No / About a week after the terrorist attacks on New York and Washington, staff and students in the Department of Peace Studies at the University of Bradford met to begin discussing how the Department should respond. At one end of the spectrum was the conviction that the Department should publicly express a collective position. Both within and outside the Department, people were asking: What is the position of peace studies? At the other end, there was the equally strong conviction that it was both impossible and inappropriate for the Department to answer this question, that peace studies should provide a space for argument and debate about the complexities of the situation rather than presume a consensus that might not exist beyond a very general level. The first argument worried those who —justifiably —insist that intellectual freedom and debate is integral to academic activity. The latter disappointed those who —equally justifiably —expect peace studies to take a clear stance in favor of the values that constitute the very rationale of the discipline.

Previous issue date: 2017-05-05 / Coordenação de Aperfeiçoamento de Pessoal de Nível Superior - CAPES / The thesis The theory of emancipation in Karl Marx and Jürgen Habermas aims to understand the conceptual historical development of emancipation’s notion. The emergence of this concept occurs in the universe of Roman law and remain with this characteristic until the eighteenth century, in the Enlightenment movement, when it will receive new meanings. The emancipation’s concept is present in the Karl Marx and Jürgen Habermas’s thinking, from distinct categories, respectively, work and interaction, but within the same notion of Enlightenment rationality. Our hypothesis is that a relation of distinction between the competing thoughts of these authors is established, but that it will enable the understanding of the theory of the emancipation of both, arising from influences of the Enlightenment. To answer this problem we go through four stages: first, we approach the state of the art of emancipation’s concept; Second, we investigate the notion of human emancipation in Marx; Third, we analyze the emancipatory conception of Habermas and fourth, we approach a critique of the habermasian notion from contemporary philosophy. / Le sujet de cette thèse comprendre dans ‘La théorie de l'émancipation en Karl Marx et Jürgen Habermas’, vise à comprendre le développement historique et conceptuel de la notion d'émancipation. L'émergence du concept d’émancipation se produit dans l'univers du droit romain et de rester avec cette fonction jusqu'au XVIIIe siècle, le mouvement des Lumières, un temps que recevront de nouvelles significations. Le concept d'émancipation est présent dans la pensée de Karl Marx et Jürgen Habermas, de différentes catégories, respectivement, soit les catégories de travail et de l'interaction, cependant, dans la même notion de rationalité des Lumières. Notre hypothèse est qu'il ya une relation qui distingue la notion de émancipation entre les pensées concurrents de chaque auteur, et que, d'autre part, permettre la compréhension de la théorie de l'émancipation parmi les philosophes allemands, montrant en particulier l'influence des Lumières. Pour répondre à ce problème, nous choisissons quatre étapes: tout d'abord, nous avons abordé l'état d’art du concept de l’émancipation; en deuxième lieu, nous étudions la notion d'émancipation humaine chez Marx; ensuite, nous analysons la conception émancipatrice de Habermas; et finalement, nous traitons de la critique de la notion de Habermas sur la philosophie contemporaine. / A tese A teoria da emancipação em Karl Marx e Jürgen Habermas objetiva compreender o desenvolvimento histórico conceitual da noção de emancipação. O surgimento deste conceito dá-se no universo do direito romano e mantêm-se com esta característica até o século XVIII, no movimento iluminista, quando receberá novas significações. O conceito de emancipação está presente no pensamento de Karl Marx e de Jürgen Habermas, a partir de categorias distintas, respectivamente, trabalho e interação, mas dentro de uma mesma noção de racionalidade iluminista. Nossa hipótese é que se estabelece uma relação de distinção entre os pensamentos concorrentes destes autores, mas que possibilitará a compreensão da teoria da emancipação de ambos, surgidas de influências do Iluminismo. Para responder a este problema percorremos quatro etapas: primeiro, abordamos o estado da arte do conceito de emancipação; segundo, investigamos a noção de emancipação humana em Marx; terceiro, analisamos a concepção emancipatória de Habermas e, quarto, abordamos uma crítica a noção habermasiana a partir da filosofia contemporânea.

Dès l'apparition de la Théorie de l'agir communicationnel, les philosophes critiquent le modèle système/monde vécu. Cette théorie de la société repose sur la nouvelle théorie habermassienne de la pragmatique universelle et de son appropriation à la théorie des systèmes de Talcott Parsons. La plupart de ces critiques doutent de la viabilité théorique de d'un modèle binaire de la société. Toutefois, dans cette thèse, je constate l'impossibilité de réconcilier cette nouvelle conception de la société avec les positions politiques antérieures d'Habermas. Il est improbable qu'Habermas aurait pu participer à ces débats tout en défendant sa théorie binaire de la société. Finalement, je constate l'impossibilité de réconcilier ce nouveau modèle théorique avec la théorie du droit développée dans Droit et démocratie. J'arrive à la conclusion suivante : le modèle système/monde vécu doit être modifié ou abandonné.

I föreliggande studie undersöktes eventuella skillnader mellan de politiska blocken i valen mellan år 1988 och 2014. Valmanifesten från de nuvarande riksdagspartierna exklusive Sverigedemokraterna kodades i enlighet med en innehållsanalys och problematiserades utifrån teorier från Chantal Mouffe och Jürgen Habermas. Från Mouffe användes teorin om den så kallade konsensuspolitiken och från Habermas teorin om det kommunikativa handlandet. Författarna ville med teorierna dels se om blocken genom konsensus närmat sig varandra, dels resonera kring om detta har skett i en anda av förståelse och samförstånd utmynnande i överrensstämmelse blocken emellan.Teorierna användes som problematiseringsverktyg på de tio kategorier som av författarna fastställdes, utifrån vilka frågor som dominerade valmanifesten. Studien visar att det mellan 1988 och 2014 fanns en mätbar skillnad blocken emellan, det vill säga, blocken hade blivit mer lika och därmed vad de undersökta sakfrågorna beträffar, mer homogena.

Previous issue date: 2015-03-13 / O direito fundamental ao meio ambiente ecologicamente equilibrado está
relacionado a vários casos submetidos ao Supremo Tribunal Federal (STF) e ao
Superior Tribunal de Justiça (STJ), a fim de que se estabeleça o que é devido às
partes envolvidas no processo judicial. O conteúdo das decisões e as teorias que
subsidiam a prática decisória de ambos os tribunais influenciam as demais
instâncias do Poder Judiciário no Brasil. Porém, nem todos os pressupostos
embutidos nas práticas decisórias dos julgadores satisfazem a exigência do Estado
Democrático de Direito de que as decisões jurídicas mantenham, ao mesmo tempo,
a segurança jurídica e a correção. O objetivo do presente estudo foi analisar se as
decisões judiciais envolvendo o direito fundamental ao meio ambiente
ecologicamente equilibrado, nas quais o sopesamento foi considerado como método
adequado para resolução de colisões entre princípios, afirmam aquilo que foi
democraticamente estabelecido, mantendo, ao mesmo tempo, a segurança jurídica
e a correção da decisão judicial. Foi desenvolvida uma pesquisa qualitativa, de
carácter descritivo, optando-se por um corte transversal, com período analisado
compreendido de 01 de julho de 2008 a 30 de junho de 2014. Para tratamento dos
dados utilizou-se a técnica de análise documental. Nos dois votos analisados do
STF, constatou-se uma prática decisória que não segue os pressupostos do
sopesamento conforme preconizado por Robert Alexy. No voto analisado do STJ, o
Ministro, apesar de considerar a ponderação como método adequado para
resolução de colisões, seguindo corretamente a teoria de Robert Alexy, o julgador
entendeu que não foi necessária a aplicação do método. Ao final, considerou-se que:
(I) o sopesamento não satisfaz as exigências de segurança jurídica e correção das
decisões judiciais envolvendo o direito fundamental ao meio ambiente
ecologicamente equilibrado, fragilizando a função de estabilizar expectativas que
esse direito deve realizar; (II) a prática decisória encontrada no dois votos do STF
fragilizam ainda mais essa função, atendendo menos ainda às exigências para a
decisão judicial. / The fundamental right to an ecologically balanced environment is related to several
cases submitted the Supreme Court (STF) and the Superior Court of Justice (STJ), in
order to establish what is owed to the parties involved in the judicial process. The
content of the decisions and the theories that support the decision-making practice of
both courts influence the other instances of the judiciary in Brazil. However, not all
the assumptions embedded in decision-making practices of the judges satisfy the
requirement of democratic rule of law: legal certainty and correctness of the
judgment. The aim of this study was to examine whether the court decisions involving
the fundamental right to an ecologically balanced environment, in which the
balancing was selected as an appropriate method for resolving collisions between
principles, confirm what was democratically established, ensure at the same time,
legal certainty and the correctness of the judgment. A qualitative and descriptive
character research was developed, opting for a cross-section, with the analyzed
period comprised of 1 July 2008 to 30 June 2014.The document analysis technique
was used to process the data used up. In both STF votes analyzed, there was a
decision-making practice that does not follow the balancing assumptions as
recommended by Robert Alexy. On a vote of the STJ analyzed the Minister, despite
considering the balancing as appropriate method for resolving collisions, following
the theory of Robert Alexy correctly, the judge understood that it was not necessary
to apply the method. In the end, it was considered that: (I) the balancing does not
satisfy the both requirements of legal certainty and correctness of judgments
involving the fundamental right to an ecologically balanced environment, weakening
the function of stabilizing expectations that this right must be carried out; (II) the
decision-making practice found in the two votes of the Supreme Court further weaken
this function, given even less to the both requirements of the judgment.
