuienis-reël. Die impak van die 1996 Grondwet, asook die moderne ontwikkeling van die rekenaar en elektroniese dokumente op die ekstrinsiekegetuienis-reël word ook kortliks ondersoek.
Daar word verder grondig ondersoek ingestel na die ekstrinsieke getuienis-reël in ’n regsvergelykende perspektief met spesifieke verwysing na die Engelse, Amerikaanse, Kanadese, Nederlandse, Duitse, Franse en Switserse reg, asook die moontlike waarde wat sodanige benaderings kan toevoeg tot die reël in ’n Suid-afrikaanse konteks.
Die gevolgtrekking waartoe gekom word in hierdie proefskrif is dat die ekstrinsieke getuienis-reël aansienlik gemodifiseer moet word in die Suid-Afrikaanse reg deur middel van die promulgering van spesifieke wetgewing op hierdie gebied. Die essensie van hierdie wetgewing moet daaruit bestaan dat alle relevante ekstrinsieke getuienis toegelaat behoort te word ten einde die ware bedoeling van die kontrakspartye vas te stel, behalwe waar dit blyk dat hulle ooreengekom het om hulle algehele ooreenkoms in die skriftelike kontrak te integreer. The aim of this research is to investigate how handwriting as an individualisation technique in fraud investigation can be used by police detectives, SARS investigators and forensic investigation specialists, who are responsible for the investigation and linking the perpetrator, with a view to criminal prosecution.
A further intent was to share and introduce a number of important concepts, namely: criminal investigation, identification, individualisation, fraud, evidence and handwriting. The research will explain the sophisticated investigation techniques used to obtain sufficient information to prove the true facts in a court of law. Identification is the collective aspect of the set of characteristics by which an object is definitively recognisable or known, while the individual characteristics establish the individuality of a specific object. Many types of evidence may be used to link an individual with a crime scene, and associate that individual with the performed illegal handling.
It also explained that during a cheque/document fraud investigation, it is in most cases the only link to information to trace, identify and individualise the perpetrator, and to obtain a handwriting specimen. It is also discussed how to eliminate a person being a writer of a document, and how to collect, package and mark a disputed document during the investigation. If the investigators use their knowledge of these concepts, it should enhance their investigative skills, and empower them to be become better equipped for the challenges they face in identifying, individualising and linking the perpetrators, in order to ensure successful prosecution and conviction. / Police Practice / M.Tech. the police stand at the point of balance on the one hand securing
human rights on the other exercising their lawful powers given
to them by Governments in the name of the people, to protect

This is no small expectation. It means that the police are
expected to maintain and secure the principles of democracy and
human rights, the principles upon which our Constitution is
based. At the same time it is the duty of a police service to
maintain law and order which sometimes require the exercise of
power and the use of force which on the face of it may appear to
violate human dignity and certain rights and freedoms which a
police force is expected to maintain in a democratic society.
The manner of exercising that power has an impact on the
credibility and effectiveness of the police. Human rights law
internationally accepts that a police service needs to be given
the power to, at times restrict certain individual freedoms in
the interests of the security of the community at large. These
restrictions may take place only in a constitutional way. If it
takes place in an unconstitutional way the courts must have the
right to exclude evidence which is unconstitutionally obtained.
At this stage the courts have to formulate such a qualified
exclusionary rule, but the ultimate goal must be to include such

case were protected, from disclosure to the opponent, by privilege. The purpose
of this dissertation is to investigate whether such claims to privilege are justified
and whether openness before and during the trial is not perhaps more important
to the interests of justice. The disclosure of witness statements to the defence is
a commonly recognized practice all over the world. This practice enhances
openness before and during the criminal trial. The arguments against and in
favor of such a practice are many, but investigation into these has shown that it
is in the interests of justice to disclose such statements to the defence, rather
than to deny access. Furthermore, the writer investigates whether it would be in
the interests of justice to compel the defence to assist the court in determining

Les récents développements de l’intelligence artificielle, de l’Internet des objets et des outils de reconnaissance vocale, couplés à la démocratisation des appareils électroniques de grande consommation et à la couverture Internet étendue maintenant disponible dans plusieurs pays industrialisés, ont permis la mise en marché à grande échelle d’assistants vocaux personnels, qui consistent en des logiciels installés sur différents appareils tels que des téléphones cellulaires et des haut-parleurs connectés permettant aux utilisateurs de ces appareils d’interagir avec ceux-ci au moyen de commandes vocales.
L’adoption de technologies permettant aux utilisateurs d’interagir avec des objets connectés à l’Internet au moyen de leur voix connaît une forte croissance, et celles-ci constitueront bientôt l’un des modes d’interaction privilégiés pour utiliser l’Internet. Considérant la vaste nature des opérations réalisées au moyen de l’Internet en général et de l’Internet des objets en particulier, il convient de se questionner sur la manière de documenter les interactions entre un utilisateur et un assistant vocal.
Le présent mémoire adopte une approche comparant le cadre juridique québécois à différents cadres juridiques avec l’objectif de procéder à une qualification technique et juridique des assistants vocaux et des éléments de preuve en découlant. Dans un second temps, ce mémoire s’intéresse à la recevabilité et à la force probante de ces éléments de preuve dans le contexte du droit civil québécois. L’auteur se penche sur les conditions de recevabilité, discutant de la qualification du document technologique et de ses attributs, nommément ainsi qu’en premier lieu son authenticité et son intégrité et de la proportionnalité. L’auteur discute des exceptions à la recevabilité, soit spécifiquement l’atteinte aux droits fondamentaux et le respect du secret professionnel. Ensuite, l’auteur discute de la force probante de la preuve technologique en avançant que la compréhension de la technologie sous-jacente est l’élément clef dans l’évaluation de la force probante de tout élément de preuve technologique. L’auteur propose que l’intelligence artificielle relève d’une nouvelle catégorie de preuve qui commande peut-être des changements à la procédure et aux principes judiciaires québécois. / Recent developments in the fields of artificial intelligence, of the Internet of Things and of voice recognition, together with the accessibility to electronic devices and wide Internet connection in the industrialized countries, led to the introduction of virtual personal assistants. This software, installed on various devices such as mobile phones and smart speakers, allow their users to interact with these devices using their voice.
As these technologies allow their users to interact with connected devices through the Internet, they will most likely become the main gateway to the Internet in a near future. Considering the great variety of tasks performed with connected devices, the legal questions regarding evidence generated by and collected from their use must now be asked.
First, this master’s thesis will compare the normative frameworks of both Quebec and other jurisdictions in order to define, technologically and legally, the virtual personal assistants and the evidence they generate.
In a second time, this thesis will focus on the admissibility and the probative value of the evidence garnered from virtual personal assistants, in the context of Quebec’s civilist tradition. The author focuses on the conditions of admissibility and on the designation of technological documents and of their characteristics, analyzing first and foremost the criteria of authenticity and integrity and the questions of proportionality. The author discusses exceptions to admissibility, especially the violation of a fundamental right and privilege considerations. Furthermore, the author discusses the probative value of technological evidence, proposing that the understanding of the underlying technology is a key factor in the determination of the probative value of any technological evidence. Finally, the author suggests that artificial intelligence creates a new category of technological evidence that might be calling for changes in the judicial principles and procedures of the province of Quebec.

Text in Afrikaans / Artikel 35(5) van die Grondwet 108 van 1996 handel oor die uitsluiting van
ongrondwetlike getuienis en bepaal dat sodanige getuienis uitgesluit moet word
indien toelating daarvan sal lei tot 'n onbillike verhoor of tot nadeel sal strek vir
die regspleging. Uit die bewoording van die artikel blyk dit dat die howe geen
diskresie het ten opsigte van die toelaatbaarheidsvraag nie en 'n streng
uitsluitingbenadering moet volg. Die doel van hierdie verha• ndeling is om
ondersoek in te stel na die mate van diskresie .en die wyse ·waarop diskresie
toepas word in hierdie besluitnemingsproses. Twee benaderings is deur die
howe gevolg, naamlik 'n benadering waar 'n wye diskresie uitgeoefen word en 'n
benadering waar 'n beperkte diskresie uitgeoefen word, dus 'n gekwalifiseerde uitsluitingsbenadering. Die skrywer doen aan die hand dat beide gronde vir
uitsluiting van belang is en dat die howe verkeie faktore moet oorweeg ten einde
'n beslissing te vel oor die insluiting of uitsluiting van ongrondwetlike getuienis. 'n
Balans moet dus gehandhaaf word tussen die belang van die beskuldigde op 'n
billike verhoor en die belang van die gemeenskap daarin dat regspleging nie
benadeel moet word nie en dat reg en geregtigheid moet geskied / Section 35(3) of the Constitution Act 108 of 1996 deals with the exclusion of
unconstitutionally obtained evidence and stipulates that such evidence must be
excluded if the admission would render the trial unfair or be detrimental to the
administration of justice. From the wording of the section it seems that the
courts have no jurisdiction in regard to the admissibility question and that a strict
exclusionary approach must be followed. The purpose of this dissertation is to
investigate the amount of discretion that the Courts have, and the manner in
which this discretion is applied in the process of decision making. Two
approaches were followed by the courts namely a wide discretionary approach
and an approach where a strict discretion was applied. It is submitted that botR
grounds for exclusion are of importance and that the courts must consider a
variety of factors in deciding the question on the inclusion or exclusion of
unconstitutionally obtained evidence. A balance must be struck between the
interest of the accused in a fair trial and the interest of the community that the
