Desenvolvimento tecnológico : a propriedade industrial na produção da guitarra elétrica e captadores no Brasil

The creation of new products and functional improvement of these can promote competitive advantage and provide opportunities for economic development through IP Intellectual-Property. The Electric Guitar is an innovation that resulted from research and exploration carried by independent inventors. Production on a significant scale occurred from the 1940s in the United States, country that registered the first patents in the development of this musical instrument. Electric Guitar, which combines technological innovation since its inception, impacts the cultural development of Western society. It constitutes an important pillar for the industrial platform related to music that connects a worldwide chain of input suppliers and service providers. The pickup is the electromagnetic component that allowed the invention of the electric guitar in the United States of America and the Bahiana Guitar in Brazil. Both inventions are inducing cultural changes, however their economic impacts are different in scale and characteristics. The technological development of the pickups is crucial to the competitiveness of Electric Guitar's manufacturers. This dissertation represents an opportunity to reflect about the dynamic of this industry. Currently, the production of the Electric Guitar it is both industrial and artisanal. Brazil is a consumer market in expansion, what favors the increase of imports. In contrast, the international operations of brazilian industry in this sector is still under construction. Based on a descriptive applied research, the present dissertation is exploratory and explanatory. The elements of the research are: the current situation of the industrial segment of the Electric Guitar at the national level and in other relevant countries in the production and consumption of this instrument; exploration and analysis of the technological development of the pickup in Industrial Property databases, and the industry connection with the exportation incentive mechanisms. This dissertation aims to contribute to present this economic sector's potential and to demonstrate the importance of Industrial Property for its development, by considering the opportunities for the promotion of applied research, the Industrial Property registration, the development of technological innovation, and support mechanisms available in the National Innovation System. / A sociedade do conhecimento contempla a valorização do intangível. A criação de novos produtos e respectiva melhoria funcional destes constituem diferencial competitivo e oportunidade de crescimento por meio da Propriedade Intelectual (PI). Neste sentido a Guitarra Elétrica é uma inovação resultante de pesquisas e descobertas de inventores independentes. Sua produção em escala significativa ocorreu a partir da década de 1940, nos Estados Unidos da América, país que registrou as primeiras patentes no desenvolvimento deste instrumento musical. A Guitarra Elétrica agrega inovações tecnológicas a partir da sua criação, impactando no desenvolvimento cultural da sociedade ocidental, consistindo em um pilar relevante para a plataforma industrial relacionada à música, interligando uma cadeia mundial de fornecedores de insumos e prestadores de serviços. O Captador é o componente eletromagnético que permitiu a invenção da Guitarra Elétrica nos Estados Unidos da América e da Guitarra Baiana no Brasil. Ambos os inventos são indutores de mudanças culturais, porém, com impactos econômicos em escalas e características distintas. O desenvolvimento tecnológico dos Captadores é crucial para a competitividade dos fabricantes de Guitarras Elétricas, e nesta dissertação representam uma oportunidade para análise e entendimento da dinâmica setorial. Atualmente, a fabricação da Guitarra Elétrica ocorre tanto com produção industrial, quanto artesanal, sendo o Brasil um mercado consumidor em expansão, favorecendo o aumento das importações oriundas de diversos países, contrapondo uma atuação internacional ainda em construção da indústria brasileira. Baseado em uma pesquisa descritiva aplicada, o trabalho de dissertação é exploratório e explicativo. Os elementos da pesquisa são: o panorama atual do segmento industrial da Guitarra Elétrica em âmbito nacional e em outros países relevantes na produção e no consumo deste instrumento; a prospecção e análise do desenvolvimento tecnológico do captador nas bases de Propriedade Industrial, e a conexão setorial com os mecanismos de incentivo à exportação. Assim, este trabalho de dissertação visa contribuir apresentando o potencial econômico do setor, demonstrando a importância da Propriedade Industrial para o seu desenvolvimento, considerando as oportunidades para o fomento à Pesquisa Aplicada, o registro da Propriedade Industrial, o desenvolvimento da Inovação Tecnológica, e os mecanismos de suporte disponíveis no Sistema Nacional de Inovação.

Marca : evolução e proteção - um estudo comparativo entre as empresas Sadia e Perdigão

Over the years there have been major developments in corporate identity, which included the integration of the concept of the logo branding systems of both companies and products; extending thereby at the level of legal definitions or in the application forms, colors and uses of logos, as well as the design of the mark. Since then, the brand began to be considered one of the main intangible assets, providing the basis for a sustainable competitive advantage. Thus, the legal protection of this asset becomes indispensable. Considering the growth and importance of intangible assets |brand|, this study aimed to evaluate the profile of the trademark filing consolidated two Brazilian companies and national prominence in the food sector, including analysis of trademark protection since its evolution and extension the visual identity to the comparative study of management strategies relating to these distinctive signs. From data collected in the National Institute of Industrial Property for the years 2000 to 2013, exploratory-descriptive research was conducted, analyzing the evolution of marcarios records and protection of trademarks by the companies Sadia and Perdigao SA. According to the records, it was found that from the beginning to the present day, Perdigao brand and had a few minor alterations and identified records of change in mixed company brand in the years 1958, 1980 and 2005 On the other hand, for Sadia records modernization of its visual identification in the years 1960, 1993 and 2011, characterized by the association consumers make the brand together the stylized S and the image of the mascot were observed. The strategies of brands of both companies are extensions: line (creating different flavors and different features in various products); brand (using their names in different product categories, including meat products, pizza, snacks and pasta) and multi (insertion of brands introduced in the same product category market, such as margarines and Deline Qualy). Furthermore, firms make use of licensing strategies, for example: |Monica| (Sadia) and |The Smurfs| (Perdigao). As for the number of records was verified to occur in six different classes: 29, 30, 31, 32, 39, 43, however, with greater expressiveness in class 29, comprising 436 records of Sadia and Perdigao 162. However, 80% of the records of Sadia are active and 20% of applications filed, the total of 731 On the other hand, the 196 brands Perdigao 71% refers to the active. So mark protection is very important for both companies, evidenced by the high numbers of records over the years. Moreover, the construction of each brand was strategic element for both companies to consolidate the market, communicating its value proposition to consumers. It is noteworthy also that Sadia and Perdigao, during its existence, used strategies similar brands, however with regard to launching products, Sadia is still higher than Perdigao. / Ao longo dos anos houve grande evolução na identidade coorporativa, o que compreendeu a integração do conceito de logotipo aos sistemas de identidade visual tanto das empresas quanto de produtos; estendendo-se, desta forma, em nível de definições legais seja nas formas de aplicação, cores e usos de logotipos, como também ao design da marca. A partir de então, a marca começou a ser considerada um dos principais ativos intangíveis, proporcionando a base de uma vantagem competitiva sustentável. Logo, a proteção legal desse ativo torna-se indispensável. Considerando o crescimento e a importância do ativo intangível marca , este trabalho teve como objetivo avaliar o perfil do depósito marcário de duas empresas brasileiras consolidadas e de destaque nacional no setor alimentício, incluindo a análise de proteção das marcas desde a sua evolução e extensão da identidade visual até o estudo comparativo de estratégias administrativas referentes a estes sinais distintivos. A partir de dados coletados no Instituto Nacional da Propriedade Industrial, correspondentes aos anos de 2000 a 2013, foi realizada pesquisa exploratório-descritiva, com análise da evolução dos registros marcario e da proteção de marcas pelas empresas Sadia S.A. e Perdigão. De acordo com os registros, foi constatado que do início até os dias atuais, a marca Perdigão teve poucas e discretas alterações, sendo identificados registros de modificação na marca mista da empresa nos anos de 1958, 1980 e 2005. Por outro lado, para a marca Sadia foram observados registros de modernização de sua identificação visual nos anos de 1960, 1993 e 2011, caracterizados pela associação que os consumidores fazem à marca conjuntamente ao S estilizado e a imagem da mascote. As estratégias de marcas de ambas as empresas se constituem de extensões: de linha (criando diversos sabores e características diferentes em vários produtos); de marca (utilizando seus nomes em diferentes categorias de produtos, incluindo derivados de carne, pizzas, salgadinhos e massas) e multimarcas (inserção no mercado de marcas introduzidas na mesma categoria de produto, como exemplo margarinas Deline e Qualy). Ademais, as empresas se utilizam de estratégias de licenciamento, por exemplo: Turma da Mônica (Sadia) e os Smurfs (Perdigão). Quanto ao número de registros foi verificada a ocorrência em seis classes diferentes: 29, 30, 31, 32, 39, 43, no entanto, com maior expressividade na classe 29, compreendendo 436 registros da Sadia e 162 da Perdigão. Contudo, 80% dos registros da Sadia encontram-se ativos e 20% de pedidos arquivados, do total de 731. Por outro lado, das 196 marcas da Perdigão 71% referem-se às ativas. Portanto, a proteção marcaria representa grande relevância para as duas empresas, constatada pelos elevados números de registros ao longo dos anos. Além disso, a construção da marca de cada uma foi elemento estratégico para ambas as empresas se consolidarem no mercado, comunicando sua proposta de valor aos consumidores. Ressalta-se, ainda, que a Sadia e a Perdigão, no decorrer de sua existência, utilizaram estratégias de marcas semelhantes, contudo no que diz respeito ao lançamento de produtos, a Sadia ainda é superior à Perdigão.

La présente recherche vise à comprendre le processus ou le mécanisme de valorisation de la propriété industrielle aussi bien dans les pays développés que dans les pays en développement suite à la conclusion de l’accord historique ADPIC.L’analyse de données factuelles se rapportant à la protection de la propriété industrielle pharmaceutique en Tunisie nous oriente vers une modélisation possible de l’industrie pharmaceutique tunisienne.La recherche identifie deux voies ou stratégies d’exploitation des brevets : « license in » ou « license out ». Cependant, c’est le dépôt de brevet par les nationaux résidents qui fait défaut en Tunisie dans le domaine pharmaceutique, dominé par les biotechnologies à l’échelle mondiale.Le rapprochement des industries locales avec des partenaires scientifiques internationaux pourrait être une voie possible de valorisation. / We aim in this research to study how to assess the value of a patent in developed countries as well as in emerging ones, mainly according to the TRIPS.Modelization of the pharmaceutical industry in Tunisia has been possible when analyzing data evidence from pharmaceuticals patents in Tunisia.This research identify two strategies to capitalize on patents: « license in » ou « license out ».However, only few local industries in Tunisia are willing to file patents, even ifbiotechnologies dominate global pharmaceutical market.Being in touch with international scientific partners, signing contracts could help to valorize industrial property in Tunisia.

A transferência internacional de tecnologia é operação que serve como base para o desenvolvimento tecnológico. Muito além da dicotomia desenvolvimento autóctone versus importação de tecnologia, verificamos que a importação de tecnologia é, também, geradora de parte das condições precedentes para o desenvolvimento de inovação localmente. Componente-chave de qualquer processo de transferência de tecnologia é a efetiva transferência de habilidades e know-how intangível que assegurem a capacidade produtiva. O canal de transferência de tecnologia não é uma forma fácil de construir capacidade de inovação. Por meio deste, as conseqüências da transferência de tecnologia serão determinadas pelos objetivos gerais das corporações que contratam, os quais certamente não englobam a disseminação da tecnologia para potenciais concorrentes. Dentro do contexto de conflito tecnológico norte-sul ainda existente, a harmonização do direito da concorrência e da propriedade intelectual em torno do interesse coletivo concentra-se justamente na administração da intenção dos países detentores da tecnologia de manter o seu monopólio e acesso restrito à tecnologia e o dos países receptores de terem amplo acesso e utilização da tecnologia. A política de intensificação da transferência de tecnologia internacional depende não somente de políticas regionais e internacionais, mas também de políticas nacionais. É preciso analisar caminhos viáveis para as políticas dentro da moldura nacional e internacional existente. A industrialização brasileira orientou-se no sentido de gerar capacidade produtiva com adoção de padrões tecnológicos relativamente atrasados e imposição de elevadas barreiras à entrada, impactando significativamente a capacidade do país de gerar, transferir e introduzir inovações tecnológicas. A regulação da transferência de tecnologia que a acompanhou tinha como vetores principais a substituição de importações paralelamente a controles fiscais e cambiais dos pagamentos das contratações, como forma de promover o equilíbrio da balança de pagamentos do país. Esta permanece em vigor, com alterações mínimas. Ao Governo cabe delinear de forma mais clara em sua política industrial o tipo e maneira de controles que pretende exercer sobre a importação de tecnologia para o país, e com qual finalidade. Adicionalmente, é preciso promover uma harmonização dos vários diplomas legais incidentes na operação para que expressem coerência entre si. A coerência será atingida na medida em que se escolham os vetores definidores da regulação de forma consistente. A regulação deve concentrar-se na absorção da técnica pela mão-de-obra local, sem desestimular o fornecedor estrangeiro. Ambos objetivos serão atingidos com a (i) matização da regulação na área tributária e cambial e a (ii) promoção de maior interatividade entre a regulação pela propriedade industrial e o direito concorrencial, que devem focar nos termos das contratações. Quanto à política da concorrência, é preciso distinguir entre uma política de concorrência baseada somente em inovação e aquela baseada em disseminação da inovação. Quando se foca somente na inovação e se impede a disseminação, esquece-se de que o bônus que se concede hoje à inovação implicará um preço no futuro. Uma política de concorrência com a intenção de promover a disseminação e absorção de tecnologia não pode ser tarefa para as autoridades da área concorrencial, somente. / The international transfer of technology is an operation that serves as a basis for technological development. Well beyond the contrast indigenous development versus importation of technology, the importation of technology also generates preconditions for the development of local innovation. A key component of any transfer of technology process is the effective transfer of expertise and intangible know-how that ensure the production capacity. The transfer of technology vehicle is not a simple form of building innovation capacity. Through it, the consequences of the transfer of technology are determined by the overall purposes sought by the companies that convene this and certainly does not cover the dissemination of the technology to potential competitors. Within the context of the northsouth technological conflict that still exists, streamlining of antitrust law and of intellectual property law considering the public interest lays precisely on the management of the intention of the countries that own the technology to sustain their monopoly and restrict the access to the technology and the intention of the acquiring countries to have broad access and use of the technology. The policy of incrementing transfer of international technology depends not only on regional and international policies, but also on national policies, being necessary to analyze viable courses for the policies in the existing national and international framework. The Brazilian industrialization was guided in the direction of generation of production capacity adopting international standards that were relatively obsolete and by imposing obstacles to imports, substantially affecting the countrys capacity to generate, transfer and adopt new technologies. The technology transfer regulations that accompanied it had as its main pillars the replacement of imports and tax and currency exchange controls over the payments of the agreements to stabilize the countrys foreign trade deficit. This continues to exist, with minimal changes. It is incumbent on the Government to clearly outline in its industrial policy the type and form of the control that it intends to use in the importation of technology into Brazil and with what purpose. Further, it is necessary to harmonize the several statutes that apply to the operation so that they reflect coherency among each other. Coherence shall be attained upon selecting the vectors that define the regulation in a consistent manner. The regulation should concentrate on the absorption of the know-how by the local workers, but without discouraging the foreign supplier. Both goals would be met upon (i) softening the regulation under the tax and exchange aspects, and (ii) fostering greater interaction between the regulation in the intellectual property and antitrust laws areas, which should focus on the contractual clauses. As regards the antitrust policy, it is necessary to distinguish between an antitrust policy that is based solely on innovation and that which is based on the dissemination of the innovation. When only innovation is focused and dissemination is hindered, the bonus that is now being conferred to innovation and that will have a toll in the future is ignored. An antitrust policy that is intended to foster the dissemination and absorption of technology cannot be a task borne only by the antitrust authorities.

Les biens immatériels que possèdent les entreprises, sont le plus souvent des droits de propriété industrielle ou un savoir-faire tenu secret. Leur exploitation indirecte, nationale ou internationale, s’effectue à travers la conclusion de différents contrats d’exploitation. Avec la mondialisation, ces contrats sont au cœur de l’économie moderne et constituent l’un des outils de transfert de technologie. Cette thèse propose une analyse globale des contrats d’exploitation des droits de propriété industrielle et de savoir-faire en droit marocain et en droit français. Dans la première partie, on expose leur régime général, en droit des contrats, droit de la propriété industrielle et droit de la concurrence. La deuxième partie propose une analyse unitaire de chaque type de ces contrats dans ces deux systèmes et traite leurs régimes spécifiques. / Intangible property owned by companies consists most often of the industrial property rights or a secret know-how. Their indirect exploitation, national or international, is made through the concluding of various contracts of exploitation. With the globalization, these contracts are at the heart of the modern economy and constitute one of the most important tools of technology transfer. This dissertation offers a global analysis of the various contracts of exploitation of the industrial property rights and know-how in Moroccan law and in French law. The first part of the thesis exposes their general regime under contract law, industrial property law and competition law. The second part proposes a unitary analysis, which views the problems raised by each type of these contracts in these two legal systems and treats their specific regimes.

Marca notória: um estudo sobre a aquisição e perda de distintividade de marcas decorrentes de sua notoriedade

Firstly, it aims to introduce the institute of the mark as a distinctive sign, demonstrating that the distinctiveness is a condition of validity for the grant thereof. After defining the institute, the attainment of notoriety by the mark is analyzed, being the object of the present study the notorious mark as the category, and the well-known mark and high-reputation mark as the types. The legal provision and the scope of protection of notorious marks are broached, as well as the main consequences of trademark notoriety. Having made this introduction, the present study discusses the phenomena of attainment and loss of trademark distinctiveness resulting from the notoriety thereof. The first of them is studied by the theory of secondary meaning, and its occurrence is analyzed in all systems of trademark attainment. Emphasis is given to the expressions originally non distinctive and which are susceptible of attainment of secondary meaning, being therefore susceptible to registration as a mark. Next, the phenomenon of loss of trademark distinctiveness resulting from its distinguishability is analyzed, the phenomenon known as trademark degeneration or trademark degeneracy. Since it deals with a slow process, and almost always irreversible, some indicator signs of trademark degeneration are studied, as well as customary forms used to avoid it. Finally, a few judicial and administrative decisions involving the referred to phenomena are analyzed, seeking to exemplify some forms found for proving and identifying the attainment of secondary meaning and trademark degeneration empirically, emphasizing the position of the Courts and the INPI (the Brazilian Patents and Trademarks Office) in relation to the matter / O presente trabalho visa analisar dois fenômenos empíricos decorrentes da notoriedade de marca: a aquisição e a perda de distintividade marcária. Primeiramente, busca-se introduzir o instituto da marca como signo distintivo, demonstrando ser a distintividade condição de validade para sua concessão. Após definir o instituto, a aquisição de notoriedade pela marca é analisada, sendo objeto do presente estudo a marca notória como gênero, e suas espécies marca notoriamente conhecida e marca de alto renome. A previsão legal e o âmbito de proteção das marcas notórias são abordados, assim como as principais conseqüências da notoriedade marcária. Feita esta introdução, o presente trabalho aborda os fenômenos de aquisição e perda de distintividade marcária decorrentes de sua notoriedade. O primeiro deles é estudado pela teoria do secondary meaning, ou teoria do significado secundário, e sua ocorrência é analisada em todos os sistemas de aquisição de marca. É dado destaque às expressões originalmente não distintivas e que são passíveis de aquisição de significado secundário, sendo, portanto, passíveis de registro como marca. A seguir, é analisado o fenômeno da perda de distintividade marcária decorrente de sua distintividade, fenômeno conhecido como degeneração ou degenerescência marcária. Por se tratar de processo lento, e quase sempre irreversível, são estudados alguns sinais indicadores da degeneração marcária, e formas costumeiramente utilizadas para evitá-la. Unfortunately, such a facet of industrial property has never been exploited and disseminated either by the local legal community or national companies. The first one preferred to adopt a position characterized by a strong social appeal (not always technically grounded) and the second ones did not do so because they simply lacked a culture of protection of their intangible assets. A simplistic and perfunctory judgment of the matter may suggest that industrial property and competition law are two areas of Law completely antagonistic and irreconcilable with each other. Such a construction could jeopardize the legal safety that economic agents need to invest in scientific development and technology research. This study therefore aims at examining, in a scientific fashion, the relationship between industrial property law and competition law. First and foremost, an assessment of both foreign and Brazilian experiences will be conducted as a preparatory field for a principiologic analysis of both areas of Law. Once the relevant principles are identified in both foreign and Brazilian experiences according to the deductive method, it will be investigated which principles are either coincident or harmonic and the theoretical formulation of Robert Alexy will be applied to cases of conflict, in order to demonstrate that the relationship between both legal areas is actually harmonic and complementary / entre os vários agentes econômicos, a propriedade industrial, antes de um direito de exclusiva, consiste num poderoso instrumento de concorrência. Esta faceta da propriedade industrial infelizmente não foi, até o momento, explorada e difundida tanto entre a comunidade jurídica local quanto pelo empresariado brasileiro. A primeira preferiu um discurso pautado em forte apelo social (e nem sempre tecnicamente fundamentado); e o segundo não o fez simplesmente porque lhe faltava a cultura da proteção de seu capital imaterial. Uma análise simplista e perfunctória da questão poderia levar ao entendimento de que a propriedade industrial e o direito da concorrência seriam duas áreas da ciência jurídica completamente antagônicas e inconciliáveis, interpretação esta que poderia colocar em risco a segurança jurídica de que os agentes econômicos necessitam para investir em desenvolvimento científico e pesquisa tecnológica. O objetivo do presente estudo consiste, pois, em discorrer, de forma científica, sobre as relações entre direito de propriedade industrial e defesa da concorrência. Proceder-se-á, por primeiro, a um estudo da experiência estrangeira e brasileira como campo preparatório para a análise principiológica. Desenho industrial: abuso de direito e o reflexo na concorrência do mercado de reposição / Industrial design: abuse of right and the reflection on competition in the aftermarket.

O direito antitruste, atualmente ditado pela Lei 12.529 de 30 de novembro de 2011, e o direito da propriedade intelectual permeiam o ordenamento jurídico brasileiro buscando regrar condutas e procedimentos com vistas a tutelar, de um lado, a livre concorrência e, de outro, estimular a inovação e o desenvolvimento tecnológico do país. No exercício de ambos os direitos, muitas vezes observam-se conflitos, que aparentemente revelam uma contradição: a concessão de exclusividade de exploração de bens intangíveis, tais como patentes e desenhos industriais, conflita com a livre concorrência, sendo uma excludente da outra. Entretanto, essa contradição, como se verá, encontra-se superada. Em nosso sistema jurídico não há direitos absolutos que possam justificar a dominância pura e simples de um sobre o outro sem medir as consequências. O equilíbrio é buscado através da vedação legal aos abusos de direito, especialmente abusos de direito de propriedade intelectual e o exercício abusivo de poder econômico. Adicionalmente, a Constituição Federal subordina o uso da propriedade à sua função social. O presente estudo analisa as questões que envolvem esse aparente conflito e os abusos decorrentes do exercício desses direitos. O tema é introduzido com a análise da interface entre o direito da propriedade intelectual e o antitruste e as questões de direito dela decorrentes. A seguir, são analisados o abuso de direito, o abuso de poder econômico e o abuso de posição dominante, com destaque para o entendimento da existência de venda casada mesmo que o vínculo ocorra com diferimento no tempo. O estudo prossegue discorrendo sobre a livre iniciativa e a livre concorrência, bem como o instituto do desenho industrial e seu eventual uso abusivo. Também são analisados o mercado de reposição de peças e partes de produtos complexos e sua repercussão no Brasil e no exterior, e a posição do CADE sobre eventuais condutas anticompetitivas. A jurisprudência comentada ilustra as diversas posições doutrinárias acerca da matéria. O monopólio decorrente de direito de propriedade intelectual seria benéfico para a eficiência e regulação dos mercados, apesar de seus eventuais efeitos contra os interesses do consumidor? Este ensaio procura responder essa indagação, aprofundando o debate sobre o conflito entre o monopólio concedido por desenho industrial às peças de reposição de objetos complexos e a liberdade de escolha do consumidor. Oferece ainda uma proposta legislativa que visa assegurar o equilíbrio entre os direitos dos envolvidos. / The antitrust law, currently under Law 12,529, of November 30, 2011, and the intellectual property law is within the Brazilian juridical ordination, seeking to rule conducts and procedures intended to protect the free competition, on one hand, and to stimulate the innovation and technological development of the country, on the other hand. In the performance of both rights, conflicts are many times observed, which apparently reveal a contradiction: the granting of exclusivity for the exploitation of intangible goods, such as patents and industrial designs, conflicts with the free competition, excluding one another. Said contradiction, however, has been overcome, as it will be noticed. Our juridical system encompasses no absolute rights liable to justify the pure and simple dominance of one on the other, without assessing the consequences. The balance is searched by means of the legal prevention of the abuses of right, especially the abuses of the intellectual property law and the abusive exercise of the economic power. In addition, the Federal Constitution subordinates the use of property to its social function. This study analyzes the issues involving this apparent conflict and the abuses resulting from the enforcement of said rights. The theme is introduced with the analysis of the interface between the intellectual property right and the antitrust one and the resulting legal issues. Then, the abuse of right, the abuse of economic power and the abuse of the dominant position are analysed, pointing out the understanding of the existence of a tying arrangement, even though the binding occurs with deferral in time. The study proceeds by analyzing the free initiative and the free competition, as well as the industrial design institute and its eventual abusive use. The parts reposition and parts of complex products and their repercussion in Brazil and overseas, the CADE´s position as to eventual anticompetitive conducts are also analyzed. The commented jurisprudence illustrates the several opinion of jurists on this matter. Would the monopoly resulting from the intellectual property right benefit the market efficiency and regulation, despite the eventual effects against the consumer interests ? This paper seeks to reply such a question, by deepening the debate on the conflicts between the monopoly granted by industrial design to spare parts of complex objects and the consumer´s free choice. It also offers a legislative proposal intended to ensure the balance between the involved parties´ rights.

Valoração de tecnologias em organizações científicas e tecnológicas (OCTs) do estado do Paraná (Brasil) / Technology valuation in scientific and technological organizations (OCTs) of Paraná (Brazil)

O modelo de inovação aberta proposto recentemente por Henry Chesbrough tem encorajado a transferência de tecnologia entre empresas, universidades e instituições de pesquisa. Em resposta a esse fenômeno o Brasil criou mecanismos para incentivar a transferência de tecnologia entre essas diferentes organizações pelas Leis 10.973/2004 e 11.196/2005. Assim, a maior integração entre esses agentes de inovação tecnológica levanta a necessidade de voltar maior atenção à avaliação do valor da tecnologia objeto de transferência. O objetivo da pesquisa foi descrever as principais características de processos de valoração de tecnologias desenvolvidos e utilizados por organizações científicas e tecnológicas no Paraná. Esta é uma pesquisa de natureza aplicada, qualitativa do ponto de vista da abordagem do problema, descritiva no que diz respeito aos seus objetivos e predominantemente documental em relação aos seus procedimentos técnicos. Os procedimentos metodológicos incluíram uma pesquisa bibliográfica buscando o mapeamento de características de processos de valoração de tecnologia utilizados no Brasil e no exterior, que foram levantados por meio do acesso a sítios, via internet, de importantes organizações científicas e tecnológicas e levantamentos usando instrumentos como questionário. Como resultado, verificou-se que as principais características que definem o perfil das OCTs no processo de transferência de tecnologia são: a maior abrangência do escopo da missão institucional das OCTs (maior quantidade de objetivos); maior envolvimento com atividades de pesquisa; o envolvimento de outros agentes na definição dos critérios para valoração de um ativo tecnológico (incluindo parceiros e pesquisador); adoção de maior número de tipos de contratos de transferência; e maior tempo de experiência do NIT. Adicionalmente foi possível verificar que a aderência aos métodos mais indicados na literatura não é uma característica das OCTs paranaenses, o que sinaliza um potencial para convergência das práticas atuais às melhores práticas. Como sugestão recomenda-se que as OCTs adotem como prática a oferta de diferentes tipos de contratos de transferência em suas negociações para maximizar as possibilidades de sucesso. Recomenda-se também incluir nos catálogos de patentes, além dos descritivos técnicos, redações sobre as possibilidades de aplicação das tecnologias em operações da produção de bens ou prestação de serviços. As recomendações incluem também a publicação do portfólio de projetos de pesquisa cujos objetivos sejam conceber novos produtos ou processos de produção. Este trabalho sugere também a criação de um cadastro de demandas tecnológicas, que poderia ser publicado no Relatório Formict, para que os NITs possam identificar oportunidades de transferência de tecnologia. / The open innovation model recently proposed by Henry Chesbrough has encouraged the transfer of technology between companies, universities and research institutions. In response to this phenomenon Brazil has created mechanisms to encourage technology transfer between these different organizations by Law 10,973 / 2004 and 11,196 / 2005. Thus, the further integration of these technological innovators raises the need to pay more attention to assessing the value of the transfer object technology. The objective of the research was to describe the main features of valuation processes developed technologies and used by science and technology organizations in Paraná. This is an applied research, qualitative by point of view of the problem approaching, descriptive with regard to their objectives and predominantly documental in relation to its technical procedures. The methodological procedures include a bibliographical research aiming at the mapping technology valuation process characteristics used in Brazil and abroad, which were raised through access to sites via the Internet of important scientific and technological organizations and surveys using tools such as questionnaire. As a result, it was found that the main characteristics that define the profile of the OCTs in the technology transfer process are: a more comprehensive scope of the institutional mission of the OCTs (larger number of objectives); greater involvement in research activities; the involvement of other agents on decision process of the criteria for valuing a technological assets (including partners and researcher); adoption of more types of transfer agreements; longer NIT experience. Additionally we found that adherence to the methods most indicated in the literature is not a feature of Paraná OCTs, which indicates a potential for convergence of current practices to best practices. As a suggestion it is recommended that OCTs adopt a policy of offering different types of transfer agreements in their negotiations to maximize the chances of success. It is also recommended to include in the patent catalogs, in addition to technical descriptions, information about the possibilities for the application of technologies involving the production of goods or services. The recommendations also include the publication of the portfolio of research projects whose purposes are designing new products or production processes. This work also suggests the creation of a register of technological demands, which could be published in Formict Report so that NITs might identify technology transfer opportunities.
