More than "Modern Day Slavery": Stakeholder Perspectives and Policy on Human Trafficking in Florida

In recent years, Florida has acquired a reputation as fertile ground for human trafficking. On the heels of state and federal anti-human trafficking legislation, a host of organizations have risen to provide a range of services. In this thesis, I discuss findings from 26 interviews conducted with law enforcement, service providers, legal representatives and trafficked persons to contextualize the variability in the way anti-trafficking work is conceptualized by stakeholders across the state. Additionally, I explore how conflicting organizational policies on the local, state, and federal levels impact stakeholder collaboration and complicate trafficked persons' attempts to navigate already complex processes of social/health services and documentation. Lastly, I provide policy recommendations that attempt to address the major issues associated with anti-trafficking work identified through the analysis of participant interviews.

Human Insecurity and Anti-Trafficking Policy: Representations of Trafficked Persons in Canada

Anti-trafficking discourses in Canada feature prominently in policy discussions of prostitution and sex work as well as national security and border integrity, including discussions of migration, migrant smuggling, refuge, and asylum. Yet, representations of trafficked persons have gone largely unquestioned in the country and anti-trafficking policies have garnered broad acceptance without detailed consideration of how such representations affect the rights and experiences of trafficked persons. In this context, anti-trafficking discourses are relied upon to justify a variety of conflicting political agendas. By placing existing discourses of human trafficking under scrutiny, including representations of trafficked persons from the perspective of frontline workers, government officials, law enforcement, and trafficked persons themselves in Western Canada, this study examines the politicized construction of trafficking discourses and thereby identifies how some anti-trafficking measures claiming to liberate “victims of trafficking” contribute to the insecurities faced by trafficked persons. Further, by examining recent immigration policy amendments alongside anti-trafficking discourses, this study considers the role of anti-trafficking discourses in shaping contemporary boundaries of inclusion and exclusion. In particular, the study highlights the insecurity trafficked persons experience as a result of measures emphasizing criminalization and deportation as well as the effect of criminalization for temporary migrant workers, particularly migrant workers experiencing exploitation in a context of socio-economic constraint.

Although trafficking in human beings is not a new issue of our society as its history reach ancient times, it becomes especially important because of increasing scope of migration influenced by economic crisis in Europe and worldwide. Thus it is essential to promote awareness raising campaigns in order to decrease the scope, however not less important is assistance for victims of this crime. Assistance and integration for victims of human trafficking are one of the main principles of the EU policy in the counter-trafficking field. One of the most important steps of successful victims integration into society is entering into employment, thus victims of human trafficking (re-)integration into the labour market was chosen as an object of the research. The aim of the research is to study the phenomenon of human trafficking focusing on the social policy measures in victims of human trafficking (re-)integration into the labour market process in Austria, Finland and Lithuania. During the study a scientific literature review of the research object and analysis of secondary data and statistics are done. In order to reveal experts’ and victims of human trafficking personal experience in (re-)integration into the labour market process, a qualitative research method was chosen. 11 specialists and 2 victims were questioned by semi-structured interviews in Austria, Finland and Lithuania. [to full text] / Nors prekybos žmonėmis reiškinys nėra nauja visuomenės problema, kurios istorija siekia senovės laikus, ji šiuo metu tampa ypatingai svarbi dėl blogėjančios ekonominės situacijos Europoje ir pasaulyje bei dėl šios priežasties augančio migracijos masto. Svarbu įgyvendinti ne tik prevencines kampanijas, keliant visuomenės sąmoningumą ir tokiomis priemonėmis mažinti didėjančius prekybos žmonėmis aukų skaičius. Taip pat yra svarbu suteikti pagalbą šio reiškinio aukoms. Pagalba aukoms ir jų integracija yra vienas svarbiausių ES įgyvendinamos kovos su prekyba žmonėmis politikos principų. Sėkmingos aukų integracijos į visuomenę vienas iš žingsnių yra jų įsitvirtinimas darbo rinkoje, tad prekybos žmonėmis aukų (re-)integracija yra pasirinkta šio darbo tyrimo objektu. Tyrimo tikslas – ištirti prekybos žmonėmis reiškinį sutelkiant dėmesį į politines priemones įgyvendinamas prekybos žmonėmis aukų (re-)integracijos į darbo rinką procese Austrijoje, Suomijoje ir Lietuvoje. Currently human trafficking is named the fastest growing criminal enterprise in the world. It is the second largest social problem in the global community, just behind narcotics and drug trade. Approximately 70% of trafficking is in the form of sexual exploitation. Victims of human trafficking often go undetected because of the deceptive nature of the crime, however once identified there are social services available to help re-integrate these individuals back into society. This research seeks to illuminate social work in human sex trafficking and how the phenomenon of trafficking manifests itself in the United States and Lithuania. The question is asked what are the services provided to victims of sex trafficking in the United States and Lithuania and how does the perceived inherent differences between the victims of phenomenon in each nation impact the delivery of these services, and the understanding of empowerment? In relation to the above research question and objective, the concepts of human trafficking, prostitution, social services, empowerment and international social work will be theoretically explored. Tai antra pagal dydį socialinė problema pasaulio visuomenėje, pirmą vietą užleisdama prekybai narkotinėmis medžiagomis. Apytiksliai 70% prekybos sudaro seksualinis išnaudojimas. Prekybos žmonėmis aukos dažnai lieka neatskleistos dėl apgaulingo nusikalstamos veiklos pobūdžio, tačiau jas aptikus, egzistuoja socialinės paramos organizacijos, galinčios padėti tokiems asmenims integruotis atgal į visuomenę. Šis tiriamasis darbas siekia informuoti, kokios socialinės paramos organizacijų paslaugos teikiamos nuo prekybos žmonėmis nukentėjusioms aukoms, ir tai, kaip prekybos žmonėmis reiškinys pasireiškia minėtose šalyse. 人口販運是一種古老的罪惡,且係為嚴重違害基本人權之犯罪,其可能以跨國境或國家境內的方式進行,為國際社會共同關注之人權議題,並可能發生於世界各個角落,究其成因不外乎犯罪集團猖獗,貪圖低價格的勞動力及為獲取高額暴利。在全球化的趨勢使然之下,象徵人口販運的古老奴隸制度不僅沒有消失,而且已經成為全球性的威脅,其已由跨國犯罪集團整體化經營,成為非法獲益龐大可觀之犯罪事業。 澳洲是南太平洋地區最重要的國家,而且還是美國在南太平洋地區的一個重要盟友,對於南太平洋地區國際局勢的變化有著重大的影響。從地緣政治角度看,澳洲是南太平洋地區唯一的大國,對南太平洋國家有舉足輕重的影響力,而該地區又是中華民國拓展外交空間的重要著力點,澳洲可說是亞太地區最重要的西方國家代表,具有關鍵性指標地位意義。澳洲在重大國際和地區問題上,長期追隨美國政策,該國亦為美國國務院連續多年評等為打擊人口販運最佳成效之第一級國家,本論文藉由探討澳洲防制人口販運政策,了解澳洲與東南亞國家人口販運之關係,並進一步研析該國因應作為與對策,透過澳洲於區域合作或國際合作間之角色與具體之合作方式,提供未來亞太區域國際合作之作法參考。 / Human trafficking is an ancient crime and severely harms the basic human rights. It might occur worldwide, cross or within countries. As a common concern to the international society, the human right issue derives from the exchange of cheap labor to high profit which is grasped by the criminal gangs. Along with the trend of globalization, the symbol of human trafficking – the ancient slavery system – not only does not disappear but becomes of global threat and criminal business which is managed integrally by the transnational criminal gangs to gain huge illegal benefits. Australia is the most important country in South Pacific area. As a principal ally to the United States, she has paramount influence upon the international situations. From a geopolitical point of view, Australia is the only great country there and possesses decisive impact on the surrounding countries. To expand Taiwan’s diplomatic space, she is considered to be the force point and the superior representative of Western countries in Asian Pacific with the key indicator position. Following the policies of United States to her major international and regional issues over a long period of time, Australia is also ranked as Tier 1 by United States Department of State in consecutive years for the best outcomes to combat human trafficking. The main purpose of this study is to discuss the policy on combating human trafficking in Australia to understand the relationship with the human trafficking in Southeast Asian countries and further to analyze the countermeasures of regional cooperation or the role and practices of international cooperation to provide the references in Asian Pacific.

Interesse público e o poder da telenovela: merchandising social e repercussão do tráfico de pessoas em Salve Jorge

Essa tese analisa o poder da telenovela ao dramatizar o tráfico de pessoas, um tema da esfera dos direitos humanos, portanto, de interesse público, que foi projetado na mídia durante a veiculação da novela Salve Jorge (exibida pela Rede Globo). A telenovela é geradora de visibilidade de temas sociais e a inclusão de tais temas nas tramas é reconhecida como merchandising social. O tráfico de pessoas, além de fazer parte da estória, circulou na pauta midiática brasileira no período entre 2013 e 2014 por intermédio de campanhas de sensibilização e de engajamento, tanto de cunho não governamental (Campanha do Coração Azul), como de caráter religioso, com o lançamento da Campanha da Fraternidade de 2014 pela Conferência Nacional dos Bispos do Brasil (CNBB), além de ter sido elemento central de políticas públicas com a cobertura do lançamento de planos de enfrentamento a esse crime no âmbito governamental. O estudo, assim, indaga como se efetiva a dramatização do Tráfico de Pessoas a partir de Salve Jorge, considerando a projeção de visibilidade e de debate do tema e seu papel na promoção da imagem da emissora. Para realizar esse percurso, utiliza-se como metodologia a pesquisa bibliográfica, a pesquisa documental e a Análise Crítica do Discurso (ACD) de Fairclough (2001), que apresenta a tridimensionalidade analítica de texto, das práticas discursivas e das práticas sociais, preocupando-se com as relações de poder no discurso e a análise do contexto, promovendo reflexões sobre a realidade social produzida. A abordagem teórica da tese privilegia os conceitos relacionados à comunicação e ao interesse público, à biopolítica e ao poder da telenovela na perspectiva de autores como Esteves, Foucault, Gomes, Wolton, Machado, Buonanno, Martín- Barbero, Lopes, Souza, Weber, Hamburguer, Porto, entre outros. Sob a ótica tridimensional, as categorias de dramatização e de repercussão do tráfico de pessoas são analisadas, tendo como elementos observados os espaços de circulação da telenovela Salve Jorge, as ações do Estado via políticas públicas, as campanhas sociais e religiosas de sensibilização e a visibilidade midiática dessas dimensões. O Tráfico de Pessoas é reificado pela emissora, assumindo um caráter de interesse público sob a ótica de Arendt (2001). A evidência do corpo e de sua regulação inerente ao crime reforça a dimensão de intervenção do Estado com suas políticas de enfrentamento ao tráfico humano, discutidas na biopolítica. Porém, é na dramatização que a eficácia de visibilidade ao combate à escravidão moderna se estabelece, reforçando a estratégia de merchandising social, própria do melodrama. O que se percebe é que há uma evidência do poder da dramaturgia ao tratar temas de interesse público e, da mesma forma em que o entretenimento debate o tráfico de pessoas, ele gera seu esquecimento ao encerrar sua exibição, tornando-se mercadoria da própria trama. / This thesis analyzes the power of the soap opera to dramatize human trafficking: theme of sphere of human rights issues - therefore, by the public interest - which was designed in the media during the broadcasting of the “Salve Jorge” soap opera (by Rede Globo). The soap opera generates visibility of social issues and the inclusion of theses issues in the plot is recognized as social merchandising. Human trafficking, as well as part of the melodrama of the plot, circulated in the Brazilian media agenda in 2013 and 2014 through awareness campaigns and engagement. It had worked in the non-governmental nature (Blue Heart Campaign), in religious field (Fraternity Campaign by the National Conference of Bishops of Brazil - 2014) and as central element of public policies with the media coverage of the launch of the containment plan for this crime in the government sphere. The study inquires how effetive is the dramatization of Human trafficking from Salve Jorge, considering the projection of visibility and the debate of theme and its role in the TV Globo's image promotion. This research used as methodology the bibliographical research, the documentary research and the Critical Discourse Analysis (CDA) from Fairclough (2001) which presents the three-dimensional analytical of text - discursive practices and social practices. Through this perspective, there is a worry with the power relations in the discourse and the analysis of the context, promoting reflections on the social reality produced. The theoretical approach of the thesis focuses on the concepts related to communications and public interest, biopolitics and the power of the soap opera in concepts of Esteves, Foucault, Gomes, Wolton, Machado, Buonanno, Martín-Barbero, Lopes, Souza, Weber, Hamburguer, Porto, among others. By the three-dimensional perspective, the categories of drama and impact of human trafficking are analyzed. The observed elements are the circulation areas of the soap opera Salve Jorge, the State's actions, through public policies, social and religious awareness campaigns and media visibility. Human trafficking is reified by the TV channel, assuming the public interest from the perspective of Arendt (2001). The notification of the "body" and regulation inherent on crime reinforce the State's intervention dimension with the coping policies to human trafficking, discussed in biopolitics. However, it is in the dramatization that the effectiveness of the fight against modern slavery is established, reinforcing the social merchandising strategy, typical of this melodrama. There is evidence of the power of drama to address issues of public interest. At the same time that entertainment gives visibility to human trafficking it also generate the oblivion of the theme when the soap opera's transmition ends and human trafficking issue becomes the plot's commodity.

Cooperação penal internacional e o combate ao tráfico de pessoas na tríplice fronteira

O Estado contemporâneo enfrenta duas realidades que exigem um esforço imediato da sua parte, quais sejam, a necessidade da proteção integral dos direitos humanos e o efetivo combate à criminalidade organizada. Nesse respeito, observa-se que esse panorama sofre uma forte influência do processo de internacionalização e da dinamicidade de um mundo ―sem fronteiras‖, que, apesar dos benefícios inegáveis a outros campos da vida social, como na economia, acarretam a transnacionalização do crime e a proliferação de espaços em que a efetividade estatal é reduzida. Desse modo, o objetivo do presente trabalho é verificar a adequação da cooperação penal internacional como meio de combate à criminalidade organizada transnacional ocorrente na Tríplice Fronteira entre o Brasil, Argentina e Paraguai, na região de Foz do Iguaçu. A análise do caso possibilita identificar a tensão existente entre a soberania estatal, calcada no princípio da territorialidade, e a internacionalização, que pressupõe a abertura das fronteiras. No âmbito do Direito Penal, em razão da titularidade exclusiva do jus puniendi, a tutela dos direitos afetados pela criminalidade transfronteiriça deve ser atingida, especificamente no caso do tráfico de pessoas que ocorre na Tríplice Fronteira, por meio da cooperação entre os Estados que compõem a região. Identifica-se, nesse caso, que dois passos primordiais devem ser adotados: a criação de mecanismos de cooperação e a harmonização dos regramentos internos com os instrumentos internacionais. No caso específico, observa-se que há uma tendência à harmonização como alternativa a facilitar a repressão ao tráfico de pessoas pelos países da Tríplice Fronteira, sobretudo em vista da adesão dos ordenamentos nacionais à Convenção de Palermo e aos seus protocolos adicionais, que ditam normas para o combate à criminalidade organizada transnacional. Além disso, a adesão a pactos internacionais que privilegiam a assistência mútua em matéria penal, tal como a Convenção de Nassau e o Protocolo de São Luís, indicam a dimensão do processo de internacionalização e da criação de espaços regionais de integração jurídica. A consequência, e também a conclusão, é que a internacionalização é inevitável ao Estado, que enfrenta diversas crises. Nesse caso, sobretudo em razão da soberania, a cooperação se molda como alternativa mais apropriada para o cenário atual na região da Tríplice Fronteira, mostrando-se necessária a adequação dos ordenamentos dos países aos regramentos internacionais, por meio da harmonização e da internalização. / Nowadays, the State faces two realities that demand an immediate effort from it, that is, the need to fully protect the Human Rights and, at the same time, effectively combat organized crime. In this sense, we observe that this panorama is submitted to a strong influence of the internalization process and the dynamics of a borderless world that, in spite of the undeniable benefits to other fields of social live, such as economics, bring about the ―transnationality‖ of crime and emergency of spaces in which the State effectivity is reduced. Therefore, the objective of this work is to verify the adequacy of the mutual legal assistance in the combat of the transnational criminality that takes place in the tri-border of Brazil, Argentina and Paraguay, in the Foz do Iguaçu region. The case analysis enables to identify the existing tension between sovereignty, based in the territoriality principle, and the internationalization, which presuppose the opening up of the frontiers. In the case of the Criminal Law, due to the exclusive control of the jus puniendi by the State, the protection of the rights affected by the transnational criminality is mandatory, specifically in the case of the human trafficking that occurs in the tri-border, by means of the cooperation between the States that exist in the region. We identify, in this case, that two primordial steps must be adopted: the creation of cooperation mechanisms and the harmonization of the internal Law in accordance with the international treaties. In the specific study, we observe that there is a tendency towards the harmonization in the combat of the human trafficking by the countries of the tri-border, specially due to the participation in the Palermo Convention and its additional protocols, which dictate norms to the combat of the transnational organized crime. Besides, the participation in international treaties that favor the mutual legal assistance in criminal matters, such as the Nassau Convention and the San Luis Protocol, indicate the dimension of the internationalization process and the creation of regional juridical integration spaces. The consequence, and also the conclusion, is that the internationalization is inevitable to the State, which faces various crises. In this case, specially due to the sovereignty, the cooperation is set as the most appropriate alternative to the actual scenery in the tri-border region, demonstrating the need to adequate the internal order of the countries to the international order, by means of the harmonization and the internalization.

A critical understanding of the policing of trafficking in persons

The aim of conducting this research was to obtain a critical understanding of how the South African Police Service (SAPS), law enforcement (LE) and Non-Governmental Organisations (NGOs) understand the concept, policing of Trafficking in Persons (TIP). The study indicates different role players in the policing of TIP. The researcher explored the present and possible future cooperation between SAPS and NGOs in the Cape Town area. The development of policing and legal aspects concerning TIP was explored globally. Research indicates the necessity of a professional partnership approach between SAPS, LE and NGOs, in the policing of TIP. The researcher identified factors that inhibit the effectiveness of policing of TIP. These factors include among others the lack of training in the identification of TIP and lack of trust between role players. Recommendations to this effect and the implementation of the policing of TIP are made to all concerned, especially SAPS management. / Police Practice / M. Tech. (Policing)
