A pretensão do positivismo jurídico é o esclarecimento teórico para se realizar uma descrição correta do direito. A presente dissertação busca verificar qual a abordagem mais adequada para se alcançar a concretização da separação do direito da moral, sendo que o fio condutor é a obra de H.L.A. Hart, na qual se destaca o livro The Concept of Law. Dessa maneira, o problema a que se propõe o trabalho é evidenciar a complexidade da separação do direito da moral. Pretende-se demonstrar, principalmente através da teoria e obra de Herbert Hart, que Oliver Holmes e Hans Kelsen ao apresentarem seus projetos para separação do direito da moralidade, trataram o direito do ponto de vista descritivo, perdendo a caracterização do próprio direito. O primeiro capítulo é dedicado a apresentar e explicar o projeto positivista, já que condutas exigíveis por regras jurídicas não se confundem com as condutas exigidas por regras morais, ainda que conjuntamente possam existir. Ainda nesse capítulo apresentam-se algumas noções importantes para a compreensão e desenvolvimento do trabalho em relação à teoria de Hart, em especial no que tange ao ponto de vista interno e externo. No segundo capítulo é abordada a obra de Holmes, The Path of the Law, e as principais críticas construídas por Hart e discutidas por Stephen Perry e Scott Shapiro. Partindo-se da perspectiva do homem mau presente na teoria, pretende-se demonstrar que esta é insuficiente para compreender a teoria do direito, em especial nas razões pelas quais um cidadão segue o direito, já que nem todos estariam preocupados em qual é a sanção que receberão do Estado caso desobedeçam à regra. No terceiro e último capítulo demonstra-se quais os problemas da teoria de Kelsen apontadas por Hart. Especialmente no que se refere à ideia de Kelsen de que o direito é só forma, podendo ter qualquer conteúdo, enquanto que Hart acredita que o direito deve possuir conteúdo mínimo. Segundo Kelsen, a estrutura normativa é pressuposta, sendo que a regra funciona como esquema de interpretação e a principal função desta é a sanção. O objetivo final do trabalho é demonstrar que neste projeto de tentar salvar a autonomia do direito, Holmes e Kelsen descaracterizaram o fenômeno jurídico como uma prática social. / The claim of legal positivism is the theoretical clarification to perform a correct description of the law. This work aims to verify the most appropriate approach to achieving the implementation of the separation of law from morality, and the common thread is the work of H.L.A. Hart, which stresses the book The Concept of Law. Thus, the problem that is proposed work is to show the complexity of separating law from morals. We intend to show, especially through the theory and work of Herbert Hart, that Oliver Holmes and Hans Kelsen when presented their projects for separating the right of morality, they treated law of the descriptive point of view, losing the characterization of the law itself. The first chapter is dedicated to present and explain the positivist project, as required by legal conduct rules are not confused with the conduct required by moral rules, albeit jointly may exist. Although this chapter presents some important concepts for understanding and development work in relation to Hart's theory, especially with regard to internal and external point of view. The second chapter discussed the work of Holmes, The Path of the Law, and the main criticisms built by Hart and discussed by Stephen Perry and Scott Shapiro. Starting from the bad man present perspective in theory, intended to demonstrate that this is insufficient to understand the theory of law, in particular the reasons why a citizen follows the law, since not everyone would be worried about what is the sanction which receive if they disobey the rule. In the third and last chapter shows is that the problems of Kelsen's theory pointed out by Hart. Especially with regard to the idea of Kelsen that law is shaped and can have any content, while Hart believes that law should have a minimum content. According to Kelsen, the regulatory framework is presupposed, and the rule works as interpretation scheme and the main function of this is the sanction. The ultimate goal of the work is to demonstrate that this project of trying to save the autonomy of law, Holmes and Kelsen misrepresent the legal phenomenon as a social practice.

Status & solidarity through codeswitching: three plays by Dolores Prida

This analysis employs the sociolinguistic framework of status and solidarity (Holmes, 2001) to examine the use of codeswitching on the relational development between the characters in three plays by Cuban-American playwright Dolores Prida. The three plays discussed are Beautiful Señoritas (1978), Coser y cantar (1981) and Botánica (1991). Linguistic scholars recognize the lack of linguistic analysis of literary texts; specifically, codeswitching at present is not fully explored as a linguistic phenomenon in written contexts. Furthermore, Prida's works have never before been appraised using linguistic methodology. Hence, this work aims to add to scholarly research in the fields of codeswitching, discourse analysis, and literary linguistics, using the status and solidarity framework to examine the codeswitching in Dolores Prida's plays. Dolores Prida is a feminist and Hispanic dramatist whose central theme is the search for identity of Hispanic immigrants, specifically women, in the United States today. Due to her ideological stance, it is expected that a strong emphasis on solidarity rather than status and the use of affective rather than referential speech functions are present in the relationships in her plays. Accordingly, the analysis of Botánica reveals that indeed codeswitching between the characters does affect their relational development in maintaining solidarity and intimacy. However, the relationships found in Beautiful Señoritas and Coser y cantar do not offer such conclusions, due to the variable nature of the relationships identified. Further analysis of these and other literary works will more accurately determine benefits of the status and solidarity framework as applied to the codeswitching research.

This thesis is a queer masculinity reading of Sir Arthur Conan Doyle’s short story collection The Memoirs of Sherlock Holmes (1894). The analysis focuses on the dissonances, tensions and queerness that reside within the text itself. This has been done from my problem statement: How is Sherlock Holmes and John Watson’s sexuality and masculinity portrayed within the boundary of the text? What is being said, what is hidden, and what is dealt with silently? To reveal these queer parts this analysis has been focused around five themes: the late Victorian male, the Woman, countertypes and decadence, the homosocial sphere and sexuality. The thesis has two major theoretical perspectives: masculinity theory, and queer theory. For the masculine analysis I have used Jørgen Lorentzen and Claes Ekenstam’s concept of manly/unmanly, character, and the citizen from the book Män i Norden: Manlighet och modernitet 1840-1940 and George L. Mosse’s countertype. For the queer theoretical I have used a queer resistant reading combined with Eve Kosofsky Sedgwick’s concept of homosexual panic, and Judith Butler’s gender melancholia. Professor Joseph A. Kestner’s Sherlock’s Men has guided the reading of the short story collection. This thesis aims at showing that the improbable might well reside within the text, not least in the relationship between the two main characters Holmes and Watson. At first glimpse this world of Holmes’s seems devoid of desire, but in a closer reading cracks appear. There are silences, and unnecessary explanations, which have little to do with the adventures themselves, not to mention silent looks, and the association with the domestic. These threaten to effeminize their masculinity, especially Holmes who is a bachelor and suffers from repeated nervousness. Disease of the nerves was associated with effeminacy and homosexuality during the Victorian era. Also, the relationship between Holmes and Watson do at times parody the heterosexual. It’s hard however to find any conclusive evidence of any sexuality in the text, least of all homoerotic, which is hardly surprising considering the forbidding laws that were in place.

La cohérence du sujet en éthique environnementale: J. B. Callicott vu par le prisme de la théorie intégrale de K. Wilber

Estimant qu'il est nécessaire de fonder la valeur intrinsèque de la nature et constatant l'insuffisance des pistes tracées par Baird Callicott pour ajuster son axiologie subjective moderne à un cadre de pensée postmoderne, j'entreprends de repenser ses notions de sujet et de valeur intrinsèque afin d'y intégrer non seulement l'invalidation écologique-quantique d'une séparation tranchée entre sujet et objet, mais également des éléments prégnants de la pensée postmoderne :la contextualisation, le constructivisme, et l'aperspectivisme découlant de ces deux traits (la pensée ne peut plus indûment privilégier une perspective particulière). <p>J'utilise pour cela comme outil heuristique la théorie intégrale de Ken Wilber, et mets à profit une série d'analyses et de concepts novateurs inscrits dans une post-métaphysique intégrale, afin de proposer une voie de dépassement au dualisme inhérent à l'axiologie de Callicott et d'équilibrer son approche foncièrement matérielle de l'ontologie morale et du soi relationnel par et au sein d'un holisme intégral (extérieur et intérieur). Celui-ci repose sur la ré-introduction des intériorités du monde :le holisme n'est en effet pas simplement un multiplexe de relations internes entre surfaces matérielles mais également, et nécessairement, le multiplexe des relations intérieures qui co-constituent toute entité, tout holon. <p>Un holon désigne un tout-partie – à la fois entièreté persistante en relation avec d'autres entièretés et partie constituante d'une entièreté plus profonde – qui possède donc intrinsèquement une dimension individuelle et une dimension collective. Celles-ci se doublent de dimensions extérieures (aspects du holon accessibles à l'observation par les sens physiques ou leurs extensions) et intérieures (aspects du holon qui échappent à l'observation matérielle et requièrent, pour leur appréhension, dialogue et interprétation). <p>Je préconise d'intégrer aux notions de sujet et de valeur intrinsèque ces quatre dimensions co-constitutives de tout holon, irréductibles les unes aux autres, et nécessairement impliquées pour tout référent. L'intersubjectivité, littéralement intrinsèque à tout rapport au monde comme à tout référent, en elle-même irréductible à des composantes matérielles, représente le dépassement des dualismes modernes en même temps que la ré-introduction en propre de l'intériorité inhérente du monde. Atomisme et holisme sont transcendés en une approche intégrale qui réinscrit, en regard des relations internes entre surfaces matérielles, les relations intérieures qui les agencent. Par le biais de la théorie intégrale de Wilber, je propose donc de réconcilier l'axiologie de Callicott et sa théorie de la valeur intrinsèque de la nature avec un cadre de pensée postmoderne réhabilitant les intériorités du vivant. <p>--------------- <p>Considering it necessary to articulate and to ground an understanding of the intrinsic value of nature, and finding that Callicott's proposals for adjusting his modern subjective axiology to a postmodern framework fall short on several accounts, I set about to rethink and reexamine his notions of subject and intrinsic value so as to have them integrate not only the ecological-quantic invalidation of the modern subject-object dichotomy but also some prominent features of postmodern thought :contextualism, constructivism, and, following those, aperspectivism (intenability of unduly privileging a single perspective). <p>To this end, I make use of Ken Wilber's Integral Theory as a heuristic tool and take advantage of several innovative analysis and concepts, set in the context of an integral post-metaphysics, in order to suggest a way of transcending the dualism inherent to Callicott's axiology whilst allowing for the fundamentally material conception of his moral ontology and relational self to be balanced by and within an integral holism (exterior and interior). This means re-introducing the world's interiorities :holism isn't simply about a multiplex of internal relations between material surfaces but also, and necessarily, about the multiplex of interior relations that are co-constitutive of any entity, of any holon. <p>A holon designates a whole-part – both a persisting entirety or whole involved in relations with other entities and a constitutive part of deeper wholes – that intrinsically possesses an individual and a collective dimension. These are both further comprised of exterior (aspects of the holon that are accessible to observation by the physical senses or their extensions) and interior (aspects of the holon that evade material observation and require, for their apprehension, a dialogue and interpretation) dimensions. <p>Intersubjectivity, which is literally intrinsic both to any relation with the world and to the co-creation of any referent, and is in itself irreducible to whatever material component, appears as the fundamental overcoming of modernity's dualisms. Concurrently, a holonic understanding of the notions of subject and of intrinsic value is recommended, such that the main constitutive and irreducible dimensions of any holon become foundational to both these notions. Atomism and holism are transcended into an integral approach that acknowledges the interior relations prominent in giving agency and meaning to the various internal relations between material surfaces focused on by Callicott. ”There is Nothing More Deceptive than an Obvious Fact” : A Feminist Study of the Detective Work by Miss Marple and Sherlock Holmes

This comparative study focuses on the detective genre and is conducted through literary analysis with a feminist critical perspective of two of its most iconic protagonists, Sherlock Holmes and Miss Marple, created by Sir Arthur Conan Doyle in 1887 and Agatha Christie in 1930 respectively. The purpose is to attempt to establish the effect of the gender differences on these two protagonists. Both Holmes and Miss Marple are deemed as iconic in the detective genre, but the protagonists do not have similar experiences and are created by authors of different genders. Thus, the focus is to explore how gender differences are represented in the literary texts A Study in Scarlet (1887), “A Scandal in Bohemia” (1891), and The Murder at the Vicarage (1930) when it comes to their work as detectives. By using a feminist critical perspective and with the help of previous research, the differences in three central issues, that is, work methods, attitudes and method of disguise, are established. The most prominent result from the analysis is that Miss Marple has to work independently from the police force and trust another character, Leonard Clement, with what she knows hoping that Clement will use her observations to make the case move forward. By contrast, Holmes is approached by clients and even assists the police force in investigations, while Miss Marple is dismissed because of gender discrimination and ageism when she reaches out to the police force. Miss Marple is clearly a victim of gender discrimination and ageism, while Holmes is seen as eccentric but fully competent as a detective. Holmes is even described as having “extraordinary powers” while Miss Marple is described as an “old pussy” in a derogatory manner.
