Trademark and Design Protection of Applied Art

The aim of the thesis is to analyse suitability of trademarks and designs for protection of products’ appearance, name its advantages and disadvantages and identify and discuss conditions that must be fulfilled for an appearance of a product to be protected by each of the two mentioned types of protection. The thesis further aims to ascertain whether it is, in general, more difficult to obtain a trademark or a design protection of products bearing in mind difficulties that may arise during the registration process. The thesis focuses mainly on the European Union trademarks and Community designs.   Further, the scope of protection conferred by both instruments is analysed and evaluated and it should be determined which type of protection confers a wider protection on its owner. The thesis also aims to respond a question “which of the analysed intellectual property law instruments is more suitable and favourable for protecting an appearance of products.” Therefore, based on this thesis, users of trademarks and designs should be able to decide which of these two types of protection they should use in order to protect their products or products of their clients.

Le droit de marque appréhendé à travers sa finalité / The trade mark law accross his purpose

Depuis ses premières jurisprudences mettant en balance la libre circulation des marchandises et le droit de marque, La Cour de justice n'a cessé de remodeler le droit de marque. Elle lui a découvert une finalité concurrentielle, une fonction de garantie d'origine et un objet spécifique qui ne figurent dans aucuns textes mais qu'elle utilise pour déterminer le contenu du droit de marque et ses conditions d'exercice. Elle évoque depuis plusieurs années de nouvelles fonctions de ce droit et elle les a récemment énumérées et expressément intégrées au périmètre du droit. Pour appréhender le droit de marque, il convient aujourd'hui de rechercher l'apport de ces nouvelles fonctions au droit, les éventuelles modifications de la finalité qu'elle engendre et la manière dont elles influencent son contenu. Considérant que la finalité est le point de départ de la création d'un droit nous allons chercher la finalité du droit de marque pour pouvoir l'appréhender. / Since its early case law by balancing the free movement of goods and trade mark law, the Court of Justice has continued to reshape the trademark right. She has discovered a competitive purpose, as a guarantee of origin and a specific object. They don't appear in any texts but it uses to determine the content of the right brand and its operating conditions. She mentioned several years ago some new features of this right and it has recently listed and expressly incorporated in the content of the right. To understand the trade mark right now, we should be to seek the contribution of these new functions to the right, possible amendments to the purpose that it engenders and how they influence its content. Considering that the purpose is the starting point for creating a right we'll collect the purpose of trade mark rights in order to apprehend him.

Limites do direito de propriedade industrial de plantas

Por meio deste trabalho são analisados os limites do direito de propriedade industrial de plantas. Os limites jurídicos são verificados pela análise da teoria da propriedade industrial, teoria da função social da propriedade, dos acordos internacionais pertinentes e da legislação e dos bancos de dados referentes à propriedade industrial dos Estados Unidos da América, da União Européia e do Brasil. O objetivo é verificar que tratativas a legislação e a jurisprudência brasileiras apresentam para os limites da propriedade industrial de plantas em suas duas formas de proteção – a proteção de cultivares e a patente de invenção. No apoio deste estudo se procura verificar como o setor vitivinícola do Rio Grande do Sul percebe a existência desta proteção e os seus limites aplicados à videira. O método utilizado neste estudo é o dedutivo e sua implementação se faz mediante estudo de caso, por meio do uso da ferramenta mesoanalítica da teoria do campo organizacional. Como resultados verifica-se que: 1) os limites à propriedade industrial de plantas são temporais, territoriais, legais, compulsórios e de esgotamento de direitos; 2) há insipiente jurisprudência brasileira, que aborda o tema de modo não uniforme; 3) os atores do setor vitivinícola do Rio Grande do Sul reconhecem a existência de direitos à propriedade industrial, identificando a forma de proteção desta propriedade e entendendo a existência desta proteção como importante para o Brasil. O seu desconhecimento e o desrespeito a esta proteção, bem como a falta de fiscalização, podem se constituir em fontes de dificuldades para a aplicação desse direito. Em regra, os atores conhecem muito pouco sobre os limites desta proteção, vêem uma relação positiva entre a propriedade industrial e a inovação tecnológica e esperam que a propriedade industrial de plantas seja efetivamente praticada no Brasil. É apresentado um modelo de abrangência do direito de propriedade industrial sobre o objeto planta, que pretende ajudar a orientar o reconhecimento dos respectivos direitos do inventor e dos usuários das plantas e seus limites. / In this dissertation the limits of the industrial, intellectual property rights as applied to plants are analyzed. The limits of the legal rights are unfold by the analysis of the theory of industrial property, the related, the theory of the social function of the property, international treaties, and by present laws, and available data bank on industrial property in the United States of America, European Union, and Brazil. The aim of this work is to point out how Brazilian laws and jurisprudence deal with the limits of the intellectual property rights of plants in the two used protection systems, the variety protection and the patent ones. To embody this study with a field work we proceeded a search on how people of the grape and wine industry of the State of Rio Grande do Sul, Brazil perceive the existence and the enforcement of this kind of right protection, and its limits when applied to vines. The method of analysis used in this study is the deductive one, its application by the way of a study case using the mesoanalysis of the organizational field theory. The principal points of the results of this study are: 1) the limits of the intellectual, industrial property rights are related to time, territory, legal and mandatory matters, and to exhaustion of rights; 2) there are indeed an incipient Brazilian jurisprudence, which deals with the subject in a non-uniform way; 3) representatives from the grape and wine industry of the State of Rio Grande do Sul do recognize the existence of the intellectual, industrial property rights applied to vines in Brazil, and understand them as an important form of property protection for the country. The lack of knowledge, and the eventual disregard for this kind of legal protection, and the lack of the corresponding law enforcement as well, might become significant sources of difficulties for fully implementing the intellectual, industrial property rights in the country. As a rule, people involved in the grape and wine business know very little about the limits of these legal rights, but do recognize a positive relationship between the intellectual, industrial property rights and the process of technology innovation, and hope that these rights will soon be widely enforced in Brazil. As a conclusion, a framework is proposed for application of the intellectual, industrial property rights related to protected plants, aiming orienting the recognition of the rights of the inventor, and of the users of these plants, and the corresponding limits of the rights called upon.

The thesis begins with defining the industrial rights as a term and its relation to the broader area of intellectual property rights. The main international classifications of industrial property rights are introduced along with the basic principles of their international protection. La contrefaçon de la propriété intellectuelle constitue l'un des sujets d'actualité les plus marquants de nos jours. Un tel phénomène n'épargne à l'heure actuelle aucun pays et l'on se demande de quelle manière pourrait-on protéger la propriété intellectuelle, dans une ère où la contrefaçon peut atteindre tous les secteurs intellectuels. Au rebours du droit français qu'est assez avancé en ce domaine, le droit marocain y compris la jurisprudence marocaine quand bien même inspirée de la législation française ne sont qu'au stade du balbutiement. A cet égard, nous avons scindé notre thèse en deux parties, la première est consacrée aux éléments constitutifs de contrefaçon de propriété intellectuelle à savoir, les éléments constitutifs de la contrefaçon de propriété intellectuelle de la manière suivante. Après une introduction, le premier chapitre expose l'élément matériel (un comportement frauduleux) de contrefaçon en matière industrielle et en droit d'auteur et droits voisins. Le second chapitre présente un élément moral (la connaissance d'agir mal), le troisième chapitre traite l'élément légal (un texte de loi). Dans la deuxième partie, on a étudié, la procédure de lutte contre la contrefaçon de propriété intellectuelle, dans un premier temps on a traité la constatation préalable des faits de contrefaçon (Chapitre I), puis le déclenchement de la procédure de lutte contre la contrefaçon (Chapitre II) avant de nous attarder sur les mesures de lutte contre la contrefaçon de propriété intellectuelle (Chapitre III). / Our days, Counterfeiting of intellectual property is one of the most significant subject. Such a phenomenon touchs at present all countries and we wonder how can we preserve intellectual property in Morocco, in this era where counterfeiting can reach all intellectuals sectors. Contrary to French law which is quite advanced in this area, Moroccan law including Moroccan case law, inspired by French law are at the stage of babbling, in  this regard, we have split our thesis in two parts .The first part focuses on the elements of infringement of intellectual property, as follows. After an introduction, the first chapter outlines the physical element of counterfeiting industrial matters and copyright and neighboring rights. The second chapter presents a moral element , the third chapter deals with the legal element (a law). In the second part, we have studied how to fight against counterfeiting of intellectual property, initially was treated prior determination of the facts of infringement (Chapter I), then the start of the procedure against counterfeiting (Chapter II) before dealing with  measures against infringement of intellectual property rights (Chapter III).

In this part are also given reasons of valuation of trademarks and methods suited for this valuating. The second part contains case study representing legislation and methods of valuation of trademarks on specific example.

The master thesis analyses and compares selected accesses to patent information systems of Czech Industrial Property Office, European Patent Office, United States Patent and Trademark Office and World Intellectual Property Organization. This includes accesses via web sites of the institutions mentioned above and an access via Google Patents service. The thesis is divided into six parts. The first part discusses patent information systems, the second one gives an overview of the selected institutions, the third part presents evaluation methodology of patent information systems, the fourth part includes a comparative analysis, the fifth one consists of a user survey and the sixth part introduces possibilities of future development of patent information systems. The comparative analysis showed the access to information system of World Intellectual Property Organization (Patentscope) as the best one among all the analysed accesses. In the user survey the respondents selected the information system of European Patent Office (Espacenet) as the most user-friendly access.
