This thesis focuses on the ethical aspects of soldiers of the Army of the Czech republic participating in the foreign operations, not only in relation to the legality and legitimacy of military intervention, but also from the point of view of practical ethical questions of soldiers sent to perform tasks in these operations. The first part of this thesis introduces the Army of the Czech Republic as a tool to ensure national security and national sovereignty, built with emphasis to fulfill military traditions, virtues and professional ethics. Later, in historical and contemporary contexts summarizes the basic ethical solutions for the legitimate use of force to resolve international conflicts. The second part reflects the umanitarian and security operations taking place in the former Yugoslavia, Iraq and Afghanistan as the consequences of massive human rights violations, ethnic violence and global terrorism. In the context of the ethical and Christian dimension of legitimate use of military means, summarizes the basic issues while solving security threats and enforcing national interests.

Russia's European agenda and the Baltic states

Russia has always been a primary factor in the development of the Baltic States. It is impossible to analyse Baltic security without looking into the processes inside Russia and the prevailing trends vis-a-vis the Baltic States. However, the changes in the Baltic security landscape in the 21st century lack a comprehensive analysis. This thesis seeks to bridge the gap. Two key aims are being pursued in this thesis. The first is to present an analysis of Russia's European agenda under President Vladimir Putin and to examine the place of the Baltic States in this agenda. The second aim is to define Russia-related threats and challengers to the Baltic States, as well as prospects in Russo-Baltic relations. To attain these aims, inter-active approach to international relations, comprising three levels of analysis - the international system, the nation state (domestic level) and the individual (personality) level - has been applied. The neo-realist paradigm of international relations theory, comparative analysis and the Knudsen model, which addresses the peculiarities of relations between great powers and small states, are the methodological framework of the thesis. When analysing the development of Russo-Baltic relations in 1990-2006, this thesis focuses on the evolution of the Baltic States from factors to actors and their chance of shaping Russo-Baltic relations from within the enlarged EU and NATO. It also examines possibilities for more active engagement of Russia in the Baltic region. The thesis concludes with an analysis of perspectives for the Baltic States in countering Russia-related threats and building cooperativer elations with Russia. The author maintains that 'high politics' in Russo-Baltic relations has ended, yet, the tensions do remain in 'low politics'. Russia seeks to retain her political and economic influence in the Baltics by exploiting various tools, primarily economic levers and Baltic dependence upon Russian energy.

Para isso, partiremos do início desta discussão que ocorreu antes da formação e da consolidação dos Estados nacionais e o fortalecimento do princípio da soberania, e passaremos pelos impactos causados pela nova ordem jurídica internacional criada pela Organização das Nações Unidas. Isso trará subsídios para a análise da situação do combate às crises humanitárias nos anos 1990 sob a ótica da intervenção. Como exemplo da atuação do Conselho de Segurança das Nações Unidas, investigaremos dois casos emblemáticos de intervenções humanitárias deste período: o genocídio de Ruanda, em 1994, e os ataques da OTAN no Kosovo, em 1999. For that, it will start from the beginning of this discussion which occurred before the constitution and consolidation of national states and the strengthen of the sovereignty principle, and goes through the impacts caused by the new international legal order created by the United Nations. This will support the analysis of the humanitarian crisis in the 90's under the optic of intervention. As an example of the United Nations Security Council performance, it will investigate two emblematic cases of humanitarian intervention of the period: Rwanda's genocide, in 1994, and NATO¿s air strikes on Kosovo, in 1999. From this perspective, it will rise the present understanding on this issue, bringing up the dilemma between the moral duty of saving lives jeopardized by the scourge of war and the legal bar of doing it considering the international legal system in vigor. Morphodynamic modelling of a wave-dominated tidal inlet : the Albufeira lagoon / Modélisation morphodynamique d'une embouchure tidale dominée par la houle : la lagune d'Albufeira

Les embouchures tidales dominées par la houle sont des systèmes côtiers particulièrement dynamiques dont la morphologie est continuellement remodelée par l’action des vagues et de la marée. Les rapides évolutions morphologiques auxquelles elles sont sujettes impactent directement leurs environnements écologiques et socio-économiques. Afin de mettre en œuvre des réglementations adaptées à la gestion durable des embouchures tidales, des études environnementales systématiques sont nécessaires. L’objectif principal de cette thèse est de mieux comprendre les processus physiques qui contrôlent les évolutions morphologiques d’une embouchure tidale éphémère au Portugal - l’embouchure de la lagune d’Albufeira – à partir de l’analyse de mesures hydrodynamiques et topographiques et de résultats d’un système de modélisation morphodynamique récemment développé. Les processus qui influent sur la dynamique de l’embouchure tidale à court terme, notamment ceux liés aux interactions vague-courant, ont été étudiés à travers l’application du système de modélisation à l’embouchure. Les modulations saisonnières du climat de vagues et du niveau moyen de la mer affectent fortement la dynamique sédimentaire de l’embouchure et contribuent au comblement naturel de l’embouchure pendant l’hiver. Les processus à long terme ont également été étudiés à partir de simulations rétrospectives de paramètres moyens de vagues pour des échelles régionales et locales sur une période 65 ans. Les fortes variabilités interannuelles du climat de vagues et de la dérive littorale qui lui est associée pourraient expliquer les différences d’évolutions morphologiques du système embouchure-lagune sur des échelles de temps pluri–annuels. / Wave-dominated tidal inlets are very dynamic coastal systems, whose morphology is continuously shaped by the combined action of the waves and the tides. The rapid morphological changes they experience impact directly their ecological and socio-economic environments. In order to implement adequate regulations for the sustainable management of tidal inlets, systematic environmental studies are necessary. The main objective of this PhD research work is to gain a better understanding of the physical processes that control the morphological evolutions of an ephemeral tidal inlet in Portugal - the Albufeira Lagoon inlet - based on the analysis of hydrodynamic and topographic data and on the results of a newly developed morphodynamic modelling system. The processes that impact the dynamics of the inlet at short time-scales, particularly those related to wave-current interactions, are investigated through the application of the modelling system to the inlet. The seasonal modulations of the wave climate and mean sea level strongly affect the sediment dynamics of the inlet and contribute to the natural closure of the inlet during the winter period. Long-term processes are also investigated based on a 65-year hindcast of mean wave parameters at regional and local scales. The large inter-annual variability of the wave climate and the associated longshore sediment transport – both correlated to the North-Atlantic Oscillation – are proposed to explain the differences in the morphological behaviour of the inlet-lagoon system at pluri-annual time-scales.

Analyses of Common Elements and Oxides in the Paleosols of the Bahamas and of the Northern Mariana Islands

Paleosols from the Bahamas and the Northern Mariana Islands (CNMI) are closely related to past atmospheric circulation and dust load. In the Bahamas the sources of insoluble residue (IR) must be allogenic because the islands consist of almost pure carbonates. The Al2O3:TiO2 ratio was used to establish the provenance of the IR of the paleosols. Comparisons of this ratio from Bahamian paleosols, North African dust, Lesser Antilles ash and North American loess reveal that the African dust is the major contributor to the IR, with a potential minor volcanic input from the Lesser Antilles. The contribution of the North American loess to the IR was not determined because of geochemical similarities with the North African dust. The study of two outcrops in Eleuthera indicate that paleosols can act as aquicludes. The Bahamian samples were collected on a roughly north-south transect in order to establish the climatic influence on paleosol properties. Even though there is a marked climatic gradient in the Bahamas, the paleosol geochemistry shows no trend that could be related to paleoclimate. While previous studies indicated that the source of insoluble residues in the soils of CNMI is carbonate dissolution, the present study shows that atmospheric deposition of ash from the Mariana arc and dust from the Asian continent may play a significant role in paleosol formation.

聯盟的本質:解釋後冷戰時期的北約存續 / Essence of alliance: explaining the NATO's endurance in the Post-Cold War era

第二次世界大戰結束以後,以美國為首的西方國家為了嚇阻蘇聯的入侵,遂成立了北大西洋公約組織。這也標誌著冷戰時期美蘇兩強對峙的局面。冷戰結束以後,許多學者因而預言北約即將瓦解。但多年以來,北約卻依然存在,更歷經了三次東擴。本文寫作的目的,便欲透過重新檢視國際關係理論三大主要學派的觀點,對於後冷戰時期的北約存續提出解釋。 在現實主義學者陣營中,摩根索與華爾滋的「權力平衡」論點與北約發展的史實不符;施韋勒的「扈從利益」論點僅部分解釋了國家聯盟行為,對於「扈從」概念的界定又出現前後不一;米爾斯海默的「推卸責任」論點試圖同時涵蓋「制衡」與「不制衡」兩種選項,而純粹的「推卸責任」策略又必須依賴其他國家願意承擔,因此不易成功。瓦特的「威脅平衡」理論雖仍有不足之處,但較適合解釋本文的個案。筆者認為,後冷戰時期的北約便是面臨了大規模毀滅性武器擴散、俄羅斯存在與恐怖主義等威脅,才強化了盟國繼續合作的意願。 從新自由主義學者的觀點而言,國家若欲在無政府狀態的國際體系中維持合作關係,便需要以互惠為基礎而運作的國際制度。當國際制度能隨著成員的需求而調整時,就能獲得更多支持。由於美國的優勢國力受到北約的制度規範與集體決策機制削弱,又具有軟權力的勸服力量,遂吸引了中、東歐國家加入聯盟。此外,民主國家之間較不容易發生戰爭。這些因素都維繫了北約盟國在後冷戰時期的合作關係。 由於後冷戰時期的北約在訴求「內群體」偏袒的同時,卻未激化「外群體」歧視。建構主義學者認為,若隨著聯盟關係的發展,成員之間能培養出休戚與共的集體身份,將個別的國家安全問題視同為集體的安全議題時,彼此便超越了傳統軍事聯盟在攻擊與防禦上合作的功能,而達到安全共同體的境界。北約所具備的規範特性也進一步增強了其對盟國的型塑能力。 聯盟的本質在於合作。但關鍵是國家為何合作、如何促進合作,以及如何決定合作對象或競爭對手。事實上,後冷戰時期的北約並未放棄對付共同威脅的核心目標,卻也逐漸發展出安全管理的功能,不但參與了維和行動,也建立起和俄羅斯與烏克蘭的對話機制,更凝聚了盟國的信念而形成具有集體身份的安全共同體。 / In the aftermath of WWII, North Atlantic Treaty Organization (NATO), mainly led by the U.S., was formed to deter U.S.S.R.’s aggression. This organization signified the bipolar system of international relations. When the Cold War came to an end, many scholars once predicted NATO would collapse. However, the alliance still endures for decades and enlarges eastward three times. The purpose of the dissertation is to reappraise the perspectives from three major schools of International Relation theory and provide some explanation of NATO’s endurance in the post-Cold War era. In the camp of realists, the balance-of-power theory raised by Hans J. Morgenthau and Kenneth N. Waltz is inconsistent with the facts of NATO’s development. The bandwagon-for-profit theory proposed by Randall L. Schweller only gives partial explanation of international alliances and takes a contradictory position on the concept of bandwagon. The buck-passing theory maintained by John J. Mearsheimer tries to include both the options of balance and not-balance on the one hand, while depends heavily on other states’ willingness to take the responsibility of balance on the other hand. As far as we know, the latter seldom results in success. Although the balance-of-threat theory sustained by Stephen M. Walt still has some shortcomings, it can provide a better explanation of the case discussed in the dissertation. This author concludes that NATO faces multiple threats of the spread of WMD, the existence of Russia and transnational terrorism in the post-Cold War era. That’s why the allies continue to cooperate. From the standing points of neo-liberalists, if states want to maintain cooperation under the anarchical international system, they will need international institutions based on reciprocity. When international institutions can be adjusted with the demand of their member states, they will obtain more supports. Because the primacy of the U.S. was reduced by the institutional rules and joint decision making process in NATO and accompanied with persuasive soft power, some Central and Eastern European Countries (CEEC) were drew to join the alliance. Moreover, there are few wars among democracies. For all these reasons, NATO still survives until now. When NATO seeks to develop in-group favoritism in the post-Cold War era, it does not activate out-group discrimination. Constructivists state that if members of alliances can cultivate their collective identities and transform national security problems into collective ones, they can go beyond traditional military alliances and become security communities. Features of norms in NATO also strengthen their capabilities in shaping the alliance. The essence of alliance is cooperation. Its key points for states lie in why they cooperate, how to facilitate their cooperation and how to choose their partners or opponents. As a matter of fact, in the aftermath of the Cold War, NATO doesn’t give up its core purpose of fighting against common threats, while it develops the function of security management gradually. Besides, NATO takes part in the peace-keeping operations and builds the mechanisms for communication with Russia and Ukraine. In the end, NATO solidates the belief from its member states and turns into a security community of collective identity.

The main aim of this dissertation is to analyze selected economic activities and economic relations occurring between the European Union and China. This dissertation is divided into four main chapters to ensure coherence and continuity throughout the research. The first chapter deals with the historical development of mutual cooperation between Europe and China. This chapter emphasizes recent events. The most extensive part of this work, the second section, addresses key areas of cooperation between the EU and China. Most of the research focus is devoted to trade economic relations and investment relations. Further, the second chapter addresses controversial areas within the mutual EU-China relations. In contrast with the second chapter, which looks at the mutual relations from the perspective of the whole EU, the third chapter distinguishes bilateral relations between two EU countries and China. The purpose of the third chapter is therefore to highlight the different approach of individual EU member countries. In the last chapter, I try to assess the growing influence of both the EU and China within the global economy. Finally, I outline the possible future development of the research topic.

Terrorism, war and international law: the legality of the use of force against Afghanistan in 2001

The thesis examines the international law pertaining to the use of force by states, in general, and to the use of force in self-defence, in particular. The main question addressed is whether the use of force, which was purported to be in self-defence, by the United States, the United Kingdom and their allies against al Qaeda, the Taliban and Afghanistan, beginning on 7 October 2001, was lawful. The thesis focuses not only on this specific use of force, but also on the changing nature of conflict, the definition of terrorism and on the historical evolution of limitations on the use of force, from antiquity until 2006. In the six chapters which trace the epochs of international law, the progression of five inter-related concepts is followed: limitations on the resort to force generally, the use of force in self-defence, pre-emptive self-defence, the use of forcible measures short of war, and the use of force in response to non-state actors. This historical analysis includes a particular emphasis on understanding the meaning of the 'inherent right of self-defence', which was preserved by Article 51 of the United Nations' Charter. This analysis is then applied to the use of force against Afghanistan which occurred in 2001. Following the terrorist attacks of 11 September, the US and the UK notified the United Nations Security Council of their resort to force in self-defence under Article 51. Each element of Article 51 is analysed and the thesis concludes that there are significant doubts as to the lawfulness of that decision to employ force. In addition to the self-defence justification, other possible grounds for intervention are also examined, such as humanitarian intervention, Security Council authorisation and intervention by invitation. This thesis challenges the common assumption that the use of force against Afghanistan was an example of states exercising their inherent right to self-defence. It argues that if this particular use of force is not challenged, it will lead to an expansion of the right of self-defence which will hinder rather than enhance international peace and security. Finally, this thesis draws on recent examples to illustrate the point that the use of force against Afghanistan could become a dangerous precedent for the use of force in self-defence.
