Investigating factors that motivate teachers to teach after normal working hours : a case study in the Capricorn district of Limpopo

The purpose of the study was to identify factors that motivate teachers to teach after hours. It was a qualitative study employing the interpretive research paradigm. The study employed a case study design of three secondary schools. Twelve teachers were purposively selected. Data was collected through focus groups and open-ended questionnaires of which thematically analyzed. Key findings revealed that teachers are motivated to teach after hours by among others their ability, pertinent PD, resources, positive environment, theories of motivation and goals set. The study concluded that these factors should be upheld. The study also recommended enough time for PD, bursaries and salary adjustments, teacher involvement in textbook requisition, excellence awards, incentivisation and goal setting. / Educational Leadership and Management / M. Le droit à la réparation des lésions professionnelles des travailleurs soumis à une obligation de disponibilité : une analyse jurisprudentielle longitudinale

L’obligation de disponibilité du travailleur met en lumière un temps durant lequel le travailleur demeure à la disposition de son employeur malgré le fait qu’il n’accomplit pas concrètement sa prestation de travail, le temps de disponibilité. Conséquence de plusieurs phénomènes, notamment la mondialisation des marchés, la financiarisation de l’économie et l’essor des nouvelles technologies de l’information et de la communication, l’obligation de disponibilité est mal définie par les règles juridiques actuelles au Québec. Considérant cet état du droit, notre mémoire cherche à évaluer dans quelle mesure la Loi sur les accidents du travail et les maladies professionnelles capte l’obligation de disponibilité du travailleur. Pour ce faire, nous avons effectué une analyse quantitative et qualitative de la jurisprudence rendue par la Commission d’appel en matière de lésions professionnelles et la Commission des lésions professionnelles entre 1995 et 2014. Notre mémoire comporte trois volets. Sous un angle plus sociologique, nous voulions examiner si notre population de décisions nous permettait, d’une part, de constituer différentes manifestations-types de l’obligation de disponibilité et d’autre part, de discerner une progression dans le temps du nombre de décisions portant sur une obligation de disponibilité. Enfin, nous désirions examiner dans quelle mesure un travailleur victime d’une lésion durant une période de disponibilité peut se prévaloir des droits accordés par la L.a.t.m.p.. À l’aune de notre mémoire, plusieurs manifestations-types de l’obligation de disponibilité peuvent être en constituées en fonction du moment durant lequel elle se manifeste. L’obligation de disponibilité peut également être rattachée au statut de travailleur autonome. En outre, il semble que la reconnaissance de la lésion professionnelle du travailleur varie en fonction de ces manifestations-types. Cependant, nos résultats ne révèlent pas une progression dans le temps du nombre de décisions portant sur une obligation de disponibilité. / The concept of worker availability requirements refers to instances in which workers are required to be available to their employers outside of standard work hours (off-duty). Due to several factors, especially the internationalization of markets, financialisation of the economy, and the development of information and communication technology, this normative requirement is inadequately regulated by current legislation in Quebec. Therefore, our research evaluates the extent that the Loi sur les accidents du travail et les maladies professionnelles addresses availability requirements imposed on workers in the province. To this end, we carried out qualitative and quantitative analyses of decisions made by the Commission d’appel en matière de lésions professionnelles and Commission des lésions professionnelles between 1995 and 2014. From a sociological perspective, we attempted to produce different categories of off-duty availability requirements, and to discern whether an augmentation in the number of decisions concerning availability requirements has taken place over time. Finally, we examined the extent that workers benefit from the rights provided by the L.a.t.m.p. when injuries occur during off-duty hours in which workers are required to be available. Our results demonstrate that many categories of availability requirements can be developed related to the period of time during when such obligation occurs. Furthermore, these requirements are also linked to individuals’ status as self-employed workers. Finally, it seems that the recognition of workers’ employment injuries vary along these categories. However, our results also suggest that there exists no positive trend in the number of decisions concerning worker availability requirements over time.

Aim of this thesis is to plot employee care in organizations and companies, that have a seat in Pelhřimov district. The thesis deals with employee relationships and employee care, where participate working hours and work regime, work enviroment, personal development of employees, services provided to employees by employer, employee benefits, work safety and protection of their health and their motivation and stimulation as well. The first step during processing of this thesis was studying the special literature; making of questionaries was directly connected with it. The questionary was essintial for following survey and the survey took four months. Then, acquired information were processed and incuded into graphs and charts and annotated. The result of the thesis is an undestandable picture of employee care in Pelhřimov district and discovery of the greatest problems and the most problematic branches of the national economy.

Les modes d’organisation des temps liés au travail et la protection de la santé et de la sécurité des travailleurs : examen d’une protection morcelée

Certains phénomènes contemporains, comme le développement des technologies de communication, la mondialisation des marchés et l’intensification du travail ont perturbé de manière radicale le marché du travail. Ainsi, nous assistons à la transition entre une société industrielles caractérisée par des horaires prévisibles et stables, vers une société post-industrielle où les modes d’organisation des temps liés au travail sont flexibles et diversifiés et où il existe un brouillage des frontières entre le temps de travail et le temps personnel. Plusieurs études scientifiques ont établi des liens significatifs entre les modes d’organisation des temps liés au travail, par exemple les longues heures de travail, le temps supplémentaire obligatoire, le travail posté, l’obligation de disponibilité, les périodes de garde, les horaires de faction, le temps partiel et les périodes de pauses et de repos, et plusieurs problématiques de santé physique et psychologique. Il est donc légitime de se demander si l’ensemble législatif encadrant les rapports de travail au Québec, qui a été mis sur pied pendant la période industrielle, est toujours pertinent et adéquat pour soutenir l’un des objectifs qu’il porte, soit la protection de la santé et de la sécurité des travailleurs. Le but de notre recherche est de déterminer dans quelle mesure l’encadrement juridique actuel au Québec permet de protéger la santé et la sécurité des travailleurs exposés aux risques générés par les modes d’organisation des temps liés au travail. Afin d’atteindre notre objectif, nous avons examiné, par une étude empirique de la jurisprudence, l’encadrement juridique des différents modes d’organisation des temps liés au travail que nous avons retrouvés dans notre échantillon, soit le temps supplémentaire obligatoire, le travail posté, les horaires de faction, l’obligation de disponibilité, les périodes de pauses et de repos ainsi que les litiges relatifs à la grossesse et à l’allaitement. Nous nous sommes particulièrement intéressés à la question de la mobilisation des normes et des recours dans le contexte d’un système juridique morcelé. De manière générale, notre recherche démontre que le droit du travail souffre de plusieurs lacunes qui nuisent à la mobilisation des normes par les travailleurs, ce qui diminue la protection légale de leur santé et de leur sécurité et qui réduit l’accessibilité de la justice. / Contemporary phenomena such as the development of communication technologies, the globalization of markets and the intensification of work have radically disrupted the labour market. Thus, we are witnessing the transition from an industrial society characterized by predictable and stable working hours to a post-industrial society where the ways of organizing the work-related time are flexible and diversified, and in which the boundaries between working time and personal time are blurred. Several scientific studies have established significant links between the modes of organization of work-related time, such as long working hours, overtime, shift work, mandatory availability, on-call periods, faction schedules, part-time work, and break and rest periods, and several physical and psychological health issues. It is therefore legitimate to wonder whether the legislative framework governing Quebec’s labour market, which was instituted in the industrial era, is still relevant and adequate to achieve one of its aim, namely to protect the worker’s occupational health and safety. The purpose of our research is to determine the extent to which the current legal framework in Quebec allows for the protection of the health and safety of workers exposed to risks generated by the organization of work-related time. We have examined, through an empirical study of case law, the legal framework surrounding the different ways of organizing work time that we identified in our sample, such as mandatory overtime, shift work, faction schedules, mandatory availability, rest and break periods and disputes related to work time for pregnant or breastfeeding workers. We were particularly interested in the issue of mobilizing norms and recourses in the context of a fragmented legal system. Overall, our research demonstrates that the labour legal framework suffers from important shortcomings, which impede the mobilization of the rules by workers, thereby radically diminishing the legal protection of the workers’ occupational health and safety and raising significant concerns about the accessibility to justice.

De ledande revisionsbyråerna på den svenska marknaden präglas av en hög säsongsbaserad arbetsbelastning samt en hög personalomsättning. Mängden revisorer har minskat markant under de tre senaste decennierna samtidigt som den yngre generationens värderingar har förändrats. Studien syftar till att undersöka den rådande psykosociala arbetsmiljön inom branschen och hur den uppfattas av aktiva revisorsassistenter. Vidare undersöks om miljön haft en inverkan på de individer som valt att lämna branschen. Den tidigare forskningen kring revisionsbranschen är relativt omfattande. Det saknas dock studier på hur de som befinner sig längst ned inom den hierarkiska stegen uppfattar och upplever den arbetsmiljö som de omfattas av. Den empiriska datainsamlingen utfördes genom tio intervjuer. Hälften av studiens deltagare arbetar aktivt som revisorsassistent, och den andra hälften har tidigare arbetat som revisorsassistent men lämnat yrket helt. För att bygga en användbar modell att analysera det empiriska resultatet har studien utgått från de teoretiska begrepp Eklöf (2017) använder sig av för att definiera den psykosociala arbetsmiljön. Det framkom att de ledande byråerna visar tydliga brister i arbetets psykiska krav samt att det finns en problematik gällande arbetsrelaterade normer och en bristande organisatorisk rättvisa. Det synliggjordes samtidigt att assistenter upplever resurser i form av stimulans och egenkontroll, ett socialt stöd, ett bra teamarbete, en anställningstrygghet och att arbetsplatsen inte präglas av konflikter eller mobbning. Beroende på hur egenskaperna värderas kan en individs incitament till att lämna yrket påverkas positivt eller negativt. Slutsatsen blev därför att de ledande revisionsbyråerna präglas av en bristande psykosocial arbetsmiljö, vilket enligt studien haft en påverkan på incitamenten att lämna yrket. Studien påvisar dessutom att den upplevda psykosociala arbetsmiljön bygger på subjektiva värderingar och att upplevelsen på så sätt varierar mellan assistenterna. / The leading auditing firms in Sweden are characterized by a high seasonal workload and high staff turnover. The number of auditors has decreased over the past three decades, while the values of the younger generation have changed. The study is written in Swedish and aims to examine the prevailing psychosocial work environment in the industry and how it is perceived by currently active audit assistants. Moreover, the impact on the individuals who have chosen to leave the industry will be examined. Previous research on the auditing industry is relatively extensive. However, there is a lack of studies regarding how the individuals situated at the bottom of the hierarchy perceive and experience the work environment they are covered by. The empirical data collection was performed through ten interviews. Half of the study participants work actively as audit assistants, and the other half have previously worked as audit accountants but left the profession completely. To build a useful model to analyze the empirical result, the study has been based on the theoretical concepts that Eklöf (2017) uses to define the psychosocial work environment. It emerged that the leading agencies show clear shortcomings in the work's psychological demands and that there are problems with work-related norms and a lack of organizational justice. At the same time, it was made clear that assistants experience resources in the form of stimulation and self-control, social support, good teamwork, job security and that the workplace is not characterized by conflicts or bullying. Depending on how the qualities are valued, an individual's incentive to leave the profession can be affected positively or negatively. The conclusion was therefore that the leading auditing firms are characterized by a lack of psychosocial work environment, which according to the study had an impact on the incentives to leave the profession. In addition, the study also shows that the perceived psychosocial work environment is based on subjective values and that the experience thus varies between the assistants.

This work deals with issues of business trips in primary schools that are provided by municipality in relation to the law No. 365/2011 Sb., that changes law No. 262/2006 Sb., Labour code, as amended and other related laws valid since January 1st 2012 that says empoyees cannot give up on their rights in advance. Based on assumption that travel expenses that must have been paid to employees in full are huge burden on school budgets. All the travelling with pupils becomes very expensive. According to connection between theory and practical use, all activities cannot be provided only at school and it's necessary that teachers travel with children to learn away from school. This work summaries the rules for reimbursement of travel expenses and reflects the views of headmasters at issues of business trips in primary schools.
