Les rapports de systèmes constitutionnel et européens de protection des droits fondamentaux en France / Relationships between French constitutional and European fundamental rights protection systems

Les interférences nées de la coexistence des systèmes constitutionnel et européens de protection des droits fondamentaux peuvent, sous certaines conditions, être bénéfiques aux titulaires de ces derniers. Elles comportent cependant une part de risques devant d’autant plus être prise au sérieux que le recours au traditionnel principe hiérarchique est aporétique. Quelle est la gestion faite de ces risques ? Qu’elle soit neutralisée ou, de manière plus aboutie, concurrencée dans ses principales fonctions, la hiérarchie est en tous cas, sinon évitée, du moins relativisée au profit de méthodes de plus en plus perfectionnées s’inscrivant dans une perspective durable et construite d’émergence de principes de régulation des rapports entre les systèmes axés autour des idées maîtresses de coopération et de conciliation. L’hypothèse de la mise en place d’un système de rapports doit toutefois être aussitôt éclairée par le constat de son caractère inabouti, du fait notamment de phénomènes de résurgence de hiérarchie. C’est finalement toute la dialectique de la coopération des systèmes de protection qui se fait jour et révèle le tournant à l’aune duquel se trouvent les rapports étudiés : la limite de la satisfaction paraît avoir été atteinte et des défis d’un genre nouveau apparaissent. Il est primordial que le système d’ensemble parvienne à préserver l’équilibre progressivement construit. Au-delà, c’est également un mouvement de redynamisation qu’il convient d’encourager afin que, dépassant le stade actuel, le défi de l’achèvement et de l’amélioration soit relevé / The interferences between constitutional and European fundamental Rights protection systems can help the subject of fundamental Rights under certain conditions. But they also provide some risks that should be taken seriously, given that the traditional hierarchical principle does not appear to give an appropriate solution. How do the principal actors of the fundamental Rights protection in Europe deal with that? The hierarchy, simply neutralized or challenged in its main functions, is avoid or at least reduced in favor of more sophisticated methods. Those appear to be maintained over time and to give pace to regulation principles within systems, based on cooperation and conciliation ideas. However, the theory of a new system of relations emergence is still incomplete. The perfect normative harmony hasn’t been reached yet, due to several factors, including phenomena of resurgence of hierarchy. In the end, the whole dialectic of system of protection’s cooperation is revealed and highlights a turning point where the studied relations now find themselves: the limitation to the satisfaction appears to be reached as new challenges are emerging. It is crucial that the global system remains in capacity to keep a progressively built balance. Above all, a stimulating impulsion should be encouraged in order to complete and improve what has been started

Foreshadowing and flashback are two techniques that look alike because they share certain features, namely repetition and experience. These two techniques nevertheless differ in many ways and this research study thus intends differentiating between the two. Existing descriptions of the two techniques provided by critics such as Irwin and Morson do not clearly indicate the differences between them. Terminology pertaining to foreshadowing and flashback is confusingly similar. This makes the identification of these techniques in literary texts difficult, and indeed no theorist explains clearly how to go about such an identification procedure. In order to achieve the aim of this research study, the descriptive, interpretive and comparative methods are used. In addition, an adapted narratological model is employed. In this model, a text is seen as having three levels, namely content, plot and style. In the analysis of content, the topic is emphasised, while theme and atmosphere are emphasised in plot and style analysis respectively. The concept 'technique' has been explained by placing emphasis on its functions and types. With regard to types, the emphasis is on structural techniques with the focus on the second level of a text, i.e the plot, because the two techniques under study, namely foreshadowing and flashback are part of the plot. Foreshadowing is described as a technique whereby an author uses details to suggest the ultimate outcome of the plot or to meaningfully precede the appearance of other details in a literary work. The functions and types of this technique are explained. Forms of this technique include knucklebones, dreams, language, character's name, shadow, conscience, beliefs, etc. Flashback is defined as the author's interruption of the chronological sequence of events in a work of literature. The importance of this technique is also emphasised. The different types of flashback are (a) external retrospection, (b) internal retrospection, and (c) mixed retrospection. A problem with regard to the types of this technique is the fact that not all types have been identified in existing research. This study has thus added two more types of flashback, namely (a) events that have been complicated and (b) events made similar to one another. There are two ways of complicating events, namely (a) changing the chronological order of events and (b) inserting events. Differences between the above-mentioned techniques that have not received attention from theorists are identified as follows in this study: <ul> <ol>In the case of foreshadowing, an unusual event appears, while in flashback, a known event is encountered, i.e. a common, everyday event. With foreshadowing, the event itself seems to be amazing.</ol><ol> In the case of flashback, however, the event may not seem amazing in itself at first, but only causes suprise later when the reader realises that his notion of what has happened and what he thinks he has understood so far is undermined.</ol> <ol>Foreshadowing whets the reader's interest, while this does not happen in the case of flashback. Foreshadowing emphasises coming events. Flashback on the other hand reveals the origin of the problem.</ol> The application of foreshadowing has been analysed by examining its forms in various Sepedi literary works. On the other hand, the application of flashback has been analysed by investigating the use of its different types rather than its forms. In the concluding chapter, the relationship between flashback and the structure of a detective narrative has been looked into. Nomadic figurations of identity on the work of Berni Searle

This study focuses on Berni Searle’s art, in which she searches for alternative figurations of identity. For Searle, identity as a category seems insufficient, as it cannot account for individuals of mixed heritage. Searle’s body of work testifies to an attempt to position and locate herself and marginalised subjects within post-apartheid South Africa. History, tradition, culture, race and gender are pivotal to Searle’s visual examination of her body and her identity, as these inscribe the subject at both symbolic and physical levels. Identity was investigated within South African context and the contexts of various postcolonial, postmodern and feminist debates. Searle’s works were investigated revealing nomadic subjectivity, as philosophised about by Gilles Deleuze and theorised about by Rosi Braidotti. Nomadic subjectivity promotes the notion that identity is fluid and located in the interstitial spaces between dichotomies and various debates. The habitation of such liminal spaces in the interstices between binary oppositions and views relates to what Homi Bhabha has defined as the “third space” and the notion of hybridity. Searle constructs her identity by affixing disparate aspects of her self. This is a continuous process whereby the artist inserts and erases her body. Searle’s works are investigated by using the film as a format. In Cinema 1: the movement-image (1986) Deleuze outlined three core cinematic elements, namely the frame, shot and montage, which are employed in an attempt to investigate the various processes at work in Searle’s artistic production. In addition to this, these filmic components were considered for their conceptual implications both in terms of the medium of film and symbolically. The concept of time, as discussed in Cinema 2: the time-image (1989) was utilised to investigate the implications of time for the nomadic subject and the notion of memory. Diploma thesis Language in athletics is focused on stratification of Czech national language and deals with vocabulary and its layers. The thesis describes slang and different aspects of slang in detail, brings a closer view to a language processes, to the beginning of sports slang and to a sport journalism. Furthermore, thesis describes a history of Czech athletics, the origin of terminology in physical education and the origin of Czech athletic terminology. The thesis uses linguistic research for a description of current athletic terminology and completes it by a new slang expressions. This diploma thesis contains both a vocabulary of athletic terminology and slang extended by some equivalents of English and Russian terminology. Comportement mécanique et couplage mécanique-oxydation dans l'alliage 718 : effet des éléments en solution solide / Mechanical behavior and coupling between mechanical and oxidation in alloy 718 : effect of solide solution elements

L'alliage 718 est le superalliage le plus utilisé industriellement du fait de ses excellentes propriétés mécaniques, ainsi que de sa tenue à l'oxydation et à la corrosion dans une large gamme de températures et de modes de sollicitation. Néanmoins, cet alliage présente une sensibilité vis-àvis des phénomènes de corrosion sous contrainte et fissuration assistée par l'oxydation sous contrainte dans les gammes de température de service. Les mécanismes à l'origine de ce phénomène restent encore mal compris, cependant un lien entre le changement de mode de rupture et les domaines d'apparition d'instabilités de l'écoulement plastique est clairement établi. Au cours de cette étude nous avons étudié ce phénomène d'instabilités, effet Portevin Le Chatelier, de l'alliage 718 au cours d'essais de traction menés dans une large gamme de températures et de vitesses de déformation. Différents domaines d'instabilités ont pu être mis en évidence, dont les caractéristiques suggèrent l'interaction des dislocations avec des solutés de différentes natures : interstitiels aux plus basses températures, et substitutionnels pour les températures les plus élevées. Des essais de spectroscopie mécanique sur l'alliage 718 et des alliages de compositions voisines montrent un effet de la mobilité des atomes de molybdène au sein du matériau dans cette gamme de températures. Des essais dédiés à l'étude des phénomènes d'interaction entre plasticité et oxydation ont aussi été réalisés. Les résultats mettent en évidence un fort effet de vitesse sur les propriétés mécaniques de l'alliage 718 en atmosphère inerte et sur les caractéristiques de l'endommagement intergranulaire assisté par l'oxydation lors d'essais sous air laboratoire. La discussion engendrée par l'ensemble des résultats présentés permet d'émettre certaines hypothèses sur les couplages entre mécanismes de déformation et endommagement par l'oxydation à l'origine des phénomènes de fissuration observés. / Alloy 718 is the superalloy the most widely used in industry due to its excellent mechanical properties, as well as oxidation and corrosion resistance in wide range of temperatures and solicitation modes. Nevertheless, it is a well-known fact that this alloy is sensitive to stress corrosion cracking and oxidation assisted cracking under loading in the range of temperatures met in service. Mechanisms explaining this phenomenon are not well understood: nevertheless, it is well established that a relation exists between a change in fracture mode and the apparition of plastic instabilities phenomenon. During this study, the instability phenomenon, Portevin-Le Chatelier effect, in alloy 718 was studied by tensile tests in wide ranges of temperatures and strain rates. Different domains of plastic instabilities have been evidenced. Their characteristics suggest the existence of interactions between dislocations and different types of solute elements: interstitials for lower temperatures and substitutionals for higher testing temperatures. Mechanical spectroscopy tests have been performed on alloy 718 and various alloys which composition is comparable to that of alloy 718. These tests prove the mobility of molybdenum atoms in the alloy in the studied temperature range. Specific tests have been performed to study interaction phenomenon between plasticity and oxidation. These results highlight the strong effect of plastic strain rate on both mechanical behavior and intergranular cracking in alloy 718. The subsequent discussion leads to propose hypothesis on coupling effects between deformation mechanisms and oxidation assisted embrittlement in the observed cracking processes.

This work processes and systematically describes the latest knowledge in the field of setting up fictitious companies in the Czech Republic, characterizes their current status and future trends. The main objective of this work is the analysis of the current level and the comparison between setting up fictitious and real company in terms of general business and legal requirements, simplicity and delays and in terms of comparison of individual legal forms and types of business representation. The theoretical part of the work deals with the procedure of starting a real company in time-sequential steps. In the practical part of the work, except for explaining the procedure setting up a fictitious company, is the attention focused on the comparison of the two procedures. There are described the individual differences in detail, which in many respects results from formal dissimilarities of the participated subjects. For this purpose was done a survey conducted among teachers of the school subject the Fictitious Company. The main aim of this work is to provide teachers, teaching the subject, with a didactical and teaching aid that, apart from the information on setting up fictitious companies, provides a comparison with the setting up of a real company. Defining the differences between setting up fictitious and real companies is an important tool for understanding the nature and the meaning of fictitious companies and help to improve the quality of teaching.

Mécanismes d'adaptation des insectes forestiers à de nouveaux arbres hôtes : une approche intégrative / Adaptation mechanisms of forest insects to novel hosts : an integrative approach

Avec l'intensification de la sylviculture et des échanges internationaux (introductions d'insectes ou plantations d'essences exotiques), les arbres forestiers sont de plus en plus confrontés à des attaques de nouveaux insectes phytophages. La compréhension des mécanismes d’adaptation de ces insectes à de nouveaux hôtes représente un enjeu scientifique majeur faisant intervenir de nombreux facteurs et des processus biologiques complexes. Dans ce contexte, nous nous sommes focalisés sur l’étude du rôle de deux facteurs : (1) la proximité taxonomique entre hôtes naturels et nouveaux de l'insecte ; (2) l’étendue du spectre d’hôtes naturels de l’insecte. Quatre approches complémentaires (méta-analyse, inventaire terrain, tests comportementaux, analyses génétiques), réalisées à différentes échelles taxonomiques et géographiques, ont été développées, les trois dernières approches se focalisant sur les relations scolytes indigènes - conifères introduits. Les objectifs étaient, d'une part d’approfondir les connaissances sur les capacités des insectes forestiers à étendre leur gamme d’hôtes, d'autre part d'apporter des informations utiles au gestionnaire forestier pour évaluer les risques économiques et écologiques qui découlent de ces adaptations. Les résultats des quatre approches concordent pour démontrer l’importance des deux facteurs testés dans les relations insectes-arbres en général et scolytesconifères en particulier. Les insectes à large spectre d’hôtes naturels seraient plus aptes à coloniser de nouveaux hôtes que ceux dont la gamme d’hôtes est plus restreinte. Parallèlement, la présence d'hôtes nouveaux proches taxonomiquement des hôtes naturels faciliterait le changement d’hôte. L’ensemble de nos résultats a contribué à compléter les connaissances sur l’évolution de la gamme d’hôtes des insectes forestiers phytophages en présence de nouveaux hôtes et par conséquent sur la sensibilité relative de ces hôtes par rapport aux hôtes autochtones. / With the intensification of forestry and global trade (insect introductions or plantations of exotic trees), forest trees have increasingly to face attacks by novel phytophagous insects. Understanding the adaptation mechanisms of these insects to their novel hosts, represents a crucial scientific issue involving many factors and complex biological processes. In this general topic, we focused on the role of two factors: (1) the taxonomic proximity between natural and novel hosts of the insects; (2) the host specificity of the insect. Four complementary approaches (meta-analysis, field inventory, behavioral tests and genetic analyses) at different taxonomic and geographical scales have been developed, the last three approaches focusing on the adaptation of indigenous bark beetles to exotic conifers. The objectives were, firstly to improve knowledge on the ability of forest insects to extend their natural host range, and secondly to provide useful information to forest managers, in order they can assess ecological and economic risks arising from these adaptations. Results from the four approaches agree to demonstrate the importance of both tested factors in the insect-tree relationships in general and conifer-bark beetle in particular. Forest insects with a broad natural host range appear to be better colonizers of novel hosts than insects with a narrow host range. The presence of novel tree species taxonomically related to native hosts seems to favor insect host shift. This work has also contributed to improve knowledge on the evolution of the host range of phytophagous forest insects in presence of novel host trees species, and consequently on the sensitivity of these hosts relatively to native ones.

Enseigner les concepts logiques en début d'université dans l'espace mathématique francophone : aspects didactiques épistémologiques et langagiers. L’objet de notre étude porte sur la logique et le langage à la transition entre le lycée et l’université dans le contexte camerounais. Au Cameroun, dans l’enseignement secondaire, les concepts de logique sont très peu explicités en classe de mathématiques, du fait que leur enseignement n’est pas prescrit par les nouveaux programmes1 officiels. Ce n’est pas le cas de l’enseignement supérieur où un cours de logique formelle sous forme de rappel, est souvent donné en début d’année. Ce cours n’est pas prescrit par les programmes, mais certains enseignants en voient la nécessité. Les résultats de plusieurs travaux ont montré que certaines des difficultés que les étudiants rencontrent dans la pratique des mathématiques proviennent d’une mauvaise maîtrise des concepts de logique. Nous faisons l’hypothèse qu’ils sont insuffisamment pris en charge pa rles enseignants dans la classe de mathématiques, qui pensent qu’ils sont disponibles chez les étudiants, du fait de leur utilisation dans la vie courante d’une part, et progressivement dans l’activité mathématique. La thèse que nous soutenons est que, pour rendre opératoire les concepts de logique chez lesétudiants nouvellement arrivés à l’université, un minimum d’explicitation de ces concepts en relation avec leur usage dans l’activité mathématique est nécessaire pour les apprentissages en mathématiques à tout le moins dans l’enseignement supérieur. Pour défendre notre thèse, nous avons divisé notre travail en deux parties. Dans la première partie, nous présentons des éléments théoriques et analytiques nécessaires à notre travail, et une revue des travaux antérieurs en relation avec notre problématique. La deuxième partie porte sur les résultats d’une expérimentation que nous avons menée avec des élèves de terminale C d’un lycée de Yaoundé 2, et des étudiants de première année de licence de mathématiques de l’Ecole Normale Supérieure de Yaoundé. Elle s’est déroulée en deux temps : nous avons fait passer un questionnaire portant sur la logique et le langage aux élèves et aux étudiants, et à la suite de ce questionnaire, nous avons organisé un module de suivi avec huit étudiants ayant passé ce questionnaire. Le questionnaire nous a permis de repérer certaines conceptions des élèves et des étudiants concernant les concepts de logique,et le module de suivi a permis de provoquer des débats qui permettaient dans certains cas d’affiner nos analyses et nous donnaient des éléments permettant d’identifier des occasions pour expliciter certaines notions. / Our study focuses on logic and language at the transition between high school and university in the Cameroonian context. In Cameroon secondary education, the concepts of logic are paid little attention in mathematics classes, due to the fact that their teaching is not prescribed in the new official syllabuses3. This is not the case of higher education, where a course on formal logic is oftengiven at the beginning of the year to first year university students, with a refreshing purpose. That course is not required in the syllabus, but some teachers see the need. Several scientific studies have shown that some of the difficulties encountered by studentswhile practicing mathematics come from their poor familiarity with concepts of logic. We assume that these students are insufficiently attended to by their teachers who think that the concepts are at their reach, since they are used in everyday life on the one hand, and they are gradually used in mathematical activities, on the other hand. In this thesis, we stand for the point that, for the concepts of logic to become real operational tools to a student who begins university studies, some teaching of these concepts which should address the connections with mathematical activities is necessary, at least as a starting point in higher education studies. To defend our thesis, we have divided our work into two parts which are as follows : In the first part, we present theoretical material necessary to our work as well as other technical tools that will be needed. We also provide a review of previous studies related to our issue. The second part is on an experiment we carried out with students from the Upper Sixth class - science option - of a high school in Yaoundé (Cameroon), and with first year university students of mathematics of the Yaoundé Higher Teachers’ Training College. This experiment had two stages : Firstly, the high school students and the university students filled out a questionnaire on logic and language. Following this, we organized a follow-up module involving 8 students purposely selected from their answers to the questionnaire. This questionnaire enabled us to detect meaningful points on how high school and university students grasp the concepts of logic, and the module helped to start debates which enabled in some cases to refine our analysis, and also provided us with strategic approaches forexplaining certain concepts of logic.
