Disability discrimination and undue hardship within the working environment: a critical analysisNxumalo, Lindani Goodman 07 1900 (has links)
South Africa is faced with a huge challenge of disability discrimination and inequality. Disabled people are not enjoying equal treatment as compared to others. Those who are on the working sector are not reasonable accommodated. The study examines challenges faced by people with disabilities. The study further submit that people with disabilities should be reasonably accommodated and be retained in the working sector as they have a positive role to play in the economy. The study also looks at the various legislations and argues that they are ineffective as they fail to address the imbalances of the past. The study further suggest that there is a need for all people to understand disabled people and not to isolate them as such stigma cause people with disabilities to be unfairly discriminated against in society and in employment / College of Law / LL. Normative narratives and disabled ideologies in Nabokov’s Lolita and Laughter in theUnknown Date (has links)
The works of Vladimir Nabokov have traditionally functioned in a way that
challenges its reader to question existing notions of normality. In his works, Nabokov has
frequently utilized representations of disability as a means to comment or critique the
human condition. Throughout this project I intend to demonstrate how the narratives in
both Lolita and Laughter in the Dark function as a normative force which embodies the
cultural attitudes regarding disability. This is accomplished through the enforcement of a
normative reading by the narrative. It is clear then that Nabakov is attempting to subvert
literary conventions by using nontraditional narrators to demonstrate the relativity of
normality. Throughout this project, I will be focusing on Nabakov’s use of narrator to
distort the cultural line between disability and ability. Ultimately, the goal of this project is to demonstrate that current societal notions of normality and disability are outdated and
arbitrary. / Includes bibliography. / Thesis (M.A.)--Florida Atlantic University, 2013.

Previous issue date: 2008-12-13 / The objective of this investigation is to analyze the relation between work and people
with disabilities in Brazil, examining the quota policy which establishes the
reservation of vacancies for people with disabilities in the formal work market and in
the public service the direct or indirect administration, in the three spheres of
government. In its legal and institutional aspects, the mentioned policy is anchored in
the 1988´s Federal Constitution of Brazil and in other norms which constitute the
guidelines, the programs, the objectives, the principles and the goals that compound
the social policies which are implemented by the capitalist State. Starting from the
presumption that work was and still is the originating and founding base of the social
being, the present study intends to demonstrate that in any historical period of
mankind primitive community, mode of production slave-based, feudal and
capitalist the argument which better explains the exclusion of people with
disabilities from the production processes relays on the following central idea: in the
primitive communities, the fact that they could not produce their own material
existence, through their own labor, and in the other modes of production, besides
that, the fact that they could not produce the surplus. This gets more evident when
made clear that the logics of the capitalist s production organization, directed to the
maxim extraction of work, productivity and profit, does not sustain and does not need
the workforce of those people. Even the small number of people who are working in
the formal work market is employed only because of the pressure made by the
disabled-rights movement and the existence of the legal regulation, which, despite its
limits, in this case, plays an important role. The conclusion is that the law ends up
producing an effect more ideological than practical, as it transmits to the society in
general, and specifically to people with disabilities, an ideological argument by which
the simple legal prescription grants the right to work as a concrete reality. This is
revealed when, after more than 20 years from the promulgation of the 1988 s Federal
Constitution, which granted the reservation of vacancies, the unemployment rate
among people with disabilities in work age is still superior to 91%, while among
people without disabilities the number floats around 10%. The right-to-work guaranty
for people with disabilities represents the result of a process of fights marked by
uncountable social-economical, political and cultural relations and mediations which
express contradictories class interests, a fact that gets evident as the corporations
and the capitalist State resist following the law statement. In spite of this conclusion,
the disrespect for the law may be used by disabled-rights movement as an important
political instrument with two objectives: to denounce the capital s system and the
State, not only demanding the respect for the law, but also pointing the contradiction
between what the law states and the concrete reality; and, through this political fight,
to create a class conscience among people with disabilities engaged with the social
mobilizations committed to the working class interests. / O objetivo desta investigação é analisar a relação trabalho e a pessoa com

Neįgaliųjų įsidarbinimo galimybės socialinių pedagogų ir neįgaliųjų požiūriu / The view of social educators and disabled towards the employment opportunities for disabledBarkauskaitė, Raimonda 21 August 2013 (has links)
Employment opportunities for people with disabilities from the point of view of social educators and people with disabilities are analysed in the present Bachelor’s Thesis. Access to sexual and reproductive health services for persons with disabilities : a case study of Clarendon home for persons with disabilities, Durban, KwaZulu-Natal.Mavuso, Sibusisiwe Siphelele. 29 October 2014 (has links)
Sexual and reproductive health are integral parts of the health and well-being of every human being, however they remain sensitive and controversial issues, particularly when they concern persons with disabilities. Within the legal framework, sexual and reproductive health is recognized as basic human rights. They are also essential components of good health and personal development. Making sure that persons with disabilities have access to sexual and reproductive health services contributes to the fulfillment of their sexual and reproductive rights by providing them with more choices that potentially best suit their reproductive health needs. South Africa has one of the most progressive and liberal sexual and reproductive health laws and policies in the world, yet persons with disabilities still face major barriers in accessing these services. In fact, their sexuality has been largely overlooked or actively suppressed and in turn, their reproductive rights denied.
With this background information, the study aims to shed more insights into the experiences and perspectives of persons with disabilities in accessing sexual and reproductive health in Durban, KwaZulu-Natal. Following the rights-based approach it assesses their awareness of sexual and reproductive health services and determines the factors that hinder their access to sexual and reproductive health services.
The findings from the sample of 16 persons with different types of disabilities suggest that access to sexual and reproductive health services is complex and involve a variety of factors. The majority of respondents revealed that sexual and reproductive health services are a big part of their lives. However, there seemed to be a huge gap between their needs for services and their right to access these services. The general consensus was that persons with disabilities face challenges and multiple barriers to access services. Significantly these barriers are not raised by the disability itself but are related to specific contexts or instances of persons with disabilities trying to access services. From the discussions it was apparent that respondents‟ rights to be treated with dignity and to access sexual and reproductive health services is often overshadowed by social isolation, discrimination and other stereotypical assumptions that the society holds about the sexuality of persons with disabilities. Often, persons with disabilities are percieved as not sexually active hence information on sexual and reproductive health matters is not widely available in formats accessible to them. Health providers appeared surprised that person with disabilities will require assistant with family planning services and they are not given choices about suitable birth control methods rather often the nurses suggested that they terminate their pregnancies or to be sterilized. This reveals a need to address access to sexual and reproductive health services for persons with disabilities especially, through public health facilities in South Africa. / Thesis (M.Dev.Studies)-University of KwaZulu-Natal, Durban, 2013.
