Le présent mémoire s’intéresse à la déstabilisation d’un réseau de distribution de stupéfiants. Il est basé sur l’étude d’une enquête policière réalisée dans une grande ville canadienne. L’objectif principal de cette enquête était le démantèlement d’un réseau criminel perçu comme étant hiérarchisé. Différentes stratégies ont été mises en œuvre par les enquêteurs afin de déstabiliser le réseau. Cinq de ces stratégies sont étudiées dans cette recherche. Des analyses de réseaux et l’évaluation de l’évolution des opérations de distribution de stupéfiants démontrent que, parmi les stratégies déstabilisatrices, le retrait sélectif (arrestation) et l’ajout (infiltration) de participants dans le réseau sont les plus efficaces. Les résultats détaillés montrent l’importance de préparer des enquêtes systématiques et réfléchies en vue de déstabiliser un réseau. Bien que les rafles massives de participants soient intéressantes, il est essentiel d’en soulever les limites. Le fait de se concentrer sur des enquêtes planifiées permettra non seulement de répondre aux objectifs de l’enquête en cours, mais également de comprendre et développer des pratiques de déstabilisation à long terme au niveau du marché criminel en général (méta-réseau). / This research focuses on the disruption of a drug distribution network and is based on a case study of a law-enforcement investigation conducted in a major Canadian city. The aim of the investigation was to dismantle a criminal network that was perceived to be hierarchically structured. Different strategies were applied by the investigating team to disrupt the network. Five of these strategies are studied in the present research. Network analyses and an assessment of the evolution of the drug distribution operation demonstrate that, amongst the set of disrupting strategies, those aimed at the selective removal (arrests) and addition (infiltration) of actors to the network were most effective. The details surrounding such findings highlight the importance of preparing well-planned and systematic investigations following such guidelines, while also pointing to the limits of massive crackdowns that lead to the arrests of all participants in a criminal network. Conceiving such a focus will not only meet the short-term objectives of a police investigation, but also allow for an understanding that is crucial to develop long-term disruptive practices of not simply the operation under investigation but the wider criminal network environment surrounding it.

L’étude scientifique des réseaux criminels démontre, de plus en plus, que leur structure est flexible et dynamique et que la thèse du contrôle ou de la centralisation des marchés criminels est discutable. Pourtant, devant la présence d’une organisation criminelle dite «traditionnelle» dans un marché criminel, autant la population que les milieux médiatiques, politiques, policiers et judiciaires, peuvent percevoir le marché comme étant contrôlé par cette organisation. Le fait de surévaluer la menace réelle de certains groupes criminels et de considérer que la centralisation des marchés criminels existent au détriment de la collaboration entre différents individus et groupes d’un réseau, peut notamment influencer les stratégies policières. D’une part, les autorités policières peuvent orienter leurs stratégies en tenant pour acquis que la structure dont s’est doté une présumée organisation criminelle se transpose dans le marché criminel dans lequel ses membres opèrent. D’autre part, cette organisation devient la première cible des autorités et les autres participants du réseau se voient accorder une moins grande importance dans les activités du marché. La recherche qui suit présente les résultats d’une analyse de réseau effectuée à partir des transcriptions de surveillances électroniques et physiques issues d’une importante opération policière visant la lutte aux motards criminalisés : l’opération Printemps 2001. À l’aide de ces données, un réseau de 349 individus a été créé. Bien que la cible principale de l’opération policière ait été l’organisation des Hell’s Angels, plus précisément, le chapitre Nomads et son club-école, les Rockers, d’autres groupes et d’autres individus ont été interceptés par les surveillances policières. Il ressort des analyses de la position occupée par l’ensemble des groupes et des individus identifiés, que les principales cibles des autorités policières n’étaient pas celles qui occupaient les positions les plus stratégiques pour être influentes et durer dans la portion du marché ciblée par l’opération. / The scientific study of criminal networks reveals that their structure is flexible and dynamic and that the thesis supporting the control or the centralization of the criminal markets are at the least debatable. Nevertheless when a «traditional» criminal organization is active in a criminal market, the people, the media, the politicians, the police force and the judiciary tend to perceive that the market is under the control of that organization. In over-evaluating the real threat posed by certain criminal groups and in considering that there is a centralization of the criminal markets held by a known criminal organization, police strategy is biased and underscores the importance and influence of other individuals or groups of persons within the criminal market. Police strategy is then oriented in thinking that the structure of a criminal organization is transposed in the criminal market wherein its members operate. Consequently, the organization becomes the main target of the authorities and giving less attention to the other actors in the activities of the market. The following research paper presents the results of a network analysis taking its main sources from transcripts of electronic and physical surveillance collected during an important police operation against criminal bikers in the Province of Québec, Canada, and known as Operation Springtime 2001. From these transcripts, a network of 349 individuals was created. Though, the Hells Angels organization and more precisely the Nomads Chapter and its farm team, the Rockers, were the main targets of the police operation, other groups and individuals were also intercepted by police surveillance. After analysis of the position occupied by all the groups and individual that were identified it became apparent that the main target of the police authorities were not those who held the most strategic positions to exercise influence and last in the market under examination by the operation Operation Springtime 2001.

Previous issue date: 2013-10-18 / The scientific work aims to produce knowledge. This is not put into question. Although what is the purpose of that work, or if there is any purpose at all, is a question that must be made ex ante any task. The answer resounds: all knowledge must be turned to the instrument, technology in order to improve people's lives. In legal terms, this should be put in technical terms: improving justice, democracy, human dignity, certainty. However, these basic elements - justice, democracy, human dignity, certainty - have great fluidity, which does not allow them to extract a precise meaning. Same phenomenon occurs in the large themes: people, society, State, Law, State of Law, and Democracy. Witch shall be studied in Unitarian philosophical view of the world. Therefore it is necessary to introduce certain methodological warnings, and it explains the option for analyzing these institutes under the attributes of form and function, starting from abstractions up to very precise and contextualized content of those institutes; in order to propose solutions for fighting crime in a democratic way, especially organized crime. A resposta ressoa: todo conhecimento deve ser voltado a dar
instrumento, tecnologia para melhorar a vida das pessoas. Em Direito, põe-se
em termos técnicos: é assistir a justiça, a democracia, a dignidade
humana, segurança. Contudo, estes elementos básicos --justiça,
democracia, dignidade da pessoa humana, segurança-- possuem grande
fluidez, que não permite extrair-lhes um significado preciso. Fenômeno que
se verifica nos grandes temas: pessoa, sociedade, Estado, Direito, Estado de
Direito, Democracia. Sempre tomando visão unitarista de mundo.
Por isso, necessário introduzir advertências metodológicas, e a opção
por analisar estes institutos sob sua forma e função, para chegar-se, de
abstrações até conteúdos muito precisos e contextualizados. E ao fim
propor solução para combate democrático à criminalidade atual, em
especial a organizada. E assim estudar as possibilidades de negociação no
inquérito policial, principal meio de investigação no Direito Processual
Penal Brasileiro

The focus of this thesis is on Advance Fee Fraud (419 scams) on how it is executed and more importantly, on how it can be prevented. The research addresses the origins of AFF, the nature and extent of this crime and how the perpetrators are able to defraud their victims. The research described, examined and analysed the crimes, the perpetrators, the victims, adjudication and the prevention strategies of this fraud. Information was gathered through literature and empirical research. A qualitative research method was used to gather information from AFF offenders who were incarcerated in South African prisons in 2005. The results of the empirical research were carefully examined, analyzed and integrated into the various chapters of this thesis. A theoretical framework was also developed in an attempt to explain this complex phenomenon. The findings and recommendations in terms of the crimes, the criminals, the victims, adjudication and prevention were also made and some suggestions for further research thereof were also cited. / Criminology / D. La personne qui a osé porter atteinte à une valeur pénalement protégée par la société mérite-t-elle, de la part de celle-ci une quelconque défense? Pendant longtemps, cette défense a fait l'objet de controverses, si certains y étaient favorables, d'autres y étaient résolument hostiles. Le compromis a consisté à refuser les droits de la défense dans l'enquête policière en adoptant un système inquisitoire et à les consacrer largement dans la phase de jugement avec un système accusatoire. Cette mixité de la procédure semble a priori répondre aux intérêts antagonistes au cœur de la procédure pénale. Mais, à l’aune des droits fondamentaux et sous l’influence des dispositions internationales et européennes, cette conception de la procédure devient inadaptée. Les droits de la défense, droits du procès équitable, ne doivent plus faire l’objet de limitations, ils doivent gouverner toute la procédure, de l’enquête policière jusqu’à la phase de jugement. Comment des droits qui ne s’appliquaient initialement que devant une juridiction indépendante et impartiale vont-ils faire irruption dans l’enquête policière sans l’existence d’un juge présentant des garanties équivalentes à celles de la juridiction de jugement ?Si le législateur a d’abord introduit les droits de la défense dans la phase de l’instruction pénale, le déclin de cette dernière au profit de l’enquête policière devrait le pousser à procéder à leur extension. C’est ce qu’il a d’ailleurs commencé à faire, mais de manière timorée. L’effectivité des droits de la défense dans l’enquête policière nécessite non seulement de procéder à leur élargissement, mais aussi de mettre en place un juge indépendant et impartial chargé de garantir leur pleine application comme dans la phase de jugement. Une juridictionnalisation de l’enquête policière est aujourd’hui un impératif. / Did the person who dared to infringe a value criminally protected by the society deserve any defense from that latter? This defence has been controversial for a long time, while some have been in favor, others have been resolutely hostile. The compromise consisted in refusing the rights of the defense in the police investigation by adopting an inquisitorial system and devoting them largely in the judgment phase with an adversarial system. This diversity of the procedure seems a priori to answer the conflicting interests at the heart of the criminal proceedings. But in the light of fundamental rights and under the influence of international and European provisions, this conception of procedure becomes inappropriate. The rights of the defense, as well as the rights to fair trial must no longer be limited, they must govern the entire procedure from the police investigation to the trial stage. How would rights that initially applied only before an independent and impartial jurisdiction break into the police investigation without the existence of a judge providing guarantees equivalent to those of the trial court? If the legislator first introduced the rights of defense in the criminal investigation phase, the decline of the latter in favor of the police investigation should push him to extend them. In fact, this is what he has started to do, but in a timorous way. Not only does the effectiveness of the rights of the defense in the police investigation require to be enlarged, but it also allows putting in place an independent and impartial judge responsible for ensuring their full implementation as in the trial stage. A jurisdictionalization of the police investigation is now a requirement.
