In the company of music and illness : the experience and meaning of music listening for women living with chronic illness

The purpose of this study was to contribute an experiential understanding of everyday "music listening experiences through a text that also conveyed a pathic way of knowing. I studied the phenomenon of music listening in the particular context of women living with chronic illness (i.e., a physical condition that is managed rather than cured), and in keeping with van Manen's (1990, 2000) applied hermeneutic-phenomenological approach. Van Manen's approach to phenomenological inquiry emphasizes implementation of the reductio (the reduction), attention to the vocatio (the vocative dimension), and the use of empirical and reflective methods to generate and analyze data. The question that guided this study was: What is the lived experience and lived meaning of music listening for women living with chronic illness? Six women were interviewed in multiple conversations about their music listening experiences. All lived with chronic illness, and identified music listening as important in their lives. Following an initial analysis based on multiple readings from holistic, selective, and detailed perspectives, I used a guided existential reflection based on lived body, lived time, lived space, and lived relation to further understand, organize, and reveal the many ways in which the women listened to music. Writing and rewriting in a reflective and dialogical manner were grounding elements of analysis. Findings contribute in several ways. Most broadly, the final text was constructed to communicate an understanding that is embodied and discursive (i.e., knowledge as participation), and that leads to personal formative knowledge (i.e., knowledge as being). As a phenomenology of music listening, results suggested that to listen to music is to be in the company of music; that is, to be with a longtime companion who ultimately aids in accommodating the unanticipated arrival of chronic illness. Implications include future research to further investigate the complex, relational dynamics associated with music listening experiences, as well as the possibility of the body as a source of knowledge (i.e., mind-body), acting as a musical compass in music listening experiences. Implications for counselling practice are also described.

Foram examinados 3.249 processos trabalhistas, a partir dos quais se construiu um banco de dados com informações quantitativas e qualitativas. Em nossa pesquisa, buscamos apreender o significado das humilhações, dos xingamentos e dos maus-tratos, a partir das falas do próprio trabalhador e das suas testemunhas, cujos relatos, retirados dos processos, têm o potencial de demonstrar o grau de exploração da força de trabalho e o nível da precarização das atuais relações de trabalho. A proposta de estudo desta tese, em uma perspectiva regida pelo campo da sociologia do trabalho, é a construção do assédio moral como estratégia de dominação em um contexto de precarização social do trabalho. Em tempos recentes, a exploração do trabalhador é intensificada pelos métodos violentos de gestão e o assédio moral se tornou a melhor ferramenta, enquanto estratégia de gestão, para promover a política da precarização das relações de trabalho. O assédio moral, de acordo com os relatos dos trabalhadores constantes em ações trabalhistas, é o mecanismo de coação utilizado pelas empresas para impor o ritmo do trabalho no atual contexto produtivo e pode ser considerado como uma estratégia da precarização das relações de trabalho cujo método de gestão é configurado pela prática permanente de atos de violência psicológica e moral. Constatou-se que o assédio moral não é fruto das relações interpessoais e sim o resultado das atuais estratégias capitalistas de gestão e organização do trabalho. O assédio moral enquanto violência que se metamorfoseia nas relações capital trabalho é o velho elemento dos métodos coercitivos e disciplinadores da organização do trabalho e o novo fenômeno da gestão do trabalho associado ao processo de precarização do trabalho. O objetivo do assédio moral não é, simplesmente, perseguir e expulsar o trabalhador do local de trabalho e sim o de exercer um efetivo controle sobre as suas ações, para garantir o cumprimento de metas de produtividade. A concepção que se defende nesta tese é que o assédio moral é estratégia de gestão e controle do trabalhador que hoje, mais do que nunca, passa pela precarização das condições de trabalho para deixá-lo indefeso, dócil, dominado, sem resistências. Por isto, o assédio moral é uma das principais formas de precarização do trabalho, constituindo-se em uma (nova) forma de dominação e de exploração da força de trabalho pelo capital. This study focuses on cases of moral harassment as denounced in labor lawsuits by workers claiming compensation for moral damage, under the jurisdiction of the Regional Labor Court of the State of Bahia (Brazil) from 2001 to 2010, a period in which the number of lawsuits rose from one to 989. A database with quantitative and qualitative information was assembled from the analysis of 3,249 labor lawsuits. We aimed at apprehending the meaning of the humiliations, swearing and ill treatment by taking into account the workers’ and the witnesses’ own speeches, the accounts of which, extracted from the lawsuits, have the potential to show the degree of exploitation endured by the workforce and the extent to which current work relations have been rendered precarious. The study proposal of this thesis, within the field perspective of work sociology, is to view moral assessment as a strategy of domination in a context of ever-increasing precarious work from the social standpoint. In recent times, the exploitation of workers has been intensified by violent management methods, and moral harassment has become the best tool, as a management strategy, to foster a policy towards ever-increasing precarious work relations. Moral harassment, according to the workers’ accounts in the lawsuits, is the coercion mechanism used by the corporations to impose the work place in the current productive context and can be considered as a strategy towards precarious work relations, the management method of which consists of the permanent perpetration of psychologically and morally violent acts. Moral harassment was shown to result not from interpersonal relationships, but from the current capitalist strategies of management and work organization. Moral harassment, as an act of violence that morphs into capital-work relations, is both the old component of coercive methods aimed at organizing the work and the new phenomenon of work management linked to the process of rendering work increasingly precarious. The aim of moral harassment is not merely to persecute and expel the worker from the workplace, but also to control his/her actions effectively in order to assure the achievement of productivity goals. The concept of moral harassment advanced in this thesis views moral assessment as a management strategy to control the worker, whose working conditions nowadays, more than ever before, have been rendered precarious, thereby causing him/her to become defenseless, docile, dominated and without resistance. That is why moral harassment is one of the main ways to render work precarious, being a (new) way for the capital to dominate and exploit the workforce.

O idoso vÃtima de violÃncia: desafios do sistema de saÃde para o enfrentamento do fenÃmeno / The elderly victim of violence: challenges for the health system to face the phenomenon

Isso demonstra o alargamento do topo da pirÃmide etÃria, onde houve um crescimento da participaÃÃo relativa da populaÃÃo com 65 anos ou mais, que era de 4,8% em 1991, passando a 5,9% em 2000 e chegando a 7,4% em 2010 (IBGE, 2011). Os dados demogrÃficos mostram a necessidade urgente de mudanÃas que resultem na efetivaÃÃo das polÃticas pÃblicas de atenÃÃo ao idoso, especialmente Ãquele vitima de violÃncia, pois este agravo tem se destacado no processo saÃde e adoecimento desta populaÃÃo. Diante dessa realidade, desenvolvemos esta pesquisa com o objetivo de compreender o modelo de atenÃÃo à saÃde do idoso vÃtima de violÃncia no sistema de saÃde de Sobral, CearÃ, considerando os princÃpios da integralidade. Para tanto, realizamos um estudo compreensivo, de natureza qualitativa com profissionais que representam os segmentos gestÃo e atenÃÃo no sistema de saÃde de Sobral, CearÃ, Brasil, constituindo-se de seis coordenadores da gestÃo colegiada, seis enfermeiros e cinco agentes comunitÃrios de saÃde. As informaÃÃes foram coletadas no perÃodo de outubro/2010 a marÃo/2011 atravÃs da tÃcnica do CÃrculo HermenÃutico DialÃtico (CHD) adaptado por Oliveira (2007) e submetidas à anÃlise do discurso. Esta pesquisa incorporou os princÃpios da BioÃtica, conforme ResoluÃÃo 196/96 do Conselho Nacional de SaÃde. Os resultados evidenciaram que o sistema de saÃde de Sobral apresenta um modelo de atenÃÃo ao idoso vÃtima de violÃncia que conhece o fenÃmeno e o reconhece como uma realidade que se intensifica no municÃpio de Sobral, CearÃ, apresentando as mais diversas formas de maus-tratos. Esta atenÃÃo aparece negligenciada, nos discursos dos depoentes porque o sistema nÃo atende o idoso na sua totalidade, denunciando dificuldades na operÃncia do princÃpio da Integralidade. Considerando o contexto situacional do idoso que sofre violÃncia em Sobral, o modelo de atenÃÃo à saÃde impresso nos discursos dos profissionais e as diretrizes do Estatuto do Idoso, PolÃtica Nacional de SaÃde da Pessoa Idosa e Pacto pela SaÃde, observamos que as polÃticas estudadas sÃo contempladas apenas parcialmente, tendo, o municÃpio, um percurso desafiador para trilhar, no sentido de dar respostas efetivas e eficazes Ãs demandas e necessidades de saÃde da populaÃÃo idosa. / In Brazil the representativity of the age groups in the total population in 2010 is lower than that observed in 2000 for all groups aged up to 25 years, whereas the other age groups increased their participation in the last decade. This demonstrates the widening at the top of the age pyramid, where there was a participation increase relative to the population aged 65 years of more, which was 4.8% in 1991, rising to 5.9% in 2000 and reaching 7.4% in 2010 (IBGE, 2011). Demographic data shows the need for urgent changes that result in the execution of public policies for elderly care, especially those victims of violence, as this aggravation has been highlighted in the health and sickness process of this population. Facing this reality, we developed this survey with the objective of understanding the health care model of the elderly victim of violence in the Health System of Sobral, Ceara, considering the principle of integrality. For which, we performed a comprehensive study, of qualitative nature with professionals who represent the management and care segments in the health system of Sobral, Ceara, Brazil, composed of six coordinators from collegiate management, six nurses and five community health agents. The information was collected in the period from October 2010 to March 2011 by means the Hermeneutic Dialectic Circle (HDC) technique adapted by Oliveira (2007) and submitted to speech analysis. The study incorporated the principles of Bioethics according to Resolution 196/96 from the National Health Council. The results revealed that the health system in Sobral presents a care model to the elderly victim of violence that acknowledges the phenomenon and recognizes it as a reality that is intensified in the city of Sobral, Ceara, presenting the most diverse forms of ill-treatment. This care appears neglected, in the speeches from the deponents on why the system does not attend the elderly in its totality, denouncing difficulties in the operance on the Integrality principle. Considering the situational context of the elderly that suffer violence in Sobral, the health care model defended in the speeches from professionals and the directives of the Elderly Statute, National Health Policy of the Elderly and Health Pact, we observed that the policies studied are only contemplated partially, leaving, the city, a challenging task to lay the way, in the sense of providing effective and efficacious answers to the demands and needs for the health of the elderly population.

Some questions based the studies in two perspectives: thew first, through the Elder Project in Risk Situation, trying to know, according to the professionals who act in the area, what are the kinds of accusations registered, the reasons that led to the elder ill treatment and what were the effective taken measures. And other, referring to the elder, to know how they react, how they feel about the ill treatment and what were the alternatives to overcome such a situation. The research of comprehensive nature,is a case study and developed through indirect documentation consisting of: documental research, through the public archives of the Elder Municipal Secretary in order to know the institution where the accusations come from official, administrative and statistical documents; bibliographical research, through scholars, national and international intellectuals who dedicate themselves to the study of the elder ill treatment. The direct documentation of the field research, of exploratory nature, recurring to the home visit, through a semi-structure interview, and with the support of questionnaire, previously elaborated, in order to reveal the scenario and the subjects involved in the social ill treatment question. Finally, we concluded that the violence against the elders from Londrina, happen in the domestic environment, and practiced by their own family members, and these acts occur because of family conflicts that precede the aggression / Esta tese tem como objetivo relatar uma investigação sobre os idosos, vítimas de maus-tratos, atendidos pela Secretaria Municipal do Idoso, de Londrina/PR. Neste fazer, algumas questões pautaram os estudos, em duas perspectivas: a primeira, através do Projeto Idoso em Situação de Risco, buscando conhecer, segundo a constatação dos profissionais que atuam, quais os tipos de denúncias registradas, os motivos que engendraram os maus-tratos ao idoso e, quais as medidas providenciadas que tem se mostrado eficazes. Em outra, com referência ao próprio idoso, conhecer como reagem, como se sentem em relação aos maus-tratos sofridos e quais as alternativas para superar tal situação. A pesquisa, de natureza compreensiva, é um estudo de caso e se desenvolveu através da documentação indireta, composta pela: pesquisa documental, através de arquivos públicos da Secretaria Municipal do Idoso - a fim de conhecer a instituição onde ocorrem as denúncias documentos oficiais, administrativos e estatísticos; pesquisa bibliográfica, através de estudiosos, intelectuais de nível nacional e internacional que se dedicam à questão dos maus-tratos ao idoso. A documentação direta composta pela pesquisa de campo, do tipo exploratório, recorrendo à visita domiciliar, através da entrevista semi-estruturada e com apoio de um formulário, previamente elaborado, a fim de desvelar o cenário e os sujeitos em que ocorre a questão social dos maus-tratos. Por fim, conclui-se que as violências contra idosos londrinenses ocorrem no âmbito doméstico, praticado por seus próprios familiares, sendo esses atos decorrência de conflitos familiares que antecedem a agressão

States are routinely confronted with conflicting duties of maintaining full respect for human rights, on the one hand, and protecting national security and public safety, on the other. This is not least noticeable when States’ sovereignty and the right to control who enters and leaves their territories clash with the obligation to afford protection to refugees fleeing persecution. Some refugees are bound to be dangerous criminals, presenting a serious threat to national security and public safety in the host State. Refugee law prescribe that allegedly serious criminals must be excluded from refugee protection. However, the principle of non-refoulement, as developed and interpreted under international and regional human rights law, prohibits removal of persons if there is risk for torture or ill-treatment in the country of origin. This thesis explores the fact that a person can be considered fundamentally undeserving of protection under refugee law, while protected against removal under human rights law. Persons like this have fittingly been coined undesirable but unreturnable.      The relationship between the relevant provisions on refoulement and exclusion from refugee protection is examined and analyzed, followed by a recount of the effects that this clash of legal regimes and legitimate interests has on the individuals concerned, on the States, and on the integrity of refugee law. Possible solutions to adverse effects are identified and discussed, including the question of whether the principle of non-refoulement, as understood today, is viable in light of the challenges presented to national security and public safety.
