Thinking about the responsible parent : freedom and educating the child in Western AustraliaMcGowan, Wayne S. January 2004 (has links)
This study is concerned with how educational legislation shapes and uses freedom for the purpose of governing the parent. The key question guiding the study was: How does the Act constitute the ‘parent’ as a subject position responsible for schooling the child? Central to the work is an examination of the School Education Act 1999 (the Act) using Foucault’s thinking on governmentality. This is prefaced by historical accounts that bring together freedom and childhood as contrived styles of conduct that provide the governmental logic behind the Act. The study reveals how the Act shapes and uses the truth of freedom/childhood to construct the responsible parent as a style of conduct pegged to a neo-liberal political rationality of government. It is this political rationality that provides the node or point of encounter between the technologies of power and the self within the Act which forms the ‘responsible’ identity of the parent as an active self-governing entrepreneur made more visible by the political construction of ‘others.’ This is a legal-political subjectivity centred on the truth of freedom/childhood and a neo-liberal rationality of government that believes that any change to our current ethical way of being in relation to educating the child would ruin the very freedoms upon which our civilised lifestyle depends. In essence, the Act relies on the production of ‘others’ as the poor, Aboriginal and radical who must be regulated and made autonomous to constitute the ‘parent’ as an active consumer whose autonomous educational choices are an expression of responsibility in relation to schooling the child

Die Tradierung von Studien über Hegel hat in den letzten Jahrzehnten sehr an Bedeutung gewonnen, und zwar sowohl was die zahlenmäβige Zunahme der Hegel gewidmeten Werke angeht, als auch im Hinblick auf den modus operandi der Theamtisierung und Präzisierung der Probleme und Reflexionen, die sich aus seinem Werk ergeben. In diesem Kontext der Renaissance der hegelschen Philosophie erscheint das Problem der Anerkennung als eines der wichtigsten der Hegelforschung. Freilich sind im Rahmen dieses neuen Interesses an der Anerkennung die Arbeiten selten, die darauf abzielen, das Thema Anerkennung von seiner logischen Wurzel her aufzugreifen. Die vorliegende Forschungsarbeit hat es sich zur Aufgabe gesetzt, die Rekonstruktion der logischen Struktur der Anerkennung herauszuarbeiten, wobei sie ihre Stufen anhand der Wissenschaft der Logik ausdrücken wird. Die vorliegende These von hermeneutisch-bibliografischem Charakter ist darauf angelegt, dieses Ziel zu erreichen, was sie in einer in 05 (funf) Kapitel aufgeteilten Struktur unternimmt. Die Aufgabe des ersten Kapitels ist es, den Forschungsstand über die Anerkennung in der zeitgenössischen Philosophie herauszuarbeiten. Das zweite Kapitel konstituiert die erste Schicht der Anerkennung und zeigt, wie die Logik als transitiver Nenner arbeitet. Das dritte Kapitel etabliert die zweite Schicht der logischen Struktur der Anerkennung und rekonstruiert die Konditionen der subjektiven Interaktion, die Andersheit als würde sie durch zwei ihr eigene Modi ausgedrückt: durch Beziehung und durch Verhältnis. Das vierte Kapitel stellt die dritte logische Schicht der Anerkennung vor durch die Präzisierung der Subjektivität und die Arten der Relation der Subjektivität, ausgehend von ihren semantisch-pragmatischen meta-Niveaus des Universellen, Partikulären und Singulären. In einer zweiten Argumentation stellt das viertel Kapitel dar, wie die Subjektivität in ihrer theoretischen Dimension als Wissen und in ihrer praktischen Dimension als Wollen zu verstehen ist. Dentro deste contexto de Renaissance da filosofia hegeliana, o problema do reconhecimento emerge como de importância capital na Hegel-Forschung. Todavia, a par deste novo interesse sobre o reconhecimento são raros os trabalhos que se propõem a enfrentar o tema reconhecimento desde a sua matiz lógica. O presente trabalho de pesquisa se propõe estabelecer a reconstrução da estrutura lógica do reconhecimento, exprimindo os seus níveis a partir da Wissenschaft der Logik. A presente tese de caráter hermenêutico bibliográfico se configura para a consecução de tal objetivo, dividindo internamente o trabalho em comento em 05 (cinco) capítulos. O primeiro capítulo se destina a situar o estado da arte nas pesquisas sobre o reconhecimento na filosofia contemporânea. O segundo capítulo constitui o primeiro nível do reconhecimento e apresenta a lógica operando como um denominador transitivo. O terceiro capítulo estabelece o segundo nível da estrutura lógica do reconhecimento e reconstitui as condições de interação subjetiva, a alteridade (Andersheit) como se explicitando por dois modos próprios: por referência (Beziehung) e por relação (Verhältnis). O quarto capítulo apresenta o terceiro estágio lógico do reconhecimento pela explicitação da subjetividade e os modos de relação da subjetividade a partir de seus metaníveis semântico-pragmáticos do: universal, particular e singular. Num segundo momento, o quarto capítulo expõe como a subjetividade se compreende enquanto dimensão teórica: como conhecer, e em sua dimensão prática como querer. Por fim, o quinto capítulo, expõe como os três metaníveis lógicos do reconhecimento, os quais seguem do conhecer (Kennen) ao reconhecer (Anerkennen), se fazem explicitar no processo histórico pelo recurso a Fenomenologia do Espírito em seu capítulo IV. O quinto capítulo objetiva ainda demonstrar que é possível reconstruir uma estrutura lógica sem subordinar os fatos à teoria. Espera-se por tanto, a título de conclusão, que mediante a explicitação e reconstrução lógica dos níveis da transitividade, da alteridade relacional, e da subjetividade enquanto unidade no sujeito entre o eu teórico e prático, se faça exprimir a estrutura lógica subjacente ao reconhecimento. / During the last decades, the tradition of studies of Hegel has assumed great importance, as much referring to the amount of work dedicated to his philosophy as to the mode of operation of focusing and explaining the problems and reflections raised by him. In this context of the revival of Hegel’s philosophy, the problem of recognition emerges as of capital importance in the research about Hegel. However, in the context of this new interest about recognition, studies that go about pursuing the theme of recognition until its logical matrix are rare. The present study aims at establishing a reconstruction of the logical structure of recognition, expressing its levels starting from the Wissenschaft der Logik. The present theses of hermeneutic-bibliographic character is conceived to reach this aim, internally dividing the work in 05 (five) chapters. The first chapter aims at showing the state of research in the studies of recognition in contemporary philosophy. The second constitutes the first level of recognition and presents logic working as transitive denominator. The third chapter establishes the second level of the logical structure of recognition and reconstitutes the conditions of subjective interaction, the otherness (Andersheit) as being made explicit by two proper modes: by reference (Beziehung) and relationship (Verhältnis). It is hoped, however, in terms of a conclusion, that in the face of a logical attempt at making explicit and reconstructing the levels of transitivity, of relational otherness and the subjectivity in terms of unity of subject between the theoretical and the practical I, the logical structure subjacent to recognition can be made to express itself.

The thesis analyses the concept ‘fairness’ in consumer contracts regulated by the Consumer Protection Act 68 of 2008, mainly from the perspective of a freedom and fairness orientation. It discusses the evolution of ‘fairness’ as background to a more detailed
discussion of the classification of fairness into substantive and procedural fairness. The thesis examines dimensions of fairness, factors which play a role in the determination of fairness, and fairness- oriented approaches in an attempt to formulate a framework for fairness in
consumer contracts. The main aspects that should be taken into account to justify a finding of fairness, or to determine whether a contract is fair, are identified. The constitutionality of affirmative action in terms of section 8 of Act 200 of 1993 is investigated.
The study contends that in constitutional interpretation it is permissible to have recourse to
ethical precepts as long as these are anchored within the four corners of the Constitution. It is
contended that the •equality clause• does not prescribe equality of outcome in favour of
substantive equality of opportunity. It is asserted that group-based affirmative action may
justifiably be attacked as being unconstitutional; either on the basis that it infringes the nonbeneficiary's
equality rights in terms of sections 8(1) and 8(2) or that it falls beyond the
constitutional protection afforded to affirmative action in terms of section 8(3). Furthermore,
group-based modalities of affirmative action may also not constitute a permissible limitation on
the fundamental right to equality, if compared to an individual-based socio-economic affirmative

Together with the requirements of citizens to secure their safety it brings the risk of privacy loss. The main intention of this thesis is to place the Urban camera supervising system into the focus point of the dilemma between two basic human rights: the right of human privacy and personal safety right. Next to the description of the terms privacy and safety, the writer examines the harmony of legal regulations of Urban camera supervising system with the concept of human liberty and the status of the state in the point of securing human safety. This thesis thinks of the problem by empirical facts and different theoretical aspects of political philosophy and political thinking, especially liberalism and conservatism. The thesis also looks into the quality of the connection between the citizen and local public administration in the realization of the project of Urban camera supervising system.

Previous issue date: 2014-07-17 / Coordenação de Aperfeiçoamento de Pessoal de Nível Superior - CAPES / “Herbert Marcuse‟s „Reason and Revolution‟ towards a institutional changing‟s dialectic” expounds the philosophical reasons of a revolutionnary‟s praxis. The argument is developed by the reciprocity of two dialectic‟s criteria: the historic understanding of the libertarian aims and of its institutional actuality. The freedom as an ontological category, first criterion, and the political process of human liberation, the second, accomplish the elements of the reciprocity‟s dynamics as expounded in “Reason and Revolution” at 1941. The 1960‟s preface, “A note on dialectic” develops the reciprocity between the freedom‟s consciousness and the process of its actuality, as a alternative discourse instead of surrendering to the establishment. The text also recognizes in the Marcuse‟s work of 1966, the analogy between the essential criteria of the dialectic perspective and the understanding that the affluent capitalism‟s negation demands two types of strategies, one stood by the concept of negation one as a internal power and the other as an external one. The internal negation reveals the unaccepetable contradictions of the capitalist system and the external permits understanding the protest for justice and for the human good, universal values, beyond the capitalist system. / “„Raison et Révolution' pour une dialectique de changement institutionel" déploit une fondement philosophique pour la practique révolutionnaire. L'argumentation était déployée par la réciprocité entre deux critères de la dialectique: la compréhension historique des objetives libertaires et la compréhension de sa éféctivité institutionel. La liberté comme catégorie ontologique, prémier critère et le processus politique de libération humaine, le second, constituent les éléments de la dynamique de la réciprocité exposés dans l'oeuvre de 1941, "Raison et Révolution". Canada’s experience in the war against terrorism goes back to the seventies, and continues to develop nowadays, with the last direct terrorist activity in 2017. The Canadian Government reacted to these terrorist attacks by enacting a number of statutes that reflect a changing international paradigm in relation to the fight against terrorism. Fundamental rights and liberties such as the freedom of expression, the right to private life and to personal freedom have been curtailed by these legislative measures. The practical consequences of these measures are analyzed via a comparative examination of the Inter-American System of Human Rights. In general terms, the war against terrorism produces significant impacts over the human rights. / La experiencia de Canadá en la lucha contra el terrorismo se remonta a inicios de la década de los setenta y se desarrolla hasta la época actual (los acontecimientos más recientes han tenido lugar en el año 2017). Las medidas legislativas fueron la vía adoptada por parte de Canadá para contrarrestar los ataques y reflejar el cambio de paradigma político en la esfera internacional con relación al fenómeno del terrorismo. Derechos fundamentales como el derecho a la libre expresión, a la vida privada y a la libertad personal se encuentran particularmente afectados por estas medidas.
