A war on the marginalised : The legitimisation and inevitability of the protection of privilege through an analysis of the Police, Crime, Sentencing and Courts Bill (PCSC), the Nationality and Borders Bill (NB), and the institutions that enable them

Higgins, Mia January 2022 (has links)
This article explores the declining state of and increasing threat to human rights in the UK, through an analysis of the Police, Crime, Sentencing and Courts Bill (PCSC) and the Nationality and Borders Bill (NB). It focusses on the ostracisation, demonisation and criminalisation of marginalised groups, and how this has been achieved through a regime of right-wing populism, capitalising on crises within the elite to direct public anger at economic suffering and perceived erosion of social values towards the most marginalised in society by proposing that they are favoured by the elite over 'the people'. This has created an ‘other’ of many minorities, allowing them to be more easily dehumanised and their human rights to be more easily eroded, legitimised by exploiting or manufacturing crises such as austerity, an immigration crisis and the COVID-19 pandemic. Victims include asylum seekers, refugees, protesters, human rights defenders, black communities, Gypsies, Roma and Travellers. The article argues that due to the intersectionality of oppression, other marginalised groups are indirectly impacted, as the bills are part of a wider aim to transfer power from marginalised to privileged groups, a move that impacts most citizens negatively by further concentrating power at the top. The creation of an ‘other’ has succeeded in dividing groups oppressed by the same systems and pitting them against each other to ensure that the systems and institutions that oppress flourish, while simultaneously reducing government accountability. An analysis of the media and police will reveal how they uphold and enable institutional discrimination, how they have legitimised these bills, and how the failure of successive governments to reform these institutions has resulted in the inevitability of these bills with media functioning as an enabler and the police as an enforcer of institutional oppression. The transferral of powers to the police, while simultaneously delegitimising regulators, ensures human rights are threatened on multiple levels through legislation, implementation, and accountability.

Essays on Social Class Origins in Entrepreneurship

Oh, Jean Joohyun January 2024 (has links)
Entrepreneurship is often touted as a key avenue for upward mobility. However, it is also a context that highlights the profound impact of underlying privileges, such as family wealth and social capital associated with higher social class origins. This dissertation consists of three empirical essays studying the impact of social class origins on entrepreneurial entry and outcomes. Chapter 1 documents the magnitude of the social class advantage in being an entrepreneur and investigates mechanisms in terms of human, cultural, and entrepreneurial capital. Chapter 2 examines how investors’ interest in a startup varies by the social class origins of the founder and the investor themselves, using a lab-in-the-field experiment on angel and venture capital investors. Chapter 3 studies the venture capital funding gap between founders from privileged backgrounds and others, using large-scale observational data on startup founders "at risk" for venture funding.

Privileged Communication and Sex Offenders in Florida

Mathews, Meryl 01 January 2006 (has links)
The history of privileged communication and the evolvement of the psychotherapist-patient privilege are explored. The psychotherapist-patient relationship is a relatively modern relationship. New laws concerning child abuse and neglect, and the reporting requirements of child sex offenders have begun to shape the application of privileged communication within the psychotherapist-patient. These laws exist at the federal level and throughout each of the fifty states. The effects of abrogating privileged communication for child sex offenders in the psychotherapist relationship are explored. Withdrawal of the privilege creates distrust and hinders open communication within this relationship and prevents sex offenders from receiving needed treatment. The effectiveness of treatment to sex offenders, and particularly child sex offenders, by a psychotherapist is explored. The research shows that those treated by a psychotherapist have a lower recidivism rate than those who do not receive treatment. Recommendations include a change in current federal and Florida state laws that will allow sex offenders to receive proper treatment by a psychotherapist while still protecting children from harm

Toegang tot getuieverklarings in strafsake

Struwig, Petrus Johannes Dirkse 11 1900 (has links)
Summaries in English and Afrikaans / Text in Afrikaans / In the past, witness statements obtained by or on behalf of a party to a criminal case were protected, from disclosure to the opponent, by privilege. The purpose of this dissertation is to investigate whether such claims to privilege are justified and whether openness before and during the trial is not perhaps more important to the interests of justice. The disclosure of witness statements to the defence is a commonly recognized practice all over the world. This practice enhances openness before and during the criminal trial. The arguments against and in favor of such a practice are many, but investigation into these has shown that it is in the interests of justice to disclose such statements to the defence, rather than to deny access. Furthermore, the writer investigates whether it would be in the interests of justice to compel the defence to assist the court in determining the truth. / Law / LL.M.

Research on parliamentary privilege concurrently discuss Chinese National People's congressional privilege

Yi, Weizhong 23 September 2009 (has links)
This thesis analyses parliamentary privilege. The privilege is an ancient parliamentary power. All of countries that have democratized or will soon have democratized provide them by own constitution. The purpose of the parliamentary privilege is to permit members of the legislature to speech freely and express their opinion of political position, and not worry about retaliation on the basis of political motives. The Parliament formulates itself its own rules of procedure and maintains the discipline of parliament itself and so on, in order to ensure that the parliament can independently, freely discharge of its duties and perform its functions. Parliamentary privilege, however, is often misunderstood by popular who believes that the privilege is the special protection of all of the elites of society. That is ironic, because privilege was originally produced as a whole of the protection of Parliament, and it protected members of parliament from the elites at that time. It may be said that parliamentary privilege is a special institutional arrangements based on the principles of democracy. Compared with other parliamentary powers, it is special because it is the defensive power of Parliament rather than an offensive power which the parliament must proactively exercise. After studying on the foundation in the theory of parliamentary privilege, the paper comprehensively discusses on the main elements of parliamentary privilege, the problems at the practice of parliamentary privilege and the development of privilege. Finally, it is to argument how to improve and perfect the relevant privilege systems of Chinese National People’s Congress.

I am white, therefore I am : A phenomenological study of whiteness as experienced by white women in relation to Others within a travel context

van Schaik, Valerie January 2022 (has links)
This thesis provides a complex understanding of the phenomenological experience of whiteness as a racial category. Based on theories of critical whiteness studies, intersectionality and (white) phenomenology, I conducted five semi-structured interviews with five white women about their understandings of their whiteness within a context of transnational travel. The interviews have been interpreted using thematic analysis, with the aim to show that whiteness is inherently relational and contextual, always in conjunction with Others and in interplay with the spatial context, while at the same time intrinsically related to other intersectional parts of the self. By making use of autoethnography as a methodology, my situated knowledge as a researcher was integrated within the entire thesis. The study has shown that whiteness never stands alone but is inherently relational, not only with racialized Others, but also with other intersections such as womanhood, which complexifies the experience and understanding of it. Moreover, whiteness is perceived as the most normalized standard from which everything different and other is measured by, while it serves as an invisible social category that can move through the world unnoticed. Consequently, the normality of whiteness creates a feeling of reassurance and comfort and thus keeps it in its place as the most normalized social category from which the world unfolds.

Essential amino acid depletion by embryonic stem cells as a mechanism of immune privilege

Ichiryu, Naoki January 2013 (has links)
Mouse embryonic stem cells (ESCs) are capable of differentiating into any somatic cell type and are known to display fragile immune privilege in vivo and in vitro. The extent to which the depletion of essential amino acids (EAAs) by ESCs contributes to this phenomenon was investigated. ESCs were found to express various enzymes capable of catabolising EAAs within the culture medium. In particular, depletion of threonine, valine and lysine was found to have significant impact on T cell proliferation and differentiation, biasing their polarisation towards a FoxP3+ T regulatory (Treg) phenotype. Supplementing ESC conditioned medium with these three EAAs alone rescued normal T cell proliferation, whereas artificially limiting their availability was sufficient to induce Treg cell differentiation to a level equivalent to general EAA depletion. The pattern of EAA catabolism by mouse ESC was shared by induced pluripotent stem cells, while mouse melanoma cell lines and human ESCs displayed distinct patterns of EAA depletion. The cytosolic branched chain aminotransferase enzyme, Bcat1, catalyses the first step of branched chain amino acid catabolism (isoleucine, leucine and valine), and is highly expressed by both mouse and human ESCs. The contribution of this enzyme to the establishment of acquired immune privilege by ESC-derived tissues was, therefore, investigated. ESC lines were derived from mice lacking Bcat1 activity and were characterised. Bcat1−/− ESC lines displayed no difference to their wildtype counterparts (Bcat1LoxP) in terms of in vitro proliferation and their capacity to form teratomas in vivo. Furthermore, the loss of Bcat1 function had little impact on the inhibition of T cell proliferation in culture, ability to induce Treg cell commitment or their ability to prevent rejection by T cell receptor transgenic recipients, suggesting the minimal contribution of Bcat1 to the depletion of EAAs by ESCs. In conclusion, EAA depletion by mouse ESC may provide a mechanistic explanation for the previously described immune-suppressive capacity of ESC.
