Medida socioeducativa de internação no Maranhão: uma visão de seus atores / Educational measure of hospital Maranhão: a view of its actors

O presente trabalho apresentado ao Programa de Pós-Graduação em Psicologia Social da Universidade do Estado do Rio de Janeiro (UERJ), no Curso de Doutorado Interinstitucional (DINTER) realizado em parceria com a Universidade Federal do Maranhão (UFMA), teve como proposta pesquisar a visão dos atores sociais envolvidos diretamente com a medida socioeducativa de internação no Maranhão. O objetivo da pesquisa foi identificar a visão dos atores sociais sobre aspectos relacionados ao processo de aplicação, execução e cumprimento da medida socioeducativa de privação de liberdade. Com o propósito de compreender a percepção das pessoas que atuam nas três etapas da medida socioeducativa de internação, realizou-se uma pesquisa de campo com três grupos sendo que, cada grupo foi representado por indivíduos que estavam vinculados a cada uma das etapas da referida medida. Os dados foram coletados por intermédio de entrevistas com os respectivos sujeitos, utilizando-se como apoio um roteiro semiestruturado, elaborado em consonância com os objetivos da pesquisa. Para categorização, dimensionamento e análise dos dados e dos registros do diário de campo utilizou-se a técnica de Análise de Conteúdo. Os resultados alcançados com a pesquisa proporcionam subsídios para uma reflexão sobre o processo e as condições em que se dão a execução e o cumprimento da medida socioeducativa de internação no Centro da Juventude Esperança (CJE) da Fundação da Criança e do Adolescente (FUNAC) no Maranhão (MA). Os resultados da pesquisa apontam para uma incongruência entre o que estabelece a Lei n 8.069/1990, que instituiu o Estatuto da Criança e do Adolescente (ECA), o que preconiza o Sistema Nacional de Atendimento Socioeducativo (SINASE) e o que, de fato tem sido efetivado pela unidade (CJE) de internação e execução da medida de privação de liberdade. Além destas questões, os resultados da pesquisa também indicam que o Sistema de Garantias de Direitos da Criança e do Adolescente (SGDCA), no Maranhão não vem funcionando em conformidade com os princípios e diretrizes previstos pelo ECA, cujo objetivo principal da medida socioeducativa de internação, abrangendo aspectos educativos, formativos e sociais, não estaria acontecendo no Estado do Maranhão. / This paper presented to the Graduate Program in Social Psychology at the State University of Rio de Janeiro (UERJ), the Interinstitutional Doctorate Course (DINTER) conducted in partnership with the Federal University of Maranhão (UFMA), was proposed search the vision of the social actors directly involved with the admission a socioeducative measure in Maranhão. The objective of this research was to identify the vision of social actors on issues related to the implementation process, implementation and enforcement of a socioeducative measure deprivation of liberty. With the purpose of understand the perception of people who act in three stages a socioeducative measure admission, there was a field research with three groups of which each group was represented by individuals who were linked to each step of the measure. Data were collected through interviews with their subjects, using as support a semi-structured, prepared in line with the research objectives. For categorization, measurement and analysis of data and registers of daily records we used the technique of content analysis. The results achieved from research grants to provide a reflection on the process and give conditions under which the implementation and enforcement of the measure socio admission in Hope Youth Center (CJE) Foundation for Children and Adolescents (FUNAC) in Maranhão (MA). The search results point to an incongruity between what the law provides n 8.069/1990, which established the Child and Adolescent (ECA), which advocates the National Socio-Educational Services (SINASE) and that in fact has been effected by the unit (CJE) admission and implementation of the measure of deprivation of liberty. Besides these issues the search results also indicate that the System Guarantees Rights of the Child and Adolescent (SGDCA) in Maranhão not have worked in accordance with the principles and guidelines provided by ACE, and that the main objective of the measure socio-admission, which are the aspects of education, training and social, would not be happening in the State of Maranhão.

De maneira geral, os resultados indicaram que os profissionais brasileiros apresentam qualificação para o trabalho com essas situações e utilizam especialmente a entrevista como instrumento principal de avaliação. Comparados aos profissionais americanos, os psicólogos brasileiros estão em desvantagem no que se refere ao conhecimento da literatura sobre abuso sexual. Em relação ao aspecto da tomada de decisão, os psicólogos decidem diferentemente sobre um caso fictício, mesmo diante das mesmas informações e são influenciados por aspectos representativos dos casos de abuso sexual. Para os operadores do Direito, a participação da Psicologia é essencial em diferentes funções no Poder Judiciário, tanto por habilidades e conhecimentos técnicos, quanto por habilidades pessoais que contribuem para o manejo das situações. Andando no fio da navalha: riscos e armadilhas na confecção de laudos psicológicos para a justiça / Walking on the razors edge: avoiding ethical pitfalls while performing psychological evaluations for the court

A perícia psicológica é um recurso previsto no Código do Processo Civil para instruir litígios processuais em Vara de Família. O laudo psicológico como documento escrito resultante da avaliação psicológica pericial deve preencher requisitos formais para ser aceito enquanto prova pericial pelo Direito. O laudo psicológico deve preencher requisitos técnicos e éticos para ser considerado um trabalho cientificamente aceitável na Psicologia. Estudou-se uma amostra de 31 representações (denúncias éticas) contra psicólogos que produziram laudos no período de 1997 a 2005 julgados pelo Conselho Regional de Psicologia 06. As categorias de análise criadas a partir da literatura especializada permitiram: conhecer o motivo da representação, identificar o profissional representado e discriminar o que o laudo deve conter para ser considerado um operador de verdade. Os resultados revelaram uma amostra heterogênea. Havia apenas quatro laudos psicológicos periciais sendo que os demais documentos eram declarações, pareceres e relatórios de atendimento psicoterapêutico. O maior número de representações partiu de pessoas que não foram atendidas ou avaliadas por estes psicólogos. O grupo profissional que recebeu o maior número de representações foi o dos que realizaram psicodiagnósticos ou terapias de crianças (21 profissionais). Do total, 20 representações foram arquivadas ou terminaram em absolvição. Oito profissionais foram condenados por fazerem afirmações a respeito de pessoas sem fundamentação técnica condizente. Três casos prescreveram. Concluiu-se que existe desconhecimento por grande parte da categoria sobre o trabalho desenvolvido no campo da Psicologia Jurídica, especificamente na Vara da Família. O psicólogo judiciário que atua nesta área produzindo laudos não é o profissional mais representado no CRP-06. Quase dois terços dos trabalhos escritos foram considerados isentos de falhas técnicas ou éticas. Os laudos considerados aceitáveis pelos padrões da profissão também o são para fim de prova judicial. As falhas mais graves não são da ordem da linguagem (problemas semânticos ou sintáticos), como também não são de dificuldade de comunicação da matéria psicológica ao leitor leigo, mas de estratégias de avaliação psicológica equivocadas. Os documentos escritos foram gerados a partir de atendimentos que desconsideraram aspectos importantes das famílias envolvidas em litígios processuais. Atribuiu-se tais falhas à atuação contratransferencial, falta de familiaridade com o trabalho com famílias e desconhecimento das relações de poder no trato com advogados e juízes. Alerta-se para o risco ético de se prescrever encaminhamentos jurídicos (sentenças) como resultado da avaliação psicológica, extrapolando o objeto e o objetivo da Psicologia. Reconhece-se o processo de normalização que é efetivado pela avaliação psicológica para fim de normatização da conduta pelo Poder Judiciário como forma de dirimir o conflito social. A atuação das Comissões de Ética dos Conselhos Regionais e Federal possui importante papel para garantir o exercício da cidadania e a normatização da prática psicológica. It must fulfill certain requirements to be accepted as a means to provide truth for the justice. It must present ethical and technical requirements to be considered a result of sound recognized psychological practice. 31 complaints of professional misconduct relating to the producing of psychological evaluation documents for Family Law courts were reviewed. These complaints were filed with Professional Board for Psychology 06 and processed during 1998 and 2005. Categories of analyses were devised through available scientific literature in the field. The reasons for the complaint, the identification of the respondent (the person that the complaint is filed against) group and the criteria to review the contested document were analysed. The result shows different kinds of written documents but only three complete psychological evaluations performed for the court. The largest group of respondents were clinical child psychologists (21 respondents). 20 complaints were either dismissed or considered that a rule violation was not established. Eight psychologists were found responsible of Ethical Principles of Psychologists and Code of Conduct violation by making statements about people without sufficient scientific basis. Three cases expired. There is a general lack of knowledge about forensic psychological activities in Family Law courts. The forensic psychologist whose activity is to perform child custody evaluations is not the prevalent group of respondents. Almost two thirds of all the contested written reports were considered flawless. Psychological evaluations contested but not sanctioned were found valid and useful in court. Semantic or syntax problems of language or incompetence to convey psychological subject to lay people were not the basis of filed complaints. There seems to be problems with psychological evaluation strategies instead. Important dynamic family issues were ignored leading to faulty conclusions stated on written reports. Acting out of counter transference feelings, lack of experience in work with families involved in justice, and lack of knowledge of the power struggle in dealing with lawyers and judges are thought to be reasons for the misconduct. A warning is made against psychological evaluation that addresses the merit of the case, thus performing an act alien to the object and objective of psychological practice. It is recognized that psychological evaluation leads to the normalization of human conduct then ruled acceptable or not through legal standards. Social conflicts should be ruled by courts and not by psychologists. The works of Professional Board of Psychology both regional and federal are of paramount importance for the active citizenship and responsible provision of psychological services.

A content analysis of forensic psychological reports written for sentencing proceedings in criminal court cases in South Africa

Since the 1970s there has been a rising trend in South Africa for legal professionals to use the services of psychologists in legal proceedings. Psychologists have therefore increasingly started to appear as expert witnesses in court cases. Despite this, the field of forensic psychology in South Africa has yet to be defined and delineated. Currently there are no set guidelines or regulations regarding who is qualified to do forensic work, and no standards against which this work can be measured. Psychology in the courtroom has begun to receive a notorious reputation as a result of this. The Professional Board for Psychology (PBP) of the Health Professions Council of South Africa (HPCSA) is investigating the creation of a new category of registration, that of Forensic Psychologist, partly in an effort to manage and address this problem. However, to date little, if any, research has been conducted on the scope of the work presented to the courts by psychologists appearing as expert witnesses. This research aimed to address this gap by analysing a sample of forensic psychological reports. The following aspects were investigated: <ul><li>Who (category or registration, length of registration, etc.) is doing sentencing reports;</li> <li>How (interviews, collateral information, psychometric tests, etc.) these reports are compiled; and</li> <li>Whether these reports measure up to professional expectations as well as adhere to the guidelines of the HPCSA.</li></ul> It is clear from the results of this research that some of the psychologists doing forensic assessments and writing reports do so in an idiosyncratic way. Besides the fact that no uniformity exists, forensic work is sometimes done by psychologists who are not qualified to do so in terms of their registration category and thus their scope of practice. The reports analysed did not always measure up to guidelines or professional standards from abroad (in lieu of local standards or guidelines for reports) and/or transgressions were made in terms of HPCSA policies and guidelines. This situation is understandable in the light of two shortfalls in this field, namely training and regulation. The following recommendations can be made on the basis of this study: <ul><li>That psychologists who are adequately trained and have the proven experience in forensic work, be accredited by the PBP;</li> <li>That guidelines and standards for forensic work be drawn up by the PBP; in addition, that more complete ethical guidelines than those contained in chapter 7 of the PBP’s Rules of Conduct Pertaining Specifically to Psychology also be drawn up;</li> <li>That adequate training at MA level in basic forensic issues be made compulsory, with the option of advanced training for those wishing to specialise in the field; and</li> <li>That lawyers be trained in basic concepts of psychology so as to allow for better selection of an appropriate psychologist to assist them and also to assure effective cross-examination regarding psychological issues in court.</li></ul> If these recommendations were implemented, they could aid in regulating the field, thus producing forensic work of a consistently high quality. This will hopefully help to narrow the gap between the expected and actual interaction between law and psychology. <p>  </p> <p>An increasing number of working age adults are choosing to delay or forego parenthood entirely, but little research has explored how voluntarily childfree adults are perceived and treated in the workplace. While a large body of research has examined the impacts of motherhood on working women, little work has been done to understand the experiences of voluntarily childfree women. This study explored perceptions of working women based on their reproductive choices and whether these perceptions relate to differences in promotion decisions. Based on social backlash theory, I hypothesized that voluntarily childfree (VCF) women would be penalized in promotion decisions, and that perceptions of agentic-dominance and communality would explain this relationship. Using a sample of 220 participants recruited through Amazon Mechanical Turk, I tested my proposed mediation model and found no support for my hypotheses. Counter to expectations, no evidence of the motherhood penalty emerged either. Despite the lack of significant findings in this study, future work should consider assessing the relationships proposed with different experimental design.</p>

[pt] O abuso sexual infantil (ASI) é um fenômeno de extrema complexidade, considerado como uma das mais graves formas de violação de direitos humanos. São necessárias intervenções terapêuticas e judiciais. Quando ocorrido no seio familiar, além das medidas que interrompam a violência e responsabilizem o agressor, é imprescindível o tratamento da criança e da família. O presente estudo investigou as práticas em avaliação psicológica realizadas pelos psicólogos forenses do judiciário fluminense nos processos judiciais envolvendo suspeita de abuso sexual infantil intrafamiliar. Para tanto, foram entrevistados seis psicólogos forenses vinculados ao Tribunal de Justiça do Estado do Rio de Janeiro (TJRJ). Entre os participantes estão quatro analistas judiciários ocupando cargos de psicólogos e duas psicólogas peritas judiciais. A partir da análise de conteúdo de Bardin, emergiram três categorias: avaliação psicológica: percepções e recursos; perícias psicológicas em casos de abuso sexual infantil intrafamiliar; e dificuldades dos psicólogos forenses no contexto do TJRJ. Concluímos que as práticas avaliativas são diversas e que há pouca abertura para a utilização de instrumentos psicológicos além das entrevistas. O espaçamento temporal entre a ocorrência da violência e a perícia, o alto volume de trabalho e os curtos prazos processuais foram complicadores referidos por todos os participantes. Evidenciamos que as limitações inerentes ao contexto forense interferem na sistematização do processo avaliativo e na escolha dos procedimentos a serem utilizados nas perícias judiciais. Destacamos a importância de mais estudos sobre as dificuldades enfrentadas pelos psicólogos no campo forense em razão das particularidades de cada estado brasileiro. / [en] Child sexual abuse is a phenomenon of extreme complexity, considered one of the most serious forms of human rights violation. Therapeutic and judicial interventions are required. When it occurs within the family, in addition to measures that stop the violence and hold the aggressor accountable, the treatment of the child and the family is essential. The present study investigated the practices in psychological assessment carried out by forensic psychologists of the Rio de Janeiro judiciary in judicial proceedings involving suspected intrafamilial child sexual abuse. For that, 6 forensic psychologists linked to the Court of Justice of the State of Rio de Janeiro were interviewed. Among the participants are four judicial analysts occupying positions of psychologists and two psychologists who are judicial experts. From Bardin s content analysis, three categories emerged: psychological assessment: perceptions and resources; psychological expertise in cases of intrafamilial child sexual abuse and difficulties faced by forensic psychologists in the context of the Court of Justice. We concluded that the evaluative practices are diverse and there is little opening for the use of psychological instruments besides the interviews. The temporal spacing between the occurrence of violence and the expertise, the high volume of work and the short procedural deadlines were complicating factors mentioned by all participants. We evidenced that the limitations inherent to the forensic context interfere in the systematization of the evaluation process and in the choice of procedures to be used in the judicial expertise. We emphasize the importance of further studies on the difficulties faced by psychologists in the forensic field due to the particularities of each Brazilian state.

Validation of the Forensic Assessment Interview Technique

This research paper has examined the validity of the Forensic Assessment Interview Technique (FAINT). FAINT is a specific interview process - accepted and in current use - integrating the works of this researcher with the works of John Reid, Richard Arther, and Avinoam Sapir. The FAINT technique involves the evaluation of nonverbal behavior, projective analysis of unwitting verbal cues, and statement analysis. The fundamental hypothesis of FAINT is that truthful and deceptive criminal suspects differ demonstrably in their nonverbal, verbal and written communication, when asked to respond to a structured format of interview questions. FAINT maintains that these differences are observable and can be quantified to allow forensic interviewers to make accurate determinations of a suspect's involvement in a crime. This research has examined the validity of the technique as measured by a traditional, unweighted 3 point scale and a weighted scoring system (an issue being researched in this paper) comparatively used for determining truth or deception. This dissertation reports the results of both scoring systems, as well as a comparison between them and the historically used Behavioral Analysis Interview (BAI) that was developed by John E.
