La dématérialisation des méthodes de traitement, de transmission et de conservation de l’information modifie substantiellement les rapports économiques et sociaux. Le domaine juridique n’aurait pu rester étranger à ce mouvement de fond. Le droit et la justice s’en trouvent bouleversés jusque dans leurs organisations, leurs méthodes et leurs métiers. L’adaptation du droit aux technologies numériques désormais acquise, les craintes et résistances liées à leur intégration dans le fonctionnement judiciaire surmontées ; la dématérialisation des actes du procès et leur communication électronique se généralisent. Une phase de maturation débute à présent, celle d’un retour au droit de la procédure civile et de l’appréciation que la jurisprudence fera de ces innovations technologiques. Il conviendra dès lors de veiller à ce que cette appropriation serve pleinement les intérêts des justiciables et de la justice. / Paperless methods of data production, process and records management has substantially changed both the economic and social relationships. Therefore, French law and justice could not have ignored these technological evolution which is deeply impacting their own organisation, methods, and professions. The necessary adaptation by French law and Justice to digital technologies now acquired, and concerns or fears on their integration into the civil litigation process being overcome ; dematerialisation of procedural acts and their communication in electronic forms are generally used. Regarding this technological reality, attention needs henceforth to be directed towards the role of each relevant actor of the French E-justice to make sure that such proceedings allow a fair trial to any litigant

This thesis deals with out-of-court dispute resolution within international business transactions. Its goal is an analysis of those methods of dispute resolution that may be encountered both in practice and specialized literature and determination of their basic characteristics that allow comparison. The thesis is divided into six chapters. The first two chapters are of general nature and specify the content of the given topic. The third chapter establishes the framework of relevant law and the subsequent chapters are concerned with the online dispute resolution with the help of modern technology. The first chapter is composed of three parts. The first part defines the notions of out-of-court dispute resolution and alternative dispute resolution (ADR) and explains the relation between those two notions that are not considered synonymous. The second part describes the common features of the out-of-court dispute resolution methods. To the contrary, the third part points out the differences between them and groups the particular methods based on various criteria. The second chapter defines the international business transactions and focuses on international or foreign element and its determination. Esta tese trata da resolução online de controvérsias. Parte-se da hipótese de que sua expansão para múltiplas jurisdições e vários tipos de conflitos, incluindo os complexos e de alto valor, provocará mudanças significativas no direito. São analisados, das perspectivas jurídica e econômica, as condições para a resolução extrajudicial de disputas, por meios alternativos (adequados), inclusive online, com atenção para o design orientado à prevenção e à resolução massificada de conflitos e para o emprego de tecnologias persuasivas com esta finalidade. Examinam-se os desafios conexos a tecnologias de informação e comunicação, os conflitos deles derivados e as instituições e partes envolvidas em sua resolução. Descreve-se o potencial dos mecanismos de resolução online de controvérsias a partir de três estudos de caso eBay, prefeitura de Nova York e Wikipedia. Investigam-se as consequências jurídicas da disseminação de mecanismos de resolução online de controvérsias à luz das experiências públicas e privadas e projetos existentes. Por fim, os impactos destas novas formas de dirimir conflitos são analisados nos planos nacional em relação a devido processo legal, direitos de terceiros e ordem pública e internacional, com destaque para as alternativas que se apresentam a Estados e organizações internacionais. Conclui-se apontando, por um lado, as preocupações relativas ao controle jurisdicional sobre a resolução online de controvérsias; por outro, as promessas desta decorrentes, traduzidas em especial em eficiência e acesso à justiça. / This dissertation discusses online dispute resolution. Its hypothesis is that the expansion of this form of dispute resolution across jurisdictions and towards many types of conflict, including complex and high-value ones, will promote substantive legal changes. The conditions for outof-court dispute resolution are analyzed, from the normative and economic perspectives, covering alternative (adequate) and online dispute resolution, with attention to its design focused on the scalable resolution of controversies and to the use of persuasive technologies to that end. The challenges connected to information and communication technologies, the conflicts deriving from them and the institutions and parties involved in their resolution are examined. The potential for online dispute resolution is described through three case studies eBay, New York City and Wikipedia. The legal consequences of the dissemination of online dispute resolution are studied in light of the existing public and private experiences and projects. Finally, the impacts of these new forms of solving conflicts are analyzed at the national with respect to due process, third party rights and public policy and international levels, highlighting the alternatives available to states and international organizations. The dissertation concludes by noting the concerns related to jurisdictional control over online dispute resolution and the prospects arising out of it, especially prominent in terms of efficiency and access to justice.

Ante a crescente utilização dos meios eletrônicos como forma de viabilizar o comércio de produtos e serviços além das fronteiras estatais o presente estudo tem como escopo identificar os desafios oriundos do embate entre a realidade cibernética e o direito internacional contemporâneo, pontuando, de forma crítica, as soluções descortinadas pela sociedade internacional. Isto porque as questões de direito internacional, já conflituosas no âmbito do comércio internacional tradicional, se mostram ainda mais subjetivas no peculiar ambiente virtual, em regra desmaterializado e a desterritorializado. Tais características e peculiaridades refletem na identificação da jurisdição e da lei aplicável no contrato eletrônico, nas soluções para o combate do cibercrime e na solução alternativa de conflitos, ademais de outros temas que foram possíveis de serem abordados neste estudo. Para tanto é proposto um exame das soluções até então desenvolvidas para a regularização e/ou padronização das condutas no âmbito do comércio internacional por via eletrônica, colacionando a normativa e a jurisprudência implementadas e/ou em desenvolvimento na área. / In view of the increasing on the usage of electronic media as a means to facilitate the trade of goods and services beyond the State borders, the purpose of this study is to identify the challenges arising from the clash between the practices in the cyberspace and the contemporary law, showing in a critically way the solutions unveiled by international society. The international law issues, that are already conflictual before the traditional international trade, become even more subjective in particular virtual environment, dematerialized and deterritorialized. Such characteristics and peculiarities reflects in the identification of jurisdiction and applicable law, in the solutions to prevent the cybercrime and in the alternative dispute resolutions as well as other subjects that were likely to be addressed in this study. Therefore this study intends to examine the solutions developed so far in order to regularize and/or standardize the actions in the electronically international trade, presenting rules and case law implemented or in developing in the area.

This diploma thesis seeks to characterize and critically evaluate current development in the field of Online Dispute Resolution. In particular, interpreting international legislation focusing on present development and trends in this alternative dispute resolution, with help of Information and Communication Technologies. This thesis is divided into a total of seven chapters, which four of them are considered essential. The first is the second chapter, where the author of the thesis deals with the legislation of the Online Dispute Resolution in the Czech Republic. Secondly, the third chapter provides an explanation related to the domain disputes in the Czech Republic, the EU and the rest of the world. The fourth chapter deals with the development of legislative initiatives at the European Union level. Of particular note being, the European Union Regulation No. 524/2013 on online dispute resolution for consumer disputes. Further to that, chapter 5 deals with the activities of the The United Nations Commission on International Trade Law conducted by the third working group. In conclusion, the author notes that the main goal of the diploma thesis, namely the provision of an overview of the legislation of the Online Dispute Resolution, developing possibility of alternative dispute resolution, has been achieved.

Le commerce électronique n'est plus un simple support promotionnel de la distribution des biens de consommation: il s'apparente de plus en plus à un marché parallèle à la distribution classique. Cependant, quel que soit le schéma emprunté, les rapports humains suscitent inévitablement des conflits et le commerce électronique ne fait pas exception à la règle. Ce nouveau vecteur n'a pas pour seule vertu le rapprochement des individus; de la même façon qu'il a affecté nos relations, il a eu un impact sur les litiges eux-mêmes. Le contexte particulier dans lequel s'inscrivent les transactions privées sur Internet, ont pour conséquence des litiges portant sur de faibles sommes d'argent et qui sont qui plus est - conditionnés par certains aspects techniques ou certaines particularités du monde en ligne. A cela s'ajoute une dimension internationale qui accentue encore la complexité du règlement des litiges, dans la mesure où elle implique pour les parties de délicates délibérations sur la question du forum et du droit applicable. La dispersion des parties ne facilite pas l'exercice de l'action en justice. Aussi l'arbitrage en ligne a-t-il pour ambition éthérée d'éluder la voie judiciaire et, plus encore, la voie judiciaire à l'étranger. La Toile, par la multitude de possibilités qu'elle offre, perturbe autant les repères de la justice classique qu'elle ne lui apporte des solutions jusqu'alors inexplorées. Par un recoupement de leurs caractéristiques, l'arbitrage fait ainsi écho au commerce électronique. En d'autres termes la gestion de la procédure arbitrale se fera à distance. Une attention toute particulière doit être accordée aux spécificités d'Internet et à l'impact que ce contexte particulier peut avoir sur le cadre traditionnel de l'arbitrage. La transition vers le monde virtuel ne se fait donc pas sans heurts. Si l'arbitrage en ligne est techniquement praticable, juridiquement il soulève nombre de questions. L'arbitrage classique exige de nombreuses conditions de fonds et de v fonnes que l'arbitrage en ligne par sa nature même ne peut totalement satisfaire. Malgré cette évidence, le droit, dans un souci de perfection et de maniabilité toujours plus poussé, tend peu à peu à passer outre cet écueil. It has become an alternative trading market for those consumption goods. However, whether trade takes place through e-trading or more traditional ways, human relationships are likely to entail conflicts. As a new fonu of trading, e-commerce fostered and strengthened the relationships between individuals, inc1uding lawsuits. Nonetheless, the types of lawsuits related to e-commerce differ from those related to the standard trade in several ways. For example, lawsuits related to etrading often involve relatively limited amounts of money because of the particular context in which trade takes place through the internet or some technical aspects of it. In addition, the international dimension of the trade further complicates the settlement of litigation since it implies sensitive deliberations about the place ofjurisdiction and the applicable law. In this case, the difficulty in conducting the legal practice is exacerbated by the fact that parties are far apart. Consequently, online arbitration has the noble goal of eluding the legal process, especially abroad. The World Wide Web, through its numerous possibilities, raises questions on the references of the c1assical justice and proposes solutions in ways that so far were unexplored. Since they share many of the same characteristics, on-line arbitration is similar to e-trading-that is, the on-line arbitration process is made from distance. Overall, a very particular attention must be paid to the specificities of the Internet and to its possible effects on the traditional arbitration framework. For the arbitration, the transition of trade toward the electronic world has created lots of vii difficulties. While online arbitration is technically practicable, it raises many legal issues. Online arbitration cannot totally fulfill the numerous conditions of content and fonn that standard arbitration requires. Nevertheless, the Law, with its growing concern for perfection and adaptability, is progressively overcoming this difficulty. La résolution en ligne des conflits de consommation à l'aune de l'accès à la justice

Dans son sens le plus courant, mais aussi le plus étroit, la résolution des conflits en ligne (RCL) réfère à la migration, vers Internet, des modes alternatifs de règlement des conflits. Notre mémoire se concentre sur la transposition, en ligne, des seuls modes amiables de règlement des différends, dont font notamment partie la négociation et la médiation. La question guidant notre étude consiste à savoir si la résolution en ligne permet d’accroître l’accès du consommateur québécois à la justice. La première partie répond par l’affirmative, en démontrant en quoi la RCL permet de surmonter plusieurs obstacles à la fois objectifs et subjectifs auxquels se heurte le consommateur québécois souhaitant obtenir justice. Nous y présentons également certaines critiques récurrentes en matière de RCL et y répondons. Si cette première partie aborde essentiellement la question du pourquoi il est opportun de recourir au règlement électronique des litiges de consommation dans une perspective d’accès à la justice, la seconde s’intéresse à celle du comment. Notre hypothèse est que si le recours à la RCL est souhaitable pour améliorer l’accès du consommateur québécois à la justice, ce mode de règlement ne pourra véritablement porter ses fruits que s’il est encadré par l’État. Nous démontrons ainsi l’opportunité d’une intervention étatique en matière de règlement en ligne des différends de consommation. Selon nous, seule l’institutionnalisation de la RCL permettra de lever, en partie du moins, les barrières qui ont freiné, jusqu’à maintenant, le déploiement à grande échelle de ce procédé de règlement novateur. / According to its most common, but also most narrow definition, Online Dispute Resolution (ODR) refers to the electronic form of Alternative Dispute Resolution (ADR). Our master’s thesis focuses on the online version of consensual dispute resolution processes, among which negotiation and mediation are found. The question underlying our research is the following: does ODR increase Quebec consumers’ access to justice? The first part of our study gives a positive answer to this question, by demonstrating how ODR can tackle many obstacles, both objective and subjective, to Quebec consumers’ access to justice. It also provides answers to the most frequent criticisms of ODR. This first part essentially addresses the question of why ODR can enhance consumers’ access to justice, while the second part focuses on the how. Our hypothesis is that ODR’s numerous advantages with regards to consumers’ access to justice will only truly materialize in practice if the government intervenes to regulate this dispute resolution method. We therefore demonstrate the opportunity of a State involvement in the field of consumer ODR. In our opinion, institutionalizing ODR will lift, partially at least, barriers that have hindered, to this day, the large-scale deployment of this innovative dispute resolution process.
