La gestion d'une identité « hors norme » dans la sphère professionnelle : l'exemple de l'homosexualité / Handling an "non-strandard" identity in the professionnal world : the exemple of homosexuality

Peu de recherches existent sur la manière dont les gays et lesbiennes vivent leur homosexualité dans leur environnement professionnel. Le milieu associatif de défense des personnes LGBT s'intéresse de façon tout à fait légitime aux freins que peuvent constituer les cultures de travail homophobes pour la visibilité des gays et des lesbiennes. Loin de penser que la seule considération prise en compte par les individus concerne les potentielles réactions homophobes, cette thèse propose de re-situer leur choix au sen d'enjeux de nature divers et de logiques plus globales. La problématique soulevée est d'identifier ce qui, dans la manière dont l'individu gère son homosexualité au travail, relève de la structure de l'individu (notamment la place plus ou moins centrale de l'homosexualité dans l'identité globale) et ce qui relève des interactions (culture du milieu de travail). À partir d'une enquête par entretiens auprès de 53 hommes et femmes d'âges variés, et travaillant dans trois secteurs professionnels principaux (métiers de l'ordre, enseignements, médico-social), nous avons pu identifier les différentes articulations entre des logiques identitaires distinctes et différentes cultures de travail. Après avoir discerné comment les individus géraient leur homosexualité hors travail, nous avons vu les différents types de mobilisations venant des milieux professionnels et enfin, comment à partir de la logique identitaire poursuivie, ils agissaient dans le système de contrainte propre à leur environnement de travail. Cette approche permet d'éclairer des normes sous-jacentes et invisibles à l’œuvre dans les sphères professionnelles et donne des clés de compréhension sur la gestion d'autres identités "hors norme" dans le milieu de travail. / Few studies have been conducted on the handling of homosexuality by gays and lesbians within the working environment. The associations defending LGBT rights legitimately highlight the impact of homophobic working cultures on the visibility of gays and lesbians. Instead of using the apprehension of potential homophobic reactions as the sole explanatory factor, this thesis intends to place the choice of gays and lesbians within a wider series of issues and a more comprehensive logic. Regarding the way an individual handles their homosexuality at work, this thesis intends to identify what pertains to the individual's structure (and especially the place occupied by homosexuality in their global identity) and what pertains to the interactions (the working culture). From a series of interviews conducted with 53 men and women of diverse ages and working mainly in three professional sectors (forces of order, education, medical-social field), we could identify the different linkages between identity-related issues and working cultures. After studying how individuals handle their homosexuality outside of work, we studied the mobilizations of the professional environments. Finally, we studied how individuals act within the specific constraints of their working environment, based on their identity-related issues. This approach shed light on underlying and invisible norms existing in the professional worlds and gave the keys to understanding other « non-standard » identities in the professional environment.

Šiame magistro baigiamajame darbe analizuojamas užsieniečių pavardžių rašymas ir ES teisės įtaka. Nagrinėjama vardo samprata, jo funkcijos ir ypatybės. Aptariama vardo vieta kalbos sistemoje, kuri dažnai tampa ginčų objektu, siekiant priimti teisės aktus užsieniečių pavardžių rašymo srityje. Taip pat skiriamas didelis dėmesys teisės į vardą analizei. Siekiant išsiaiškinti pavardžių reglamentavimo ypatumus, pateikiama tarptautinių, ES ir nacionalinių teisės aktų analizė. Taip pat darbe analizuojama ESTT ir EŽTT praktika, susijusi su pavardėmis. Ypatingas dėmesys skiriamas visai neseniai ESTT nagrinėtoms Sayn-Wittgenstein ir Runevič-Vardyn byloms, kurios doktrinoje dar neanalizuotos. Daroma išvada, kad ES lygmeniu reikalingas teisės aktas, kuris išspręstų pavardžių rašymo priimančiojoje valstybėje narėje problemas, kadangi nacionalinio reglamentavimo skirtumai šioje srityje gali lemti ES piliečiams garantuojamų laisvių ir teisių pažeidimus. / This master thesis focuses on writing foreigners’ surnames and the influence of European Union (EU) law. It analyses the concept, functions and features of name and discusses the place of name within the language system that often becomes a subject of dispute especially when a necessity of legal act in a field of foreigners’ surnames arises. Special attention is paid to analyze the right to name. In order to find out the main features of regulation of surnames, analysis of international, EU and national regulation is provided. This thesis analyses a case-law of the Court of Justice of the European Union (CJEU) and the European Court of Human Rights (ECtHR) in a field of surnames. Particular attention is paid to cases Sayn-Wittgenstein and Runevič-Vardyn recently examined by the CJEU that are not analyzed in the doctrine yet. The main conclusion of this thesis is that there is necessary to adopt legislation at the EU level that would be able to resolve problems of writing foreigners’' surnames in the host member state, because existing differences in this sphere can lead to violations of main freedoms and rights granted to EU citizens.

Inom en snar framtid kan effektiva behandlingsmetoder mot antisocial personlighetsstörning komma att bli tillgängliga för användning. I denna uppsats driver jag en tes om hur vi på ett etiskt försvarbart sätt skulle kunna använda dessa metoder. Tesen begränsar sig till (1) tvångsbehandling (2) av våldsamma återfallsbrottslingar (3) som diagnostiserats med antisocial personlighetsstörning och psykopati, samt till (4) behandlingsmetoder som klassificeras som kapacitetsförbättringar riktade mot moralisk kompetens. Jag argumenterar för att vi har starka skäl att godta tesen, främst med hänseende på fördelarna det skulle innebära för patienten, potentiella brottsoffer, och samhället i stort. Jag diskuterar också de två allvarligaste invändningarna mot min tes – att behandlingen hotar patientens autonomi, respektive personliga identitet – men konstaterar slutligen att de inte tycks kunna falsifiera tesen.
