Contrats publics et domaine privé / Publics contracts and private domain

Alors que les contrats d'occupation du domaine public focalisent l'attention de la doctrine, cette dernière délaisse largement l'analyse et la compréhension des éléments de particularité des contrats conclus sur le domaine privé. La présente recherche propose ainsi d'appréhender les évolutions textuelles et, surtout, jurisprudentielles qui intéressent la définition, la nature ou encore le régime juridique des contrats qui prennent pour objet ce domaine. L'intérêt de la thèse réside alors tant dans son champ d'étude que dans l'hypothèse formulée. Au travers du prisme du caractère public des contrats, la recherche met en exergue les éléments de convergence de ces différentes techniques contractuelles portant sur le domaine privé. Cette approche théorique permet de dépasser l'analyse doctrinale classique qui consiste à présenter et opposer ces contrats par rapport à leur dualité de nature juridique.Ainsi, une classification des contrats publics portant sur le domaine privé fondée sur leur prestation caractéristique et le lien plus ou moins ténu qu'ils entretiennent avec l'intérêt général, se montre en premier lieu pertinente. Le contentieux relatif à ces contrats connaît d'autre part certains bouleversements et incertitudes qui nécessitent d'être analysés et éclaircis.La seconde partie de la thèse se recentre sur la spécialisation de leur régime juridique, non pas à l'égard des seuls contrats ayant une nature administrative, mais bien au titre d'un examen d'ensemble des contrats publics portant sur le domaine privé. Au-delà de la nature juridique particulière de chaque contrat, les effets de droit liés au critère organique confirment que celui-ci est partiellement opérant en ce qu'il caractérise une certaine spécialisation de leurs régimes de formation et d'exécution. Leur régime illustre en fin de compte l'existence d'une certaine originalité des règles spécifiquement applicables à cette catégorie de contrats publics. / When the law teaches mainly about the use of the public domain, we need to understand the specific elements relative to the contracts on the private domain as well. This research paper will show how the texts, as well as the jurisprudence, have affected the definition, the nature and the legal status of these contracts, particularly in relation to the private domain. The specifics of this research lay in the study of the different contracts relative to the private domain and how these techniques can converge on the issue of the public property of the public persons. This particular theory will allow to widen the classic analysis which is opposing contracts on their nature.In a first part, we will classify the public contracts relative to the private domain, according to their characteristics and their relation to the general interest. The different litigations related to these contracts have been changing and some uncertainties need to be clarified and analysed.The second part of the thesis will focus on the legal status of these contracts, not only from their administative's nature, but also the contracts related to the private domain as a whole. Beyond the specific nature of each contract, being a public person implies specific legal rights as far as the constitution of the contract and its execution. In the end, their status illustrates a certain originality in the rules relative to this particular category of public contracts.

Disease and Hygiene in the Construction of a Nation: The Public Sphere, Public Space, and the Private Domain in Buenos Aires, 1871-1910

The maturation of the public sphere in Argentina during the late nineteenth and early twentiethcenturies was a critical element in the nation-building process and the overall development ofthe modern state. Within the context of this evolution, the discourse of disease generatedintense debates that subsequently influenced policies that transformed the public spaces ofBuenos Aires and facilitated state intervention within the private domains of the city’sinhabitants. Under the banner of hygiene and public health, municipal officials thusEuropeanized the nation’s capital through the construction of parks and plazas and likewiseutilized the press to garner support for the initiatives that would remedy the unsanitaryconditions and practices of the city. Despite promises to the contrary, the improvements to thepublic spaces of Buenos Aires primarily benefited the porteño elite while the efforts to rootout disease often targeted working-class neighborhoods. The model that reformed the publicspace of Buenos Aires, including its socially differentiated application of aesthetic order andpublic health policies, was ultimately employed throughout the Argentine Republic as theconsolidated political elite rolled out its national program of material and social development.

La valorisation des biens publics / The valorization of public properties

La présente recherche vise à cerner et définir le concept de valorisation appliqué aux biens publics en s’appuyant sur son double fondement, le droit de propriété et le bon usage des deniers publics. Ce concept repose sur deux composantes, l’exploitation et la cession, qui permettent de mettre en lumière les multiples formes de la valorisation : économique, sociale, environnementale. Ces manifestations de la valorisation renouvellent l’analyse afin de mieux comprendre l’enjeu de la réforme du droit des biens publics, la manière dont la valorisation a influencé ce droit et les évolutions à venir. Ainsi, le rapprochement des régimes domaniaux a permis d’assouplir et de moderniser les outils de valorisation et les principes juridiques régissant le domaine public. Ce rapprochement devrait aboutir à une unification de la compétence juridictionnelle au profit du juge administratif. Par ailleurs, sous l’impulsion de la valorisation, de nouvelles obligations s’imposent aux propriétaires publics : mise en concurrence des occupations domaniales, inventaire des biens, valorisation d’avenir. / This research aims to identify and define the concept of valorization applied to public properties based on its double foundation, the right to property and the proper use of public funds. This concept is based on two components, exploitation and disposal, which highlight the multiple forms of valorization : economic, social, environmental. These valorisation events renew the analysis in order to better understand the stake of the reform of the law of the public properties, the way in which the valorization has influenced this right and the evolutions to come. Thus, the approximation of state regimes has made it possible to soften and modernize valorization tools and the legal principles governing the public domain. This rapprochement should lead to a unification of jurisdiction for the benefit of the administrative judge. In addition, under the impetus of the valorization, new obligations are imposed on the public owners : competition of the public occupations, inventory of the properties, valorization of the future.

Imergindo em sua recente história, a pesquisa propicia maior destaque para a arte urbana que surgiu a partir a década de 1970 com proeminente viés crítico político-social. A Arte Urbana é descrita e problematizada por meio da tensão entre o domínio público e o privado, da violência urbana e do sistema das artes, de modo a se alcançar uma melhor concepção sobre esse fenômeno cultural em crescente evolução. Em seguida percorro por minha trajetória na arte e descrevo minhas experiências com intervenções urbanas. Then, I explore my career in art and I describe my experiences with urban interventions. Performing an analysis based on my production as an urban artist, which counts, predominantly, with works that attempt to establish a dialogue with the dynamics of urban life, highlighting practical problems of everyday life, such as violence, the gap between state and citizen and the social inequality. Si la cession des propriétés publiques est un phénomène en vogue, il reste discret au plan doctrinal. Ce décalage entre la théorie et la pratique s’explique par sa place instable, entre le droit public et le droit privé. Par conséquent, l’étude de la cession implique un effort de classification, puis un exercice de déduction, en dépassant la distinction classique, entre le domaine public et le domaine privé, au profit d’un monisme domanial. Cette conception tire les conséquences de la modernisation du droit administratif des biens, derrière la bannière de la propriété publique, tout en offrant une large place au critère organique. Elle présente également l’avantage d’une application immédiate, sans relais de la part du législateur. Cependant, la pérennité de ce modèle dépendra de la conservation d’un équilibre, entre la liberté de l’administration-propriétaire, et la continuité du service public. Pour préserver cet héritage, les bases constitutionnelles du droit des biens publics devront être confirmées, et de manière explicite. / Even though the disposal of publicly-owned assets is occurring more and more frequently, these activities remain doctrinally unclear. The discrepancy between the theory and practice of such disposals can be explained by their uncertain position between public law and private law. Consequently, when considering such disposals, attention is paid to their classification and the exercise of judgement which goes beyond the traditional distinction between public and private domains in favour of the application of a single principle of public ownership. This concept has as consequence the modernization of administrative property law in the context of public ownership with an emphasis on the criteria of institutional law. It also has the advantage of being put into practice immediately without intervention from the legislature. However, this model will only be sustainable if it can maintain a balance between the prerogative of the administration-owners and the continuity of public services. To maintain this legacy, the constitutional basis of the law of publicly-owned assets must be confirmed explicitly

Depuis une dizaine d’années, les personnes publiques prennent conscience du potentiel économique que représente leur "patrimoine immatériel". A l’analyse, celui-ci présente une grande diversité dans sa composition et comprend ainsi tout à la fois des éléments non appropriés et des éléments appropriés, qualifiables de "propriétés publiques immatérielles". Les personnes publiques doivent impérativement trouver un équilibre entre différents impératifs dans la valorisation qu’elles opèrent de leur "patrimoine immatériel". Elles doivent en effet pouvoir en tirer de nouvelles ressources financières en les exploitant tout en en assurant une protection adéquate. Les éléments non appropriés du "patrimoine immatériel" font souvent l’objet de régimes juridiques autonomes qui, dans l’ensemble, permettent aux personnes publiques d’en envisager une valorisation équilibrée. Quant aux propriétés publiques immatérielles, la démonstration se concentrera sur les difficultés rencontrées pour les faire bénéficier du régime de la domanialité – qu’elle soit publique ou privée –, puis sur les options envisageables pour mettre un place un régime juridique susceptible d’en assurer une valorisation optimale. / Over the past decade, public entities have become aware of the economic potential of their "intangible assets". Upon analysis, such assets are highly diversified and include both irrelevant and relevant items, which can be described as "intangible public properties". It is critical for public entities to achieve a balance between different constraints when promoting their "intangible assets". They must be able to generate new financial resources from such assets by exploiting them while ensuring its adequate protection. Irrelevant elements usually included in the "intangible assets" are often subject to autonomous legal regimes which, taken altogether, allow public entities to contemplate a balanced valuation. As for intangible public properties, the analysis will focus on the challenges faced while incorporating them into the domain regime - whether public or private - and then on the available options to implement a legal regime capable of ensuring an optimal valuation.

La domanialité des biens de l'Administration publique à l'épreuve des régimes fonciers traditionnels : le cas du Mali / The domain of the property of the public administration to test the traditional land tenure systems : the case of Mali

La domanialité des biens de l'administration publique à l'épreuve des régimes fonciers traditionnels pose le problème de la situation juridique du domaine au Mali. Il s'agit de donner la photographie des biens de l'administration publique ainsi que leur évolution par rapport aux régimes fonciers coutumiers. Cette étude passe naturellement par un aperçu historique des biens de l'Etat et des collectivités territoriales. Nous aborderons en même temps la situation juridique des biens au sens traditionnel de l'expression. Il sera notamment question de l'étude des biens pendant la période précoloniale, coloniale et postcoloniale. Avant la colonisation,le domaine tel que connu aujourd'hui n'existait pas et le mode de détention des biens était collectif. On ne parlait pas de domaine mais bien plutôt de propriété collective. Aussi, ce ne sont pas les lois qui ont établi les modes de tenure traditionnelle mais plutôt les principes quazi religieux. Les biens qui constituent aujourd'hui le domaine de l'Etat et des collectivités locales appartenaient, non pas aux hommes mais aux divinités. Ils étaient la propriété de la collectivité et étaient gérés le chef de terre ou le Dji tigui (propriétaire de l'eau). Ces derniers étaient les dépositaires d'une partie de la souveraineté divine et en même temps les délégués des puissances supérieures. Plus qu'ils ne les possédaient, la terre et l'eau étaient les propriétaires du chef de terre net du Dji tigui. Leurs obligations étaient dictées par les croyances ancestrales amoindries certes par le temps et les interprétations partisanes. Ces biens n'étaient pas dans le commerce juridique, ils étaient inaliénables. La propriété individuelle existait certes, mais elle n'était pas très repandue. Elle ne concernait ni la terre ni les cours d'eau. Cette propriété individuelle au sens du code civil ne pouvait concerner que certains biens biens mobiliers à l'exception de ceux qui constituaient la fortune mobilière indispensable des collectivités indigènes. A l'entame de la colonisation, l'Etat colonial décidait, non sans opposition, de mettre en place le système expérimenté en Australie du Sud par les anglais à savoir l'Act Torrens. Les indigènes avaient leur propre régime juridique et ne voulaient aucune bouleversements de leurs habitudes millénaires. Mais, dans la perspective de développer l'agriculture et l'industrie dans la nouvelle possession française, il importait d'introduire dans l'arsenal juridique de la colonie le principe de domanialité des biens. Pour ce faire, l'administrationdevait jouer toute sa partition. En conséquence, elle devait avoir les moyens de sa politique par la constitution, en premier lieu, d'un domaine public et privé. Cette constitution de domaine passait forcément par des spoliations de biens appartenant aux collectivités autochtones. A l'accession du pays à l'indépendance, la problématique est restée entière. Les textes coloniaux ont continué à régir le domaine jusqu'à l'adoption d'un code domanial et foncier en 1986. Les droits coutumiers désormais reconnus et magnifiés à la faveur de la valorisation des traditions séculaires contestent la primauté du droit écrit. Ce dernier reconnaît, qu'avant son avènement, les rapports juridiques et économiques entre individus et groupements d'individus étaient bien organisés. C'est d'ailleurs pourquoi le colonisateur n'a pas entendu faire table rase des coutumes précoloniales encore moins les nouvelles autorités. Pour autant, des problèmes de constitution et de gestion ont persisté. De nos jours encore, de nombreuses difficultés demeurent par rapport à la gestion du domaine qu'il soit public ou privé, qu'il appartienne à l'Etat ou aux collectivités territoriales. / The state ownership of assets of public administration to the test traditional land tenure raises the question of the legal situation of the area in Mali. Individualownership was true, but it was not widespresd. It did not concern either the land or waterways. This individual property within the meaning of the french Civil Code could only relate to certain personal property except those who were truly essential property of indigenous community. At the start of colonization, the colonial state decided, not without opposition, to implement the experimenced en South Australia by the English to know the Torrens Act. Indeed, the natives had their own legal system and did not want any disruption in their habits millennia. But, in view of developing agriculture and industry in the french possession, it was important to introduce into the legal arsenal of the colony the principle of state ownership of property. To do this, government should play itd full score. Consequently, it must be adequate means of its policy by establisheing, first, a public and private domain.This domain constitution necessarily spent by the spoliations of property belonging to indigenous communities. At the country attained independence, the problem remained large. The colonial tested continued to govern the field until the adoption of a code Land Law in 1986. Customary rignts recognized and magnified now thanks to the recovery of ancient traditions challenge the rule of written law. The latter recognizes that before his accession, economic and legal relationships between individuals and groups of individuals were well organized. This is why the colonizers did not intend to make a clean sweep of pre-colonial customs let alone the new authorithies. However, problems of formation and management persisted. Even today, many challenges remain in relation to the management domain whether public or private, whether owned by the state or local authorithies.

Les biens publics mobiliers s’entendent comme l’ensemble des biens mobiliers placés dans une relation juridique patrimoniale avec les personnes publiques. Certes, ils se caractérisent par leur mobilité (comme les biens privés mobiliers), c’est-à-dire une aptitude à la circulation, physique et juridique, vectrice de souplesse et de fragilité, favorable à la dissociation de leurs utilités ; mais la question ici centrale est celle de savoir si la propriété publique est toujours un instrument pertinent pour appréhender cette mobilité. Il s’avère que la propriété publique, lorsqu’elle est sollicitée, exerce potentiellement une force d’attraction efficace sur tous les biens publics mobiliers ; elle permet ainsi de freiner leur circulation. En revanche, une fois le bien capté, la propriété publique ne suffit plus à maîtriser l’intégrité des biens publics mobiliers. Elle n’endigue pas leur délitement et leur évaporation naturels. Elle est même concurrencée par d’autres rapports de droit qui, par des dissociations des utilités des biens, par la déliaison entre propriété et utilisation, conduisent à interroger sa pertinence. / Movable public property shall be understood as the set of personal property placed in a patrimonial legal relationship with public entities. These goods are characterized by their mobility (such as movable private property), that is to say an ability to circulate, physically and legally, a flexibility and fragility medium, favouring the dissociation of their utilities. But the central question remains whether public ownership is still a relevant instrument for understanding this mobility. It turns out that public ownership, when called upon, potentially exerts an effective force of attraction on all movable public property; thus it allows slowing down their circulation. It doesn’t stem their natural crumbling and evaporation. It is even challenged by other legal relationships which, by dissociation of goods’ utilities, and by unbinding ownership and use, lead to question its relevance.
