A imprescritibilidade da negatória de paternidade e o melhor interesse da criança / The imprescriptibility of the paternity denial and the childs best interest

Estudo sobre a filiação com ênfase na regra do caput do artigo 1.601 do Código Civil Brasileiro Lei 10.406/2002, segundo a qual cabe ao marido o direito de contestar a paternidade dos filhos nascidos de sua mulher, sendo tal ação imprescritível. A dissertação tem como objetivo principal demonstrar a inconstitucionalidade do direito perpétuo do pai em desconstituir a paternidade do filho menor nascido em uma relação de casamento à luz do princípio do melhor interesse da criança. Para tanto foi realizada pesquisa bibliográfica e jurisprudencial em tribunais nacionais de segunda instância, no Superior Tribunal de Justiça e no Supremo Tribunal Federal. Os critérios da presunção legal pater is est quem nuptiae demonstrant, da verdade biológica e da posse de estado de filho foram um a um analisados, não havendo entre eles predominância no ordenamento jurídico. O levantamento deste material permitiu a constatação de que a regra supracitada é, pela doutrina majoritária, acriticamente louvada e utilizada nos julgados de conflitos de paternidade. O filho, no entanto, não pode permanecer por toda a vida sujeito à possibilidade do pai desfazer, a qualquer momento, a relação paterno-filial pela ausência do dado biológico por que: (i) o exercício deste direito é mutilador de sua identidade e dignidade humana; (ii) a posse de estado de filho confirma a presunção pater is est; (iii) o estado civil de filho deve se tornar certo e estável em um curto período de tempo. Sustenta-se que é imperioso o afastamento por inconstitucionalidade material da regra do artigo 1.601 do Código Civil e a aplicação analógica do prazo de quatro anos previsto no artigo 1.614 do Código Civil. De lege ferenda propõe-se a elaboração de uma norma que fixe um prazo decadencial para que o marido e pai possa exercer o direito potestativo de negar a paternidade. / A study of paternity with emphasis on the rule of the caput of the article 1.601 of the Brazilian Civil Code law 10.406/2002, which states that its allowed to the husband contesting the paternity of his wifes child, and such claim is imprescriptible. The main purpose of the thesis is demonstrate the unconstitutionality of the fathers perpetual right to disregard the paternity of the minor born from a married couple, based on the principle of childs best interest. It was based on Brazilian Courts jurisprudence and bibliographical research. The criteria of legal presumption pater is est quem nuptiae demonstrant, of biological truth and of putative fatherhood were peered reviewed, and no hierarchical relevance was observed. Based on this survey it is reasonable to declare that the aforementioned rule is uncritically employed in the paternity issues. On the other hand, the child might not be a lifelong susceptible to paternal status changing based on the absence of biological linkage, in that: (i) this practice may be perverse and annihilate the human dignity; (ii) informal adoptions confirm the pater is est presumption; (iii) the paternity status must be undeniable, stable and promptly established. According to the arguments demonstrated along this thesis, the article 1.601 of Brazilian Civil Code must be banished and a four years term rule, as proposed by the article 1.614 of the Brazilian Civil Code, must fulfill it. It is mandatory the elaboration of a new rule of law in which the husband and father, after a four years period of limitation, is prohibited from denying the paternity.

The study covers the analysis of reasonable duration of the criminal process and its underlying approach to the institution of criminal prescription. To investigate the possibility of the fit of both theories between the two concepts. At first are considered the conceptions of time (absolute and relative) and their intimate relationships with the law, more specifically with the criminal procedural law, considering that all procedural acts are governed by lapse of time. In a second moment is directly addressed the fundamental right to duration of the criminal process and its current hermeneutics inaccuracy. Thus, it held a brief analysis of the doctrine of the fixed term and also the doctrine of non-term as well as the legal consequences and solutions proposed by the academy in the case of non-observance of reasonable time. The third moment it is analised the criminal prescription and the theories that give it grounds for the legitimacy, as well as the nefarious institution of criminal imprescriptibility. At the end it is examined the possibility of the punitive preintention to limitade the period of reasonable duration of the criminal process, taking into perspective the concepts of time previously developed. The research employed the deductive method and the research through the literature. / Examina-se o direito fundamental à razoável duração do processo penal previsto no artigo 5º, inciso LXXVIII da Constituição Federal, com a redação dada pela Emenda Constitucional nº 45/2004, com o escopo de (re)pensar sua interpretação jurídica, tendo em vista o instituto da prescrição da pretensão punitiva. O estudo percorre a análise da razoável duração do processo penal e sua latente aproximação com o instituto da prescrição penal. Para tanto investiga a possibilidade de adequação teórica entre os dois conceitos. Num primeiro momento são consideradas as concepções de tempo (absoluto e relativo) e, as suas intimas relações com o direito, mais especificamente com o direito processual penal, haja vista que todos os atos processuais são regidos pelo decurso do tempo. Num segundo momento é abordado diretamente o direito fundamental à razoável duração do processo penal e sua atual imprecisão hermenêutica. Assim, é realizada uma breve análise a respeito da doutrina do prazo fixo e, também da doutrina do não-prazo, bem como das soluções e consequências jurídicas propostas pela academia no caso de não observância do prazo razoável. Num terceiro momento é abordada a prescrição penal e as teorias que lhe fornecem fundamento de validade, assim como o famigerado instituto da imprescritibilidade penal. Ao final examina-se a possibilidade do prazo da prescrição da pretensão punitiva funcionar como limite para a duração razoável do processo penal, tendo em perspectiva as concepções de tempo desenvolvidas anteriormente. A pesquisa realizada utiliza-se do método dedutivo e como técnica de pesquisa a bibliográfica.

Les droits civils perpétuels en droit français contemporain

« L'indépendance de la durée de vie d'un droit face à l'érosion qui touche inéluctablement un bien ou une valeur protégée », voilà quelle paraît être la définition la plus révélatrice des droits civils perpétuels en droit français contemporain. Cette dernière ressort d'une analyse au terme de laquelle il semble que le système normatif actuel est peu enclin à reconnaître des droits survivants à leurs titulaires. Pis, les instruments juridiques permettant de circonscrire leur domaine sont nombreux, à l'image du plus efficace d'entre eux : la prescription extinctive. Mais ces instruments restrictifs ne sont pas isolés. La nature même du droit peut porter en elle le germe de sa disparition. C'est alors que sont renversés de vieux préjugés. Les droits réels ne sont pas davantage voués à la perpétuité que ne le sont les droits de la personnalité. En outre, là où la prohibition devrait s'imposer aux droits personnels, certains s'en émancipent en fait. C'est alors que la perpétuité se dévoile dans trois droits civils en particulier : le droit de propriété, le droit moral de l'auteur et le droit au nom. Restreints dans leur nombre, ces droits sont cependant privilégiés dans leur régime. En effet, selon la qualité qu'ils revêtent, ils bénéficient de moyens de mise en œuvre et de protection supplémentaires, comme en témoignent la théorie des droits subjectifs ou la reconnaissance de droits fondamentaux. Selon qu'ils sont interprétés comme les premiers ou les seconds, ou voire même les deux simultanément, leur justiciabilité est clairement renforcée / « The independence of the life span of a right confronted to the erosion which unavoidably affects a belonging or a protected value », here is which seems to be the most revealing definition of perpetual civil rights in contemporary French Law. This definition springs from an analysis which leads us to think that today's normative system is reluctant to admit surviving rights to their holders. Even worse, there are numerous legal instruments which can be used to restrain their fields of activity, like the most efficient of all: negative prescription. However these restrictive instruments are not isolated. The very nature of a right can carry in itself the germ of its own disappearance. This is on these occasions that old prejudices are knocked over. Real rights are not more dedicated to perpetuity than individual rights. Moreover, if prohibition should be imposed on personal rights, in fact some of them manage to do without it. This is when perpetuity appears in three civil rights in particular: the right to property, the author's moral right and the right to the name. Limited in their numbers, these rights however are privileged in their schemes. Indeed, depending on their quality, they benefit from supplementary means of implementation and protection as the theory of subjective rights or the recognition of fundamental rights testify. Whether they are read as the former or the latter or even both simultaneously, their justiciability is clearly reinforced. However the conclusion of the study may be disappointing as, to tell the truth, perpetual rights are sometimes the victims of real incursions on behalf of the lawmaker or the co contracting party

Si la cession des propriétés publiques est un phénomène en vogue, il reste discret au plan doctrinal. Ce décalage entre la théorie et la pratique s’explique par sa place instable, entre le droit public et le droit privé. Par conséquent, l’étude de la cession implique un effort de classification, puis un exercice de déduction, en dépassant la distinction classique, entre le domaine public et le domaine privé, au profit d’un monisme domanial. Cette conception tire les conséquences de la modernisation du droit administratif des biens, derrière la bannière de la propriété publique, tout en offrant une large place au critère organique. Elle présente également l’avantage d’une application immédiate, sans relais de la part du législateur. Cependant, la pérennité de ce modèle dépendra de la conservation d’un équilibre, entre la liberté de l’administration-propriétaire, et la continuité du service public. Pour préserver cet héritage, les bases constitutionnelles du droit des biens publics devront être confirmées, et de manière explicite. / Even though the disposal of publicly-owned assets is occurring more and more frequently, these activities remain doctrinally unclear. The discrepancy between the theory and practice of such disposals can be explained by their uncertain position between public law and private law. Consequently, when considering such disposals, attention is paid to their classification and the exercise of judgement which goes beyond the traditional distinction between public and private domains in favour of the application of a single principle of public ownership. This concept has as consequence the modernization of administrative property law in the context of public ownership with an emphasis on the criteria of institutional law. It also has the advantage of being put into practice immediately without intervention from the legislature. However, this model will only be sustainable if it can maintain a balance between the prerogative of the administration-owners and the continuity of public services. To maintain this legacy, the constitutional basis of the law of publicly-owned assets must be confirmed explicitly

A rebours de la croyance populaire qui veut que le temps efface les blessures, le constat s'impose de l'omniprésence de la mémoire comme matrice des orientations décidées par nos gouvernants. Soixante-dix ans après la fin de la Seconde Guerre mondiale, elle occupe l'espace public dans toutes ses composantes et pousse à l'adoption de lois de reconnaissance des victimes et de sanction des discours de négation. Parallèlement, le législateur doit répondre à ses engagements conventionnels et satisfaire aux exigences de la justice pénale internationale. Mais ici encore, les contingences politiques sont fortes, qui sclérosent la réflexion juridique et conduisent à l'élaboration de dispositions controversées. Ce phénomène, ostensible en France, l'est moins chez notre voisin allemand, pourtant tributaire d'un lourd héritage mémoriel. Cette observation peut surprendre celui qui ne tient pas compte des évolutions conjointes mais divergentes des deux Etats depuis 1945, quant à la « gestion » des crimes internationaux par nature et de leurs suites ; d'où l'utilité d'une approche transversale, historique et comparative de ces questions. / Contrary to the popular belief that the time clears injuries, the finding must be made of the omnipresence of the memory as a matrix of guidelines decided by our leaders. Seventy years after the World War II ended, it occupies public space in all its components and drives the adoption of laws recognizing victims and punishing speech of negation. Meanwhile, the legislature must meet its conventional obligations and the requirements of international criminal justice. But again, the political contingencies are strong, which block legal thinking and lead to the creation of controversial provisions. This phenomenon, striking in France, is less at our german neighbor, yet reliant on a heavy legacy memorial. This observation may surprise those who do not consider the joint but divergent evolutions of the two states since 1945, on the « treatment » of international crimes by nature and their consequences ; hence the usefulness of a transverse, historical and comparative approach to these issues.
