Nesse sentido, o Direito não se encontra pronto e acabado, especialmente em países de tradição legiferante como o Brasil, mas se faz renovado a cada dia, com a implementação de novas normas nos mais variados assuntos. No presente trabalho veremos um estudo das recentes alterações legislativas ocorridas no Direito Processual Civil e seus principais reflexos no Direito Processual do Trabalho, através da análise crítica das Leis n.º 10.352/01, n.º 10.358/01, n.º 10.444/02, n.º 11.187/05, n.º 11.232/05, n.º 11.276/06, n.º 11.277/06, n.º 11.280/06 e n.º 11.382/06. No primeiro capítulo, deste estudo, tem-se uma abordagem sobre os princípios e fontes do direito do trabalho como premissas hermenêuticas a nortear e fundamentar os demais capítulos da pesquisa. Na seqüência, encontra-se um capítulo que trata do ordenamento jurídico de maneira genérica, sua autonomia, a noção de sistema e a relação existente entre as disciplinas estudadas; de forma especifica verifica-se a abordagem de questões hermenêuticas, para fundamentação e aplicação das normas do processo civil ao processo do trabalho. Superados as questões propedêuticas dos primeiros capítulos, passa-se a explorar especificamente as alterações efetuadas no Direito Processual Civil, procurando de forma prática e conclusiva demonstrar sua co-relação e eventual utilização no Direito Processual do Trabalho. O estudo nesse capítulo é complementado com referências jurisprudenciais a fim de confrontar o entendimento empossado com a tendência do judiciário ao decidir o caso concreto. O desenvolvimento da presente pesquisa, não procura atender a um único objetivo, mas de maneira geral... / The Law is a science in a constant evolution and adaptation to the social cravings in a certain place and in a certain historic moment, because of that we can say we are talking about a science under construction. With that meaning, the Law is not ready and done, especially in countries of legislative tradition like Brazil, but it is renewed at every single day with implementation of new norms about the most varied subjects. This paper shows a study of the recent legislative alterations occurred in the Civil Procedural Law and its main reflexes in the Work Procedure Law through the critical analysis of the Laws nº 10.352/01, nº 10.358/01, nº 10.444/02, nº 11.187/05, nº 11.232/05, nº 11.276/06, nº 11.277/06, nº 11.280/06 and nº 11.382/06. In the study performed in the first chapter, there is an approach about the principles and sources of the labor law as hermeneutic premises to lead and ground the other chapters of the research. In the sequence, there is a chapter about the legal system in a generic way, its autonomy, the notion of system and the relation found in the studied disciplines; in a specific way, an approach of hermeneutic matters is checked to foundation and implementation of the norms of the civil procedure to the labor procedure. Solved the propaedeutic matters of the first chapters, an exploration, specifically in the alterations performed in the Civil Procedural Law, starts to be done; trying to show, in a practical and conclusive way, its correlation and possible use in the Work Procedural Law. The study in this chapter is concluded with jurisprudential references in order to confront the understanding installed with the tendency of the judiciary when deciding the concrete case. Cette thèse (qui a pour intitulé "Représentation, modélisation et génération procédurale de terrains") a pour cadre la génération de contenus numériques destinés aux films et aux jeux-vidéos, en particulier les scènes naturelles. Nos travaux visent à représenter et à générer des terrains. Nous proposons, en particulier, un nouveau modèle de représentation qui s'appuie sur un arbre de construction et qui va permettre à l'utilisateur de manipuler des morceaux de terrain de façon intuitive. Nous présentons également des techniques pour visualiser ce modèle avec un maximum d'efficacité. Enfin nous développons un nouvel algorithme de génération de terrains qui construit de très grands reliefs possédant des structures hiérarchiques découlant d'un réseau hydrographique : le relief généré est conforme aux grands principes d'écoulement des eaux sans avoir besoin d'utiliser de coûteuses simulations d'érosion hydrique. / This PhD (entitled "Representation, modelisation and procedural generation of terrains") is related to movie and videogames digital content creation, especially natural scenes.Our work is dedicated to handle and to generate landscapes efficently. We propose a new model based on a construction tree inside which the user can handle parts of the terrain intuitively. We also present techniques to efficently visualize such model. Finally, we present a new algorithm for generating large-scale terrains exhibiting hierarchical structures based on their hydrographic networks: elevation is generated in a broad compliance to water-tansport principles without having to resort on costly hydraulic simulations.

O controle abstrato de constitucionalidade sob o enfoque dos princípios processuais / The abstract constitutionality control enlightened by the procedural principlesCarlos Roberto de Alckmin Dutra 31 May 2010 (has links)
Este estudo volta-se a averiguar a possibilidade de aplicação dos princípios constitucionais e gerais do processo ao controle abstrato de constitucionalidade (aqui abrangidas tanto as ações direta de inconstitucionalidade, como a declaratória de constitucionalidade e, ainda, a arguição de descumprimento de preceito fundamental), bem como a verificar em que medida a especialidade do processo objetivo de controle de constitucionalidade permite, ou não, a aplicação dos princípios gerais do processo e, ainda, a expor que, algumas vezes, as particularidades do processo do controle abstrato resultam na conformação de princípios próprios, diversos daqueles que informam os processos de índole subjetiva. Após uma introdução que busca trazer a lume as origens históricas do controle de constitucionalidade, apresentando o surgimento dos dois modelos de controle repressivo existentes (quais sejam, o norteamericano e o austríaco), bem como a conformação histórica e atual do sistema brasileiro, passa-se à análise dos princípios processuais à luz dos princípios constitucionais fixados na Constituição Federal de 1988. A abordagem é feita mediante o estudo de cada um dos princípios processuais aplicáveis, quais sejam: os princípios da especialidade; do juiz natural e da reserva de plenário; da ação ou demanda; da congruência; da especificação das normas; da causa de pedir aberta; da subsidiariedade; da livre investigação das provas; da indisponibilidade; do contraditório; da publicidade; da motivação e fundamentação das decisões; da irrecorribilidade; e da irrescindibilidade. O estudo é realizado mediante a análise tanto dos posicionamentos da doutrina como das decisões do Supremo Tribunal Federal que exploram mais diretamente o tema da aplicação dos princípios processuais em questão. Ao final, conclui-se que as normas processuais de índole constitucional têm, ao menos em princípio, aplicação no processo de controle de constitucionalidade, bem como que, em decorrência da natureza jurisdicional do processo de controle abstrato, a aplicação de determinados princípios gerais do processo traria inegáveis benefícios, maior segurança e clareza ao processo do controle de constitucionalidade. / This study aims at checking the possibility of applying the constitutional and general principles of judicial proceedings to the abstract constitutionality control (i.e., judicial reviews covering direct unconstitutionality actions, as well as declaratory proceedings of constitutionality, and fundamental precept violation actions), as well as to check to what extent the specialty of the objective control of constitutionality actions permit, or do not permit, the application of general principles of the judicial proceedings and still, to expose that, sometimes, the peculiarities of the abstract control result in conformation of peculiar principles, different from those that inform legal actions of subjective character. After an introduction that aims at enlightening the historical origins of constitutionality control (judicial review), presenting the creation of two existing repressive control models (i.e., North-American and Austrian models), as well as the historical and present configuration of the Brazilian system, an analysis of the procedural principles is made facing the constitutional principles established in the Brazilian Federal Constitution of 1988. The approach is made by studying each one of the applicable procedural principles, such as: specialty principle, natural judge principle and full bench principle; as well as principles of legal actions or claims; congruence; specification or norms; open cause of action; subsidiary rights; free investigation of evidence or proof; inalienability; contradictory; publicity; motivation and recital of decisions, refuse to appeal; and irrevocability. This study is carried out by analysing both the doctrines opinion as well as the decisions of the Brazilian Federal Supreme Court that exploit more directly the theme of procedural principles application being studied. Finally, it is concluded that the procedural norms of constitutional character at least have as a principle their application in the constitutionality control action, as well as that as a result of the jurisdictional nature of the concentrated control action, the application of certain general principles of the proceedings would bring undeniable benefits, greater safety and clearness to the constitutional control actions.

Syftet med föreliggande studie var att undersöka arbetstagares upplevelser av organisatorisk osäkerhet, procedural rättvisa och organisationsidentitet vid en potentiell organisationsförändring. Den potentiella organisationsförändringen skulle innebära en separering av ett affärsområde från resterande koncernen. Studien baserades på en kvalitativ metod med deduktiv ansats. Datainsamling bestod av semistrukturerade intervjuer med sju anställda från det affärsområde som eventuellt skulle beröras av organisationsförändringen. Det insamlade materialet analyserades genom en deduktiv tematisk analys med utgångspunkt i fyra förutbestämda teman; organisatorisk osäkerhet, procedural rättvisa, emotionell organisationsidentitet och kognitiv organisationsidentitet. Respondenterna uppvisade olika uppfattningar av organisatorisk osäkerhet utifrån olika upplevelser av aspekter relaterade till procedural rättvisa som informationstillgång, inflytande i beslutsprocessen samt möjligheter att uttrycka tankar och känslor avseende förändringsprocessen. Respondenterna gav vidare ambivalenta uttryck för organisatorisk stolthet, anseende samt engagemang gällande deras emotionella organisationsidentitet. De gav uttryck för en tydlig identifikation med organisationen men däremot en mer ambivalent assimilering och inkorporering med/av organisationen gällande deras kognitiva organisationsidentitet. / The aim of the present study was to examine employees’ perceptions of organizational uncertainty, procedural justice and organizational identity in the event of a potential organizational change. The potential organizational change would result in a separation of a business area from the remaining company. The study was based on a qualitative method with a deductive approach. The data collection consisted of semi-structured interviews with seven employees from the business area who might be affected by the organizational change. The collected material was analyzed through a deductive thematic analysis based on four predetermined themes; organizational uncertainty, procedural justice, emotional organizational identity and cognitive organizational identity. The respondents expressed different perceptions of organizational uncertainty based on different experiences of aspects related to procedural justice such as information access, influence in the decision-making process and opportunities to express thoughts and feelings about the change process. The respondents also expressed ambivalent expressions of organizational pride, esteem and affective commitment regarded their emotional organizational identity. They expressed a distinct identification with the organization but a more ambivalent assimilation and incorporation with the organization regarding their cognitive organizational identity.

Procedural Natural Texture Generation on a Global ScalePohl Lundgren, Anna January 2023 (has links)
This Master’s thesis investigates the application of dynamically generated procedural terrain textures for texturing 3D representations of the Earth’s surface. The study explores techniques to overcome limitations of the currently most common method – projecting satellite imagery onto the mesh – such as insufficient resolution for close-up views and challenges in accommodating external lighting models. Textures for sand, rock and grass were generated procedurally on the GPU. Aliasing was prevented using a clamping technique, dynamically changing the level of detail when freely navigating across diverse landscapes. The general color of each terrain type was extracted from the satellite images, guided by land cover rasters, in a process where shadows were eliminated using HSV color space conversion and filtering. The procedurally generated textures provide significantly more details than the satellite images in close-up views, while missing some information in medium- to far-distance views, due to the satellite images containing information lacking in the 3D mesh. A qualitative analysis spanning six data sets from diverse global locations demonstrates that the proposed methods are applicable across a range of landscapes and climates.

Video games often include various creatures within their games, these creatures often give the world in which they inhabit a richer experience for the player. Creating these creatures can be costly, to lower these costs procedural content generated creatures could be used instead. Creatures created with PCG will have a lower upfront cost but comes with the downside of less control without a large amount of testing. This is a problem, what we have tried to do is lessening the amount of time needed to achieve the desired level of perfection. In this paper we have tried to find patterns which will further help the use of procedural content generated creatures. The game Forest Moon will be introduced to gather data and to find pattern of how players interact from various visual cues. With the data we have gained further understanding on how players react and what kind of emotions they feel when certain visual cues are presented.

Dyslexi är en form av läs- och skrivsvårighet som inte kan förklaras av t.ex. bristfällig undervisning, låg begåvning eller synproblem. Orsaken till dyslexi anses vanligen vara nedsatt förmåga av fonologiskt processande. Flera studier har dock visat att dyslexi även är förknippat med språkliga, kognitiva och motoriska svårigheter som inte kan förklaras av nedsatt förmåga av fonologiskt processande. Det procedurella minnessystemet engageras vid inlärning, processande och konsolidering av kognitiva och motoriska färdigheter. Enligt the procedural deficit hypothesis (PDH) orsakas de svårigheter förekommande vid dyslexi av en nedsättning i detta minnessystem. Forskningen inom området är inte entydig då det har rapporterats om både intakt och nedsatt procedurellt minne hos personer med dyslexi. Föreliggande studie var den första att undersöka procedurellt minne hos svenska universitetsstuderande med dyslexi. Syftet var att testa PDH med hjälp av alternating serial reaction time task (ASRT), samt att undersöka relationen mellan procedurellt minne, närmare bestämt implicit sekvensinlärning, och läsförmåga samt aspekter av språklig/fonologisk förmåga. I studien deltog totalt 37 universitetsstuderande, 11 med dyslexi och 26 utan dyslexi. Resultatet indikerade att förmågan till inlärning och konsolidering i det procedurella minnet inte skilde sig åt mellan grupperna. Resultatet ger således inte stöd åt PDH. Vidare kunde inga signifikanta korrelationer påvisas, vilket tyder på att det inte föreligger något samband mellan procedurellt minne och respektive läsförmåga, fonologisk medvetenhet och snabb benämning (rapid automatized naming, RAN). / Developmental dyslexia is characterized by reading and writing difficulties that do not derive from poor education, low intelligence or visual impairment. The disorder is commonly explained as a result of an underlying phonological deficit. However, studies have shown that dyslexia is also associated with linguistic, cognitive, and motor impairments that can not be explained by a specific phonological deficit. The procedural memory underlies learning, processing and consolidation of motor and cognitive skills. The procedural deficit hypothesis (PDH) suggests that an impairment of procedural memory is the underlying cause of developmental dyslexia. Previous research has yielded inconsistent results as studies have reported intact as well as impaired procedural memory in dyslexics. This study was the first to examine procedural memory in Swedish university students. The aim was to test the PDH, by using an alternating serial reaction time task (ASRT), and to examine the correlation between procedural memory and reading ability as well as aspects of linguistic/phonological ability. In this study there was a total of 37 university students, 11 dyslexics and 26 nondyslexics. The result showed learning and consolidation of the procedural memory in both groups and there was no significant difference between the groups. Thus, the results do not support the PDH. No significant correlations were found, which indicates that there is no association between procedural memory and reading ability, phonological awareness or rapid automatized naming (RAN).

S’il est concédé que le droit de l’Union européenne oblige à un renouvèlement des pensées juridiques traditionnelles et étatiques, du désordre et des ordres peut naître un ordre. Le droit de la procédure civile de l’Union européenne serait affirmé, l’ordre juridique de l’Union européenne s’orienterait vers un "État fédéral" et un justiciable européen serait consacré. Cependant, l’intégration du droit de la procédure civile de l’Union européenne doit s’effectuer avec les procédures civiles nationales et en tant que symbole régalien en rapport avec la souveraineté. Dans un désordre, où le droit de la procédure civile de l’Union européenne veut s’émanciper tout en restant sous la domination des États membres et de leur procédure civile qui, en souhaitant son épanouissement, désirent le maintenir sous sa coupe, les certitudes ont du être remises en cause non pas pour affirmer, mais démontrer la possible existence d’un ordre procédural de l’Union européenne. Si le droit de la procédure civile de l'Union européenne forme un ordre procédural inachevé, ce droit ne tend pas à devenir un ordre procédural dans le sens classique de la notion. En revanche, le droit de la procédure civile de l'Union européenne a vocation à participer à l'objectif de construction de l'espace judiciaire européen, où la place des procédures civiles nationales est remaniée. Ainsi, sans nier ses caractères d'ordre procédural, le droit de la procédure civile de l'Union européenne n’apparaît se finaliser que par l'espace judiciaire européen, qui offre à l’Union européenne un ordre procédural renouvelé. / Even if it is conceded that the European Union law necessarily involves the renewal of traditional and national legal concepts, order can emerge from disorder. As a result, the existence of the civil procedural law of the European Union could be asserted, the legal order of the European Union could move towards a federal model and the concept of being justiciable in the European Union for any issues, individuals or entities could be fully recognized. However, the civil procedural law of the European Union must be integrated taking into consideration the national civil procedures and as a national symbol in connection with sovereignty. In a disorder – where the civil procedural law of the European Union is described as breaking free though remaining under the domination of the member states (and their respective procedures) which look forward to the development of a procedural system while wishing to remain in control – , ce¬rtainties have not been challenged to confirm but also to prove the possible implementation of a procedural order for the European Union. Although the procedural system of the civil procedural law of the European Union is unachieved, such system is not meant to be developed on the basis of the classic model. On the other hand, the civil procedural law of the European Union is meant to take part in the construction of the European judicial area where national civil procedures are being reshuffled. Thus, without denying its procedural aspects, the European Union’s civil procedural law only seems to take shape field which provides a renewed procedural order to the European Union.
