Reconstituting the Middle: Personhood Rhetoric in Discourse and LawJanuary 2018 (has links)
abstract: Treating the Pro-Life Movement as a monolithic entity creates a blind spot regarding the cognitive effect of the fetal personhood rhetorical framework. This study applies an interpretive lens, using legal and discourse analysis as tools, to provide a critical analysis of personhood laws and web content to shed light on how linguistic patterns construct, and are informed by, worldview. Examining variations in proposed Human Life Amendments—and asking how, or if, proposed bills achieve their specified aim—reveals tension in state and federal jurisdiction of abortion regulations. It also exposes conflicts concerning tactical preferences for attaining fetal personhood and ending abortion that are useful to differentiating the Pro-Life and Personhood Movements.
Framing and discursive practices of the Personhood Movement reflect a ‘black and white’ mentality and an overly-simplified worldview. Movement cognition is shaped by patterns of omission and exclusion, inclusion, repetition, troubling phrases, and the power of labels. The linguistic choices demonstrate, constitute, and reinforce the dominant narratives of the movement and are integral to advocacy, praxis, and legislative efforts. While the struggle to pass personhood-compliant legislation has not been successful, the rhetorical practices and representational framework of the Personhood Movement have succeeded in altering the national discourse surrounding beginnings of life and abortion. The extreme views of the Personhood Movement reconstitute the middle—making tactics of the mainstream Pro-Life Movement seem moderate and reasonable by comparison, which allows dangerous legislation to slide by under the radar. / Dissertation/Thesis / Masters Thesis Social Justice and Human Rights 2018

Previous issue date: 2014-02-04 / This thesis has the purpose of analyzing the current state of the constitutional
protection of human life and, from this, specifies the axiological dimension of the vital
existence of the human being. In this sense, it pursues the goal to establish, legally,
what is life as a constitutional and legal interest worthy of protection, stating its
definition and separating it by differentiation of those so called life related rights.
These conceptual foundations are indispensable to the attainment of what is
intended as a legal-axiological study of human life, which allows to recognize that,
despite the imperatives derived from the principle of human dignity, the legal
protection of human life realizes in different degrees of intensity and from arbitrary
criteria in a way that allows the deduction that human life is considered more or less
valuable in certain circumstances and, in some cases, one can even say that the
biological life of the human being does not have any value at all. Identification of
thecritical circumstances implying varying degrees of protection of life, as well as
those authorizing the abandonment and denial of its value, constitutes the core of
identificação de circunstâncias críticas que implicam em graus variáveis de proteção
da vida, bem como aquelas que autorizam o abandono e a negação de seu valor,
constitui-se no cerne desta tese

Kommer tid kommer tillit? : Unga vuxnas och medelålders erfarenheter / Trust from a life course perspective : Young and middle-aged Swedes' experiencesGrosse, Julia January 2012 (has links)
Even though Sweden is considered a high trust society, research on this topic is primarily based on a few standardized survey questions. It is also known that there is a robust pattern of less trustful young people compared to older ones. Still, a satisfactory explanation of this fact is lacking. Thus, the first aim of this dissertation is to map trust among young adults and middle-aged individuals. The second aim is to examine by which factors and in what way different dimensions of trust are determined, focusing on individuals’ life course and consequently experiences. Analytical principles from the life course tradition are used as a theoretical framework. Data is derived from a Swedish cross-sectional nationally representative postal survey on trust, and qualitative interviews using a mixed-methods approach. A multi-dimensional concept of trust is suggested. Participants report relatively high levels of trust in known and unknown people, confidence in institutions, normative notions of trust, security, and trustful behaviour. Trust also seems to be structured according to a closeness principle. Young adults display lower trust levels in general. However, in some respects the pattern is reversed, particularly regarding domains they are expected to be more familiar with. Contrary to the well-established idea of generalised trust derived from predispositions and primary socialization, and particularised trust originating from experiences in adulthood, the results of this study suggest that unique combinations of factors, both individual characteristics and experiences, might explain each of the different dimensions. Often there is a sphere-specific relationship between experiences and later trust, i.e. experiences from one sphere of life seem to exclusively affect trust within the same sphere. It is suggested that as people grow older they accumulate what is called experience capital, which might benefit trust and contribute to an explanation of the age differences.
