Plaidoyer pour une responsabilité intégrée de l'ONU : le cas des opérations de paix

C'est avec beaucoup de complexité et d'ambiguïté que les opérations de la paix des Nations Unies se sont déployées sur la scène internationale au cours des dernières décennies. Si le déploiement de ces opérations reflète avant tout la matérialisation de l’un des buts fondamentaux de l’ONU, à savoir : le maintien de la paix et de la sécurité internationale (Article 1(1) de la Charte des Nations Unies), il n'en reste pas moins manifeste que les actions qu’elles entreprennent sur le terrain sont susceptibles de produire des effets préjudiciables pour les tiers. La question que pose le présent mémoire est donc de savoir si, et dans quelle mesure, la responsabilité de l'ONU est régie par le droit international lorsque des tiers subissent des dommages matériels et corporels du fait des troupes des opérations de paix des Nations Unies. Que prévoit le droit international ? Existe-t-il pour les victimes des voies de réparations ? S’interroger sur la responsabilité de l’ONU suppose que l’on tienne compte avant tout de sa personnalité juridique internationale, car l’existence juridique de l’Organisation universelle constitue le postulat primaire sur lequel sera fondée sa responsabilité internationale. L’avis consultatif de la Cour Internationale de Justice du 11 avril 1949 sur la Réparation des dommages subis au service des Nations Unies représente le moment précis de cette personnification de l’ONU sur la scène internationale. D’un point de vue plus substantiel, les contours de la responsabilité onusienne dans le contexte du maintien de la paix se dessineront autour d’un élément central : « le fait internationalement illicite ». Celui-ci comprend deux éléments; d’une part, un élément objectif consistant en un comportement précis (action ou omission)violant une obligation internationale; et, d’autre part, un élément subjectif attribuant à l’Organisation ce manquement au droit international. Cette ossature de la responsabilité onusienne permettra d’appréhender de façon plus précise dans quelle mesure l’Organisation pourrait être tenue responsable de ses actes ou omissions dans le contexte du maintien de la paix. Plus encore, elle nous permet de plaider pour une responsabilité intégrée tenant compte des facteurs endogènes propres à toute situation, mais aussi faisant de l’individu dans le droit international des sujets dont les intérêts sont susceptibles de protection juridique. / It is with great complexity and ambiguity that the United Nations Peace Operations took place on the international scene during the last decade. Since their deployment reflects first and foremost one of the most fundamental goal of the Unites Nations Organization, namely: to maintain international peace and security (Section 1(1) of the Charter of the United Nations), it is predictable that the actions they undertake on the field may produce harmful effects for the third parties. The question raised by this thesis aims to discover if and to what extent the UN responsibility is governed by International Law when such third parties suffer from material and personal damages at the hand of UN Peace Operations troops. What does International Law provide? Are there any means of reparation for the victims? Searching for the UN responsibility includes the supposition that the Organization possesses the international legal personality, because its legal existence represents the basic postulate on which its responsibility will be based. The Advisory Opinion of 11 April 1949 of the International Court of Justice on Reparation for Injuries Suffered in the Service of the United Nations constitutes the exact moment of the personification of the UN on the international scene. From a more substantial perspective, the outlines of the UN responsibility in the peacekeeping context are being drawn around one crucial element: « the internationally wrongful act ». This element includes two parts; on the one hand, an objective component which consists of a specific conduct (action or omission) breaching an international obligation; and, on the other hand, a subjective component attributing to the Organization the breach of this international obligation. This framework of the UN responsibility will allow a better understanding of the extent to which the responsibility of the Organization can be retained for actions or omissions committed in a peacekeeping context. More importantly, it allows us to plead for a responsibility which encompasses not only the endogenous characteristics of each situation, but also a legal protection by International Law of the interest of each individual.

Enfin, le droit international dispose d’un ensemble de règles relatives à la responsabilité des organisations internationales pour fait internationalement illicite. Après 10 ans de travail, la Commission du droit international est parvenue, en 2011, à élaborer un projet d'articles codifiant les règles en la matière. La tâche était pourtant délicate : assujettir ces entités dont la nature et le fonctionnement sont différents des Etats, à un ensemble de règles unique dans le domaine de la responsabilité internationale. L’objet de cette étude porte sur l’œuvre de codification effectuée par la Commission dans le projet d’articles. Il s’agit plus précisément d’analyser les techniques de codification utilisées par la Commission dans l’élaboration des règles applicables : s’agit-il d’une codification stricto sensu de la pratique ou bien de l’élaboration de nouvelles règles relevant du « développement progressif » du droit international ? La réponse apportée à cette question suppose préalablement de définir les sources de la codification en ce qui concerne chacune des dispositions du projet d’articles, en se demandant si elle concrétise une pratique bien établie des organisations internationales, ou au contraire une transposition des règles du projet d’articles sur la responsabilité de l’Etat, adaptées aux particularités des organisations internationales. L’autorité du projet d’articles ne semble pas, à l’heure actuelle, faire l’unanimité, et dans ce contexte, la présente étude portant sur le rapport entre codification et développement progressif dans l’œuvre de codification de la CDI permet d’apprécier l’autorité substantielle propre à chacune des dispositions du projet d’articles. D’autant qu’on ne sait absolument pas si une convention de codification sera adoptée, qui pourra ériger les dispositions du projet d’articles en normes juridiquement obligatoires. / The international law has finally a set of rules on the responsibility of the international organizations for internationally wrongful acts. After 10 years of work, the International Law Commission was able in 2011 to elaborate a draft articles codifying the rules on the matter. However the task was difficult: subject these entities, whose nature and functioning is different from States to a single set of rules in the field of international responsibility. The purpose of this study focuses on the work of codification made by the Commission in the draft articles. This is specifically to analyze the techniques of codification used by the Commission in the elaboration of the applicable rules: is it a codification sticto sensu of the practice or a creation of new rules under the "progressive development" of the international law? The answer to this question presupposes to define the sources of codification in each of the provisions of the draft articles concerned, wondering if it embodies a well-established practice of international organizations, or rather a transposition of the rules of the draft articles on States responsibility, adapted to the features of international organizations. At present the authority of the draft articles does not seem to have unanimity, and in this context, the present study on the relation between codification and progressive development in the codification work of ILC can appreciate the substantial own authority of each provisions of the draft articles. Especially that no one knows if a codification convention will be adopted, which will set the provisions of the draft articles up as legally binding norms.

The need for a flexible and discretionary system of marital property distribution in the South African law of divorce

Substantive gender equality has yet to be achieved in South Africa. As such, when a decision is made for one of the spouses to a civil marriage to stay at home and care for the children born of the marriage, or make career sacrifices to care for children, that spouse is usually the wife. As a result, while the husband continues to amass wealth and grow his earning potential, the wife is unable to do so. In circumstances where such spouses are married out of community of property or subject to the accrual system with onerous exclusion clauses in the antenuptial contract, the wife may be left with little more than a claim for rehabilitative maintenance in the event of a divorce. The courts only have the discretion to make an equitable distribution of marital property in civil marriages with complete separation of property concluded prior to 1 November 1984 (or 2 December 1988) and customary marriages. It is arguable that this limitation of the judicial discretion violates the equality clause contained in the Constitution of the Republic of South Africa, 1996. A broad judicial discretion to equitably redistribute the spouses’ assets upon divorce is therefore proposed in this dissertation. / Private Law / LL.M.

特約條款之檢討與重構 / The examination and reconstruction of express warranties of insurance law in Taiwan

由於過度粗糙立法、缺乏相關深入研究暨流於形式之契約解釋取向,臺灣保險契約法第二章第三節特約條款制度實沈苛已深而積重難返,亟待立法者、司法者及主管機關進行大幅度改造。本文研究聚焦於探討該制度-相當於英美保險契約法之明示擔保條款-起源、本質暨新近發展,並研擬相關修法提案俾供後續立法者與研究者參酌。基此,本文擬採用法律經濟分析、實證分析與比較法等研究方式加以進行。從英美法系各國之立法潮流可發現,契約基礎條款因違反合理期待原則而遭多數國家揚棄。此從英格蘭暨蘇格蘭法律委員會目前保險契約法修法暫時提案,以及澳洲1984年保險契約法第24條規定即可窺見一斑。再者,鑑於肯定擔保條款當初建制基礎已消失殆盡,包含英國、澳洲及紐西蘭皆採取以不實陳述制度取代肯定擔保條款之立法,俾以達成較為公平之規範結果。至於允諾擔保條款部分,增加損失與違反行為間因果關係要件實已蔚為潮流,包含英國、美國數州、澳洲及紐西蘭相關立法皆為適例。此外,相較於無效、得撤銷抑或自動向後免責,賦予保險人契約終止權誠屬較佳之法律效果,已獲各國之共識。職是之故,本文主張應修改特約條款有關肯定特約部分相關文字,使同法第64條據實說明制度可取代之,俾產生較有效率之核保資訊提供制度。另一方面,允諾擔保條款內容應限縮於與危險有關之重要性事項。此外,應考慮增加損失與違反行為間因果關係要件,並使保險人於無因果關係之情形得以主張就系爭損失免責。鑑於解除權易使法律關係趨於複雜,本文建議應以契約終止權取代現行契約解除權較佳。又在前述修法前,法院得透過契約解釋方式緩和現行法弊端,而行政院金融監督管理委員會亦得透過保險商品審查機制過濾不妥之約款加以因應。 / Express warranties of insurance law in Taiwan provoke a great number of dilemmas in both theory and practice due to oversimplified legislation, a paucity of related studies and formalism of contract construction. This study aims not only at exploring the origin, nature and development of the institution for the purpose of elucidating pros and cons of express warranties, but also at providing an amendment to express warranties of insurance law in Taiwan. The dissertation achieves the dual goals by way of comparative study and economic analysis of law. Obviously, abolition of “basis of the contract clause”-an obsolete and bitterly-criticized contract term- has been an uncontroversial trend around the world on the grounds of reasonable expectations. English and Scottish Law Commissions’ tentative proposals, as well as Section 24 of Australian Insurance Contracts Act 1984, sets an excellent example. Also, with an eye to the collapse of affirmative warranties’ keystones, several countries, including the U.K., Australia, and New Zealand, substitute misrepresentation for affirmative warranties for the purpose of leveling the playing field. As for promissory warranties, requirement of causal link between losses and breach of promissory warranties has gained a dominant position in the U.K., the U.S., Australia, and New Zealand on the grounds that considerable unfairness to policyholders would arise in the absence of it. In addition, the insurers’ right to terminate contracts has been generally regarded as a more superior legal effect than III rendering contracts void or avoid, even the insurer automatically discharged from liability. Based upon these foreign legislation and other considerations, the dissertation proposes the third section “express warranties” of insurance law in Taiwan should be amended thoroughly. Affirmative warranties in the section should be substantially supersede by misrepresentation set forth in article 64, since the latter is capable of inducing the insured to provide necessary information for the insurer in a more efficient way than is the former. On the other hand, promissory warranties of insurance law in Taiwan should be reconstructed by adding the requirement of causal connection to the insurer’s right not liable for specific losses. Furthermore, this dissertation also advocates that legislators replace the insurer’s right to avoid with the right to terminate on the basis of evading complicated legal relationship. Besides, in advance of amending aforementioned articles, the dissertation suggests that courts in Taiwan mitigate harsh effects via contract construction, and regulators should filter inappropriate or nominal warranties from insurance policies by means of administrative screening mechanism.

Transnational Corporations and Human Rights : Assessing the position of TNCs within international human rights law, and the appropriateness of an international treaty on business and human rights

Transnational corporations are playing an important role in the global economy of today. Many of these corporations have great economic resources and have the possibility of contributing to the development of societies in developing states. At the same time, in their search for profit, the activities of TNCs have proven fatal to some of the individuals employed by them, or otherwise in contact with their activities. Within the international legal framework, corporations are not traditionally treated as subjects and if a TNC allocates its production to a state with lax human rights protection, no binding international standards exist to regulate the conduct of the corporation.  In my thesis I will assess the position of TNCs under the present core human rights instruments and soft law initiatives. I will also analyze a draft treaty text produced by the Intergovernmental Working Group on Business and Human Rights, released in July 2018, to reach a conclusion on whether such an instrument would affect the international legal status of TNCs and provide a more robust protection of international human rights.
