This thesis examines the on-going anti-piracy and anti-file sharing measures taken by media conglomerates and big content as misguided attempts at addressing changing consumer expectations and social and technological norms. These measures include legislation such as the Stop Online Piracy Act (SOPA), Preventing Real Online Threats to Economic Creativity and Theft of Intellectual Property Act (PIPA), Anti-Counterfeiting Trade Agreement (ACTA), and Cyber Intelligence Sharing and Protection Act (CISPA); and litigation against both extremes of the spectrum: from the world's largest file sharing search engines like The Pirate Bay, and cyberlockers like MegaUpload, to private citizens who illegally downloaded a few movies or a few songs. The manner in which the entertainment industry's largest, most expensive, and highest-profile anti-piracy measures in the recent years have been received by groups from IT corporations to human rights organizations, researchers, politicians, legal and internet experts, and millions of citizens worldwide are of focus; and how this translates into an unpopular public image is explored. Piracy is underlined as a service and distribution problem, and various international studies are presented in exploring the relationship between illegal downloading and legal purchases.

Nous savons tous à quoi ressemble un pirate. Ce que nous savons moins, c'est la raison de ces succès, les causes de notre engouement - voire de notre fascination pour ce Fame Monster. La formule permet de caractériser l'ambiguïté d'un personnage dont chaque fortune connaît un revers, révélant notre soif de transgression et notre tentation pour l'envers de la morale. L'approche littéraire comparatiste, augmentée d'emprunts à l'image, à la sociologie, à la philosophie politique et à l'histoire des mentalités, permet non pas de simplement décrire un phénomène, mais d'essayer d'en extraire les sens, les besoins, les attentes, en prenant pour hypothèse que la fiction pirate constitue un jalon spécifique dans l'histoire des mentalités occidentales, et autorise l'exploration d'un état de nos désirs : d'aventure, de danger, de transgression, d'insurrection ; mais aussi de conformisme, dans un mythe continuellement répété. Histoire dans l'histoire, fiction en négatif, le pirate marginal se donne à lire comme une part retranchée de la société qui l'évacue, et partant comme l'idéal révélateur du sang et de l'or de nos virtualités, de nos " occasions manquées ".C'est ainsi que l'étude du pirate traditionnel conduit non seulement à une analyse du personnage mais encore aux enjeux fictionnels qu'il engage. Piraterie et piratage, ses deux corollaires directs, mettent en œuvre des problématiques particulières de création et de réception, et amorcent une reconversion sémantique du personnage : le pirate connaît une nouvelle fortune numérique, tandis que, devenu comportement par le truchement du piratage, il conduit à repenser le champ de la fiction. Alors : tous pirates ? Ou plutôt : tous (déjà) piratés ?

Diariamente uma batalha de grandes dimensões é travada em cidades espalhadas por todo o Brasil envolvendo, de um lado, milhares de estações de radiodifusão que operam clandestinamente (Rádios Piratas) e, de outro, órgãos responsáveis pela fiscalização e repressão da atividade ilegal. Os equipamentos irregularmente instalados, apreendidos nessas estações, são enviados aos laboratórios da criminalística para que sejam efetuados exames periciais, cumprindo o rito legal. Neste trabalho são abordados os aspectos forenses e periciais relativos ao tema realizando-se ainda uma análise técnica dos transmissores apreendidos pela Polícia Federal na Região Metropolitana de São Paulo quanto às suas características construtivas, potência e frequência permitindo uma avaliação quanto à potencialidade lesiva destes equipamentos, tomando como base informações extraídas de seiscentos e sessenta exames periciais do Departamento de Polícia Federal realizados pelo autor e por outros peritos criminais federais entre os anos de 2008 e 2011. / Daily, a battle of great proportions is engaged in cities throughout the country involving, on one hand, thousands of broadcasting stations illegally installed (Pirate Radios), and on the other, public entities in charge of monitoring and of the prosecution of such illegal activities. Improperly installed equipment are seized in these stations and sent to Criminalistics Laboratories of the Forensic Institutes for examination, thus fulfilling the legal requirements. The present dissertation deals with the forensic examination aspects of such seizures. The technical aspects of the transmission equipment arrested by the Brazilian Federal Police in the São Paulo Metropolitan Region were analyzed as to its various characteristics, such as workmanship involved, potency and frequency in order to evaluate among other things the potential damage caused by such equipment. The study was based on information obtained from six hundred and sixty forensic examination reports issued by the Forensic Examiners of the Brazilian Federal Police Department, including reports written by the author, between the years of 2008 through 2011.

Para estudar o comportamento de predação, fêmeas de O. insidiosus com idade entre 12-24h foram individualizadas em placas de Petri. Os testes foram conduzidos empregando-se as densidades de 2, 4, 8, 16 e 32 ninfas de A. gossypii para cada variedade de algodão. O período e a viabilidade ninfal de O. insidiosus foram semelhantes nas duas variedades. O número de ovos por fêmeas, viabilidade de ovos, longevidade de macho e fêmeas foram semelhantes nas duas variedades. O tempo de manipulação (h) e a taxa de ataque (h-1) foram respectivamente de 0,0697 (h) e 1, 1862 ( h-1) para a variedade Buriti e 0,0713 (h) e 0,3030 h-1 para NuOPAL. As variedades Buriti e NuOPAL não afetaram as características biológicas do período ninfal de O. insidiosus alimentado com A. gossypii porém prejudica significativamente o potencial reprodutivo do predador. This diploma thesis aims to identify the possible causes of the success of pirate parties in Iceland and the Czech Republic. The success is defined as entering the national parliaments. This was failed by pirate parties in Sweden and Germany despite their popularity. Thus, the work examines four political parties and four countries in which these parties are located. The purpose of the analysis is to find out what makes the successful parties different from the unsuccessful ones or what the successful parties have in common. The analysis is based on testing and measuring the factors contributing to the initial success of the new political parties and to the ability of maintaining their popularity. The theoretical framework for the electoral success of pirate parties is measured by factors that are derived primarily from the theory of the rise of new challenger parties by Airo Hino and from the concept of the organizational strength of political parties by Margit Tavits. The framework is expanded with additional indicators proposed by the author. I denna uppsats utreds dels om en Internetleverantör har ett medverkansansvar enligt BrB, när den i sin roll som mellanhand, via tjänsten Internetuppkoppling ger sina kunder tillgång till tjänster/webbsidor som används för att begå immaterialrättsintrång enligt gällande rätt, och dels huruvida det svenska rättsläget är förenligt med de direktiv som har utfärdats av EU på området.  I uppsatsen undersöks möjligheten till vitesförbud enligt 53 b § URL, i förhållande till lagstift-ning, förarbeten och EU-direktiv. Vidare undersöks både svensk praxis på området och ett för-handsavgörande från EU-domstolen. I ett försök att förstå gällande svensk rätt görs även en kortare jämförelse med dansk rätt, och dess domstolars möjlighet att utfärda vitesförbud mot Internetleverantörer. Utifrån bestämmelsen om vitesförbud i 53 b § URL torde det inte vara möjligt för en svensk domstol att utfärda ett vitesförbud mot en Internetleverantör som enbart tillhandahåller tjänsten Internetuppkoppling åt sina kunder. Det framkommer av de svenska förarbetena att det, för att utfärda ett sådant förbud, krävs både vetskap om intrången samt ett avtalsliknande förhållande mellan Internetleverantören och intrångsgöraren.  Vi kommer slutligen fram till att även om artikel 8.3 i Infosoc-direktivet kan anses ha imple-menterats på rätt sätt enligt dess ordalydelse är tillämpningen av 53 b § URL, i enlighet med förarbetena, i dagsläget sådan att den torde strida mot syftet med artikel 8.3. Det anser vi bör leda till att en direktivkonform tolkning av artikeln inte bara kan, utan även ska tillämpas av svensk domstol. Således kan, enligt oss, en Internetleverantör, genom att förbjudas medverka till intrång, åläggas att blockera sina kunders tillgång till tjänster/webbsidor som används för att begå immaterialrättsintrång enligt 53 b § URL även i de fall där leverantörerna endast med-verkar genom att tillhandahålla tjänsten Internetuppkoppling.
