The identification of individual-specific conflict detection sensitivities / L'identification des sensibilités de détection de conflit spécifiques à chaque individu

Les développements récents de la recherche en sciences cognitives ont établi que les individus détectent fréquemment qu'ils sont en train de commettre certaines erreurs de raisonnement, alors même qu'ils n'identifient pas, et peut-être ne peuvent pas identifier, la source de ces erreurs. Jusqu'à maintenant, ce programme de recherche a principalement visé à démontrer que même les individus aux raisonnements les plus biaisés faisaient preuve de tendances à la détection de conflits. Le présent travail s'appuie sur ces résultats et analyse trois domaines d'enquête connexes et encore inexplorés : (1) les sous-types de détection de conflits ; (2) les différences individuelles quant à la détection ; (3) le caractère de généralité ou de spécificité au domaine des sensibilités pour la détection de conflits. En identifiant des sous-types de détection de conflits de plus en plus spécifiques, ce projet a pour objectif d'examiner les corrélations entre, d'une part, certaines sensibilités pour la détection de conflits, et des prédicteurs cognitifs, d'autre part. Il s'agit, fondamentalement, d'un travail préparatoire en vue d'une analyse différentielle complète des sensibilités particulières de détection de conflits parmi les individus en train de raisonner. / Recent state of the art research into cognitive biases has revealed that individuals often detect that they are making certain reasoning errors even when they themselves do not, perhaps cannot, articulate the source of the error. Until now, this research has focused primarily on demonstrating the existence of conflict detection tendencies among even the most biased reasoners. This thesis builds on this research by analyzing three related and unexplored areas of inquiry: (1) subtypes of conflict detection; (2) individual-specific differences among detectors; and (3) the domain generality or specificity of conflict detection sensitivities. By identifying increasingly fine-tuned detection subtypes, the project aims to explore correlations between particular conflict detection sensitivities and other cognitive predictors. It is, essentially, preparatory work for a complete differential analysis of conflict detection sensitivities among reasoners.

Caractéristiques qui influencent la façon dont les personnes formées à l’étranger déterminent les réponses à l’examen d’admission à la profession infirmière au Québec

Le but de la présente recherche est de documenter, à partir d’une approche de recherche pragmatique qui s’inspire d’une méthode de recherche de type mixte, ce qui influence la performance des personnes formées à l’étranger (ci-après « PFÉ ») à l’examen d’admission à la profession infirmière au Québec (ci-après « examen »). Un devis séquentiel explicatif permet de découper cette recherche en deux grandes phases qui s’intéressent, respectivement, à des données quantitatives et à des données qualitatives. Les objectifs de cette recherche sont de 1) déterminer s’il existe une différence entre les scores observés à l’examen du 12 septembre 2020 pour les PFÉ et les personnes formées au Québec (ci-après « PFQ »), 2) déterminer s’il existe une association entre certaines caractéristiques connues des PFÉ et les scores observés à l’examen du 12 septembre 2020 et 3) décrire les caractéristiques reliées aux PFÉ et aux items qui influencent la mise en œuvre du jugement clinique infirmier lors de la détermination des réponses aux items de l’examen du 12 septembre 2020. Les deux échantillons de la première phase contiennent 1 050 PFQ et 199 PFÉ en premier essai à l’examen de septembre 2020. La collecte de données pour cette première phase a été réalisée à l’aide d’un fichier d’information obtenu auprès de l’Ordre des infirmières et infirmiers du Québec. Des analyses comparatives des deux échantillons permettent de conclure qu’il existe une différence statistiquement significative entre les scores moyens observés à l’examen pour l’échantillon des PFQ et celui des PFÉ et que la taille de l’effet est considérée comme étant modérée. Des analyses additionnelles sont réalisées afin de déterminer s’il existe une association statistiquement significative entre certaines variables disponibles, notamment l’âge, le sexe, le délai depuis la diplomation, l’indice de développement humain (ci-après « IDH ») du pays de diplomation et les scores moyens observés pour les PFÉ. Ainsi, les résultats suggèrent l’absence d’association entre l’âge ou le délai depuis la diplomation et les scores observés à l’examen. Par ailleurs, les analyses permettent d’observer une association statistiquement significative entre les scores observés des PFÉ à l’examen et le sexe ainsi que l’IDH du pays de diplomation, même si la taille de l’effet est considérée comme étant faible. L’échantillon de la deuxième phase de cette recherche contient huit PFÉ en premier essai à l’examen de septembre 2020. La collecte de données s’est effectuée à l’aide d’entrevues individuelles semi-structurées réalisées à distance et enregistrées à l’aide du logiciel Microsoft Teams. Le guide d’entrevue, explorant les thèmes tirés du cadre de référence, est construit à partir de la littérature consultée au sujet des caractéristiques pouvant agir sur les réponses aux items d’un examen. Les données ont fait l’objet d’un codage thématique à l’aide d’une grille. Les résultats indiquent que la mise en œuvre du jugement clinique infirmier, incluant la mobilisation des savoirs appropriés lors de la résolution d’items de l’examen, constitue un défi pour les PFÉ qui participent aux entrevues (ci-après « PFÉP »). Ainsi, les savoirs infirmiers mobilisés s’appuient, en partie, sur des connaissances et des expériences acquises avant l’arrivée au Québec qui diffèrent des savoirs qui sont ciblés par les items de l’examen. Ceci n’est pas surprenant puisque les PFÉP constituent un groupe hétérogène d’individus avec des parcours professionnels extrêmement variés et le contenu de l’examen cible spécifiquement les aspects requis pour exercer au Québec. Bien que les savoirs acquis après l’arrivée au Québec soient aussi mobilisés lors de la résolution des items de l’examen, ces nouvelles connaissances sont parfois insuffisantes pour certaines PFÉP qui présentent de trop grands écarts de savoirs professionnels. Par ailleurs, l’état psychologique des PFÉP, les difficultés à lire et à bien comprendre les situations cliniques de l’examen et le manque de temps influencent certainement la capacité de choisir les réponses attendues aux items de l’examen. Les résultats de cette recherche contribuent aux connaissances en éducation puisqu’ils permettent une meilleure documentation des caractéristiques qui influencent la détermination des réponses à un examen en contexte d’immigration professionnelle. Ils contribuent aussi aux connaissances en matière d’intégration professionnelle des PFÉ en mettant en lumière le caractère hétérogène de ce groupe de personnes qui exerçaient la profession infirmière dans leur pays d’origine et l’importance d’adopter une approche individuelle aux défis de ces personnes qui souhaitent obtenir un permis d’exercice au Québec, notamment les outils de préparation à l’examen. Les résultats peuvent aider les instances touchées par l’administration d’un examen à considérer différentes caractéristiques reliées à la personne ou aux items qui influencent la détermination des réponses aux items. / The goal of this research project is to document, using a pragmatic approach inspired by a mixed-method paradigm, what influences the performance of internationally educated nurses (IENs) at the entry-level exam in Québec. As is done with an explanatory sequential design, this research is divided into two phases. The first phase relates to quantitative data and the second phase relates to qualitative data. The objectives of this research are 1) to determine if there is a difference between the scores observed at the exam for IENs and Québec trained nurses (QTNs), 2) to determine if there is an association between certain IEN characteristics and the scores observed at the exam and 3) to describe the characteristics of IENs that influence the use of nursing clinical judgement while responding to the items in the September 12, 2022 exam. The two samples for the first phase of this research are made up of 1,050 QTNs and 199 IENs who were first-time writers at the September 2020 exam. The data collection for this first phase was done using information obtained from the Ordre des infirmières et infirmiers du Québec. Comparative analysis of the two samples suggests that there is a statistically significant difference between the mean scores observed at the exam for the QTN and IEN samples with an effect size that is considered moderate. Additional analyses were used to determine if there is a statistically significant association between certain variables such as age, sex, time lapse since graduating, human development index (HDI) for the country of graduation and the mean scores observed at the exam for IENs. The results suggest the absence of an association between age or the time elapsed since graduation and the observed scores at the exam. Moreover, the analyses show that there is a statistically significant association between the mean scores observed at the exam for IENs, sex and the HDI for the country of graduation, although this effect size is considered weak. The sample for the second phase of this research is made up of 8 IENs who were first-time writers at the September 2020 exam. The data collection was done through individual semi-structured interviews held remotely and recorded using Microsoft Teams. The interview guide explored themes inspired by the framework based on available literature related to characteristics which can influence item response. The data collected was coded using a themed grid. The results suggest that the use of nursing clinical judgement, including the mobilization of appropriate knowledge to respond correctly to exam items, is challenging for the participating IENs. Moreover, the nursing knowledge mobilized during item response refers, partly, to knowledge and experience acquired before arriving in Québec, which are different from the knowledge tested in the exam items. This is not surprising since IENs are a heterogeneous group with a variety of professional pathways and the content of the exam targets specific aspects required for nursing practice in Québec. Although the knowledge acquired after arriving in Québec is also mobilized by the IENs during item response at the exam, this new knowledge is sometimes insufficient for some IENs who have an important knowledge gap. Also, the psychological state of IENs, challenges with reading and understanding the clinical situations presented in the exam, and the lack of time during the examen certainly influenced the capacity to respond correctly to the items. The results of this research will contribute to the educational knowledge base because they document some of the characteristics that influence exam item response in the context of professional immigration. These results will also contribute knowledge related to the professional integration of IENs who previously practised nursing in their country of origin by highlighting the heterogeneity of this group and the importance of adopting an individualized approach to the unique challenges ¬– such as those associated with exam preparation materials – faced by IENs who wish to obtain a nursing permit in Québec. These results can help all organizations involved in administering entry-level professional exams take into consideration the different personal characteristics or items that could influence the item response process.

Bakgrund och problem: Revisionsbranschen befinner sig i ett kritiskt skede. Detta eftersom teknikens prestanda utvecklas snabbare än vad människor gör, vilket i sin tur resulterat i att människors uppgifter har börjat bytas ut mot datorer, robotar eller annan liknande teknik. Detta går att likställa med automatisering. Tidigare studier har påvisat ett flertal fördelar med att implementera automatiserade verktyg och tekniker inom revision, såsom ökad effektivitet och kostnadsbesparingar. Det är dock relativt outforskat på svenska revisionsbyråer sett till samspelet mellan människa och teknologi för att uppnå dessa fördelar och med denna studie vill författarna bidra med mer forskning inom området. Syfte: Syftet med studien är att analysera automatisering inom revisionsbranschen och möjligheter och utmaningar det medfört revisorns professionella bedömningar. Metod: Denna studie är av kvalitativ karaktär och innefattar en deduktiv forskningsansats där det empiriska materialet har samlats in genom semistrukturerade intervjuer med auktoriserade revisorer på revisionsbyråer i Sverige. Vidare har det empiriska materialet analyserats genom en tematisk analys. Slutsats: Studien visar att automatiseringen utvecklas varje dag, vilket resulterar ett flertal möjligheter. Automatiserade verktyg och tekniker ger revisorn en helhetsbild av revisionen som resulterar i att fler avvikelser upptäcks och det finns möjlighet att revisorn gör bättre bedömningar i då större delar av populationer täcks in. Samtidigt är det emellanåt svårt att följa med i alla dess framsteg, och utmaningar uppdagas. Detta då det råder en tidsbrist för revisorer att lära sig de automatiserade verktygen och teknikerna, vilket gör att det inte anses som tidseffektivt. Dessutom kan det argumenteras för att nyexaminerade inte förbereds tillräckligt mycket inför den IT-miljö som revisionsbyråer idag kantas av, vilket skapar ett kunskapsglapp och kan ses som en utmaning för revisorns professionella bedömningar. Våra fynd och studiens teoretiska modell kan ses öppna upp möjligheter för vidare forskning inom området men även andra delar av samhället. / Background and problem: The audit industry is at a critical stage. This is because the performance of technology is evolving faster than that of humans, which in turn has resulted in human tasks being replaced by computers, robots or other similar technologies. This can be equated with automation. Previous studies have demonstrated a number of benefits of implementing automated tools and techniques in auditing, such as increased efficiency and cost savings. However, the interaction between humans and technology to achieve these benefits is relatively underexplored in Swedish audit firms, and with this study the authors want to contribute with more research in this area. Purpose: The purpose of the study is to analyze automation in the audit industry and the opportunities and challenges it has brought to the auditor's professional judgments. Method: This study is qualitative in nature and includes a deductive research approach where the empirical material has been collected through semi-structured interviews with certified public accountants at accounting firms in Sweden. Furthermore, the empirical material has been analyzed through a thematic analysis. Conclusion: The study shows that automation is evolving every day, resulting in numerous opportunities. Automated tools and techniques provide the auditor with a holistic view of the audit which generates more discrepancies to be detected and the possibility for the auditor to make better judgements as larger parts of the populations are covered. At the same time, it is sometimes difficult to keep up with all of its progress, and challenges emerge. This is because there is a lack of time for auditors to learn the automated tools and techniques, which means that it is not considered time efficient. In addition, it can be argued that new graduates are not adequately prepared for the IT environment that surrounds audit firms today, which creates a knowledge gap and can be seen as a challenge to the auditor's professional judgements. Our findings and the study’s theoretical model can be seen to open up possibilities for further research in this area but also in other parts of society.

Moral Judgment and Digital Piracy: Predicting Attitudes, Intention, and Behavior Regarding Digital Piracy Using a Modified Version of the Defining Issues Test

Digital piracy, the illegal copying or downloading of copyrighted digital products without approval from the copyright holders, has brought great economic loss to the software and digital media industries. Previous studies using moral developmental theory have not found consistent relationships between moral judgment and attitudes towards digital piracy. While some researchers have developed individual test items to assess relationships between moral judgment and attitudes toward digital piracy, others have relied on the Defining Issues Test (DIT). However, in that the DIT represents a general measure of moral judgment based on broad social issues, it, too, may not adequately assess an individual’s reasoning specific to issues regarding digital piracy. The purpose of this study was to create a reliable instrument (i.e., DP-DIT) modeled after the DIT designed to assess moral judgment regarding digital piracy as well as to examine and compare the ability of both DP-DIT and DIT2-short to predict attitudes, intentions and behaviors regarding digital piracy of college students. Results indicated the reliability of both the DIT2-short and the DP-DIT were discounted, quite likely due to the small number of stories contained in each. DP-DIT appeared to have greater predictive ability due to its advantage in predicting attitudes toward digital piracy, especially using DP-DIT MNS. However, even though here DP-DIT MNS was the strongest predictor of attitudes toward digital piracy, it explained a limited amount of variance. Further research to improve reliability and validity of DP-DIT is warranted.

Este trabalho propôs-se a estudar, mediante abordagem crítica e multidisciplinar, questões processuais que surgem na impugnação de deliberações de assembleias de sociedades por ações, procurando não só comprovar a ideia de que o direito processual civil deve responder a especificidades vindas do direito material, mas tecer conclusões a respeito de qual maneira o processo civil, neste âmbito específico do direito material, atende a essas peculiaridades. Por entendermos que existe um fio condutor lógico que une conteúdo do provimento, objeto do provimento e limites objetivos e subjetivos da coisa julgada, foram eleitas algumas questões processuais como objeto principal da pesquisa, sintetizadas nas seguintes indagações: (i) qual o conteúdo do provimento jurisdicional que desconstitui deliberações de assembleias gerais de sociedades por ações?; (ii) quais os limites objetivos desse provimento e da coisa julgada que sobre ele incide?; e (iii) quais os limites subjetivos desse mesmo provimento e da coisa julgada que o acoberta? O escopo principal desta dissertação, assim, foi responder a essas perguntas, embora, para que se atingisse esse intuito, outras indagações também tenham sido respondidas. / This work aims at studying, through a critical and multidisciplinary approach, procedural matters arising out of claims that request the annulment of shareholder meetings resolutions, seeking not only to evidence the idea that the civil procedural law should correspond to specific issues of the substantive law, but also draw conclusions on how the civil procedure, within the specific ambit of the substantive law, answers to these peculiarities. Since we understand there is a logical guiding thread that links the judgment, its subject matter and the objective and subjective limits of the judgement and of the res judicata, we have chosen a few procedural issues as main object of our research, summarized in the following questions: (i) what is the content of the judgement that annuls the shareholder meetings deliberations?; (ii) what are the objective limits of this judgement and of the res judicata, which affect such deliberations?; and (iii) what are the subjective limits of this same judgement and of the res judicata, which restrict their interference in said deliberations? The main scope of this dissertation was, therefore, to answer these questions, although, in doing so, other questions have ended being answered.

The approach chosen drives the dissertation to the study about (i) the general points (lawsuit conditions, procedural requests) and (ii) the specific points (a court decision that doesn t admits revision, term to propose the lawsuit and others legal hypothesis) asked to propose the lawsuit based on the article 485 of the CPC and, more specifically, based on the article 485, V, of the CPC (lawsuit appropriated to rescind a court decision that contains a law violation). According to this planning, deserves approach the lawsuit based on the article 485 as a common lawsuit, with requests legally established in the procedural legislation, and also are studied some general aspects concerning to the procedural admission such as legitimacy, legal competence and the capacity to suspend the execution of the illegal decision. Also deserves attention the exceptional character of the lawsuit based on the article 485, V, of the CPC, considering that its object is to attack a jurisdictional decision that can not be changed by the regular ways (appellation, for instance). The dissertation concludes indicating an amplified interpretation about the article 485, V, of the CPC, approaching all the law violations mentioned in the Brazilian legislation, in order to give priority to the concept of Justice in comparison with the concept of security, specially in situations in which a decision contains a substantial law violation. / Este trabalho visa ao estudo da ação rescisória fundada em violação a literal disposição de lei, hipótese prevista no inciso V do artigo 485 do Código de Processo Civil brasileiro. A abordagem se restringe à admissibilidade da ação. Objetiva-se a apreciação dos pressupostos necessários à admissibilidade da ação rescisória, partindo dos genéricos (condições da ação e pressupostos processuais), exigíveis para todas as ações, passando pelos específicos (sentença de mérito, trânsito em julgado, prazo e enquadramento numa das hipóteses legais), pertinentes a todas as ações rescisórias, e chegando, enfim, aos que delineiam a hipótese de violação a literal disposição de lei , ensejadora da ação rescisória objeto da análise. Para tanto, explica-se o enquadramento da ação rescisória como ação típica, cujos fundamentos se encontram previstos taxativamente na lei processual, e se faz uma incursão pelos aspectos gerais da ação rescisória, como a legitimidade, a competência e o meio para suspender a execução do julgado rescindendo, itens indispensáveis para a compreensão da temática central. Ressalta-se, em diversas passagens, o caráter excepcional da ação rescisória, cuja finalidade é a desconstituição da autoridade da coisa julgada que torna imutável a sentença de mérito. Impõe-se a conclusão de que se deve dar à hipótese do inciso V do artigo 485 do Código de Processo Civil uma interpretação ampliativa, de forma a abranger todas as violações às normas que compõem o ordenamento jurídico, a fim de evitar a prevalência da segurança em detrimento da justiça (proximidade com o direito material), em situação para a qual o sistema prevê um instrumento propício à superação da barreira consubstanciada na coisa julgada e a subseqüente rescisão (anulação) da decisão judicial viciada, contrária ao direito material regulador da espécie.

Analysing "involvement" in distance education study guides: an appraisal-based approach

The main aim of this study is to extend our current understanding of the linguistic characteristics of student-centred distance education texts. This aim links directly with the shift in South Africa from an objectivistic, content-centred teaching approach towards an outcomes-based, studentcentred one. Partly because few guidelines exist as to what the linguistic characteristics of student-centred texts are, developers of such texts in a distance education environment face many challenges and thus, a secondary, more indirect aim of this study is to benefit developers of distance education study materials. In view of the educational context in which the study is situated, a brief overview of some of the most relevant pedagogic perspectives underlying the notion of student-centredness is provided. Student-centredness is then interpreted in terms of Biber's (1988) construal of `involvement' and also in terms of Systemic Functional Linguistics (SFL): more particularly, the interpersonal discourse semantic metafunction of SFL and on insights developed in Appraisal Theory. The focus of the study is thus on `involvement' and the expression of evaluative stance, and consequently on attitudinal language through `involvement' features. Of particular interest to the present study is how learning is advanced through the use of attitudinal language. The data for the study include six print-based distance education teaching texts (study guides) from three different academic departments at the University of South Africa. Two guides from each department are analysed and compared: one developed by way of a content-centred approach to teaching and the other by way of a student-centred approach. The linguistic construal of evaluative stance in these guides is analysed and interpreted in interpersonal terms. The thesis develops a theoretically motivated explanation of the linguistic characteristics of student-centred distance education texts, and in the process provides evidence of the interpersonal and pedagogic relevance of evaluative stance in the context of distance education. Some of the main conclusions reached are that student-centred texts differ from contentcentred ones with regard to: the extent to which the social presence of discourse participants is signalled in such texts; the extent to which solidarity is negotiated with students; the participation of students in the knowledge construction process; the relationship that prevails between lecturers and students; and the identity developed for both students as well as lecturers. / Linguistics / D.
