Among the different rights that workers are entitled to, the right to vacations has currently become one of the most relevant. However, many questions could be made regarding thesaid  entitlement:  What do we mean when we refer to vacations? Which are its mainelements? What is its purpose?In the present article, the author answers those questions in the light of several doctrinal studies, international legislation and constitutional jurisprudence. He also stresses the role the International Labor Organization Convention 132 plays on the matter, as well as the importance of the respect of freedom of association. / Entre los distintos derechos que el Derecho del Trabajo reconoce al trabajador, el derecho de vacaciones se ha constituido en uno de losmás relevantes actualmente. Ahora bien, al respecto pueden surgir ciertas interrogantes: ¿A qué nos referimos cuando hablamos de vacaciones?; ¿Cuáles son los elementos que la componen?; ¿Cuál es su finalidad?En el presente artículo, el autor responde estas y otras preguntas, a la luz de diversos estudios doctrinarios, legislación internacional y jurisprudencia constitucional. Destaca, asimismo, el papel que cumple el Convenio 132 de la Organización Internacional del Trabajo y la importancia del respeto de la libertad sindical.

A presente tese visa demonstrar que, à luz da experiência vivida pela Itália pela Espanha, a concertação social pode ser um instrumento bastante útil para o enfrentamento de diversos temas de política social e econômica. Todavia o pleno reconhecimento da liberdade sindical é imprescindível para que a concertação social seja realizada de maneira legítima, pois somente mediante a existência de interlocutores verdadeiramente representativos, governo e atores sociais consiguirão manter entendimentos socialmente vinculantes e que sejam capazes de espelhar a realidade social. O Brasil não reconhece plenamente a liberdade sindical e por tal motivo, as tentativas de concertação social realizadas a partir da segunda metade da década de 1980 não contaram com o efetivo envolvimento das partes sociais. Mesmo assim, o país progrediu desde então, e atualmente gera grande interesse por parte da comunidade internacional. Não obstante, para que o Brasil aprofunde o processo da integração regional, bem como conquiste uma posição de efetivo destaque e influência no contexto internacional, é fundamental o reconhecimento pleno da liberdade sindical, o que permitirá finalizar a transição democrática, bem como a celebração de pactos sociais legítimos, sempre que eles se demonstrarem necessários. / The present thesis intends to evidence that, in light of the experience lived by Italy and Spain, social concertation can be a very useful instrument in order to face many issues with regard to social and economic policy. Notwithstanding, the complete acknowledgement of freedom of association is necessary in order to social concertation be made trough legitimate means, because only upon the existence of truly representative interlocutors, government and social partners will keep socially binding understandings, capable of reflecting the social reality. Brazil does not fully acknowledge freedom of association and, as a consequence, the social partners were not concretely involved with the attempts of social concertation that took place as from the late 1980s. Even though, the country has developed since then, and currently it generates a great interest within the international community. Notwithstanding, if Brazil wishes to deepen the regional integration process, as well as to conquer a key role within the international context, it is crucial to fully acknowledge freedom of association, what will allow the country to conclude the democratic transition, as well as to execute legitimate social pacts, whenever they become necessary.

The creation of a general duty to bargain in view of the SANDF judgements / Louis Lodewyk Krüger

Section 23(5) of the Constitution entrenches trade unions, employer's organisations and employers' right to engage in collective bargaining. For employees, collective bargaining is the key which opens the door to better wages, improved working conditions and an overall better standard of living to name but a few. The Labour Relations Act was promulgated to give effect to section 23 of the Constitution. However, in section 2 of the Labour Relations Act, members of the South African National Defence Force were excluded from the ambit of the Labour Relations Act (LRA). After the Constitutional Court regarded members of the South African National Defence Force (SANDF) to be "workers", they also had the right to engage in collective bargaining. However, because of the special duty that the members of the SANDF have to fulfil namely to ensure the safety of the republic and its citizens, they are not awarded the right to strike. The question therefor is: How do the members of the SANDF compel the SANDF to bargain with them? The aim of this study is to establish if a duty to bargain was implemented by Chapter XX of the General Regulations of the South African National Defence Force and the Reserve. Firstly, the new dispensation of voluntarism under the new LRA is examined to understand how collective bargaining would work in a normal situation and not that of the members of the SANDF. Freedom of association is also discussed. The reason for this was because members of the SANDF also have to right to associate with a trade union of their choice by sections 18 and 23(2) of the Constitution. Under the new LRA, organisational rights also play a major role in the bargaining process and afford trade unions more bargaining power. The voluntarist approach followed by the new LRA effectively removed the duty to bargain from collective bargaining. As explained above, the special situation applicable to the SANDF and its members are not governed by the LRA and therefor a duty to bargain might still exist in this specific system of collective bargaining managed by the regulations. The duty to bargain is based on representativeness and good faith which are also examined in this study. To establish if a duty to bargain was created by the courts, an examination of the judgements of the High Court, the Supreme Court of Appeal and the Constitutional Court. The Constitutional Court reiterated that there is no legally enforceable duty to bargain between the SANDF and the South African National Defence Union (SANDU). If Chapter XX of the regulations is scrutinised, it can however be seen that there is an initial duty on the SANDF to bargain with a registered military trade union over matter set out in regulation 36 which include most if not all matters of mutual interest. This paper discusses if Margin of Appreciation is compatible with the idea of universal human rights. Through the case of Negative freedom of association in Sweden, it studies the phenomenon that Giorgio Agamben has called the State of exception. The questions that are discussed and answered are 1) How does the rights theories of Jack Donnelly and Ronald Dworkin relate to Margin of appreciation, and 2) How has Margin of appreciation been applied in cases concerning the negative freedom of association in Sweden, in the European court for human rights. These questions and answers are then used in the discussion on how Margin of appreciation affects the concept of universal human rights. / Denna uppsats diskuterar frågan om Margin of Appreciation är förenligt med tanken om universella mänskliga rättigheter. Genom studier av den negativa föreningsfriheten i Sverige, så undersöks doktrinen Margin of appreciation och hur den förhåller sig till tanken om universella rättigheter. Frågorna som diskuteras och besvaras är 1) hur förhåller sig Jack Donnellys respektive Ronald Dworkins rättighetsteorier till Margin of appreciation, samt 2) Hur har Margin of appreciation tolkats i europadomstolens i fall gällande den negativa föreningsfriheten i Sverige. Dessa frågor tas till hjälp i diskussionen kring hur Margin of appreciation påverkar tanken om universella mänskliga rättigheter.

Incorporating the core international labour standards on freedom of association and collective bargaining into Vietnam's legal system

This Dissertation evaluates the potential opportunities, challenges and outcomes attendant on Vietnam’s modernisation effort through the incorporation of International Labour Organisation (ILO) Core International Labour Standards (CILS) on freedom of association and collective bargaining into Vietnam law. The Dissertation shows that although Vietnam is likely to benefit from incorporating the CILS on freedom of association and collective bargaining into its legal system, its constitutional value system is not currently consistent with those of particular ILO CILS. It offers recommendations on pre- substantive and procedural measures necessary to ensure the successful reception of ILO CILS on freedom of association and collective bargaining into Vietnam legal practice.

A presente pesquisa analisa o direito à assistência jurídica integral e gratuita como pertencente ao grupo dos direitos humanos e também dos direitos fundamentais. Seu estudo é elaborado sob o aspecto do desenvolvimento do Estado do Bem Estar Social, do princípio da igualdade e da superação dos obstáculos ao acesso à Justiça. Nesse sentido, é enfatizada a função da Defensoria Pública da União como entidade responsável por prestar assistência jurídica no âmbito da Justiça do Trabalho, tanto aos trabalhadores necessitados, como aos empregadores que comprovarem os requisitos elencados pela lei para obtenção dessa assistência. Além disso, são analisadas algumas especificidades do Direito do Processual do Trabalho como o jus postulandi e a questão dos honorários advocatícios relacionadas ao tema da assistência jurídica. Por fim, em decorrência do tratamento legal concedido à prestação de assistência jurídica na seara laboral, é estudada com maior profundidade a função assistencial dos sindicatos diante do princípio da liberdade sindical e as modalidades de assistência jurídica que as entidades sindicais prestam a seus representados. / The following research analyzes the right to free and integral legal aid as part of human rights as well as fundamental rights. Its study is developed from the points of view of the Welfare State, the principle of equality and the overcoming of obstacles towards the access to Justice. In this regard, it is emphasized the role of the Federal Public Defender\'s Office as the entity responsible for providing legal aid services in the scope of Labor Court, for both workers in need and for employers who prove to meet the requirements listed by law for obtaining this assistance. Furthermore, we analyzed some particularities of the Labor Procedural Law such as the possibility for a party to plead his own cause and the matter of attorneys\' fees in labor cases related to legal aid. Ultimately, due to treatment granted to legal referral in the labor field, the assistance role of trade unions is studied more deeply next to the principle of freedom of association and the categories of legal aid services which these unions provide to their ones represented.

It is the right of collective exercise that, through a combination of efforts, aims to achieve a common and edifying goal. The understanding of the constitutional content of the freedom of association derives from the gathering of some elements which characterise this freedom, and they comply with the legal system. In addition to this, in order to guarantee its effectiveness, one needs to consider the instruments which allow the individual the full enjoyment of this freedom. The thesis foresees to the association a set of elements, rights, instruments and prohibitions which identifies the constitutional characteristic of such freedom. Furthermore, it studies the limitation of state power and the juridical security for its existence. The topic was developed on the grounds of the importance that the freedom of association, if well applied, seems to have in relation to the effectiveness of other rights, equally fundamental, and it aspires to achieve democracy. Therefore, it is necessary to recognise the constitutional content of the freedom of association in order to use / A liberdade de associação prevista como direito fundamental apresenta-se como uma das feições da liberdade individual. O conteúdo constitucional do direito de associação depreende da reunião de alguns elementos caracterizadores desse direito que o conformam ao ordenamento jurídicoconstitucional. O presente estudo tem por objetivo identificar de que forma o direito de liberdade de associação vem sendo aplicado com relação às organizações da sociedade civil no Brasil. A partir da análise das diferentes dimensões da liberdade de associação e das normas que tratam das organizações da sociedade civil no Brasil pós Constituição Federal de 1988, apresentamos os principais desafios a serem superados para que as organizações da sociedade civil sejam tratadas de forma a melhor garantir o direito de liberdade de associação e um marco regulatório mais adequado ao seu desenvolvimento. / The present study aims to identify how the right to freedom of association has been applied with respect to civil society organizations in Brazil. From the analysis of the different dimensions of freedom of association and rules dealing with civil society organizations in Brazil, after the Federal Constitution of 1988, we present the main challenges to be overcome so that civil society organizations can be treated to ensure right to freedom of association and a legal framework best suited to their development.
