Exploring the relation between U.S. and international nonproliferation regimes from power-based approach

This thesis explores the role the U.S. plays in the developmental process of international nonproliferation regime. The argument of this thesis is mainly based on the power-based perspective, which assumes that the U.S., the first country to obtain nuclear technology, profoundly influences the creation and persistence of the nonproliferation regime. First of all, I discuss the debate on the theories of international regime in order to highlight the applicability of power-based approach in the research of nonproliferation regime. Secondly, I examine both the nuclear policy of the U.S. and the developmental history of nonproliferation regime, so as to explain the former¡¦s impacts over the latter. Finally, I evaluate the different means and postures of the U.S. when she confronts different violators. Through this inquiry, I attempt to expose the flaw of the nonproliferation regime: the proliferation problem is still not totally suspended even after the establishment of the nonproliferation regime. The main factor of the flaw is, nonetheless, resulted from the U.S.¡¦ misapplication of her nuclear hegemonic power and her selective proliferation policy towards different violators, although she had positively contributed to the creation and persistence of the nonproliferation regime.

PRC Environmental Diplomacy in the Post Cold-War Era¡GParticipation in the United Nations Framework Convention on Climate Change

Abstract As ecological deterioration getting worse and worse, the degree from global environment problem threat human life is more and more striking, and brings the rise of environmental diplomacy and global environmental politics. The PRC has wide territory, numerous population, and abundant natural resource, however after twenty years of modernizing, result in environment crisis. Since 1989, the PRC being forced to enhance her attention and participation in international environmental protection field by the pressure from domestic and foreign factors. The purpose of this thesis is to realize the details about the development of the PRC environmental diplomacy during the post cold-war era. The author try to combine domestic and international approaches, and use regime theory to analyze the actions of the PRC. The findings as follows: 1. The PRC make their objectives (ex : gain financial and technical assistance, improve the domestic environmental protection ability, modify her international image, etc. ) come true by holding the principles, including secure sovereignty, the unequal responsibilities between developed and developing countries, and developed countries should bare the major responsibilities of global environment problems. 2. The decision-making about the policy guide participation in the UN Framework Convention on Climate Change origins from the result of the bargaining between bureaucracies. Besides, climate regime can change the options of environmental and science agencies, but the effect doesn¡¦t show in ultimate decisions. 3. Although the PRC still fear participation in regime will let her sovereignty invaded and economic potential repressed, try to make long-term plans and make capital of foreign firms to improve her environmental protection abilities.

International Norms and China¡¦s Human Rights Issue:Conflict or Compliance

This research takes the viewpoints of international regime, neo-realism, neo-liberalism and constructionism in analyzing the impact of international norms on state behaviors. The case study focuses on the impact of the international human rights norms on China¡¦s human rights issue. The finding of this research is that, with China¡¦s international socialization going deeper, China is eager to join and intervene in different international regimes and international organizations; China also regards international organization as the symbolic expansion of state authority. The main purpose of the international human rights norms is to promote democracy and protect human rights all over the world. In western perspectives, China can show its determination to obey international social norms and influnce its opinions about human rights by joining the international human rights norms. In China¡¦s points of view, human rights is a historic and domestic issue. The fundamental thought of the international human rights norms is from the traditional western culture; therefore China does not accept the whole idea of such international human rights norms. From the interaction between China and the international human rights norms, we can find out China totally recognizes the mainstream discourse of the international human rights norms. With the rise of China, China tries to manipulate rather than just yield (with some limits) to the international human rights norms.

Orientador: Flávia de Campos Mello / Resumo: O estudo de como grupos e redes terroristas financiam suas atividades é crucial tanto para uma compreensão geral de sua operação quanto para atividades contraterroristas. Combater o terrorismo tornou-se uma questão não tanto do uso do poder militar, mas principalmente de uma abordagem sistêmica que visa, entre outros, acabar com os fluxos financeiros para terroristas e impor sanções a grupos e indivíduos por meio de sua inclusão em listas negras e do congelamento de ativos. O presente trabalho se debruça justamente sobre essa lógica, o nexo entre o poder financeiro e a segurança internacional. A partir de uma perspectiva crítica, propõe-se investigar os múltiplos processos e instrumentos políticos e que envolvem a regulação do combate ao financiamento do terrorismo em âmbito internacional. Os objetivos do trabalho são avaliar como se deu a construção da ameaça representada pelo terrorismo; identificar os principais atores e mecanismos institucionais internacionais que promoveram a qualificação do terrorismo como um crime financeiro; examinar como se dá a articulação da internalização de normas internacionais no âmbito nacional; e analisar que tipo de dinâmica sistêmica opera no combate ao financiamento do terrorismo. Fighting terrorism has be-come a matter not only linked to the use of military power, but mainly a systemic approach that aims, among others, at stopping financial flows for terrorists and imposing sanctions on groups and individuals through their inclusion in blacklists and assets freezing. This thesis focuses precisely on this logic, on the link between financial power and international security. From a critical perspective, it proposes to investigate the multiple processes and political instruments that involve the regulation of combating the financing of terrorism at the international level. The main goal of this thesis are to assess how the threat posed by terrorism was assemble; to identify the main international institutional actors and mechanisms that promoted the qualifica-tion of terrorism as a financial crime; to examine how the internalization of international stand-ards is articulated at the national level; and to analyze what kind of systemic dynamic operates in counter-terrorism financing. Thus, it is possible to observe the structure of a global institu-tional framework regarding countering terrorism financing. 中國大陸的崛起以及逐漸融入西方主導的國際建制,引起外界對於中共對外行為的研究興趣。 這本論文從國際關係新制度主義途徑檢視改革開放政策實施後逐漸融入國際建制的中共外交行為趨勢,探討中共對於國際經濟體制之調適與中共對外行為的關係,中共因應國際經濟體制表現出來的外交行為與美國以及西方政策圈所預期行為的關係。所以,本文研究的步驟即是第一、闡明新制度主義對於改革開放後逐漸國際化的中共之外交行為的研究假設;第二、藉由與中共外交政策具體實踐相對照,檢驗新制度主義對於國際化的中共外交行為之假設相符度;第三、探討中共新制度主義途徑的合作取向外交持續與變遷的相關變數;第四、經過上述三個步驟的分析,提出敘述和解釋冷戰後中共外交發展動態的概念,並對其未來發展作一預期。 經由上述程序,本論文在結論部分描述中共外交的未來兩種圖像與場景,並且根據制度主義以及學習理論建構了促成中共新制度主義合作取向外交的持續的政策建議。 / Internationalization and Chinese Foreign Policy under Reform and Open Door Policy: An Analysis of Neo-institutional Approach ABSTRACT The rise and gradual integration of China into the western dominated international regime, incur the research interest of the outside world. This dissertation examines the trends of the Chinese foreign behavior under the reform and open-door policy, exploring the relationship between China’s adaptation to the international economic regime and Chinese foreign behavior, and find out the difference between Chinese foreign behavior and Western expectation. This dissertation first explores the neo-institutional hypothesis about the impacts of internationalization on Chinese foreign behavior; then it examines the validity of these hypotheses by the yardsticks of the practice of Chinese foreign behavior. This dissertation also explains the variables of the continuity of the cooperative Chinese foreign behavior, and finally, it describe and explain the dynamics of post-cold war Chinese foreign behavior, and predict the future development of Chinese foreign behavior. In the conclusion, this dissertation describes the two maps and scenarios of Chinese foreign behavior, and proposes a policy recommendation from the perspectives of neo-institutional approach and learning theory.

The International System of Refugee Protection: A Regime Analysis

<p>The thesis examines the international refugee protection system in order to discover whether or not the system constitutes an international regime, as defined by international relations literature. To do so, it formulates a theoretical framework combining neoliberal and constructivist approaches to regime theory. It closely examines the legal documents that provide the normative and procedural framework of the protection system (such as the 1951 Convention Relating to the Status of Refugees, various regional agreements, as well as certain human rights documents) and discusses the legal, political, and moral obligation that these documents instill upon the member states of the protection system. It evaluates the principles, norms, rules, and decision- making procedures provided by the system, and compares them to the necessary criteria of an international regime in neoliberal theory. The purpose of trying to discover whether the refugee system constitutes an international regime is to show that if it is a regime, states are no longer afforded the full freedom of action and decision-making under the doctrine of sovereignty and that they have a certain level of obligation to abide by regime rules and help in the upkeep of the regime. After showing that the system constitutes a ‘strong promotional’ international regime, it discusses the importance of the regime within the international state system. It evaluates how it brings about cooperation and increasedstability within the regime, and lowers the costs of bargaining in order to bring about mutual gains for regime members. The thesis then examines the pre- and post-entry restrictive measures used by countries and attempts to prove whether or not the use of the measures constitutes a change in, or of, the regime, or a potential weakening of the regime. The thesis concludes that while the refugee regime itself is not changing, there is increasing incoherence between the proscribed behaviour of the regime and state action, which translates into a weakening of the regime. The regime analysis discusses the role the refugee protection regime plays within the international system as a whole and how this role is evolving through the use of restrictive measures.</p>
