In this article, the author makes a critical analysis of the political regime in the 1993 Constitution. He begins analyzing the institution of the Presidency of the Republic, along with its vices and defects, criticizing the concentration of power in the figure of the President and the authoritarian management of his attributions, characteristics that are meaningless in a republic system. Thus, he concludes with a new vision of the figure of the President of the Republic and his attributions in order to achieve an improvement in the functioning and efficiency of the State, without affecting the democratic balance. / En el presente artículo, el autor realiza un análisis crítico del régimen político en la Constitución de 1993. Comienza analizando la institución de la presidencia de la República, junto con sus vicios y defectos, criticando así la concentración de poder en la figura del Presidente y el manejo autoritario de sus atribuciones, características que carecen de sentido en un Sistema Republicano. Así concluye con una nueva visión de la figura del Presidente de la República y sus atribuciones para lograr una mejora en el funcionamiento y eficiencia del Estado, sin afectar el equilibrio democrático.

A rebours des idées reçues, nous postulons que l’intervention de l’Élysée en matière de lutte antiterroriste s’avère peu prégnante, le caractère exceptionnel de l’implication mitterrandienne parasitant souvent le jugement. Quels que soient les facteurs et paramètres d’une intervention, la personnalité du Président de la République décide du périmètre de son rôle qui ne saurait empiéter sur les attributions du ministre de l’Intérieur, s’affranchir d’une configuration institutionnelle et politique. En outre, dans le cas de l’ingérence mitterrandienne, si l’entourage a eu une forte incidence sur l’action gouvernementale en matière de lutte antiterroriste, il représente une indéniable exception. D’une manière générale, il apparaît que l’influence des conseillers sur le Président de la République est occasionnelle, discontinue mais réelle. En sus, les conseillers n’exercent ni pouvoir ni autorité en dehors de la volonté du Président de la République et sont privés de tout relais administratif. / Far from common sense, we hypothesize that the intervention of French presidency of Republic in the counter-terrorism policy is very slight. Very often, the example of François Mitterrand’s presidency confuses the judgment, although it turns out to be exceptional (with regard to President’s powers or his entourage’s powers).What ever are the causes or the parameters of an intervention, the President’s personality is decisive; this factor sets the sphere of presidential operation which cannot encroach on the sphere of the Homeland security secretary because of an institutional and politic configuration. Moreover, the presidential entourage’s influence seems to be occasional, intermittent but real. This entourage doesn’t exercise neither power, nor influence outside limits of President’s will, all the more so as it doesn’t have any administration to obey its possible orders.

Les doctrines institutionnelles des Responsables Politiques Français vis à vis de la notion de Cohabitation au cours de la 5ème République : 1958-2017 / The institutional doctrines of the French political officials with respect to the concept of cohabitation during the 5th Republic : 1958-2017

La thèse retrace les nombreuses positions des responsables politiques français vis à vis de la notion de cohabitation au cours des années 1958-2017 et met en évidence leurs contradictions institutionnelles qui se révèlent en fonction de situations et de circonstances politiques données. Elle souligne ainsi les nombreuses divergences institutionnelles de la droite sur le sujet : le refus cohabitationniste du régime Gaullien et Pompidolien, le consentement Giscardien de 1978, la division au sein-même de la droite au cours des années Mitterrand entre 1981 et 1995, l'union dans la dénonciation au cours du premier mandat de Jacques Chirac entre 1995 et 2002 et enfin une succession de contradictions au cours des années 2002-2017. La thèse relève aussi certaines divergences institutionnelles du côté de la gauche socialiste : une volonté cohabitationniste au cours des années 1958-1981, une sérieuse réserve au cours des années 1981-1986 puis 1988-1993, une satisfaction cohabitationniste au cours des années 1997-2002 et également une succession de contradictions au cours des années 2002-2017. La thèse montre donc la manière dont les responsables politiques ont fait évoluer leurs doctrines institutionnelles en fonction de situations et de circonstances politiques données et cherche aussi à expliquer leurs nombreuses stratégies personnelles et leurs réflexions institutionnelles vis à vis de la cohabitation. / The thesis recalls the many positions of the French political officials with respect to the concept of cohabitation during years 1958-2017 and highlights their institutional contradictions which appear according to situations and political circumstances given. It thus emphasizes the many institutional divergences of the right-hand side on the subject : the cohabitationnist refusal of the Gaullist and Pompidolian regims, the Giscardian assent of 1978, the division within the right during Mitterrand years between 1981 and 1995, the union in the denunciation during the first mandate of Jacques Chirac between 1995 and 2002 and finally a succession of contradictions during years 2002-2017. The thesis also records certain institutional divergences on the side of the socialist left : a cohabitationnist will during years 1958-1981, a serious reserve during years 1981-1986 then 1988-1993, a cohabitationnist satisfaction during years 1997-2002 and also a succession of contradictions during years 2002-2017. The thesis shows so the way in which the political leaders have evolved their institutional doctrines according to situations and political circumstances given and also tries to explain their numerous personal strategies and their institutional reflections with respect to the cohabitation.

Dopady přímé volby prezidenta na charakter politického režimu ČR / Consequences of the direct presidential elections for the Czech political regime

Primary aim of this thesis is to describe the effects of direct elections on the nature of the political regime in the Czech Republic. Specifically, author focus on the distinctive attributes of various forms of government, which are then applied to the current state regime in the Czech Republic after the introduction of direct presidential elections and whether it effectively means a transition from parliamentary to semi-presidential regime. Historical analysis of the presidential office in the Czech countries describes the phenomenon of its extraordinary role and respectability, which is reflected in the contemporary political realities and have a major influence on the functioning of the state. Theoretical analysis deals with impacts introduction of the direct presidential election had on the constitutional order of the Czech Republic and disproves various arguments, which once lead to its legislative implementation. Using a descriptive analysis of the behaviour of the first directly elected president Miloš Zeman, author tries to unveil actual jurisdictional disputes between him and other elements of power.
